Republic of the Philippines ) Cebu City )S.S AFFIDAVIT I, Leo Iting, of legal age, married and a resident of Gochan St., Mabolo, Cebu City, after having been sworn in accordance with law, do state: 1.I am currently employed with Mr. Nelson Tan as one of his driver’s; 2.Mr. Nelson Tan, as representative of JT Trucking & Forwarding Inc., is the registered owner of a Mitsubishi L300 van with plate no. GLG 387; 3.I have been assigned to drive the above-said Mitsubushi L300 van; 4.On the afternoon of August 24, 2013, I was directed by Mr. Tan to drive and bring our mechanic, Mr. Michael Reponte to SRP Cebu City side because one of the trucks of Nelson Tan broke down and was obstructing one of the northbound lanes; 5.Upon reaching the site, the mechanic immediately inspected and examined what was wrong with the truck. After several minutes of checking, he did not see anything wrong with the engine so he surmised that there was a problem with the battery and its connections thereby causing the truck to stall; 6.I immediately called Mr. Tan to inform him of the problem. He then instructed me to go to the nearest gas station and or auto supply so I can purchase a new battery;

AFFIDAVIT

I, Leo Iting, of legal age, married and a resident of Gochan St., Mabolo, Cebu City, after having been sworn in accordance with law, do state:

1. I am currently employed with Mr. Nelson Tan as one of his driver’s;

2. Mr. Nelson Tan, as representative of JT Trucking & Forwarding Inc., is the registered owner of a Mitsubishi L300 van with plate no. GLG 387;

3. I have been assigned to drive the above-said Mitsubushi L300 van;

7. I knew there was an auto supply nearby, so I instantly went there;

8. Mr. Tan advised me to take a taxi instead of bringing the L300 to purchase because the mechanic was trying to use the battery of the L300 to see if indeed it was what was causing the problem;

9. Thereafter, I left the site and went to buy a new battery. It took me sometime to return to the site as the auto supply store was a bit far;

10. When I got back, I was shocked to see that the L300 was not there anymore;

11. Michael Reponte narrated to me that when CITOM showed up, seeing that there was nobody else there aside from the truck driver, they thought he was the driver and upon checking his license, they found it to be expired and so they impounded the van as a sanction;

12. I am executing this affidavit to state that I was the driver of the L300 vehicle with plate no. GLG 387 impounded by CITOM last Aug. 24, 2013, and for other legal purposes that this affidavit may serve;

13. Affiant further sayeth naught.
