The Committee on Laws, in its 2nd   Indorsement dated 12 December 2012,

recommends ADOPTION and APPROVAL of the “PROPOSED AMENDMENTS OF

THE TERMS OF REFERENCE” of Resolution No. 446, series of 2011, attached tothe 1st  Indorsement dated 04 October 2012 of the Technical Working Group, with the

following modification:

1)  Scope of Undertaking is limited to streetlights, park lights and existing lights

located at overpasses and flyovers. Thus, all other existing lights enumerated

from letters “D” to “L” of the proposed TOR are excluded.

2)  Provision No. 5 (a) of the proposed terms of reference should read:“a. Submit complying ISO Cert. 9001:2008 on the quality for design

and manufacturing transformers, electronic ballasts, LED lighting

applications and general lighting systems AND certificate of quality lighting

(LTFRB), Quezon City, submitting her recommendations and praying among others that once and for all,

the records of LTFRB-CAR be cleansed to stop the practice of requiring additional documents and “fixing

 fees” for the processing of “Illegal franchises”.

b.  Proposals of Atty. James S. Valeros, on the legalization of irregular Certificate of Public

Convenience (CPC).

c. 1. Recommendations mentioned in the privilege speech of Hon. Richard A. Cariño,

entitled “The irregular and the illegal franchises: What do we do with them?”  during the 23

 November 2009 Regular Session.

2. Letter dated 14 December 2009 of Atty. James S. Valeros, submitting documentsregarding irregular and illegal PUV franchises issued by the LTFRB.

3.  Proposed Resolution Nr. PR 0042-10 of Hon. Richard A. Cariño “Recommending to

the Land Transportation Franchising and Regulatory Board (LTFRB) the legalization of

irregular and illegal franchises of public utility vehicles in Baguio City and Cordillera

 Administrative Region (CAR), subject to conditions.”(NOTE: The above proposal is related to the recommendations mentioned in the privilegespeech of Hon. Richard A. Cariño, entitled “The irregular and the illegal franchises: What dowe do with them?”, during the 23 November 2009 Regular Session, which was returned to

Hon. Richard A. Cariño and the Committee on Public Utilities, Transportation and TrafficLegislation on 10 December 2009, to coordinate with the affected transport sector in order tocome out with a committee report taking consideration the observations and suggestionsraised by the transport group.) 

4.  Letter dated 14 March 2011 of Atty. James S. Valeros, Valeros, Mondok Law Offices,elucidating issues in support of the Proposed Resolution Nr. PR 0042-10 of Hon. Richard A.

Cariño.d. Letter dated 28 December 2010 of Atty. James S. Valeros recommending passage of Proposed

Resolution Nr. PR 0042-10 of Hon. Richard C. Cariño on the legalization of irregular PUV franchises forreasons stated therein.

e.  Letter dated 27 October 2010 of Atty. James S. Valeros, Valeros, Mondok Law Offices, in

response to the comment of Atty. Federico J. Mandapat Jr., on the alleged impending move of the CityGovernment to legalize irregularly issued franchises.

f.  Letter dated 09 September 2010 of Atty. Federico J. Mandapat Jr., Regional Director,

Department of Transportation and Communications-Cordillera Administrative Region (DOTC-CAR),

submitting his comment on the alleged impending move of the City Government to legalize irregularlyissued franchises as published in the local newspapers and recommending that time and further study be

given before plunging into legalizing said franchises and requesting that coordination be made with his

office who has the files, records and authority on the matter.

g.  Joint opposition dated 12 March 2010 submitted by Mr. Marcelo Lagda, President, Navy BaseTransport Operators and Drivers Association (NBTODA) and Mr. Melchor Bengaw, President, Pacdal

General Luna Operators and Drivers Association (PAGODA), to the Proposed Resolution Nr. PR 0042-10

of Hon. Richard A. Cariño and requesting the City Council to exercise utmost prudence and sounddiscretion in dealing with the said proposal.

After series of public consultation and with coordination with the Department of Transportation

and Communication – Cordillera Administrative Region (DOTC-CAR) through the Office of Regional

Director Celina B. Claver, the Committee on Public Utilities, Transportation and Traffic Legislation

recommends approval of the amended proposed resolution. Final lists of public utility vehicles which were

“irregularly issued”/issued in violation of LTFRB MC 1996-002 (Baguio Moratorium) and LTFRB MC

98-026 (BLIST Moratorium) prepared by DOTC-CAR is hereto attached which was received by the

undersigned chairman on March 9, 2012.Hon. Joel A. Alangsab, Member of the Committee, signified “for discussion/clarifications”.

definition Closed-Circuit Television (CCTV) with corresponding image recorder in their

establishments, in order to include schools, shopping malls/department stores, convenience stores,gasoline stations, pawnshops, money changers and other business establishments with minimumbusiness capital of P500,000.00’.”

(NOTE: [a] The above proposed ordinance was based on the letter dated 09 May 2012 of P/Supt. BenjaminBañez Magalong, Police Chief Superintendent, RD, PRO-Cor/Chairman, Regional Law Enforcement CoordinatingCommittee (RLECC)-CAR to Hon. City Mayor Mauricio G. The Committee on Health and Sanitation, Ecology and Environmental Protection

environment.

b.  Letter dated 15 May 2012 of Ms. Joan Gorio, land owner and representative of theheirs of Cosen Piraso and Josephine Molintas Abanag, regarding the following:

a. requesting that the order be recalled directing the City Assessor’s Office not to

issue any Tax Declaration over the parcels of land covered by O-CALT-129 and O-CALT-130 in the names of any and all heirs of Cosen Piraso andJosephine Molintas Abanag as stated under the resolutory portion of City CouncilResolution No. 097, series of 2011, for the grounds stated therein; and

 b. informing that no action was done by the City Legal Officer relative to theirclaim.

c.  Letter dated 10 July 2012 of Ms. Noemi C. Tagudar, State Auditor IV, Audit Team Leader,

Commission on Audit - Cordillera Administrative Region, Audit Group D-Baguio City, furnishing copiesof the Audit Report for Calendar Years 2008 to 2010 of the 43 Barangays of the City of Baguio.

(NOTE: Only one (1) copy was received by the Office of the City Secretary.)

After summarizing the comments and observations of the Commission on Audit from CY2005 – 2010 of various barangays of Baguio City, the Committee on Barangay Affairs recommends the following:

1.  Although the Commission on Audit can act independently on these matters, and that copies

of these concerns/comments and observations have been furnished to all the barangaysconcerned, that the Sangguniang Panlungsod call the attention of the barangays concerned

so as to be apprised of any developments, whether said barangays have complied with the

requirements and recommendations of the COA, or if not, ask them to act immediately on

such recommendations so as to avoid any disallowances and other legal actions which theCOA might take.

2.  Under Section 395 of the Local Government Code of 1991, the only qualifications of a

 barangay treasurer are: legal age, qualified voter, actual residence of the barangayconcerned. Most, if not all appointed barangay treasurers are not by profession or

experience, accountants or even with the affiliation with business or accounting activities,

and with the complexities of the documents being processed for disbursement of barangay

funds, there is a need to provide the essential or even the most basic training for the barangay treasurers on the accounting and auditing procedures to avoid technicalities,

disallowances and even being liable for criminal charges for their lack of familiarity with

the proper accounting procedures. Hence, it is requested that the Commission on Audit,

City Accountant’s Office and the City Budget Office conduct a joint seminar or training forthe barangay treasurers and the Punong Barangays, at the expense of the barangay funds,

on the basic accounting and auditing procedures, as well as to include in the training or

seminar the proper procedures to be undertaken in response to the problems encountered asreflecting in the summarized report hereto attached;

3.  The committee also requests that the Commission on Audit – Local Government Sector,

Baguio City and the City Accountant’s Office to come up with a compilation of laws,

regulations and COA rulings applicable to the barangays to serve as guide for the barangayofficials and the barangay treasurers;

4.  The committee also recommends that the Office of the City Accountant provide the

 barangays with latest rulings/memorandum/notices or updates from the national agencies

 pertaining to the government accounting and auditing procedures, and to discuss suchduring the monthly punong barangay’s meeting and/or during the barangay treasurer’s

assembly;

5.  It is also recommended to call the attention of all the barangays regarding the proceduresfor the review of their annual/supplementary budgets to avoid delays and immediate review

 by the Sangguniang Panlungsod;

6. Lastly, to call the attention of all the barangays for them to update or to enact their own tax

ordinance, whichever is applicable, to enable them to collect fees in accordance withexisting laws and procedure. (Item 31, 07 January 2013 Agenda)

13. Committee Report Nr. CR 0483-12a. Proposed Resolution Nr. PR 0136-12 of Hon. Isabelo B. Cosalan Jr.  “Urgentlyrequesting His Excellency, Benigno S. Aquino III, President of the Republic of the Philippines

through Pacquito N. Ochoa, Executive Secretary to expand the coverage of Executive Order No. 23

dated February 1, 2011 ‘Declaring a moratorium on the cutting and harvesting of timber in thenatural and residual forests and creating the anti-illegal logging task force’, to a total moratoriumon tree cutting, harvesting or earthballing, particularly and specifically, in the City of Baguio, except for those trees that directly pose immediate and imminent danger to life and property.”b. Letter dated 09 July 2012 of Regional Executive Director Clarence L. Baguilat, Department of Environment and Natural Resources (DENR-CAR) to Hon. Vice Mayor Daniel T.Fariñas, submitting pertinent documents/list of tree cutting permits issued in Baguio City and pending applications undergoing review and processing.

(NOTE: Resolution No. 149, series of 2012 called for an investigation in aid of legislation on the allegedongoing tree-cutting activities of applicants at the Department of Environment and Natural Resources(DENR) with pending requests for tree-cutting permits.)

The Committee on Market, Trade and Commerce  recommends APPROVAL of theabove proposed resolution.

Barangay Resolution No. 01, series of 2011, of Malcolm Square Barangay  entitled, “A

resolution expressing approval of the enactment by the Sangguniang Barangay of a tax

ordinance which shall authorize the barangay to collect parking fees among vehicle owners

using the streets within Malcolm Square Barangay as a parking area.” 

In view of the foregoing compliance with Sections 186 and 187 of the LocalGovernment Code mandating that ordinances levying taxes, fees, or charges shall be the subjectof a public hearing prior to its enactment, as could be evidenced by the hereto attached minutesof the meeting and attendance to the general assemblies, the Committee on Ways and Means

and Finance, Cluster C,  recommends FAVORABLE REVIEW of the subject barangayordinance.

Proposed Amendatory Ordinance Nr. PO 0065-12 of Hon. Betty Lourdes F. Tabanda “Amending Section 2 of Ordinance Numbered 014, series of 1999 [Providing for the Regular

 Medical Examinations and Other Medical Services to Senior Citizens in the City of

 Baguio].”

(NOTE: [a] Section 2 of Ordinance Numbered 014, series of 1999, states:SECTION 2. Procedure/Mechanics. - The following shall be adopted to carry

out this policy:1. The personnel of the District Health Centers, in coordination with the Office

of the Senior Citizen Affairs and the Office of the Barangay Affairs, shall

make a registry by barangay of all senior citizens residing within their areaof jurisdiction;

2. The District Health Centers shall schedule the specific dates for the

medical examinations that shall be disseminated to the concerned seniorcitizen;

3. The individual medical records of examined senior citizens shall bemaintained and updated by the personnel of the District Health Center; and

4. The other medical services to be offered by the District Health Centersshall be made available to the senior citizens.

32. Committee Report Nr. CR 0593-12 Letter dated 22 September 2011 of Ms. Sonia P. Camdas-Evangelista to Hon. Isabelo B. CosalanJr., requesting compensation for the use of their property covered by TCT Nos. T-72968 and T-72969 with an area of 150 square meters as public road at Tam-awan, Pinsao Proper, Baguio City.

The above subject property is a parcel of land containing an area of 150 square meters covered

 by TCT No. 018-2012002313 in the name of Sonia Camdas-Evangelista. Prior to the segregation of thesubject area, said lot is a portion of the titled property of Philip Camdas, et al., covered by Transfer

Certificate of Title Nos. T-72968 and T-72969. This was pointed out in a Memorandum Report of Engr.

Edward Magalgalit, Engineer II, City Engineering Office dated 06 September 2011 after the joint

relocation survey conducted by the City Government, Philip Camdas, et al. and the adjacent lot owner,Alice Arviso, et al. Accordingly, the road was constructed without the consent of the property owners.

In view thereof, the Committee on Urban Planning, Lands and Housing  recommendsAPPROVAL of the above request for compensation in the amount of One Thousand Three HundredThirty Five Pesos and 20/100 (P1,335.20) per square meter.

Likewise, TO AUTHORIZE the City Mayor to sign for and in behalf of the CityGovernment the appropriate contract for the sale and transfer of the above road lot in favor of the citygovernment.

II, City Buildings and Architecture Office, Baguio City to Hon. Nicasio M. Aliping Jr., furnishing forinformation, reference and appropriate action a copy of their recommendations pertaining to the proposal

of amending Baguio City Zoning Ordinance No. 51, series of 2001:

a. that the Zoning Office should comply with HLURB Board Resolution No. 878, s. 2011,

explaining and reiterating that all amendments to CLUP and zoning ordinances of LGUsshall not be implemented unless said amendments are subjected to the same process in the

approval of the CLUP and its implementing ordinance; and

 b. to consider the passage of a City Council resolution relative thereto.

(NOTE: a] The above matter is in reply to the letter dated 12 September 2012 of the City Secretary

requesting Engr. Oscar V. Flores, City Government Department Head II, CBAO, to give theirrecommendations relative to the construction of a commercial building at Session Road, Baguio Cit y.b] Ordinance No. 051, s. 2001 is the revised comprehensive zoning regulations for the City of Baguio andproviding for the administration, enforcement and amendment thereof and for the repeal of all ordinancesin conflict therewith.)

b.  Letter dated 18 September 2012 of Engr. Oscar V. Flores, City Building Official, CityBuildings and Architecture Office (CBAO), submitting their comment regarding the issue on the height

limit of the building at Session Road, Baguio City owned by MBP Realty Corporation represented by Mr.

Tony Ang.(NOTE: The above matter is related to the following:a] Letter dated 17 September 2012 of Engr. Oscar V. Flores, City Building Official, City Buildings and Architecture Office (CBAO) to Mr. Tony Ang, Representative, MPB Realty Corporation, informing amongothers that their office cannot act on their application for a building permit for the 7th and 8th floors of theirbuilding considering that the documentary requirement which they submitted does not conform to theclarification issued by Architect Emmanuel P. Cuntapay, Acting Executive Director, National Building CodeDevelopment Office (NBCDO), DPWH regarding the interpretation and application of the National BuildingCode provision on building height limits. This was received by the Office of the City Secretary on 18September 2012 to be forwarded to the Committee on Urban Planning, Lands and Housing.b] Matters raised during the 03 September 2012 Regular Session relative to the construction of acommercial building along Session Road, Baguio City. This was returned to the Committee on UrbanPlanning, Lands and Housing for further study and consider all the suggestions and observations of theinvited guests during the 03 September 2012 Regular Session.)

The Committee on Urban Planning, Lands and Housing recommends that the above matters

BE NOTED and BE FORWARDED to the Office of the City Planning and Development Coordinator andZoning Administrator/Officer, Baguio City for appropriate information, inviting attention and compliance

to Section 31 of Ordinance Numbered 051, series of 2001 provided as follows:“Section 31. POWERS AND FUNCTIONS OF A ZONING ADMINISTRATOR/ZONING

OFFICER. Pursuant to the provisions of E.O. 72 Implementing R.A. 7160 in relation to Sec. 5, Paragraph

a and d and Section 7 of Executive Order No. 648 dated February 1981, the Zoning Administrator/

 ZONING OFFICER shall perform the following functions, duties and responsibilities:

1.   Enforcement

 A. Act on all applications for locational clearances for all projects.

1. Issuance of Locational Clearance for projects conforming with zoning regulations.

2. RECOMMEND TO THE LOCAL ZONING BOARD OF ADJUSTMENT AND

 APPEALS (LZBAA) the grant or denial of applications of variances and exemptions

and the issuance of Certificate of Non-Conformance for the non-conforming projects

lawfully existing at the time of the adoption of the zoning Ordinance, including

clearances for repairs/renovations on non-conforming uses consistent with the

guidelines therefor.

 B. Monitor on-going/existing projects within their respective jurisdictions and issue

notices of violation and show cause order to owners, developers, or managers of

 projects that are violative zoning Ordinance and, IF NECESSARY, PURSUANT TO

SEC. 3 OF E.O. 72 AND SEC. 2 OF E.O. 71, refer subsequent action thereon to the

 HLURB.

C. Call and coordinate with the Philippine National Police for enforcement of all orders

and PROCESSES issued in the implementation of this ordinance.

 D. Coordinate with the City Prosecutor for other legal actions/remedies relative to the

 foregoing.

2.  Planning

 A.  Coordinate with the Regional Office of the HLURB regarding proposed amendments

to the zoning ordinances prior to adoption by the Sangguniang Panlungsod.”

Hon. Erdolfo V. Balajadia, Member of the Committee, signified “The Resolution is obviously

 centered on a building constructed along Session Road, Baguio City owned by MBP Realty Corporation

which allegedly exceeded the height requirement provided for in Ordinance Numbered 051, series of

 2001, particularly Section 31 thereof.The Resolution seeks to inform the City Planning and Development Coordinator and Zoning

 Administrator/Officer of Baguio City of Section 31 of the said ordinance, and, at the same time,

 recommends compliance to the cited ordinance.

This matter has been sufficiently discussed during the September 3, 2012 session of this august body so that said discussions should be taken into consideration in order not to appear that the building

in question is being singled out and in order that said office shall be able to come out with a fair and

 objective action considering other buildings constructed in the City of Baguio and considering other facts and circumstances revealed during the said session.

Consequently, the Office of the City Planning and Development Coordinator and Zoning

 Administrator/Officer of Baguio City must be advised to consider the discussions during the September

Domogan,forwarding for information and appropriate action the Memorandum of Agreement entered into byand between Hon. Senator Francis G. Escudero herein referred as First Party, Hon. City MayorMauricio G. Domogan herein referred as the Second Party and the Baguio General Hospitalrepresented by Dr. Manuel Factora, MD, Hospital Chief, herein referred as the Third Party regardingthe Priority Development Assistance Fund of the First Party for medical assistance specially intendedfor indigent patients.

 provided by these business establishments.”The Committee on Market, Trade and Commerce  recommends APPROVAL of the

above proposed SOFAD resolution and for the committee to adopt the same.Hon. Peter C. Fianza, Member of the Committee signified, “Anti-age discrimination in

(NOTE: The above matter is related to the following:[a] Letter dated 18 September 2012 of the heirs of Agustina Dizon represented by Ms. Remedios Dizon-Castillo, praying that a resolution be rendered granting their appeal for the declaration as null and voidthe award of Stall No. 13, Entrails Section, Baguio City Market to the winning bidder and ordering thelease rights be reverted back to them.[b] Letter dated 02 July 2012 of Ms. Remedios Castillo, requesting action on her appeal for the awardingof Stall 13, Entrails Section, Baguio City Public Market . The committee further recommends to UPHOLD the validityof the award of the subject stalls at the City Market, Baguio to the respective winning biddersand the latter’s right to peacefully occupy the same. As per Memorandum for the City Engineer, Baguio City, dated 22 August 2012 of

Rodrigo Samuel R. Martinez, Engineer II and noted by Constancio G. Imson Jr., Engineer IV, both of the City Engineer’s Office “the location of dilapidated road identified by the barangay

officials with former Councilor Antonio Tabora, and the undersigned, was at South Central

 Aurora Hill but in the approved project title location was written North Central Aurora Hill.” Consequently, in the same Memorandum, the City Engineer’s Office requests for a

change in project title from “rehabilitation of dilapidated road, Rimando Road at North Central

 Aurora Hill Barangay, Baguio City” to “rehabilitation of dilapidated road, Rimando Road at

South Central Aurora Hill Barangay, Baguio City”.The Committee on Public Works  recommends that after the Sangguniang

Panlungsod ng Baguio shall have taken official cognizance that the error in the situs/location ofthe project was due merely to oversight, it shall order the correction of the error by indicating inall documents covering the same that the location of the project, “rehabilitation of

dilapidated road, Rimando Road”  shall be at “South Central Aurora Hill, Baguio City.”

The Committee on Social Services, Women and Urban Poor  ADOPTS the proposed

resolution, and recommends APPROVAL thereof, with the information that upon referral,TESDA-CAR scheduled a special training on Basic Computer Literacy for the senior citizens from November 12-16, 2012 at the Baguio City School of Arts and Trade (BCSAAT). (Item 63,

 Health, the Health Services Office through the barangay volunteers, to come up with an informationdissemination campaign on the common causes and prevention of kidney diseases, or other means toeducate the constituents regarding the said subject, and enjoining the assistance and cooperation ofthe barangay volunteers such as the Barangay Health Workers, Barangay Nutrition Action Officers

and the Barangay Nutrition Scholars to assist in this program”.The Committee on Health and Sanitation, Ecology and Environmental Protection

44. Committee Report Nr. CR 0635-12 Proposed Resolution Nr. PR 0184-12 of Hon. Elmer O. Datuin, “Resolution to request the inventor

of Black Hole Technology to present the Black Hole Technology in Baguio City for possible purchase

and inclusion in the long term Solid Waste disposal technology”. The Committee on Health and Sanitation, Ecology and Environmental Protection recommends APPROVAL of the proposed resolution. It is further recommended that said technologyshall be presented to the General Services Officer and thereafter submit his comments andrecommendations to the City Council for further action. 45. Committee Report Nr. CR 0636-12 Proposed Resolution Nr. SOFAD 21-12 of Hon. Scout Councilor Franklin Jan L.

Wayang  “Requesting the Urban Planning and Development Committee to replace some existinggarbage bags in the Central Business District and local transport stations with more durable, more

accessible, more noticeable, identical and segregated garbage bins and provide more of these onevery 200 meters along Session Road, Harrison Road, Magsaysay Road and in common areas inthe Public Market.”

The  Committee on Health and Sanitation, Ecology and Environmental Protectionrecommends adopting the proposed resolution and forwarding the same to the concerned agency for

46. Committee Report Nr. CR 0637-12 Proposed Resolution Nr. SOFAD 20-12 of Hon. Scout Councilor Franklin Jan L. Wayang

“Banning the use of Styrofoam as a form of food packaging in canteens, restaurants, hotels and

caterers and encouraging the use of paper box as an alternative and furthermore, urging the

mentioned business firms to provide discount to customers who bring their own food containers whenthey order for a take out.”

(NOTE:  Ordinance Numbered 26, series of 2007 promulgates the use of paper bags, buri bags and otherbiodegradable bagging containers in all supermarkets, groceries and other related retail businessestablishments in the City of Baguio by Year 2012.)

The Committee on Human Rights, Justice, Public Protection and Safety, Peace andOrder recommends APPROVAL of the said proposed resolution.

On verification of documents submitted, the above subject lot identified as Lots 29 and 30

favor of Baltazar Cruz be cancelled and the same BE AWARDED in favor of the heirs of BaltazarCruz, represented by Erma Cruz Tamayao, subject to Ordinance No. 65, series of 1948 as amended.

Further, recommends that the mode of patenting the above parcel of land shall be throughthe Miscellaneous Sales Application (MSA) as provided under R.A. 730.

The Committee on Public Utilities, Transportation and Traffic Legislation recommendsfavorable endorsement of the application of Neutrinus Enterprises, Inc. as an IT Center from the Philippine

Economic Zone (PEZA) subject to the following conditions:

1.  Secure building permit and other pertinent permit from the city before the construction of

the building to ensure compliance with the building code;2.  Tax exemptions shall only be applied to the portion devoted to the call center. Other

 portion of the building that will be used as an ordinary commercial space for rent shall be

taxable including the income derived therefrom like another business enterprise;3.  A minimum contract period should be set for at least eight (8) years to compensate the

 provision on tax holiday incentive;4.  Provide adequate sewerage system to cater the increased number of users and to provide a

solid waste management plan in coordination with the CEPMO;5.  Provide adequate security measures to maintain peace and order at all times;

6.  Provide adequate parking facilities in the building. No on-street parking for employees of

the call center anywhere within the area at all times;7.  Submit the Traffic Impact Assessment to the TTMC for evaluation and recommendation to

include loading and unloading areas for employees and clients;

8.  Submit a copy of the Construction Safety and Health Program with the DOLE-CAR;

9.  Establishment must be registered with DOLE-CAR within thirty (30) days before itsoperation as provided for by Rule 1020 of the Occupational Safety and Health Standards of

DOLE;

10.  Qualified residents of the city shall be given preference in employment;

11.  Coordinate with the Public Employment Service Office (PESO) for establishmentregistration and placement of its job vacancies in PhilJobNet, as well as, in the recruitment

of its required manpower complement per City Ordinance No. 51, series of 1992.

 Non-compliance with the above stated conditions shall be ground for revocation of business permitissued by the city and recommendation by the city for revocation of the privileges granted by PEZA. (Item
