started excavation on the some part. In view of above we may consider consent to establish with BG and subject to EC

The application for consent to establish was discussed in CC meeting held on

13/12/2013 during discussion it was decided to issued SCN for refusal of consent to

establish as PP has started excavation work without C to E and EC.

PP has submitted reply on 28/02/2014 in reply PP stated that “we have started

excavation activity on site for site office compound wall and security office, but after

visit of SRO we have stopped the excavation activity. It will be started only after

obtaining the environment clearance.

In view of above we may consider with BG & BR with affidavit for not to take any effective step.

Recommendation of SRO/RO

RO, Pune has recommended for grant of consent to establish subject to obtaining EC &

not to take any effective stapes prior to EC.

Now the reply from SRO is received and reported that river distance is approx. 2.5 km from industry which is physically verified & letter is written to Ex. Eng. Irrigation dept. Case discussed in CC held on 15/1/2014, it was decided to issue SCN for refusal of consent and not to take any effective steps for production, as violated consent condition & EIA notification. Now this office is in reciept of reply from industry, stated that they have not violated consent condition as they have installed lower capacity project which do not require EC. Also have stated that project is audited by Govt. Authorised Chartered Engineer and apologized for not informing the changes. Previously industry obtained consent to establish from board for product MS Ingots:-8000 MT/M, with CI of Rs. 42.6 crores. Now have applied for first consent to operate with quantity of 2400 MT/M and reduced CI to Rs.24.0 crores, as have installed the machineries of 2400 MT/M capacity and for the same have submitted the Chartered Engineer certificate.

operate from Board for the same area. 5. Total water consuming for this phase 379 m3/day of water out of which 227.0 m3/day fresh

water will be supplied by Local Body & generating about 272.0 m3/day of sewage, which PP has provided STP of capacity 300.0 m3/day, Treated 113 m3/day waste water will be used for utilities, and partially of which 39 m3/day will be used for gardening.

6. Biogas plant installed by PP for bio-degradable waste which is found not in operation during visit. Non-biodegradable waste will send to authorized vender.

7. 3 no. of DG sets each having capacity, 60 KVA. 8. The cost of the project is increased from 40 Cr to Rs 86.37 Crore for which they have paid Rs.

2,00,000-as consent fees. 9. SRO Pune has visited the site and observed that, PP has submitted the plan of 13 buildings and

applicant has started construction of 2 additional buildings without obtaining consent to establish and EC for the same. (Out of 2, buildings one Building is completed upto 9

th floor and

upto ground floor). 10. PP has provided STP which is located at 20 to 30 meter approx. from river Mula. 11. RO, Pune has recommended for renewal of consent by imposing condition to shift the STP

100meter from HFL, verification of actual construction done by sanction plan and additional consent fees on increased capital investment.

The application for renewal of consent to establish was discussed in CC meeting held on 13/12/2013 during discussion it was decided to issue SCN for refusal of consent to operate as PP has carried out construction of two additional building without obtaining consent to establish from Board and amendment in EC. And not operating Bio-gas plant as per consent to operate condition. SCN issued on 17/01/2014.

Applicant has submitted reply through E-mail on dated 25/02/2014 in reply applicant stated that “For Expansion of two buildings we have already applied for amendment in Environment clearance on 05/10/2011, for same expansion we will be apply consent to establish for
