IN APPRECIATION OF LARRY ENGLISH

WHEREAS, in April of this year, the San Diego Chargers wisely selected Defensive EndLarry English in Round 1 of the NFL's 2009 Draft; and

WHEREAS, Larry English is a graduate of the Marmion Military Academy and NorthernIllinois University and proudly calls Aurora, Illinois his hometown; and

WHEREAS, known as a consummate athlete during his school years, Larry Englishearned many distinctions, among them team MVP at Marmion where he was also regarded asone of the most feared players in the Suburban Catholic Conference, named first-team All-Suburban Catholic Conference, All-Area by the Aurora Beacon News, and All-Area Tri-City by,the Daily Herald; and

WHEREAS, while at Marmion, in addition to his talents on the football field, Larry alsoearned three letters in basketball and threw the discus for the track team; and

WHEREAS, during his years at Northern Illinois University, Larry was regarded.as oneof the premier pass rushers. His 31.5 sacks set an all-time school record, he was ranked fifthin the Mid-American Conference history, and is a two-time recipient of the very distinguishedVern Smith Leadership Award, an outstanding achievement in and of itself; and

WHEREAS, even as Larry English's many activities, on and off the athletic field, havebrought him richly deserved honors, Kane County is sincerely grateful to Larry for being amentor and excellent role model to the young people in the community. His faith-based valuesand integrity have earned him the respect of his family, friends and those gathered here today.

NOW, THEREFORE, ON THIS 9TH DAY OF JUNE 2009, the Kane County Board andthe Chairman thereof offers this plaque as a token of their esteem and trusts Larry English willfind satisfaction and fulfillment in his chosen career.

WHEREAS, Lindsay Wisdom-Hylton, a Fox Valley native, was the 13th overall pick bythe Los Angeles Sparks at the WNBA's 2009 draft in April; and

WHEREAS, Lindsay grew up in Aurora and will be long remembered for her remarkabletalent in women's basketball, averaging 15.0 points, 10.6 rebounds, 5.2 blocks and 4.9 stealsin her senior year at Neuqua Valley High School: - Her career total points over four years atNeuqua Valley was an amazing 1,752, rebounds totaled 1,200, total steals during the fouryears were 662, and total assists numbered 500; and

WHEREAS, Lindsay went on to wear #32 for the Purdue Boilermakers where she ledthe women's basketball team in rebounds during her junior year (302; 8.2 average), wasnamed Big Ten Defensive Player of the Year and Big Ten All-Defensive Team two years in arow, First Team All-Big Ten by the coaches and media, was the team's second leading scorer,averaging 14.8 points, and played on the 2006 and 2007 USA National Team winning gold atthe FIBA Women's World Championship in Mexico City and Moscow. Lindsay Wisdom-Hyltonholds the school record for career rebounds (968) and blocked shots (281), and, is third.forcareer steals (313). Additionally, Lindsay established the all-time Purdue career record forblocks (227); and

WHEREAS, Lindsay Wisdom-Hylton exemplifies the female athlete who is dedicated tothe proposition that individual success and social responsibility can and should go hand inhand.

NOW, THEREFORE, ON THIS 9TH DAY OF JUNE 2009, the Kane County Board andthe Chairman thereof hereby recognize Lindsay Wisdom-Hylton for her skill , dedication andwillingness to work hard . WHEREAS, the Kane County Citizens Police Academy was established April 1, 2009 bythe Kane County Sheriffs Office and completed its first class on June 3; and

WHEREAS, the purpose of the class is to promote increased trust and understandingby providing citizens with an inside look at the operations within the Sheriffs Department; and

WHEREAS, participants in the class will have the opportunity to learn aboutinvestigations, evidence, patrols, corrections and other aspects of county law enforcement;and

WHEREAS , the classes are taught by members of the Sheriffs Office and coordinatedby Sgt . John Grimes.

WHEREAS, for many Girl Scouts , the sense of community and commitment that comefrom their work on the Girl Scout Gold Award set the foundation for a lifetime of activecitizenship; and

WHEREAS, Erin Hellwig , a senior at Hinckley-Big Rock High School and a member ofTroop 548, built on her past success with the Big Rock Library where she and a fellow GirlScout started the Children 's Library. Erin painted the basement where the Children 's Library islocated and conducted a book drive to collect works suitable for teenage readers; and

WHEREAS, the Big Rock Library Committee was very grateful for the bookcontributions to establish a library in their small community and very appreciative for the newpaint in the children 's area.

WHEREAS , for many Girl Scouts , the sense of community and commitment that comefrom their work on the Girl Scout Gold Award set the foundation for a lifetime of activecitizenship; and

WHEREAS , Kathryn King is a senior at St. Charles East High School and a member ofTroop 251. For Kathryn it was not enough to collect gently used soccer equipment to donateto an impoverished village in Guatemala , she also held a soccer clinic for disadvantaged youthin her community . In addition she headed three Afterschool Enrichment programs designed toteach children that by setting goals and envisioning a dream , they can overcome any

disadvantage; and

WHEREAS , her project enabled youth to experience the life skills learned byparticipating in team sports and taught them how those lessons translate into accomplishingother goals; and

IN APPRECIATION OF CORTNEY MORGANGIRL SCOUT GOLD AWARD 2009

WHEREAS, the Gold Award is the highest award that a Girl Scout , ages 14-18, may

earn; and

WHEREAS, for many Girl Scouts, the sense of community and commitment that comefrom their work on the Girl Scout Gold Award set the foundation for a lifetime of activecitizenship; and

WHEREAS, Cortney is a senior at St. Charles East High School and a member of Troop251. In completing her Girl Scout Gold Award project, Cortney provided an informationalpresentation to residents at Lazarus House, a temporary housing shelter, teaching them howto prepare healthy meals inexpensively; and

WHEREAS, the goal of Cortney's project was to assist in providing healthier meals thatwill reduce medical issues related to obesity and heart disease. Additionally, Cortneycoordinated a formal afternoon dinner. inviting residents from Lazarus House and HarmonyHope, a Healing of Edgewood Community in Chicago; and

WHEREAS, Cortney's efforts helped build confidence and self-esteem within thehomeless community.

WHEREAS, Kate is a sophomore at Yorkville High School and a member of Troop 312and was one of four girls involved in creating "A Play for the Community," their service projectfor the Girl Scout Gold Award at Johnson School, a school in a high need area of Aurora; and

WHEREAS, Kate has always had a love for drama and has expressed it in her actingcareer; she took the initiative not only to share her acting skills and knowledge with the kids,but learned more about some of the needs of the individual children in the process; and

WHEREAS, Kate brought the zeal and confidence needed to carry the project through.

WHEREAS , Elisabeth Scheffrahn is a junior at Rosary High School in Aurora and amember of Troop 312. She was one of four girls involved in creating "A Play for the

Community ," their service project for the Girl Scout Gold Award at Johnson School , a school in

a high need area of Aurora . Elisabeth knew from the first that her Girl Scout Award projectwould involve writing and service to others -- two areas of passion for Elisabeth . She helped to

bring the girls together , combining their skills into a project that would benefit the community;and

WHEREAS , throughout the project , Elisabeth helped write and edit the plays. She alsoplayed a major part in the recording process of how to replicate the project by helping each girldevelop the written project guide and other important documenting steps along the way.

WHEREAS, the Gold Award is the highest award that a Girl Scout, ages 14-18, may

WHEREAS, for many Girl Scouts, the sense of community and commitment that comefrom their work on the Girl Scout Gold Award set the foundation for a lifetime of activecitizenship; and

WHEREAS, Kelsey is a senior at Rosary High School in Aurora and a member of Troop

312. She was also one of four girls involved in creating "A Play for the Community," theirservice project for the Girl Scout Gold Award at Johnson School, a school in a high need areaof Aurora; and

WHEREAS, Kelsey has had a passion for art as long as she can remember, soincorporating those skills into her project was her goal; and

WHEREAS, capitalizing on past experience in creating scenery for her high school,Kelsey consulted with her high school drama director to develop a plan that would be moresuitable for the younger children and a limited budget; and

WHEREAS, Kelsey learned that you can actually do quite a bit with limited supplies,generous donations, a lot of flexibility, and tremendous amount of enthusiasm from theparticipants.

WHEREAS , Lauren is a junior at Batavia High School and a member of Troop 595 andhas always had an affinity for animals . When considering how to complete her Girl Scout GoldAward project , Lauren found a great fit by partnering with Critter Camp , an exotic pet rescuesanctuary , to renovate the rabbit and guinea pig enclosure at their facility; and

WHEREAS , Lauren overcame a number of challenges during her project . Critter Campwas under budgeted and under staffed and would not have the resources necessary to makethe USDA required upgrades to the rabbit and guinea pig enclosure; and

WHEREAS , she tackled the challenges , raised funds and worked with businesses touse materials with damaged packaging in order to continue with her project . In addition, sherecruited volunteers who were able to work under Lauren 's leadership to remove and replacewalls and ceilings over two separate weekends; and

WHEREAS, it started out as a pretty dirty project , and was a pristine environment for therabbits and guinea pigs at its completion.

WHEREAS , the current natural gas service contract is set to expire November 2009; and

WHEREAS , the best method to purchase natural gas that has daily price fluctuations in acommodity market is through a process that allows real -time submittal and acceptance of thesuccessful bid; and

WHEREAS , the established pricing model would provide the utility companies with a standardformat that would allow the County to determine its actual cost per therm; and

WHEREAS , staff has been investigating all available resources of natural gas suppliers, andhas determined that the County should provide the County Board Chairman with the authority to enterinto a contract once competitive pricing has been solicited by the Purchasing Department , reportingsuch to County Board; and

2009 AERIAL IMAGERY

WHEREAS, the County of Kane intends to continue efforts to maintain accurate, reliable,and up-to-date geographical data; and

WHEREAS, the aerial imagery serves as a framework for the County's GeographicInformation System and supports the decision making process for many important issues currentlyfacing Kane County, including real estate development and land use, transportation infrastructure,storm water and watershed management and analysis; and

WHEREAS, the 2009 collaborative aerial imagery project currently being managed by theCook County Department of Technology as governed by a contract with Merrick & Company forCook, DuPage, Kane, Kendall, Lake, McHenry & Will Counties to develop a standard specificationfor 6 inch pixel color digitally captured Aerial Imagery. The seven county project for AerialImagery includes ground control, aerial imagery (including aero triangulation), orthorectifiedimagery, DEM, geodatabase design, metadata and project management; and

WHEREAS, in order for Kane County to benefit in the lower cost based on the collaborativepartnership with the other agencies, it is necessary to enter into an agreement with the CookCounty to provide the funds to complete the project; and

WHEREAS, the cost of said agreement shall not exceed $179,327; and

WHEREAS, funds have been appropriated in FY2009 to fund said agreement, said amountshall be paid from the GIS-Technologies fund 101.060.070.50150.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County ofKane shall pay Cook County for Aerial Imagery, not to exceed One hundred Seventy NineThousand Three Hundred Twenty Seven Dollars and NO/100 ($179,327).

AN ORDINANCE PROPOSING THE ESTABLISHMENT OF THESUNVALE SPECIAL SERVICE AREA

(or SPECIAL SERVICE AREA NO. SW-37)OF KANE COUNTY, ILLINOIS

AND THE LEVY OF TAXES FOR THE PURPOSE OF PAYING THE COSTOF PROVIDING SPECIAL SERVICES IN AND FOR SUCH AREA.

WHEREAS, a Final Plat of Subdivision was approved by the County of Kane, Illinois (the"County"), for the Sunvale Subdivision Units 1 and 2 with the Unit 1 plat being recorded on June 30,1980 (Document No. 1546729) and the Unit 2 plat recorded on June 15, 1983 (Document No.1642263); and

WHEREAS, storm water detention and storm sewers were constructed and drainageeasements recorded in accordance with the Kane County Ordinances at that time; and

WHEREAS, the individual homeowners within the subdivision, under Illinois Drainage Law, areobligated to maintain the stormwater drainage system and drainage easements within their individuallots in the subdivision but do not have a Homeowner's Association in place that would be able tocoordinate the work and impose an assessment upon the owners of all of the lots within the Subdivisionto provide for the overall maintenance and improvements of the stormwater drainage system; and

WHEREAS, Kane County has received a petition signed by 10 of the 16 homeownersrequesting that the County propose a ("SSA") for the purpose of funding the replacement of a portion ofthe storm sewer system and funding long term maintenance of the stormwater improvements that servethe subdivision; and

WHEREAS, pursuant to the provisions of Article VII, Section 7, Part (6) of the 1970 Constitutionof the State of Illinois (the "Constitution"), the County of Kane is authorized to create special serviceareas in and for the unincorporated areas of the County; and

WHEREAS, pursuant to the "Special Service Area Tax Law", 35 ILLS 200/27-5, et seq. (2003),the County is authorized to levy and impose taxes upon property within special service areas for theprovision of special services to those areas and for the payment of debt incurred in order to providethose services; and

WHEREAS, it is in the public interest that the establishment of the area hereinafter described asa special service area for the purposes set forth herein and to be designated as the Sunvale SpecialService Area (or Special Service Area No. SW-37), of the County; and

WHEREAS, the Area is contiguous and totally within the boundaries of the unincorporated areaof the County; and

WHEREAS, the purpose of establishing the Area is to provide certain special governmentalservices. (the "Services") to the Area, which are unique and in addition to the services generallyprovided to the County as a whole; and

WHEREAS, a Construction Project is to be built and funded by the SSA. The ConstructionProject is defined specifically as the construction of 320 fin. ft. of storm sewer on the west side of thesubdivision to replace 320 lin. ft. of failed storm sewer. The homeowner's share of the constructioncost is $5,954. This sum shall be collected in equal installments over a 10 year period after which timethe Construction Project levy shall expire. Equal. payments shall be made each year by thehomeowners in accordance with Exhibit A for the 10 year period. No interest shall be collected. Thecost-sharing arrangement was approved by the Kane County Development Committee on December16, 2008 as Cost-Share Project 2009-001; and

WHEREAS, The Long Term Maintenance Services to be provided by the SSA may include, butare not limited to the following: the operation, maintenance, repair, rehabilitation, replacement andreconstruction of any storm water detention and/or retention area, drainageway, ditch, swale, stormsewer or other stormwater facility; costs of design, engineering and other consulting services, surveyingand permits, public liability insurance, and all administrative, legal and other costs or expenses incurredin connection therewith and with the administration of the Area, including the repayment of any loan ordebt incurred for the provision of any of such Services, Long Term Maintenance Services to beperformed are required to be located within the Drainage Easement Areas as shown on the plats ofsubdivision for Sunvale Units 1 and 2 and the Pesch easement (PIN 06-31-300-015) located west ofthe west line of the subdivision. The Long Term Maintenance Maximum Levy schedule is attached asExhibit A. The maximum long term maintenance levy amount shall increase each year the SpecialService Area is active by I % to account for inflation; and

WHEREAS, the special service area tax shall be levied upon all taxable property within the Areafor an indefinite period of time beginning for the year 2009, in an amount sufficient to produce revenuesrequired to provide the special services. The amount to be levied for construction costs andmaintenance shall be computed and determined on an annual basis on the method set forth on ExhibitA attached hereto and made a part hereof and shall not exceed the maximum amounts shown thereonfor construction and maintenance costs. Such amounts shall not exceed the amount included onExhibit A within the SSA document, and shall be in addition to all other taxes permitted by law.

WHEREAS, it is in the public interest that the levy of a direct annual tax upon all taxableproperty within the Area be considered for the purpose of paying the cost of providing the Services; and

WHEREAS, the revenue from such tax shall be used solely for Services for which the County isauthorized under law to levy taxes or special assessments or to appropriate funds of the County, all ofthe' Services to be in and for the Area and all of any necessary construction and maintenance to bewithin drainage easements within the subdivision and as defined thorough the easement document onthe Pesch property. Approval of this SSA document subsequently provides for access to the drainageeasements as shown on Sunvale Unit 1 and 2 plats of subdivision by the County, it successor andassignees for the purposes describe above; and

WHEREAS, said tax shall be levied upon all taxable property within the Area for Long TermMaintenance Services for an indefinite period of time beginning for the year 2009, in an amountsufficient to produce revenues required to provide the Services, and such amount shall not exceed theamount as shown on Exhibit A plus 1 % for each year the SSA is active and shall be in addition to allother taxes permitted by law; and S

WHEREAS, said tax shall be levied upon all taxable property within the Area for theConstruction Project for 10 years beginning for the year 2009, in an amount sufficient to producerevenues required to provide the Services, and such amount shall not exceed the amount as shown onExhibit A and shall be in addition to all other taxes permitted by law; and

Legal Description

The purpose of establishing the Area is to provide certain special governmental services(the "Services') to the Area, which are unique and in addition to the services generallyprovided to the County as a whole in regards to the stormwater drainage system. The

Services to be provided may include , but are not limited to the following : the operation,maintenance , repair , rehabilitation , replacement and reconstruction of any storm waterdetention and/or retention area , drainageway , ditch, swale , storm ' sewer or otherstormwater facility ; costs of design , engineering and other consulting services , surveyingand permits , public liability insurance , and all administrative , legal and other costs orexpenses incurred in connection therewith and with the administration of the Area,including the repayment of any loan or debt incurred for the provision of any of suchServices , all of the Services to be in and for the Area.

The levy of a direct annual tax upon all taxable property within the Area for the purposeof paying the cost of the Services will also be considered at the Hearing . The tax shall belevied upon all taxable property within the Area for an indefinite period of time beginningfor the year 2009 , in an amount sufficient to produce revenues required to provide thespecial services . The amount to be levied for construction costs and maintenance shallbe computed and determined on an annual basis on the method set forth on Exhibit Battached hereto and made a part hereof and shall not exceed the maximum amountsshown thereon for construction and maintenance costs . Such-amounts shall not exceedthe amount included on Exhibit A within the SSA document , and shall be in addition to allother taxes permitted by law.

All interested persons , including all persons owning taxable real property located withinthe Area , will be given an opportunity to be heard at the Hearing regarding theestablishment of the Area and the tax levy and an opportunity to file objections to theestablishment of the Area or to the amount of the tax levy.

At the Hearing, any interested person may file with the County Clerk written objections toand may be heard orally in respect to any issues referenced in this Notice. The Hearingmay be adjourned to another date without further notice other than a motion to beentered upon the minutes fixing the time and place it will reconvene. At the first regularmeeting of the County Board after the public hearing , the County may delete area fromthe special service area.

If a petition signed by at least 51% of the electors residing within the Area and by at least51 % of the owners of record of the land. included within the boundaries of the Area isfiled with the County Clerk, within 60 days following the final adjournment of the Hearingobjecting to the creation of the Area or the levy or imposition of a tax for the provision ofthe Services to the Area, no such special Service Area may be created or no tax may belevied or imposed.

* The six (6) properties along the existing storm sewer and detention area that areflooded fund 55% of the residents` share of the cost for construction of the Cost-Share project. The remaining ten (10) properties share the remaining 45% of thecost. As the infrastructure was approved with the subdivision, all residents sharein the responsibility of that infrastructure. To a greater extent, the residents withthe infrastructure on their property have a greater responsibility under IllinoisDrainage Law. For that reason, residents with the infrastructure on their propertyare levied approximately double as the petitioning residents felt this was fair andequitable.

** Nine (9) properties in the Sunvale Subdivision contain drainage infrastructurelocated in a drainage easement. The nine properties are responsible for 65% of anannual long term maintenance levy due to their responsibility under IllinoisDrainage Law. The remaining seven (7) properties share the remaining 35% ofthe maintenance levy as the infrastructure was key to the subdivision approval..The petitioning residents felt this was fair and equitable.

WHEREAS, the Chairman was previously authorized (Resolution 07-365) to expend $40,000.00 infunds and enter contracts related to the McLean Boulevard Fen and South Elgin FenManagement Plan,such work has been completed per the management plan. Additional vegetative management andenhancement work still remains to be completed at the McLean Boulevard Fen; and

WHEREAS, the Kane County Department of Environmental & Building Management (KCDEBM)desires to continue its partnership with the Kane County Forest Preserve District (the "KCFPD") toimplement the approved management plan for the McLean Boulevard Fen as part of the Stearns RoadBridge Corridor Project, and KCDEBM proposes to utilize monies made available from the Kane CountyRiverboat Fund ($45,000.00) to manage and enhance these wetlands; and

WHEREAS, said management plan has been developed and accepted by the KCFPD and said$45,000.00 in additional funding has been allocated and budgeted for expenditure in FY 09, FY10 and FY11 by the KCDEBM, and KCDEBM desires to continue to implement said management plan.

WHEREAS, the model building codes adopted by Kane County provide for temporary structures anduses; and

WHEREAS, the model building codes adopted by Kane County provides for building permit feedand

WHEREAS, the current building permit fees do not include descriptions or fees for temporarystructures and uses; and

WHEREAS, it is in the best interest of the health, safety and welfare of the citizens of Kane Countythat temporary structures and uses be reviewed, approved and inspected and

WHEREAS, it is in the best interest of the citizens of Kane County that building permit fees beassessed for temporary structures and uses in order to pay for the costs to provide permit administration,review and inspections for such structures and uses.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the existing text of Chapter6, Buildings and Building Regulations, of the Kane County Code, is hereby amended as follows, effective asof May 12, 2009.

INCREASING CERTAIN SHERIFF'S FEES

WHEREAS, Illinois Revised Statute 55 ILCS 5/4-5001, entitled "Sheriffs-Counties of first andsecond class" provides that where the fees allowed by that statutory section are not sufficient to coverthe costs of providing the services listed therein increased fees may be changed based upon actualcosts; and

Kane County is committed to providing a safe and secure work environment for its employeesand visitors .. The proper issuance and display of identification cards is one way to create a saferand more secure work environment . A standardized identification card also readily identifiesKane County employees when they visit other offices and organizations . Employees shouldfollow their respective Office or Department protocols with respect to security and visitors.

All Kane County employees , contractors , and interns will be issued a standardized Kane CountyIdentification card which can be secured by appointment through the Human ResourceManagement Department . Identification cards will be color coded and issued to the following

individuals:

1. Permanent employees (full time and part time)2. - Contractors (vendors doing long term projects)3. Interns (short-term employees)

The standardized employee Identification card will contain the following information:

Each office and department will be issued several "Visitor" identification cards to be used for

All Kane County employees shall wear their identification card while at the office or place ofwork unless specifically directed otherwise by their respective department head . Employees ofelected officials are encouraged to wear their identification card while at the office or place of

work. These cards are not to be altered in any way . Employees are also encouraged to look at

identification cards of those individuals with whom they come in contact . Any irregularities

should be reported to the Human Resource Management Department.

Identification cards must be returned to the employee ' s supervisor upon separation or transfer

from their department . Supervisors will then return these cards to the Human ResourceManagement Department.

Supervisors should immediately notify the Human Resource Management Department whenthere is a change in service of their employee.

Lost or stolen identification cards must be reported immediately to the employee ' s supervisor

WHEREAS, in order to carry out such duties, the State's Attorney requires informationmaintained on the computer files of the Driver Services Department of the Office of the IllinoisSecretary of State; and

WHEREAS, the Illinois Secretary of State desires to grant the State's Attorney access to thesefiles by on-line access, for the cost of approximately one hundred dollars ($100.00) for three years, andsubject to other terms and conditions as provided in the On-Line Access Agreement between theState's Attorney and Illinois Secretary of State, a copy of which is on file with the County Clerk's Office;and

WHEREAS, BI Incorporated, the vendor servicing this program for Kane County Court Servicessince 1993, received the highest overall evaluation score based upon cost, functionality of equipment,responsiveness of support personnel, and the probation staffs expertise in using BI software andhardware, which will allow for continuity of service to offenders currently on the program without a breakin service; and

WHEREAS, the County has reviewed other systems and has determined that a contract with BIIncorporated is in the best interest of the people of Kane County; and

RESOLUTION AUTHORIZING KANE COUNTY BOARD CHAIRMAN TO ENTER INTOAGREEMENTS WITH SUBSCRIBERS FOR 911 SERVICES

WHEREAS, the KaneComm Board has established that all KaneComm subscriber agenciesshall enter into agreements with the County of Kane for the dispatching of 911 service to their policeand fire users and 'to establish a fee structure for such services; and

WHEREAS, the proposed Subscriber Agreement provides that said fee structure beimplemented over the course of two years in order to allow a reasonable time for member agencies toplan and budget for the costs of service; and

WHEREAS, the proposed Subscriber Agreements are for an initial term of one (1) year, with anautomatic renewal for one additional year; and

WHEREAS, it is anticipated that upon expiration of the initial term of the agreement that theCounty and the users will enter into new subscriber agreements whereby all users shall pay 100% ofthe costs of services; and

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board, that the followingSubscriber Agreements, including the fee structure contained therein, for providing 911 service for 2009and 2010 is approved and that the Kane County Board Chairman is authorized to enter into thisagreement with any and all of the agencies listed in Exhibit A hereto and incorporated herein:

"911 SERVICE SUBSCRIBER AGREEMENT

"THIS AGREEMENT is made and entered into this day of , 20 between

Kane County (hereinafter referred to as "County") and , as thegoverning body responsible for providing the budget and funding for one or more public safety agencies(hereinafter referred to as "Subscriber").

"WHEREAS, Subscriber desires the following public safety agencies (hereinafter referred to as"User(s)" to receive emergency communication support from the County's 911 provider (hereinafterreferred to as "KaneComm") for the purpose of answering, processing and directly dispatchingemergency calls within the Kane County 911 service area:

"WHEREAS, the Kane County Emergency Communications Board (hereinafter referred to as"KaneComm Board") has established fees and charges for Subscribers per Section 6 of Chapter 24 ofthe Kane County Code attached hereto as Exhibit A, and

"NOW, THEREFORE, IT IS AGREED as follows:

"1. TERM: The term of this agreement shall be for one calendar year beginning on June 1, 2009 andshall automatically renew from one additional year. This agreement may terminate upon written requestmade by Subscriber to the KaneComm Director no later than July 1 of the year preceding the requestedtermination of services.

"2. PERCENTAGE OF TOTAL COSTS: For fiscal year 2009, Users shall be charged 50% of the total

cost. For fiscal year 2010, Users shall be charged 75% of the total cost.

"3. CALCULATION OF TOTAL COSTS: For purposes of calculating total costs, the followingformula shall be applied: Total cost shall mean the cost per call multiplied by the number of callsattributable to an individual User plus the Base Fee. The cost per call shall be determined by dividingthe total number of calls by the Net Fee for the period August 1 of the preceding year through July 31 ofthe current year. The Net Fee shall be determined by deducting salaries, benefits, non-salary operatingexpenses, and the base fee from income for the period August 1 of the preceding year through July 31 ofthe current year. The Base Fee shall be calculated as follows: Subscribers whose call percentage ascompared to the total number of calls constitutes one percent (1%) or less of the total calls shall pay aBase Fee of Five Thousand Dollars ($5,000). Subscribers whose call percentage as compared to thetotal number of calls is greater than one percent (I%) but less than forty percent (40%) of the total callsshall pay a Base Fee of Ten Thousand Dollars ($10,000). Subscribers whose call percentage ascompared to the total number of calls is greater or equal to forty percent (40%) shall pay a Base Fee ofTwenty Thousand Dollars ($20,000). For purposes of determining the Base Fee, the total calls for allUsers shall be considered.

"4. DETERMINATION OF CALLS: For 2009 and 2010, the cost per call shall be calculated using the

current HTE CAD system.

"5. USERS: Users under this Agreement may include any police, fire, emergency medical, office ofemergency management, health department, or other related governmental agency with operations inKane County and shall participate in the User Group established under Section 10 of Chapter 24 of theKane County Code through a representative appointed by the Subscriber to serve on the User Group.

"6. RESOLUTIONS REQUIRED: Each Subscriber shall furnish a certified copy of a resolutionauthorizing the Subscriber to enter into a 911 Service Subscriber Agreement which resolution shall beattached hereto and made 'a part hereof.

"7. DESCRIPTION OF SERVICES TO BE PROVIDED: KaneComm agrees to provide 911 servicesand public safety dispatching services under the terms of this Agreement. Such services shall beprovided twenty-four (24) hours a day, seven (7) days a week and shall include the following:

a. The answering of emergency telephone calls to 911 and other emergency telephone lines asshall be required for emergency medical, fire, and police services.

b. Emergency and routine radio communications with emergency, medical, fire, police or otheremergency service providers.

c. Communications between providers and other resources related emergency communication.

"8. KANECOMM PERSONNEL AND EQUIPMENT : For purposes of performing the services

outlined in paragraph (4) above, KaneComm shall furnish and supply all necessary personnel,

supervision, administration, equipment and supplies. KaneComm shall also provide all necessarytelephony in support of this service at its facility, including lines and databases.

"9. COMMUNICATION E QUIPMENT: All Users shall operate on the KaneComm radio frequenciesin order to establish and maintain an enhanced level of service for the purpose of safety for all

personnel. Subscriber agrees to furnish and to pay for the installation of equipment that meets or

exceeds minimum compatibility with the communications infrastructure to include purchasing,maintaining and repairing their own base, mobile and portable radio. equipment, as well as directlandlines from the 911 emergency communications center to their individual stations, remote radios and

offices. Current recommendations of compatible equipment shall be furnished by the KaneComm

Director upon request.

"10. FACILITIES: Kane County shall provide the facility for 911 operations including all staff and

equipment as outlined above and shall provide for the maintenance thereof.

"11. BUDGET: An annual budget shall be prepared by the KaneComm Director with cost allocationsfor each Subscriber and shall be distributed to the Users and Subscribers by September 30 of each year.

"12. PAYMENTS: KaneComrn shall provide Subscriber with an invoice to include the SubscriberBase Fee and each User Call Fee determined as provided in Section 6 of Chapter 24 of the Kane County

Code which shall be due within sixty (60) days after delivery of the invoice . Payments made later than

thirty (30) days after the due date shall be subject to an interest penalty of one percent ( 1%) on anyunpaid balance for each month or fraction thereof after the due date until final payment is made.

13. PROCUREMENT: Kane County Procurement policies shall govern with regard to all purchases

and procurements.

"14. INSURANCE: Subscribers shall provide to the KaneComm Director proof of liability insurance

for all Users within thirty (30) days of acceptance of this Agreement . Subscriber shall notify theKaneComm Director in the event of any changes to or cancellation of said liability insurance, and theCounty shall be listed as an additional insured on such policy.

"15. GOVERNING LAW: This Agreement shall be governed and construed in accordance with the

laws of the State of Illinois. Any claim, action , suit , or proceeding arising from or relating to thisAgreement shall be brought and conducted within the Sixteenth Judicial Circuit of Kane County.

"16. INDEMNIFICATION AND HOLD HARMLESS: Subscriber shall indemnify and hold harmless

the County, the KaneComm Board , its agents , officials , and employees from and against all injuries,losses, claims, suits, costs and expenses which may accrue against the County as a consequence of thisAgreement.

"17. SEVERABILITY: If any terms or provisions of this Agreement is declared by a court ofcompetent jurisdiction to be illegal or in conflict with any law, the validity of the remaining terms andprovisions shall not be affected , and the rights and obligations of the parties shall be construed andenforced as if the Agreement did not contain the particular terms or provision held invalid.

APPROVING AN INTERGOVERNMENTAL AGREEMENT WTH THE STATE OF ILLINOIS

FOR PHASE I ENGINEERING OF THE SOUTH STREET BICYCLE UNDERPASSKANE COUNTY SECTION NO. 00 -00269-00-BT

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1, et seq.authorizes the County of Kane (County) and the State of Illinois (State) to cooperate in the performance oftheir respective duties and responsibilities by contract and other agreement; and

WHEREAS, the County and the State (through the Illinois Department of Transportation) desire tocooperate among themselves to accomplish the Phase I Engineering of the South Street Bicycle Underpass(hereinafter referred to as the "Improvement"); and

WHEREAS, the County and the State desire to undertake Phase I Engineering for the Improvementat an estimated cost of One Hundred Thirty Seven Thousand Seventy Nine Dollars ($137,079.00); and

WHEREAS, the Improvement is deemed by the County and the State to be of immediate benefit tothe residents of the County of Kane and the State of Illinois in that it shall facilitate the safe and efficientmovement of traffic and shall provide for the safety of the motoringand bicycling public; and

WHEREAS, the County and the State have determined a mutually satisfactory allocation ofresponsibilities and costs for said Improvement as set forth in the agreement (a copy of which is on file withthe County Clerk's Office) with the County share of the costs estimated to be Twenty Seven Thousand FourHundred Sixteen Dollars ($27,416.00).

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof ishereby authorized to execute an intergovernmental agreement with the State of Illinois acting through theIllinois Department of Transportation for Phase I Engineering for the Improvement.

WHEREAS, the County of Kane is authorized by law pursuant to 605 ILCS 515-801 to acquire bynegotiated purchase or eminent domain proceedings, real property for highway purposes; and

WHEREAS, the County of Kane has developed right-of-way plans for the Stearns Road BridgeCorridor, Kane County Section No. 98-00214-02-BR (hereinafter the "improvement"); and

WHEREAS, in order to accomplish the improvement as contemplated, it is necessary that theCounty of Kane obtain right-of-way from adjacent property owners; and

WHEREAS, the Federal "Uniform Relocation Assistance and Real Property Acquisition PoliciesAct of 1970", the "Uniform Relocation Act Amendment of 1987" and 49 CFR Part 24, impose upon theCounty of Kane an ongoing requirement to reimburse and/or supplement the business owners and ortenants of property acquired by the County of Kane for certain ongoing business relocation costs; and

WHEREAS, Brackmann Trucking, Inc. was a business tenant of Stearns Road Parcel No.1ST0047, which parcel has been acquired by the County of Kane, and is entitled, pursuant to saidFederal Acts and Regulations, to the reimbursement of business relocation expenses for variousbuilding code compliance requirements in an amount of One Hundred Twelve Thousand Twenty Twoand 68/100 Dollars ($112,022.68).

RESOLUTION SUPPORTING THE SECOND AMENDMENT TO THEUNITED STATES CONSTITUTION

WHEREAS, in 1789, the first Congress of the United States passed and submitted to theseveral states ten articles of amendment to the US Constitution; and

WHEREAS, in 1791 these amendments were declared ratified by the several states and havecome to be known as the Bill of Rights; and

WHEREAS, the second Article of Amendment states that , " a well regulated Militia, beingnecessary to the security of a free State , the right of the people to keep and bear Arms, shall not beinfringed."; and

WHEREAS, the framers of the Second Amendment were mindful of the importance of an armedmilitia in the battles of Lexington and Concord and throughout the war for American independence; and

WHEREAS, the United States Supreme Court has reaffirmed the rights of citizens. to keep andbear arms in its recent decision in District of Columbia vs. Heller, 554 U.S. 290 (June 26, 2008); and

WHEREAS, the Kane County Board desires to affirm its support for the Second Amendment tothe United States Constitution and for all of the rights of citizens guaranteed by the Bill of Rights.

NOW, THEREFORE BE IT RESOLVED by the Kane County Board that it does hereby affirm itssupport for the Second Article of Amendment to the United States Constitution and for the rightsthereby secured to the People, of the State of Illinois.

BE IT FURTHER RESOLVED that a copy of this Resolution should be sent to the Governor ofthe State of Illinois, the President of the Illinois Senate, the Speaker of the Illinois House ofRepresentatives and all members of the General Assembly representing Kane County.
