BE IT RESOLVED , that the Town Board approve the Buildings & Grounds Dept. to purchase one new2022 Ford F350 4x4 pickup truck from West Herr Ford off the NYS Bid list, in the amount of $38,544.68. Funds available in A.1640.202 MOVED: Shaw Justification:Several pieces of equipment which were no longer of use were sent to auction. The total amount we willreceive from the auctioned off equipment is $39,000, which will cover the cost of the new truck. B&G wasalready short one pickup, and due to the age of another which would not pass inspection we are currentlydown 2 vehicles. In an effort to maintain safety for our employees and an adequate fleet, at least one vehicle isneeded.

WHEREAS, People Inc. is celebrating fifty (50) years of supporting people with intellectual anddevelopmental disabilities, families and older adults across Western New York and the Greater Rochesterregion; and WHEREAS, in 1970, a small group of parents and professionals joined together to address the needs ofpeople with intellectual disabilities and formed what would grow to become People Inc.; and WHEREAS, over the years, People Inc. expanded its mission and services to support even more people withintellectual and developmental disabilities, older adults and the general public to live, work and thrive to beindependent, to have access to affordable and safe housing, all while promoting independence and fulfillingexperiences; and WHEREAS, People Inc. has become one of the region’s largest employers, having a significant economicimpact on our local economy and contributes tens of millions of dollars to it annually; and WHEREAS, People Inc opened its first home in the Town of Hamburg for people with developmentaldisabilities in 1985; and WHEREAS, The Town of Hamburg, with opened arms, worked with People Inc on their first independentsenior housing project in 1992 at the corner of South Park and Sowles Road; and WHEREAS, People Inc currently has fourteen (14) programs serving people with developmental disabilitiesand two (2) independent senior housing sites in the Town of Hamburg serving hundreds of tenants at Iris andElm Senior Housing on Sowles Road; and WHEREAS, Out of People Inc.'s twenty (20) independent senior housing sites throughout the region, theirHamburg locations are their most popular; and WHEREAS, People Inc. has ninety-six (96) employees who reside in the Town of Hamburg and seventy-three(73) of whom work in the town; and WHEREAS, People Inc commends the Town of Hamburg and its decades long commitment to Fair Housing. 10. Resolution - Change of electric service contract

WHEREAS, the Town of Hamburg is continually looking for ways to save money, and WHERAS, the time has come to re-examine our electric contract with New Wave Energy Corporation who wehave had a contract since 2013. New Wave Energy Corporation has been a good partner with the Town ofHamburg, but the Town has an obligation to see if there are other alternatives which might better suit theTown's needs. Therefore, the Town is going to end its existing contract and test the market. NOW THEREFORE BE IT RESOLVED, the Town of Hamburg is directing the Town Attorney’s office tonotify New Wave Energy Corporation of its intent to not renew the existing contract, and that when the existingcontract ends this summer our accounts will be transferred to the Erie County Consortium. The Town is ableto switch into the Erie County Consortium and out of it with no penalties IT IS FURTHER RESOLVED, that the Town Attorney’s office is also directed to put together an RFP forour Electric service. 12. TWIN WILLOW PIPE

WHEREAS, there are two large storm sewer pipes along the lakeshore in the Twin Willow residentialneighborhood that are causing problems in the area; and WHEREAS, the Town Board has committed to aiding the residents and set aside funding of work at TwinWillows; and WHEREAS, the 54” pipe is causing sink holes throughout the area, but the interior condition is unknown atthis time and further investigation is required; and WHEREAS, the Town Supervisor and Engineering Department met with a local contractor to establish ascope of work for investigation of the 54” pipe and the contractor, United Survey Inc., provided the attachedproposal. THEREFORE BE IT RESOLVED, that United Survey Inc. is authorized to complete the investigation workof the 54” pipe at Twin Willow as outlined at a cost of $2,500.00. TOWN OF HAMBURG, NEW YORK

Local Law 3 of 2021 

A Local Law enacted to the Town of Hamburg Code Chapter _____ to provide for the creation of a Historic Preservation Advisory Board

Be it hereby enacted by the Town Board of the Town of Hamburg, pursuant to Municipal Home Rule Law § 10, General Municipal Law § 96-a, and General Municipal Law Article 5-k, as follows:

SECTION I. Title and Purpose

A. There is hereby created a volunteer advisory board to be known as the "The Town of

Hamburg Historic Preservation Advisory Board."

B. The Advisory Board shall consist of seven members and up to two alternate members. The Town of Hamburg shall be the primary residence of each Advisory Board member. Advisory Board members (except for the alternate Town Historian and Historical Society members referenced below) shall serve a term of four years. Members and alternate members shall serve without compensation.

C. Up to two alternate members shall each serve a term of two years and be subject to the following provisions: (1) If a regular member of the Advisory Board is absent or unable to participate on a matter before the Advisory Board, the Chairperson shall designate an alternate member to serve in that member's place. Such designation shall be reflected in the minutes of the meeting(s) at which the substitution is made. (2) When an alternate member is designated to serve, he or she shall serve with the same powers and responsibilities of a regular member of the Advisory Board. (3) Alternate members shall regularly attend the scheduled meetings of the Historic Preservation Advisory Board in order to ensure that should the need arise for an alternate to be designated, such alternates are familiar with actions before the Advisory Board. (4) All provisions related to eligibility, vacancy, removal, and other provisions of state or local law applicable to regular members of the Advisory Board shall be equally applicable to alternate members.

D. Appointment of Advisory Board members and up to two alternate members shall be made by the Town Board.

E. To the extent available in the Town of Hamburg, the Advisory Board should consist of the following: (1) All members shall have a known interest in, and shall have demonstrated significant interest and commitment to the field of historic preservation, evidenced either by involvement in a local historic preservation group, employment or volunteer activity

in the field of historic preservation, or other serious interest in the field. (2) At least one member shall be the Town Historian, appointed annually; (3) At least two members shall be representatives of the Hamburg Historical Society, who shall serve two-year terms. (4) At least two members shall be a licensed NYS Realtor. (5) At least one member shall be an architect.

F. The Chairperson and Vice Chairperson shall be elected by and from voting members of

the Advisory Board. The term of office shall be two years. If the Chairperson or Vice Chairperson cannot fulfill his or her term of office, a successor shall be elected by and from the membership of the Advisory Board to fulfill the remainder of the term until the next regular election.

G. If any Advisory Board Member shall resign or otherwise cannot fulfill his or her term of office, the Town Board shall appoint an interim member to serve the remainder of the term.

H. The powers of the Advisory Board shall include: (1) To recommend designation of landmarks and historic districts to the Town Board for its consideration. (2) To advise and recommend to the Town Board on matters of professional consultants as necessary to carry out the duties of the Advisory Board. (3) To recommend rules and regulations as necessary for the conduct of its business. (4) To recommend criteria to the Town Board for the identification of significant historic, architectural, and cultural landmarks and/or for the delineation of historic districts. (5) To collect and evaluate information about significant historic, architectural, an cultural landmarks within the Town.

(6) To make recommendations to the Town Board on acceptance or donation of façade easements and development rights; the acquisition of facade easement and development rights or other interests in real property as necessary to carry out the purposes of this act. (7) To increase public awareness of the value of historic, cultural and architectural preservation by developing and participating in education programs. (8) To make recommendations to the Town Board concerning the utilization of state, federal, or private funds to promote the preservation of landmarks and historic districts within the Town. (9) To recommend acquisition of a landmark or structure by the Town where its preservation is essential to the purposes of this act and where private preservation is not feasible. (10) To recommend approval or disapproval of applications for certificates of appropriateness, subject to review by the Code Enforcement Officer, to the Town Board.

I. The Advisory Board shall meet at least monthly if any business is pending. Meetings may be held at any time on the written request of any two Advisory Board members. The Advisory Board must meet at least once quarterly.

J. A quorum for the transaction of business shall consist of a majority of the Advisory Board members, but not less than a majority of the full membership may recommend a grant or denial of a certificate of appropriateness, to the Town Board.

SECTION II Severability. If any clause, sentence, paragraph, or part of this chapter or application thereof to any person or circumstances shall be adjudged by a court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof or the application thereof to other persons and circumstances, but shall be confined in its operation to the clause, sentence, paragraph or part thereof and the persons and circumstances directly involved in the controversy in which such judgment shall have been rendered. SECTION III. Effective Date. This local law shall be effective immediately upon filing with the New York Secretary of State.

14. Resolution - Clock Tower

WHEREAS, the Town of Hamburg needs to repair the clock tower sidewalk and adjacent area along the shorelineof Lake Erie which were significantly damaged by the 2019 and 2020 winter storms. WHEREAS, the Town issued an RFP to obtain plans as to how to repair this area so that it will withstandfuture storms. This plan would also need approval from the NYSDEC and the US Army Corps of Engineers. WHEREAS, the Town received the following five (5) proposals: NussBaumer Clarke $88,725.00

Urban Engineers $74,500.00GDH $75,000.00LaBella $26,800.00Foit-Albert $50,526.00

THEREFORE BE IT RESOLVED, that after a thorough review of all of the proposals, the Town Boarddecided to award the contract to repair the clock tower sidewalk and adjacent area to Urban Engineers basedupon its experience, cost and scope of services. Moved: Shaw

15. Resolution - NYS Unified Solar Permit

WHEREAS, the Town of Hamburg currently requires residents to obtain a building permit for theinstallations of solar panels, pursuant to Town of Hamburg Code Section 280-370, and; WHEREAS, the Town of Hamburg Code Enforcement Officer has advised the Town Board of theTown of Hamburg that the New York State uniform process is consistent and compatible with the Town ofHamburg Zoning Code and permitting practices, and; WHEREAS, the Town Board of the Town of Hamburg supports the use of solar energy as arenewable energy source. NOW THEREFORE, IT IS HEREBY RESOLVED BY THE TOWN BOARD OF THE Townof Hamburg that the Town of Hamburg hereby fully and formally adopts the New York State Unified SolarPermit process for NY – Sun Solar Powering New York, and incorporates the Town solar installation feeschedule. IT IS FURTHER RESOLVED, that the Town Board, in regular session duly convened, does herebyauthorize and direct the Town Supervisor to execute such other and additional documents as may be requiredto perfect the resolutions herein. PERMIT APPLICATION

NY State Unified Solar Permit

Unified solar permitting is available statewide for eligible solar photovoltaic (PV) installations. Municipal

authorities that adopt the unified permit streamline their process while providing consistent and thorough review

of solar PV permitting applications and installations. Upon approval of this application and supporting

documentation, the authority having jurisdiction (AHJ) will issue a building and/or electrical permit for the solar

PV installation described herein.

PROJECT ELIGIBILITY FOR UNIFIED PERMITTING PROCESS

By submitting this application, the applicant attests that the proposed project meets the established eligibility criteria for the unified permitting process (subject to verification by the AHJ). The proposed solar PV system installation:

� Yes � No 1. Has a rated DC capacity of 25 kW or less.

� Yes � No 2. Is not subject to review by an Architectural or Historical Review Board. (If review has already been issued answer YES and attach a copy)

� Yes � No 3. Does not need a zoning variance or special use permit. (If variance or permit has already been issued answer YES and attach a copy)

� Yes � No 4. Is mounted on a permitted roof structure, on a legal accessory structure, or ground mounted on the applicant’s property. If on a legal accessory structure, a diagram showing existing electrical connection to structure is attached.

� Yes � No 5. The Solar Installation Contractor complies with all licensing and other requirements of the jurisdiction and the State.

� Yes � No 6. If the structure is a sloped roof, solar panels are mounted parallel to the roof surface.

For solar PV systems not meeting these eligibility criteria, the applicant is not eligible for the Unified Solar Permit and must submit conventional permit applications. SUBMITTAL REQUIREMENTS SOLAR PV 25KW OR LESS (ATTACHMENTS)

NY State Unified Solar Permit

This information bulletin is published to guide applicants through the unified solar PV permitting process for solar photovoltaic (PV) projects 25 kW in size or smaller. This bulletin provides information about submittal requirements for plan review, required fees, and inspections.

Note: Language in [ALL CAPS] below indicates where local jurisdictions need to provide information specific to the jurisdiction. Language in italics indicates explanatory notes from the authors of this document that may be deleted from the distributed version.

PERMITS AND APPROVALS REQUIRED

The following permits are required to install a solar PV system with a nameplate DC power output of 25 kW or less:

a) Unified Solar Permit

b) [LIST TYPE OF PERMIT(S) REQUIRED BY THE LOCAL JURISDICTION, i.e., ELECTRICAL OR BUILDING

PERMIT]. Planning review [IS/IS NOT] required for solar PV installations of this size.

Fire Department approval [IS/IS NOT] required for solar PV installations of this size.

SUBMITTAL REQUIREMENTS

In order to submit a complete permit application for a new solar PV system, the applicant must include:

a) Completed Standard Permit Application form which includes confirmed eligibility for the Unified Solar Permitting process. This permit application form can be downloaded at [WEBSITE ADDRESS].

b) Construction Documents, with listed attachments [SAMPLES ARE AVAILABLE IN Understanding Solar PV Permitting and Inspecting in New York State AT WEBSITE ADDRESS]. Construction Documents must be by stamped and signed by a New York State Registered Architect or New York State Licensed Professional Engineer.

[MUNICIPALITY NAME], through adopting the Unified Solar Permitting process, requires contractors to provide construction documents, such as the examples included in the Understanding Solar PV Permitting and Inspecting in New York State document. Should the applicant wish to submit Construction Documents in another format, ensure that the submittal includes the following information:

• Manufacturer/model number/quantity of solar PV modules and inverter(s).

• String configuration for solar PV array, clearly indicating the number of modules in series and strings in parallel (if applicable).

• Combiner boxes: Manufacturer, model number, NEMA rating.

• From array to the point of interconnection with existing (or new) electrical distribution equipment: identification of all raceways (conduit, boxes, fittings, etc.), conductors and cable assemblies, including size and type of raceways, conductors, and cable assemblies.

• Sizing and location of the EGC (equipment grounding conductor).

• Sizing and location of GEC (grounding electrode conductor, if applicable).

• Disconnecting means of both AC and DC including indication of voltage, ampere, and NEMA rating.

• Interconnection type/location (supply side or load side connection)

• For supply side connections only, indication that breaker or disconnect meets or exceeds available utility fault current rating kAIC (amps interrupting capacity in thousands).

• Ratings of service entrance conductors (size insulation type AL or CU), proposed service disconnect, and overcurrent protection device for new supply side connected solar PV system (reference NEC 230.82, 230.70).

• Rapid shutdown device location/method and relevant labeling.

c) (For Roof Mounted Systems) A roof plan showing roof layout, solar PV panels and the following fire safety items: approximate location of roof access point, location of code-compliant access pathways, code exemptions,

solar PV system fire classification, and the locations of all required labels and markings.

d) Provide construction drawings with the following information:

• The type of roof covering and the number of roof coverings installed.

• Type of roof framing, size of members, and spacing.

• Weight of panels, support locations, and method of attachment.

• Framing plan and details for any work necessary to strengthen the existing roof structure.

• Site-specific structural calculations.

e) Where an approved racking system is used, provide documentation showing manufacturer of the racking system, maximum allowable weight the system can support, attachment method to roof or ground, and product evaluation information or structural design for the rack.

INSPECTIONS

Once all permits to construct the solar PV installation have been issued and the system has been installed, it must be inspected before final approval is granted for the solar PV system. On-site inspections can be scheduled by contacting [DEPARTMENT] by telephone at [PHONE NUMBER] or electronically at [WEBSITE OR EMAIL ADDRESS]. Inspection requests received within business hours are typically scheduled for the next business day. If next business day is not available, inspection should happen within a five-day window. [IF MUNICIPALITY ACCEPTS THIRD PARTY INSPECTIONS, INDICATE THIS AND PROVIDE A LIST OF APPROVED INSPECTORS].

In order to receive final approval, the following inspections are required:

Delete Rough/Final inspection descriptions if not applicable in your jurisdiction

[ROUGH INSPECTION, IF REQUIRED] During a rough inspection, the applicant must demonstrate that the work in progress complies with relevant codes and standards. The purpose of the rough inspection is to allow the inspector to view aspects of the system that may be concealed once the system is complete, such as:

• Wiring concealed by new construction.

• Portions of the system that are contained in trenches or foundations that will be buried upon completion of the system.

It is the responsibility of the applicant to notify [ENTER CONTACT INFORMATION] before the components are buried or concealed and to provide safe access (including necessary climbing and fall arrest equipment) to the inspector.

The inspector will attempt, if possible, to accommodate requests for rough inspections in a timely manner.

[FINAL INSPECTION] The applicant must contact [INSERT CONTACT INFORMATION] when ready for a final inspection. During this inspection, the inspector will review the complete installation to ensure compliance with codes and standards, as well as confirming that the installation matches the records included with the permit application. The applicant must have ready, at the time of inspection, the following materials and make them available to the inspector:

• Copies of as-built drawings and equipment specifications, if different than the materials provided with the application.

• Photographs of key hard to access equipment, including; – Example of array attachment point and flashing/sealing methods used. – Opened rooftop enclosures, combiners, and junction boxes. – Bonding point with premises grounding electrode system. – Supply side connection tap method/device. – Module and microinverter/DC optimizer nameplates. – Microinverter/DC optimizer attachment.

[MUNICIPALITY NAME] has adopted a standardized inspection checklist, which can be found in the Understanding Solar PV Permitting and Inspecting in New York State document, found here: [WEBSITE ADDRESS].

The inspection checklist provides an overview of common points of inspection that the applicant should be prepared to show compliance. If not available, common checks include the following:

• Number of solar PV modules and model number match plans and specification sheets number match plans and specification sheets.

• Array conductors and components are installed in a neat and workman-like manner. • Solar PV array is properly grounded. • Electrical boxes and connections are suitable for environment. • Array is fastened and sealed according to attachment detail. • Conductor’s ratings and sizes match plans. • Appropriate signs are property constructed, installed and displayed, including the following:

– Sign identifying PV power source system attributes at DC disconnect. – Sign identifying AC point of connection. – Rapid shutdown device meets applicable requirements of NEC 690.12.

• Equipment ratings are consistent with application and installed signs on the installation, including the following:

– Inverter has a rating as high as max voltage on PV power source sign.

– DC-side overcurrent circuit protection devices (OCPDs) are DC rated at least as high as max voltage on sign.

– Inverter is rated for the site AC voltage supplied and shown on the AC point of connection sign.

– OCPD connected to the AC output of the inverter is rated at least 125% of maximum current on sign and is no larger than the maximum OCPD on the inverter listing label.

– Sum of the main OCPD and the inverter OCPD is rated for not more than 120% of the buss bar rating.

17. Town-wide Drainage Study

WHEREAS, the Town of Hamburg has received proposals from six companies to undertake a Town-widestorm sewer drainage study to deal with the remediation and restructuring of the Town’s drainage systems; and WHEREAS, pursuant to a bond resolution adopted in December of 2020 the Town earmarked $130,000 forthe completion of the study and the receipt of a report for further Town Board action; and WHEREAS, pursuant to a subsequent Town Board resolution a Committee was formed to review theengineering proposals, and also secure the benefit of expert advice from a Certified Public Engineer in the hopeof arriving at a recommendation to the Town Board for a an ultimate contract to accomplish the foregoing; and WHEREAS, the Committee narrowed the choices from the six proposals to three, which included theproposal of GHD, LLC, in the amount of $130,700, Wendel in the amount of $128,800 and CPL in theamount of $87,400; NOW, THEREFORE, BE ITRESOLVED, that after the conduct of interviews and the review of the proposals it is hereby determined thatthe Town of Hamburg shall offer a contract pursuant to the proposal submitted by CPL to that Company forthe purpose of conducting a Town-wide drainage study pursuant to that Company’s proposal. Whereas, the Town of Hamburg Town Board rezoned the property known as the Hamburg Business Park onMay 22, 2006 and included conditions in the rezoning that restricted certain uses; and Whereas, JSEK Hamburg has proposed a use in the Hamburg Business Park that is restricted under theconditions of the rezoning (car wash); andWhereas, the Town of Hamburg Town Board has been asked to consider amending the conditions of therezoning to allow this use; and Whereas, the Hamburg Business Park approval involved a Generic Environmental Impact Statement andFindings that included the same restrictions; Now, Therefore Be It Resolved that the Town of Hamburg Town Board hereby schedules a public hearing tobe held on June 7, 2021 regarding this request to amend the conditions of the rezoning approved in 2006; and Be It Further Resolved that the Town of Hamburg Town Board would like to re-establish itself as SEQR LeadAgency and authorizes the Planning Department to perform the appropriate mailings. 18-Mile Creek Golf Course Irrigation Project Consultant SelectionWHEREAS, on February 22, 2021, the Hamburg Town Board issued an RFP for professional services tostudy and design modifications to the 18-Mile Creek Golf Course Irrigation System, and WHEREAS, the following two (2) firms submitted proposals by the March 31, 2021 deadline: 1. Dubois & King for $50,6562. Stantec for $49,650 plus $60,00 to $95,000 estimated design and bidding fees, and: WHEREAS, on Town Councilman Connolly, the Town Engineer and a representative from the golf coursereviewed, discussed, and evaluated the proposals and provided a recommendation for award, NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Hamburg accepts therecommendation and awards the professional services contract to Dubois & King.
