PUBLIC HEARING: The Public Hearing for Ordinance NO. 2016-1 regarding Hardinzoning ordinance for mobile homes and Ordinance NO. 2016-2 regarding Beer and WineRegulations within the City limits was opened at 7:15 p.m. by Mayor Lane.Presentat the Hearingwere:Council Members: Karen Molina, Clayton Greer, Kenny Kepp, Jeremy Krebs, Darren Zent,and Harry Kautzman.City Staff: City Attorney Bob Snively, Public Works Superintendent Russell Dill, Accounting&Records Tech Angela Zimmer and several members ofthe public were also present.Molina reviewed Ordinance NO. 2016-1 and Ordinance NO. 2016-2. Laurie Tschetter saidthat she missed an opportunity for another unit, because it was 22 years old. She expressedthat she wants to live the American Dream and plan for her retirement. Anyone can buy anold home and flip it. There are no guidelines for someone buying a house. She said that shewould not purchase something that would be community decay and after 30 years you wouldhave figured out she has made good decisions. Corey Kenneyjioted that eliminating the City-County Planning Board streamlines and it is better, but msjjjpfadate, say "up to acertainstandard". £@^

Tschetter expressed her concern regarding out of town businesses acquiring a Citybusiness license. She questioned, ifthey are doing business around town, don'tthey need one?

Snively reported that the Street Maintenance fees for Michael Martinsen were thesubject of litigation and that he can address Council, but it is recommended to Council to notengage in comment.

Martinsen addressed Council regarding his Street Maintenance fees. He lives on a statehighway withno alleys. He said that most important, he appreciates the attempt for $250.00

that the signs need to be replaced. Krebs questioned ifthe signs were ADA approved. Dillnoted that he will check ADA specifications. Also, a 5 foot concrete apron will be pouredaround the facility.

The Law Enforcement Committee Meeting began at 7:30 p.m. In attendance were Mayor Jack Laneand Committee members Karen Molina, Kenny Kepp, and Darren Zent. Council members JeremyKrebs and Clayton Greer were also present. City Staff members present was Finance Officer/CityClerk Michelle Dyckman, and several members of the public.

Zent noted there were several items in the packet: wages or rates from other cities, the current cityattorney contract, a proposed non-renewal template, Forsyth's ad, a list of the area's attorneys, and acopy of Forsyth's arrangement with their attorneys.

Discussion centered on an RFP (Request for ProposaJ^ltod a potential contract. For the time being theRFP will be worked on. In the development of ^ojp&ct, other issues can be negotiated as neededdepending on what isproposed by a prospective£afior%

Kepp thought we might need to do a monthly fee. I^^Martinpl^asked about going with a retainer.Molina asked about experience. Zent replied that exp^p^^j^pTbe apreference* Laurie Tschettercommented on seeing responsiveness. Cory Kenney, alW|̂ itiiar Morrison also commented on a

5-1-2: PERSONS SUBJECT TO LICENSE; FEES:

Unless specifically exempted by state law or other provisions of this chapter, all persons and/orentities doing business or engaged in commerce in the city, whether residents or nonresidents,are required to pay city license fees.

A. Public Services: All persons, firms or corporations engaged in the business of extendingservices or accommodations to the general public, such as banks, financial institutions,pawnbrokers and money lenders, and all other agencies or institutions of a similar nature,shall pay a license fee of one hundred dollars ($100.00).

^ B. Utilities: All gas companies, power and light companies, telegraph companies, telephonecompanies and all other utility companies of a similar nature, shall pay a license fee of fivehundred dollars ($500.00).

C. Elevators And Oil Dealers: All grain and feed elevators, and all bulk gasoline and oil dealers,and all other business establishments of a similar nature shall pay a license fee of onehundred dollars ($100.00).

D. Other Businesses: All other businesses that are not listed in subsection A, B or C of thissection shall pay a license fee of fifty dollars ($50.00).

E. Exemptions: Charitable or fraternal organizations sponsoring or conducting a businessenterprise may apply to the city council for an exemption to the license requirement herein.(Ord. 2012-06, 10-2-2012)

F. Proration Of Fees: All fees set forth in this chapter shall be prorated on July 1 of eachcalendar year to fifty percent (50%) of the fee provided that the business did not operatewithin the city limits at any time during the current calendar year preceding July 1. If thebusiness operated or conducted business within the city limits at any time during thecalendar year prior to July 1 and obtains the license after July 1 then the full fee shall becollected and the business is not entitled to a proration.

G. Temporary Business License: Any person or entity doing business or engaged in commercein the city on a temporary basis may purchase a temporary license that is valid for a periodof ninety (90) days from the date of purchase. The fee for a temporary license shall be fiftypercent (50%) of a regular business license and subsection F of this section shall not apply

H. Regular Routes; Delivery Service: Merchants servicing regular routes within the city,individuals or organizations rendering a supply or delivery service to the businessestablishments of the city shall pay a license fee of fifty dollars ($50.00) per year.

Nothing herein shall be construed as requiring license fees on wholesale distributorsprovided that nothing herein shall be construed as authorizing or allowing any solicitor,peddler, hawker, itinerant merchant or transient vendor or merchant to operate in violation ofchapter 3 of this title.

I. Additional Licenses: In any case where any persons conduct, operate, transact, engage in orcarry on two (2) or more different lines of business, industry, trade, pursuit, profession orvocation, they shall be charged a separate and distinct license fee for each such individualbusiness, industry, trade, pursuit, profession or vocation. For the purposes of determiningthe assessment of more than one license fee against any person, the city clerk shallconsider the uniqueness and individuality of each such additional business enterprise asopposed to the interdependence of such enterprises and the location of said businessenterprises. If one engages in more than one type or classification of business as describedherein and it is determined that only one license fee shall be assessed, then the licenseeshall pay the highest applicable license fee.

Objection: It shall be the privilege of any persons assessed for more than one city license feeto file a written objection to such additional license fee with the city clerk and thereafter hewill be afforded a hearing before the council upon such objection. The council shall be thefinal arbiter of such objections.

Any persons wishing to file an objection to the assessment of the city license fee must filewritten objection within fifteen (15) days after notice of license fee assessment is received.

Fees assessed must be paid when due, regardless of whether any hearing or finaldetermination relating to an objection is pending. All fees paid, which the council shall, afterhearing on objections, determine to have been assessed in error will be promptly refundedby the finance officer. (Ord. 2012-06, 10-2-2012; amd. The City Council of the City of Forsyth Montana is requesting proposals for Professional LegalAttorney services.

The City Attorney, when required, shall draw for the use of the Council contracts and ordinancesfor the City ofForsyth and when required, give the Mayor or City Council verbal and/or writtenopinions on questions pertaining to the duties, rights, liabilities and powers of the city. Attorneyshall be responsible for prosecuting all violations within the city limits, including violations ofstate law and city ordinances on behalf of the City of Forsyth in City Court. The city will alsoconsider separate civil and criminal contracts.

The City of Forsyth adopted a self-governing charter with the commission executive plan ofgovernment, and holds their Council meetings the second and forth Monday of each month at7:00 P.M.
