House – 253 Democrats, 178 Republicans – 54 Democrats are “Blue Dogs” – Moderate to Conservative,
Fiscally Conservative– 80 Democrats are members of “Progressive Caucus” – More
liberal leaning, willing to spend more – Recent clash of the two over Administration Priorities
Republicans– Over the past 3 months solidified their opposition to Health Care
– likely to stand united for remainder of this Congress

increasingly concerned with regulation affecting businesses, manufacturing
– Legislation stalled at the Senate – Currently 300 House passed bills awaiting consideration
Republicans– Similar to the House, all 41 Senate Republicans are increasingly
united in opposition of Administration Priorities

Climate Change – What Has Happened?
• Waxman/Markey Bill
– Passed the House of Representatives on a very close vote, summer of 2009.
– Mandate – Reduction of GHG emissions of 17% by 2020. Long term mandate reduction is 80% by 2050.
– Requires electric utilities to meet 20% of their electricity demand through renewable energy sources and energy efficiency by 2020.
– Provides for modernization of the electrical grid

• “Cap & Dividend” receiving limited consideration
• Cap and Dividend approach would send 75% of revenue from auction of permits to consumers – attempt to offset the higher price of energy costs
• Other 25% would be provided to companies who develop alternative, renewable energy, emissions reductions technology
• Energy producers and importers of energy would be required to buy these permits

EPA Action – Absent New Congressional Authority
BackgroundClean Air Act • Passed in 1963, requires the EPA to develop and enforce regulation to protect
public from exposure to airborne contaminants that are known to be hazardous to human health.
• Requires States to develop State Implementation Plans Approved BY EPA• Creates National Ambient Air Quality Standards (NAAQS) for seven Criteria
Pollutants
EPA Determination of GHG Responsibilities – 2003
• Determined they lacked authority under the Clean Air Act to regulate carbon dioxide and other greenhouse gases
• Even if even if the EPA did have such authority, it would decline to exercise it.
• This EPA was under the Bush Administration
