DECLARATIONS OF INTEREST

The provisions of Chapter 14 of the Local Government Act, 1993 regulate the way in which Councillors and nominated staff of Council conduct themselves to ensure that there is no conflict between their private interests and their public trust. The Act prescribes that where a member of Council (or a Committee of Council) has a direct or indirect financial (pecuniary) interest in a matter to be considered at a meeting of the Council (or Committee), that interest and the reasons for declaring such interest must be disclosed as soon as practicable after the start of the meeting. As members are aware, the provisions of the Local Government Act restrict any member who has declared a pecuniary interest in any matter from participating in the discussions or voting on that matter and further require that the member vacate the Chamber. Council‘s Code of Conduct provides that if members have a non-pecuniary conflict of interest, the nature of the conflict must be disclosed. The Code also provides for a number of ways in which a member may manage non pecuniary conflicts of interest.

PURPOSE The purpose of this report is to present Council’s Investment Portfolio held at 31 August 2016.
RECOMMENDATION THAT the information on Council’s Investments as at 31 August 2016 be received and noted.
REPORT In accordance with Part 9, Division 5, Section 212 of the Local Government (General) Regulations 2005, the Responsible Accounting Officer must provide Council with a written report setting out details of all money that Council has invested under section 625 of the Act. This report provides details of Council's Investment Portfolio at 31 August 2016.
Attachment 1 to this report provides Council’s Investment Portfolio, detailing investments held and a summary of the portfolio by the institution invested with and their credit rating. In accordance with Paragraph 212(1)(b) of the Local Government (General) Regulation, the investments listed in Attachment 1 have been made in accordance with: 1. The Local Government Act, 1993 2. The Regulations, and 3. Council’s Investment Policy. Interest earned from investments totalled $510,598 for the two (2) months to 31 August 2016.

PURPOSE The objective of this report is to request Council to consider the grant of an easement for Right of Footpath over 32-36 Wingecarribee Street, Bowral (‘the property’). The property is leased by Council and forms part of the Lamond Lane Carpark, in central Bowral.
RECOMMENDATION THAT the Mayor and General Manager be delegated authority to execute an Agreement or Real Property Dealing under the Common Seal of the Council to grant the easement for Right of Footpath over property known as 32-36 Wingecarribee Street, Bowral, which is leased by Council.

BACKGROUND
Council, as Lessee, has been approached by the owner of 32-36 Wingecarribee Street, Bowral, to consider the grant of an easement for Right of Footpath over the property.
REPORT
Council, as Lessee of the subject property, has been approached to consider the granting of an easement for Right of Footpath to enable a pedestrian footpath only. The proposed footpath does not in any way adversely impact on the use of the land as a car park. The grant of the easement will authorise the pedestrian access to 38 Wingecarribee Street, Bowral, occupied by Centrelink, through the rear carpark.
Council has a valid Lease over part of the property, for a 50 year term, terminating on 31 May 2039 (Attachment 1). The property provides additional car parking space accessed via Lamond Lane, in the Bowral CBD.
The aerial map – Attachment 2 – shows the location of the property and the leased area.
Attachment 3 to this report is the sketch diagram annexure to the Deed of Grant of Easement showing the proposed easement for Right of Footpath.
As Council holds a Lease over part of the property, Council is required to consent to the registration of the easement. This report recommends that Council approve the Right of Footpath as requested by the Lessor.

CONCLUSION
The proposed easement for Right of Pathway requested by the Lessor does not have an adverse impact on the Lease held by Council nor will there be any impact on car parking in Lamond Lane. Therefore it is recommended that Council grant consent to the registration of the easement, by delegating authority to the Mayor and General Manager to execute the Deed of Grant of Easement.

PURPOSE Reporting on the evaluation of the Expressions of Interest for the grant of a Crown Reserve Licence Agreement over part Quiggs Reserve Canyonleigh for the construction, operation and management of a proposed Men’s Shed.
RECOMMENDATION 1. THAT Council as Reserve Trust Manager supports the establishment of a Men’s
Shed upon the Crown Reserve, Quiggs Reserve subject to and conditional upon the approval of the Minister for Lands.
2. THAT subject to Minister’s approval referred to in resolution 1 above, the
applicant submit a Development Application for the development of the proposed Men’s Shed at Canyonleigh for determination by Council as consent authority AND THAT subject to development approval being granted, a Licence Agreement be issued for the use of part of the Crown Reserve as a Men’s Shed with the consent of the Minister for Lands (under delegation) to be obtained.
3. THAT it be noted that any Licence Agreement granted in respect of the Crown
Reserve at Canyonleigh is for a five (5) year term with a $550 fee (including GST) to be paid to Council for the drafting of the Licence Agreement AND THAT the annual Licence Fee payable by the applicant is as per the current fees and charges of the Crown.
4. THAT the General Manager and Mayor be delegated authority to execute any
Licence Agreement for use of part of the Crown Reserve at Canyonleigh for the establishment and operation of a Men’s Shed.
5. THAT, if development consent is granted and a Licence Agreement issued to
the applicant, a Plan of Management for the Crown Reserve at Canyonleigh be prepared by Council in due course, in consultation with and subject to the Minister’s consent, expressly authorising the licensing of part of the Reserve for Men’s Shed.

REPORT
BACKGROUND
On Wednesday 11 November 2015, a report was considered by Council in respect of the request received from the S355 Committee of the Canyonleigh Community Hall. It was resolved as follows:
1. THAT Council as Trust Manager supports in-principle the proposal for a Men’s
Shed on Quigg’s Reserve Canyonleigh. 2. THAT subject to the in-principle approval of the Crown, Council will:
(a) call for Expressions of Interest for the site, advertising for a minimum
twenty eight (28) day period; (b) receive submissions following the closure of the exhibition period.
3. THAT a further report will be forwarded to a future Ordinary Meeting of Council to determine the Expressions of Interest.

Council is Reserve Trust Manager for the Quiggs Reserve at Canyonleigh. Quiggs Reserve is Crown Land owned by the State of New South Wales. This report recommends that Council:
1. formally acknowledge support of the Men’s Shed proposal, subject to Ministerial
approval; 2. invite a Development Application by the applicant and, subject to development

This report recommends that Council, as Reserve Trust Manager, seek the approval of the Minister to the grant of a Licence Agreement to the applicant subject to development approval. PURPOSE The purpose of this report is to advise Council on the outcome of the public exhibition of the Nattai Ponds Flood Study-Stage 1 Report and recommend its adoption.
RECOMMENDATION 1. THAT the Nattai Ponds Flood Study Report be adopted. 2. THAT Council apply for grant funding from the Office of Environment and
Heritage to undertake Floodplain Risk Management Study & Plan for the catchment.
REPORT
BACKGROUND
Council has been developing Floodplain Risk Management Study & Plans for various catchments for a number of years across the Shire in accordance with the NSW Government’s Flood Policy and Floodplain Development Manual.
Under the policy, the management of flood liable land is the responsibility of the Local Governments. The state government provides 2/3 subsidy for funding towards floodplain management projects and technical support through the Office of Environment & Heritage (OEH). The flood study is the first stage in the floodplain risk management process. The flood studies model floods of different magnitudes and document the extent of inundation and hazards. There are essentially four stages in floodplain management process as outlined below:

1. Flood Study Determines the nature & extent of the flooding problem

4. Plan Implementation Implementation of actions identified in the plan
Generally the Stages 2&3 are undertaken at the same time.
REPORT
Catchment Simulation Solutions were engaged by Council to undertake the Nattai Ponds Flood Study-Stage 1. The flood study was prepared in consultation with the residents and property owners in the catchment, Wingecarribee Floodplain Risk Management Advisory Committee (WFRMAC), Council staff and the Office of Environment & Heritage.
Following Council’s adoption of the recommendations of the WFRMAC, the draft report was publicly exhibited for 40 days from 6 May 2016 to 15 June 2016. One submission was received at the end of the exhibition period.
The submission primarily related to the inadequacy of the Braemar Avenue culvert. The submission went on to request that no further development occur in the upstream catchment until actions were taken to rectify the problems at the Braemar Avenue culverts.
The submission was reviewed and it was determined that no changes to the Nattai Ponds Flood Study were considered necessary. However, this comment should be noted and incorporated into the future Floodplain Risk Management Study for the catchment. The full report will be available in the Councillors’ room for viewing prior to the Meeting.

IMPACT ON FIT FOR THE FUTURE PROPOSAL OUTCOME
It is not possible to assess the impacts on Council’s Fit for the Future Improvement Plan until a floodplain risk management study and plan is undertaken for the catchment.
CONSULTATION
Community Engagement
A flood study website was established for the duration of the study. A community information brochure and questionnaire were distributed to 414 households and businesses. A total of 68 responses were received which provided data on flooding incidents which informed the flood study.
Community feedback was invited on the draft report from residents during the public exhibition period. A total of 23 property owners who indicated that they had experienced flooding in the past were also notified during the exhibition period. The draft report was

exhibited for 40 days as suggested by the WFMRAC. A media release was issued at the beginning of the exhibition.
The draft flood study report was exhibited at the Moss Vale Civic Centre; Bowral and Mittagong libraries and through the dedicated website www.nataiponds.floodstudy.com and also through the Council website.

Government subsidised floodplain management studies/projects represent significant value for money to Council, as successful projects attract 2/3rd funding from the State Government. If the report is adopted, then Council can proceed to apply for 2/3rd funding to undertake the next stage, namely Nattai Ponds Floodplain Risk Management Study and Plan.

Councils are responsible for determining the extent of flooding within the Council areas to determine future remedial works and strategies to minimise flooding impacts on the community. The completion of this flood study is the first step in this process.

PURPOSE This report considers a section 96(2) application to modify DA 15/0628. The existing consent approved the construction of six new buildings each containing four hotel suites, with ancillary development such as car parking, driveways, drainage and landscaping within the site of a locally listed heritage item. The original development application was requested by Councillors to be determined at a full Council meeting, accordingly this modification was also submitted to Council for determination. Notwithstanding, a rescission motion was approved on 27 July 2016 seeking additional information. This report is intended to be a supplementary report to that originally presented to Council on 13 July 2016 (Attachment 1) in response to the rescission motion.

RECOMMENDATION THAT DA 15/0628.02 for the construction of six new buildings each containing four hotel suites, ancillary car parking, driveways, drainage and landscaping for “Fitzroy Inn” 1 Ferguson Crescent, Mittagong being Lot 16 DP1005636 be APPROVED in accordance with the amended site plan in Attachment 2 to the report.

BACKGROUND Council at its meeting of 27 July 2016 supported a rescission motion for the above Section 96 application to modify the existing consent and resolved the following:

(a) The parking provision in the s96 amendment lodged compared to the approved application – a difference of 16 car spaces lost – as regards code provisions, etc.
(b) The physical provisions of disabled access shown in the s96 amendments in
relation to the hotel suites and their connection to the public areas of the property and compliance with the various codes, standards, Acts, etc, for access.
In response to the above the following is an assessment of (a) car parking and (b) accessibility. A) Car Parking The development as approved under DA 15/0628 proposed 40 car spaces in addition to the existing 25 spaces. The 40 spaces exceeded Council’s requirements for the accommodation units as it is accepted that a rate of 1 space per accommodation unit (i.e. 24 spaces for this development) is an acceptable rate. The Mittagong DCP provides a rate of 1 space per room for motels and hotels plus 1 space per 2 employees. The application does not specify any increase in the number of employees as a result of this proposal. The amended proposal provides for a total of 25 additional spaces to the existing 25 spaces on site as detailed on the amended site plan (Attachment 2). This both complies with the DCP requirements but also addresses Condition 5 (c) (ii) and (iii) of the consent which sought to relocate car parking areas away from the boundary and retain trees along the southern boundary. It should be noted that Councils will generally offer a reduction in car parking requirements in order to maintain the landscape setting of a heritage item, therefore the reduction in proposed car parking where DCP are exceeded can be viewed as a design improvement. B) Access The modified plan provides one (1) accessible suite (Suite 1 of Building 1) with an accessible car space located to the rear of the suite. The existing conditions of consent require: 22. Disabled Persons Access and Facilities
(a) Detailed working drawings for the fit-out to the disabled persons facilities shall be submitted with the construction certificate application. (Details shall be in accordance with AS 1428.1 Design for Access and Mobility).
(b) At least one (1) Car Parking space/s for use by disabled persons shall be
provided. These spaces shall be clearly identified by sign posting complying with AS1428.1, and comply with AS2980.1.
(c) No work is to commence on disabled persons access routes until details of the
routes are submitted to and approved by the Principal Certifying Authority. The details shall include a site plan clearly identifying the proposed route for access by disabled persons. It is noted that access from the allotment boundary, carpark and any other building on the allotment which access for people with

disabilities is required, to the entrance of the subject building. Access shall be in accordance with AS 1428.1 Design for Access and Mobility.
(d) Access for people with disabilities must be provided to and within buildings as
set out in Table D3.2 of the Building Code of Australia by means of a continuous path of travel in accordance with AS1428.1:-
(i) from the allotment boundary at the main points of entry; and (ii) from any car parking space on the allotment (whether within or outside the
building) provided in accordance with D3.5; and (iii) from any adjacent and associated accessible building on the allotment;
and (iv) through the principal public entrance.
(e) Sanitary facilities must be provided in accordance with Table F2,4 of the Building Code of Australia for:-
(i) every Class 3, 5, 6, 7, 8 and 9 building that is required by the deemed to
satisfy provisions of Part D3 to be accessible to people with disabilities and may be calculated as part of the number of facilities required by Table F2.3; and
(ii) a Class 10a building to which the public will have access and which
contains sanitary facilities, showers or hand basins etc. (iii) The construction and layout of all facilities provided in accordance with
Table F2.4 must comply with AS1428.1. (iv) A unisex facility must be located so that it can be entered without crossing
an area reserved for one sex only.
23. Identification of Accessible Facilities, Services and Features
In every building required to be accessible, clear and legible Braille and tactile signage complying with Specification D3.6 and incorporating the international symbol of access or deafness or other symbol as appropriate in accordance with AS1428.1 must identify all items as specified in Clause D3.6 of the Building Code of Australia.
24. Tactile Indicators
(a) For a building required to be accessible, tactile ground surface indicators must
be provided to warn people with a vision impairment that they are approaching any area as specified in Clause D3.8 of the Building Code of Australia.
(b) Tactile ground surface indicators required by (a) must by Type B indicators in
accordance with AS1428.4. (c) A hostel for the aged, nursing home for the aged or a residential aged care
building, need not comply with (a) (I) of D3.8 of the Building Code of Australia if

handrails incorporating a raised dome button in accordance with AS1428.1 are provided to warn people with impaired vision that they are approaching a stairway or ramp.
25. Braille Signage
In every building required to be accessible, clear and legible Braille and tactile signage complying with Specification D3.6 of the Building Code of Australia and incorporating the international symbol of access or deafness or other symbol as appropriate, in accordance with AS 1428.1 must identify:
(a) each -
(i) sanitary facility; and (ii) assessable space with a hearing augmentation system; and
(b) where an entrance or lift is not accessible, identify each accessible -
(i) entrance; and (ii) lift or bank of lifts; and the path of travel from the principal public entrance to these features and facilities where their location is not apparent to the building occupant (see Building Code of Australia Specification D3.6 Braille and Tactile Signs).
26. Disabled Sanitary Facility
The sanitary facility shall be constructed in accordance with the requirements of AS1428.1 Design for Access and Mobility General Requirements for Access.
Advisory Note
(i) The Applicants/property owner should note that the Commonwealth
Disability Discrimination Act 1992 provides opportunity for public complaint potentially leading to legal action if access to premises by people with disabilities or their carers is precluded. This may require action to provide or improve access in addition to the minimum requirements of the Building Code of Australia, particularly if such work would not cause "unjustifiable hardship" for the proprietors or owners.
(ii) The Human Rights and Equal Opportunity Commission can provide further
information on this issue.
The above details as specified in the consent are to be provided at the construction certificate stage. There is no evidence to suggest from the site conditions that these conditions cannot be complied with.

DISCUSSION OF KEY ISSUES
The development is compliant as proposed with the relevant car parking and accessibility requirements. For further discussion of issues refer to Attachment 1 and the original report to Council dated 25 November 2015 (Attachment 3).
CONCLUSION As stated in the Council report dated 13 July, 2016, the Section 96 application proposes locating Buildings 2, 3 and 4 closer to the southern boundary (setback 6m from the boundary) and relocating the driveway and car parking to the north of these buildings. The amended plan also relocates Buildings 5 and 6 closer to the tennis court to the south and marginally closer to the south western boundary. It is considered that the proposed changes to the locations of the buildings will have no impacts on heritage, water quality, drainage engineering or flooding. The proposed changes are consistent with the intent of Condition 5 in so far as the car parking and driveways are located further from the southern boundary and that all accommodation building as are 6m from the boundary. Amenity impacts on adjoining properties have been considered and amended plans have been submitted that address these issues. Conditions of consent are to be as previously approved with no amendments other than to Condition 5(c) (referred to in an earlier section of the report) in order to reflect the approval of the amended site plan. Approval is recommended.

It is to be developed and delivered as a partnership between Council, state agencies, community groups and individuals. It should address a broad range of issues that are relevant to the whole community. REPORT
BACKGROUND
On 8 June 2016 Council adopted the 2016/17 Fees and Charges Schedule when it adopted the 2016/17 Operational Plan and Budget. Included in the adopted Fees and Charges Schedule was a fee of $50 for an audio recording of a Council Meeting on CD. This was increased from a fee of $5.50 in the 2015/16 Fees and Charges Schedule, to reflect the partial cost of producing the audio recording on CD including staff time.
At its Ordinary Meeting on 13 July 2016, Council passed the following motion (MN 353/16):
1. THAT the fee for providing a CD of a Council Meeting be reinstated at a fee of $5 per Meeting.
2. THAT this amendment to the Adopted 2016/17 Fees and Charges be placed on public exhibition for a period of twenty eight (28) days AND THAT following that period a further report come back to Council.
REPORT
The proposed amendment to the fee for CD recordings of Council Meetings was publicly exhibited for twenty eight days from 22 July - 22 August 2016. No feedback was received from members of the public.

BACKGROUND
In accordance with Section 449 of the Local Government Act 1993 a Councillor or designated person holding that position at 30 June in any year must complete and lodge with the General Manager a Pecuniary Interest Return.
Under section 450A of the Local Government Act 1993 the General Manager must keep a register of Pecuniary Interest Returns and all completed Returns are required to be tabled at the first meeting of Council held after the lodgement date, 30 September 2016.
Sections 441-449 of the Local Government Act 1993 set out the requirements in relation to who is required to complete to complete Pecuniary Interest Returns. Under the Local Government Act 1993, a "designated person" is defined as:
- General Managers;
- Other senior staff of the Council;
- Other members of staff and delegates of the council who are designated by the council to make such disclosures because of the type of council functions they exercise; and
- A person who is a member of a committee of the council where the functions of the committee involve the exercise of the council's functions under the Local Government Act or any other Act.

REPORT
BACKGROUND
Steer North is a health promotion charity whose purpose is to inspire and empower people to live healthy and active lives. Steer North will embark in December 2016 on a 4,000km ride from Melbourne to Cairns in order to promote the benefits of physical activity and healthy lifestyle choices in reducing the rates of non-communicable diseases like cancer while raising funds and awareness for cancer research, education and patient care.
REPORT
The Steer North 4000km Ride’s cyclists will be passing through Moss Vale on 13 December 2016 and have been offered a reduced accommodation rate overnight of $10 per campsite at the Moss Vale Showgrounds.
As a volunteer-based health promotion charity, they rely heavily on the generosity of the community to support their activities and have requested a donation from Council of $300 to cover the accommodation costs for their 30 cyclists on the night of 13 December 2016 at the Moss Vale Showground. A copy of the Steer North request for financial assistance dated 15 August 2016 is attached (Attachment 1).

PURPOSE The purpose of this report is to table a petition in relation to the bridge repair at Colo Street, Mittagong. The petition was received on Friday, 2 September 2016 with 13 signatures of residents of Evans Street, Mittagong. A copy of the Petition has been placed in the Councillors’ Room and will be tabled at the Ordinary Meeting of Council.

REPORT A Petition has been received by Council signed by 13 residents of Evans Street, Mittagong, who have concerns regarding the bridge repair at Colo Street, Mittagong. The signatories’ concerns are as follows: ”….. the main concerns are: Lack of pedestrian access once the bridge is closed for repairs which cuts people off from church, shops, doctors and of course the station. What now takes 15 minutes will then take more than an hour which is beyond the capacity of most elderly residents ... Can you clarify what measures will be taken to assure people can cross as near as possible to the old bridge. You mentioned rerouting buses via the station or making arrangements with Frensham to cross their ground. At this point we have had no official notification of the bridge repair works which will be leading to a great deal of angst ...” COMMENT FROM STAFF On 11 August 2016 a letter was issued to residents in the vicinity of Colo Street bridge works. The letter advised residents of the planned works and notified a complete closure of the street would be required. A small number of residents called the project officer upon

receipt of the letter to discuss their concerns about the project, including the impact of closing the street to pedestrians. Council had been working with contractors to identify a way for pedestrians to travel through Colo Street during the bridge and road resurfacing project. Unfortunately the size of the construction zone, width of the creek and close proximity of private properties, escalates the cost of a temporary pedestrian bridge and path. This is mainly due to the additional risk that would be taken on by the contractor. It would be very difficult and costly to provide a safe and secure path through the works while machinery is operating as well as after hours when no-one is at the site. Staff considered alternate ways of assisting residents who do not have a car, are ineligible for school bus passes or walk into Mittagong for various reasons. To assist those residents Council worked with Berrima Buslines to organise travel vouchers and identified ways for school students to obtain bus passes. The petition was received on 2 September 2016 just as Council was finalising details prior to the preparation of a further letter to provide a bus travel voucher and explain the arrangements made. This further letter was subsequently delivered by hand on 13 September 2016. Upon receipt of the petition the project team contacted the writer of the petition who was happy to hear of the arrangements being made. She offered to advise all signatories about the bus options and await arrival of the letter. Council staff will be administering the issuing of bus vouchers as requests are received.

REPORT A Petition has been received by Council signed by 74 residents who have requested provision of a sealed footpath on the eastern side of Argyle Street between the Moss Vale Veterinary Hospital and Kings Road intersection. The signatories’ petition as follows: “Residents of Kings Road, Church Road and surrounding streets are restricted from safely accessing the Moss Vale town centre without vehicular means. We are confined by a train line, unsafe crossings and inadequate footpaths. The current path on Argyle Street (south-eastern side of Kings Road intersection) is narrow, overgrown, unsealed, uneven, dangerous and plain unsatisfactory. It is impossible to push a stroller or wheelchair, cycle with a children’s trailer or training wheels, or use a mobile scooter along this section of Argyle Street. Due to the numerous subdivisions and population growth in the abovementioned streets, it has never been more relevant for local residents to have a simple and safe way of accessing existing footpaths on the western side of Argyle Street.

A review of the existing Pedestrian Access and Mobility Plan for Moss Vale was undertaken with the nominated route not identified within the indicative master plan or supported as a priority pedestrian link.
No project has been scoped or included in the capital works program for a pedestrian footpath connecting the north eastern side of Argyle Street bridge, Moss Vale with King Street, Moss Vale (as requested in the petition).
The proposed path has merit and will link with the Argyle Street pedestrian railway crossing bridge and footpath project currently in this year’s program.
Assets will investigate and scope a project and this will be added to the capital works list based on priority assessment. Two projects will need to be included one for design and one for construction.
Future grant applications, to fund the project, will be considered when opportunities arise.

2. THAT pending a decision by the New South Wales Government on the proposed
buy back the New South Wales Government be requested to implement a moratorium on any further actions and activities by prospective mining companies in the Wingecarribee Shire area.

20.2 Notice of Motion 30/2016 - Recognition of Council and Community Position on Coal Exploration and Extraction

PURPOSE Councillor Larry Whipper has given notice that it is his intention to move the following motion at the Ordinary Meeting of Council on 12 October 2016: THAT Wingecarribee Shire Council: (a) Reconfirm its position as being a Coal Mine Free Shire. (b) Investigate and support all actions available to Council to give practical effect to
the Shire’s already determined position as a ‘coal free shire’. (c) Make direct representations to the Minister for Planning to amend the State
Environmental Planning Policy (Mining, Petroleum, Production and Extractive Industries) 2007 (SEPP) and at the same time amend Wingecarribee LEP 2010 so as to give practical effect to the prohibition on future coal mining exploration or extraction, by prohibiting these activities within Wingecarribee Shire.
(d) Acknowledge that by making these representations and by lodging the above
amendment to the SEPP and Wingecarribee LEP 2010 as a matter of priority, that Council will give practical and genuine effect to any commitment by Council to lobby the NSW Government for a prohibition on coal mining, coal extraction and coal exploration.
(e) By seeking the amendments, will demonstrate to the NSW Government its
strong position against mining and exploration as well as Council’s already declared position as a ‘coal free shire’ and support this community’s opposition to the threat of coal mining upon our environment, health and economy.

Preamble The purpose of this Notice of Motion is to re-confirm Council’s long held position in relation to Coal Mining and its threat to the water, economy and environment of our Shire. It also acknowledges that the only way to effectively protect the Shire from these negative impacts is to directly lobby the Minister for Planning to allow Wingecarribee Shire Council to make a permanent amendment to the applicable planning instruments. Support for such a motion will reflect the view of this Council and community. It will also show a sincere commitment to protect our Shire from the negative impacts of coal mining in the Shire, and also reinforce our commitment to explore more sustainable and environmentally acceptable sources of energy production and aligns with our Community Strategic Plan 2031 expectations.

PURPOSE Councillor Gordon Markwart has given notice that it is his intention to move the following motion at the Ordinary Meeting of Council on 12 October 2016: 1. THAT Council call upon the Minister for Health, the Hon Jillian Skinner, MP, to
arrange a meeting with Wingecarribee Shire Council, the Member for Goulburn the Hon Pru Goward and the Member for Wollondilly, Jai Rowell, and/or to nominate a representative on her behalf, to meet with Council to discuss the proposed Public Private Partnership of Bowral Hospital by the State Government.
2. THAT Council seek assurances that services to the public will not suffer and
that staff numbers at the hospital will not be reduced. 3. THAT after the proposed meeting, Council prepare a position in relation to the
proposal. 4. THAT in the event the Minister is unable to accept Council’s invitation in a
timely manner, this matter come back to Council for further discussion.

Preamble Recent media reports and statements by various Government officials are vague and conflicting, causing a large amount of concern within the local community. It is incumbent upon Council to be in a position to inform the Wingecaribee Shire residents and ratepayers of the facts of the matter. This can best be achieved by an urgent meeting between Minister Skinner, or her senior representatives and Council where the facts of the situation can be presented and questions asked by Council in a neutral environment.
