Public Comment Period One person requested to address the HRTPO Board. Chair Ward asked him to limit his comments to three minutes. Mr. Ellis W. James

Thank you very much, Ms. Chairman. This is an interesting situation for me. I would like to point out -- I'm Ellis James. I've resided in this area for a few years, basically a lifetime, and since the struggle on finding transportation solutions has revolved significantly around the key question of money and revenue, I'd like to point out something that caught my eye the other day. It was interesting. We had a situation in which the report on the revenue and profits from the sale of alcohol - just taking one little piece of the pie as an example, was somewhere in the neighborhood of about a $170 million. Now, if that figure is accurate, then my question is why can't the current administration find five or ten items that significantly deal with the issue of creating the revenue stream that we so desperately need to solve our transportation problems in the Commonwealth. I don't want to exclude our neighbors to the west, but they have enjoyed the fruits of many decades of labor, and they have a pretty good road system to live with. In this situation, we in Hampton Roads are soon going to find ourselves tolled off, roped off, and jammed up to the extent that we're not going to be able to effectively participate in the overall economy of the Commonwealth, and I'm especially concerned about the question of what the impact might be with respect to the military installations. I hope that each of you in your communities will speak to these people who are your representatives and don't just make it general conversation, see if you can zero in on some of the critical aspects of finding the revenue streams that we so desperately need. Thank you, Madam Chairman.

Commonwealth Transportation Board (CTB) Members Comment Period Mr. Layne reported the three major projects in the Governor’s Transportation Plan pertaining to Hampton Roads are moving forward. First, the Downtown Tunnel-Midtown Tunnel-Martin Luther King (DTT-MTT-MLK) Extension project is a topic on the HRTPO Board agenda today with a briefing provided by the Virginia Department of Transportation (VDOT). Second, funding was approved by the CTB in the form of a $152 million loan from the Virginia Transportation Infrastructure Bank for the Dominion Boulevard project to bring it to fruition. Lastly, the Commissioner of Highways indicated there should be information coming later this year regarding Route 460. The CTB approved a revenue allocation for Perdue AgriBusiness, Inc., who has a major grain exporting agreement with Asia to the Virginia Port. Mr. Layne stated the CTB de-allocated almost $17 million across the state due to projects not moving forward. Unfortunately, almost $5 million of that was in Hampton Roads. He encouraged the localities to utilize all funding allotted to projects. Mr. Miller reported the CTB allocated funding for passenger rail in order to bring the train to Hampton Roads approximately nine to ten months earlier than planned with a scheduled date of December 2012. He indicated the rail project has moved quickly and smoothly due to the efforts of DRPT Director Drake, Secretary Connaughton, CSX, and Norfolk Southern.

Mayor Krasnoff expressed his appreciation to the CTB members for their exemplary work in articulating the transportation needs of Hampton Roads. Mr. Shepperd inquired as to the primary reason for de-allocating the $17 million. Mr. Layne replied the underlying cause for the de-allocations was that no money was spent on those projects. Mr. Shepperd asked if the de-allocated funds would be moved to other projects in the Commonwealth. Mr. Layne replied affirmatively. Mr. Miller stated localities can re-apply for lost funds; nevertheless, the funds were mainly lost because the locality could not match the state contribution. He indicated that VDOT communicated the need to de-allocate before action was taken and he noted the CTB would continue to de-allocate funds if the money was not utilized. Mayor Fraim expressed his gratitude to the CTB members for their continued efforts to bring passenger rail to Hampton Roads. He explained the City of Norfolk will have the train platform complete; however, it will be hard pressed to have the station finished due to the accelerated speed of the project. Once completed, citizens will be able to ride the train into Washington D.C. by 9:00 a.m. and return to Hampton Roads by 7:00 p.m. the same day. Mr. Layne commented that the Governor has a budget line item for operating expenses for the Intercity Rail Fund for the next two years. Submitted Public Comments Chair Ward stated there were no submitted public comments in the agenda packet; however, there was one public comment handout at the table. Mr. Florin remarked that the Annual Obligations Report mentioned in the public comment and in the For Your Information section of the agenda packet, was important and asked for additional discussion either at today’s meeting or sometime in the future. Another important topic located in the For Your Information section was an announcement pertaining to the TIGER III grant recipients. Mr. Florin suggested the HRTPO Board review the application process as the region has not been effective in receiving TIGER grants thus far. Approval of Agenda Chair Ward asked for any additions or deletions to the agenda. Hearing none, Mr. Heuer Moved to approve the agenda as written; seconded by Mayor Price. The Motion Carried.

Chair Ward asked to move Item 8, the FY 2012-2015 Transportation Improvement Program Amendment: VDOT to after the presentation by VDOT regarding the DTT-MTT-MLK Extension project in Item 16. Mayor Sessoms Moved to approve Items 7, 9, 10, and 11 of the Consent Agenda and move Item 8 to after Item 16; seconded by Mr. Shepperd. The Motion Carried. Military Briefing: U.S. Navy Mr. Farmer introduced RADM T.G. Alexander, Commander, Navy Region Mid-Atlantic to brief the HRTPO Board on the Navy footprint in Hampton Roads, and the importance of transportation and collaboration to Navy readiness to the region. RADM Alexander stated that as Regional Commander of the Mid-Atlantic, he oversees the operations from North Carolina to the Canadian border, except for the state of Maryland. He explained the Navy is the largest employer, landowner, and customer in Hampton Roads, and as such, requires efficient transportation services for its military personnel, installations, and missions. He stressed that effective and efficient transportation access and mobility is a critical military readiness issue for installations and operations in Hampton Roads. Statistics from 2010 revealed the Navy “Family” comprised 282,944 of the Hampton Roads population with a total direct economic impact of $14.2 billion for the area. The Region Mid-Atlantic’s mission is to support the operating forces by enabling readiness through consistent, standardized, and reliable shore support of its quality installations. RADM Alexander reported the Navy is committed to sustaining and growing its mission in Hampton Roads; however, it will require significant infrastructure improvements to reduce congestion and increase mobility. RADM Alexander indicated the Navy is a committed partner with the HRTPO and Captain Mary Jackson, Commanding Officer of Naval Station Norfolk, attends the HRTPO Board meetings on a regular basis. Outstanding collaborations to date include the Military Transportation Needs Study and the on-going Military Commuter Survey.

He explained that in order to meet the needs of the Navy, transportation and land use planning should address:

• Compatibility with Navy operations and military readiness • Safety and quality of life for those accessing Navy facilities • “Official” Navy comments on specific projects must be limited to identifiable Navy

operational/access impacts RADM Alexander outlined the progress on the Navy Triangle Projects including the Fleet Park relocation, the Hampton Boulevard underpass, the I-564 Intermodal Connector, and the Air Terminal Interchange. He noted that the Grade Separated Interchange at Hampton and Terminal Boulevards, currently listed as a Navy Triangle Project, is un-programmed, and stressed the importance of this project. He indicated the Navy and the HRTPO are in unison regarding HRTPO priorities with Navy interest, including:

• the Downtown Tunnel-Midtown Tunnel-MLK Extension • Route17-Dominion Boulevard • the HRBT Expansion study • the Patriots Crossing study • the I-64 Peninsula Widening • Fixed Guideway Projects

RADM Alexander stated the Navy is committed to working with all stakeholders on the I-64 Peninsula widening project; however, a red line is associated with the project due to the potential for encroachment into Navy property. He indicated the Navy will continue to work together on this project, but it must be able to preserve the ability to conduct ordinance operations. Regarding the fixed guideway projects, RADM Alexander commented that the Navy is fully supportive of these projects in order to reduce the number of vehicles on the roadways. He noted there would be challenges in utilizing mass transit systems to transport people to and from the base. In conclusion, RADM Alexander stated future priorities should include continued commitment from all parties to bring the Navy perspective to the table in order to develop solutions. Education should be a common goal so that congestion can be reduced and more effective transportation measures can be initiated. He believed a cultural change was important to the success of these endeavors. Finally, RADM Alexander indicated the Navy will be briefing the Commonwealth Transportation Board (CTB) in the near future regarding the military and transportation in Hampton Roads. Chair Ward expressed her appreciation to RADM Alexander for the briefing and re-iterated the HRTPO’s commitment to collaborating with the Navy to ensure transportation solutions that benefit all citizens.

Mr. Shepperd asked for more information regarding the encroachment issue at Naval Weapons Station Yorktown with regards to the I-64 Peninsula widening project. RADM Alexander replied the issue pertains to the perimeter around the magazines that house the ammunition. There is a safety ordinance for the surrounding area that cannot be modified and the explosive arc for the magazines border the fence line. He indicated the widening of I-64 would encroach on this safety area. He referenced Captain Lowell Crow, Commanding Officer of the Naval Weapons Station Yorktown as the first point of contact for further information. Hampton Roads Long-Range Transportation Plan Adoption: Final Reports and Resolutions Ms. Ravanbakht reported the HRTPO is required to develop and maintain the region’s long-range transportation plan (LRTP). The plan serves as the blueprint for the region’s transportation development and identifies all regionally significant transportation projects for the Hampton Roads metropolitan planning area over a 20-year period. The development of the financially-constrained 2034 LRTP over the last four years has been based on a collaborative process involving many regional stakeholders and the public to identify, prioritize, and seek transportation funding for needed investments. She highlighted two components of the 2034 LRTP that set it apart from previous plans:

• the development of the project prioritization tool that was utilized to create the list of priorities for Hampton Roads

• the robust and extensive public involvement and community outreach for the plan The 2034 LRTP includes 32 committed projects costing approximately $300 million; all of which are funded and programmed. In addition, the plan identified 50 projects for construction, at a cost of almost $7 billion. Eleven studies are ongoing and critical for the transportation system in the region. Ms. Ravanbakht explained the second item of the agenda note is the completion of the 2035 Rural Long-Range Transportation Plan (RLRTP). The 2035 RLRTP was a joint effort by VDOT and HRTPO staff and consists of the City of Franklin and Southampton County. The RLRTP can be used by local, regional, and state agencies to assist in the identification process of transportation funding priorities. It includes 44 roadway system deficiencies/recommendations for the City of Franklin and 49 for Southampton County. Mayor Fraim Moved to approve both the 2034 LRTP and HRTPO Resolution 2012-01 and the 2035 RLRTP and HRTPO Resolution 2012-02; seconded by Mr. Heuer. The Motion Carried. Mayor Krasnoff expressed his appreciation regarding the approval of the 2034 LRTP. He commented that although there is no available funding, the High Rise Bridge project is of critical importance to the region.

FY 2013 Unified Planning Work Program: Establishing Planning Priorities Mr. Farmer reported that the development of the FY 2013 Unified Planning Work Program (UPWP) has been initiated by HRTPO staff. The UPWP describes transportation planning work to be performed for the Hampton Roads Metropolitan Planning Area (MPA). In addition to detailing the work associated with HRTPO core functions – the Long‐Range Transportation Plan, the Transportation Improvement Program, the Congestion Management Process, and Pubic Participation – the UPWP includes a discussion of the planning priorities for the metropolitan planning area (MPA). It is in the determination of these planning priorities that the HRTPO Board ensures its vision and goals are carried forward in the UPWP. Establishing clear direction from the HRTPO Board regarding its priorities will allow the staff to ensure that limited resources are properly allocated in the UPWP. In collaboration with HRTPO staff, the Transportation Technical Advisory Committee (TTAC) recommended the following items as FY 2013 UPWP priorities:

• Transportation Funding • Military Transportation Needs • Passenger Rail

Mr. Farmer indicated any other suggestions from the HRTPO Board could be sent through the TTAC or discussed at the May HRTPO Retreat. Mr. Heuer noted that in conjunction with Mr. Farmer’s comments, it is important to spend all federal dollars that are allocated to the region in order to avoid the loss of funding to another region. Mr. Florin recommended including the movement of freight as a fourth FY 2013 UPWP priority. Chair Ward stated the HRTPO Board should decide whether to continue studying the impact of tolls regarding usage and congestion. Mr. Farmer replied that a solution may be an expansion of the briefing provided by HRTPO staff in September 2011. The briefing pertained to the economic implications of the consequences of lowering the Midtown Tunnel toll by 50 cents. According to HRTPO staff estimates, the 50 cent change would cause 20,000 more people to conduct business and create economic activity in the region. He stated HRTPO staff would provide the Board with more information on this subject. Project Priorities and Candidate Public-Private Partnership (P3) Projects Ms. Ravanbakht reported that VDOT requested input from Virginia metropolitan planning organizations (MPOs) on regional funding priorities for the Commonwealth Transportation Board’s (CTB) FY 2013-2018 Six-Year Improvement Program (SYIP) and on identifying feasible candidate projects to advance under the Public-Private Transportation Act (PPTA).

She presented a slide that illustrated the projects, as recommended by the TTAC at its January 4, 2012 meeting, to be submitted as regional priorities during the development of the FY 2013-2018 SYIP. The TTAC-approved list of regional priorities is organized by the following CTB priorities:

• Funding deficient bridges • Increasing funding for Preliminary Engineering • Funding deficits on underway project phases, and/or accelerating existing projects

using additional funds Also during the January 4, 2012 meeting, the TTAC recommended the following as candidate projects to advance under PPTA:

• Patriots Crossing • Hampton Roads Bridge Tunnel • I-264 from I-64 to Birdneck Road

Ms. Ravanbakht noted that these projects are in accordance with the CTB’s transportation objectives and meet the screening criteria outlined in the PPTA Implementation Manual. Ms. Cuffee-Glenn indicated the City of Suffolk had the opportunity to embark on CenterPoint, an eminent project that appeared to meet the criteria for a PPTA, and asked if the project could be considered as a candidate project for submittal. Mr. Farmer replied he had previously spoken with Ms. Cuffee-Glenn regarding the CenterPoint project and asked for the HRTPO Board’s authority to vet the project further. Ms. Cuffee-Glenn expressed her appreciation for the opportunity to have the project considered. Mr. Shepperd commented there was no need to delay the decision and Moved to authorize Mr. Farmer to research the CenterPoint project for possible submittal as a candidate PPTA project. Mr. Harrison asked if the Virginia Beach Transit Extension was a viable candidate to submit for PPTA consideration. Ms. Ravanbakht indicated the City of Virginia Beach had not submitted the project to TTAC. She stated the project is currently under an alternative analysis study, and it was her understanding that the environmental work must be complete before it could be considered. Mr. Heuer explained a PPTA project is different due to its financing component. With a PPTA, there is generally a payback source of revenue. There must be a revenue stream to return the initial investment by the private sector which is usually a toll.

Mr. Shucet stated it was admirable that VDOT requested recommendations from the HRTPO; however, the ultimate determination of whether a project is a viable candidate for a PPTA is decided by the private sector. Ms. Darden inquired as to why Route 460 was not included on the candidate list of PPTA projects. Mr. Farmer replied the Route 460 project is already underway. Mayor Fraim stated the PPTA process has delivered the Downtown Tunnel-Midtown Tunnel-MLK Extension project; nevertheless, he thought it prudent to offer suggestions to the General Assembly on ways that may improve the process. He proposed this subject be an agenda item for a future HRTPO Board meeting. Chair Ward replied the agenda had been approved and asked for a motion to approve the regional priorities and candidate projects and also to authorize Mr. Farmer to work with the Cities of Suffolk and Virginia Beach on their projects. Mr. Barclay Moved to approve the regional priority projects, along with the candidate PPTA projects, for VDOT submittal, and to authorize the Executive Director to work with the City of Suffolk and the City of Virginia Beach on their candidate PPTA projects; seconded by Mayor Price. (Mr. Hutson departs) Downtown Tunnel-Midtown Tunnel-MLK Freeway Extension Project: VDOT Mr. Heuer introduced Mr. Frank Fabian, Senior Project Manager for the Downtown Tunnel-Midtown Tunnel-Martin Luther King (DTT-MTT-MLK) Extension Project to brief the HRTPO Board regarding the project update. Mr. Fabian reported the DTT-MTT-MLK Extension Project is a public-private partnership (P3) project, located in Norfolk and Portsmouth, and will be instrumental in addressing the region's transportation needs. The project overview consists of:

• A new, parallel two-lane Midtown Tunnel • Refurbishment and safety improvements to both the Midtown and Downtown

Tunnels • Brambleton Avenue and Hampton Boulevard Interchange modifications • Extension of the MLK Freeway to I-264 – High Street Interchange

There will be numerous benefits beyond the traditional traffic improvements associated with the project including:

• Direct economic stimulus • Promoting economic development • Local job creation

Mr. Fabian indicated VDOT and the DTT-MTT-MLK Extension Project Developer, Elizabeth River Crossings (ERC), had reached an agreement on several key business terms:

• Value of Comprehensive Agreement is $2.1 billion • ERC to provide $1.7 billion investment • ERC to finance, design, build, operate, and maintain facilities • The Commonwealth will provide $362 million specifically to lower tolls • Tolls for automobiles will be $1.59 off-peak and $1.84 peak • MLK Extension tolls will be $0.50 for tunnel users and $1.00 for non-tunnel uses • The terms of the project are set at 58 years • VDOT will retain ownership of the project

The timeline for the project began in May 2008 with a request for conceptual proposals. The key business terms were agreed upon in July 2011 with the comprehensive agreement determined in December 2011. Financial close should take place in the first quarter of 2012, with construction beginning in the third or fourth quarter. Tolling will commence in the third quarter of 2012 and the project is scheduled to be completed in the year 2018. Mr. Fabian explained tolls will be collected by E-ZPass® or by invoice. E-ZPass® is an automatic, electronic toll collection system that efficiently moves traffic through toll facilities and is used in 14 states, including Virginia. If a vehicle is invoiced, it will be mailed to the individual that owns the vehicle. By Virginia law, the charge invoiced will be capped at two times the base toll rate. In conclusion, Mr. Fabian stated more information regarding the project could be accessed at www.MidtownTunnel.org. Mr. Heuer reported that VDOT staff had been asked numerous times if the agreement included a non-compete clause. He informed the HRTPO Board that there was no such clause. Article twelve of the comprehensive agreement states that the CTB and VDOT have the duty to develop and operate projects in the best interest of the state. This affirmative statement essentially codifies the State’s ability to develop other facilities. However, should the Commonwealth develop another facility which has an impact in revenue and traffic to the private sector; language pertaining to this alternative facility is referenced in the agreement and discussion will then be warranted.

Mr. Shepperd asked if there are any special provisions in place to ensure that ERC maintains its budget. Mr. Fabian replied affirmatively and indicated extensive cost control methods will be utilized. Mr. Shepperd inquired if the cost methods are designed to assess cost problems before they spiral out of control. Mr. Heuer replied the DTT-MTT-MLK Extension project is based on a performance contract rather than a conditional design-bid-build contract. Unless VDOT changes the scope, ERC must deliver the project with any additional costs absorbed by ERC. Mr. Shucet noted that ERC will have an agreement with its contractor that will be relentless in terms of price control. Mr. Heretick stated the City of Portsmouth will be substantially disadvantaged by the construction of the DTT-MTT-MLK Extension project, and while the City agrees with the HRTPO in that it is the number one priority in Hampton Roads, the economic impact will fall disparagingly upon the Portsmouth community. He noted the impact of tolls upon the citizens of Portsmouth has not been appropriately evaluated and there is a need for the stakeholders to have a more active role in the decision making process. Chair Ward indicated a motion was necessary for Agenda Item #8, which had been moved to the conclusion of this Agenda Item. Mayor Sessoms Moved to approve amending the FY 2012-2015 TIP to revise information on three current projects and to add four new projects associated with the DTT-MTT-MLK Extension project; seconded by Mr. Shepperd. The Motion Carried with Mr. Heretick voting in opposition. Virginia Department of Rail and Public Transportation Comments and Updates Ms. Inman reported that work regarding the Norfolk Passenger Rail train is moving forward. She indicated DRPT is continuing its efforts and is excited for Hampton Roads in this new venture. HRTPO Board Action Items: Three Month Tentative Schedule Mr. Farmer reminded the HRTPO Board that the February HRTPO meeting was cancelled in order to convene the HRPDC Retreat. The HRTPO Retreat will be held in May, and therefore, members can expect full agendas in March and April. Correspondence of Interest Chair Ward highlighted the items in the Correspondence of Interest section of the Agenda packet.
