Sample over-subscription criteria.

The Governing Body of ************* Catholic School has sole responsibility for admissions and will admit up to the school’s admission number *****.

The Governing Body will assess applications for admission to the school, using the information provided on the application form. Where the number of applications is equal to or less than the admissions number, all applications will be accepted.

Where the number of applications exceeds the number of places available, the Admissions Panel of the Governing Body will apply the following oversubscription criteria to all applications and allocate places accordingly.

Children with a statement of SEN naming XXXXX Catholic School will be admitted.

Over-subscription Criteria

1. Looked after or previously looked after baptised Catholic children.2. Baptised Catholic children attending *********** Catholic Primary school at time of application.3. Baptised Catholic children living in the Parish of ********** at time of application.Confirmation of Baptism will be required in each of the above categories.4. Confirmation of BaptismConfirmation of Baptism will be required by the provision of a copy of the baptism certificate from the relevant parish or confirmation in writing from the current Parish Priest / Minister.

ProximityIf the governing body are unable to admit all applicants who fall into the lowest criterion a tie-breaker will be applied. The governing body will give priority to children living nearest the school as measured by the safest walking route (primary school) and will ask the Local Authority to calculate this. The Local Authority use the GPS system to calculate home school distances in miles.

SiblingsFor admission purposes a sibling is a child who is the brother / sister, half brother / sister (children who share one common parent), step brother / sister where two children are related by marriage. This definition also includes adopted or fostered children living at the same

address. Priority will be by reference to the youngest sibling in the school at the time of admission, the youngest sibling commanding the highest degree of priority.When allocating places, if the last place is offered to a multiple birth child (e.g. a twin or triplet), the governors will also admit the other sibling(s).

ResidenceEvidence of permanent residence of the child at the time of application must be supplied. Permanent residence is considered to be the child’s along with the parent / guardian’s main place of residence. If the child is resident with friends or relatives (for reasons other than guardianship) the friend or relative’s address will not be considered.

Shared parental responsibilityWhere parents have shared responsibility for a child, and the child lives with both parents for parts of the week, the home address will be determined as the property where the child lives for the majority of the school week (i.e. 3 out of 5 days) as at the time of application.

Looked after children / previously looked after childrenThe definition of a Looked after Child is a child who is looked after by the Local Authority in accordance with Section 22 of the Children Act 1989. Children who are in the care of the Local Authority (looked after children) or provided with accommodation by them e.g. foster parents (section106 of the Education Act 2005).A child who has been in the care of the Local Authority as defined above for at least 24 hours will be regarded as a previously looked after child.

Additional Learning NeedsPupils with Statements of SEN where St ******* Catholic School is named on the Statement will be admitted.

Late applicationsLate applications will be looked at after the applications received by the closing date have been considered. If the number of offers has reached the admission number in the first round, then all late applications will be considered and placed on the waiting list.

Waiting ListChildren not offered a place will be placed on a waiting list. The order of priority on the waiting list is the same as the list of criteria for over-subscription. No account is taken of the length of time on the waiting list. If offers of a place are refused then the place will be offered to the first child on the waiting list at that point in time. The order of the waiting list will vary as late applications are received, refused and placed on the waiting list in the order of the oversubscription criteria.The waiting list will be maintained until 30 September.

Right of AppealWhen a child is refused a place at a school the governing body will write to the parent giving full details of why the application was refused. Parents have a right to appeal this decision. Parents wishing to appeal the decision must return the appeal form within 14 days of the receipt of the decision letter.The appeal will be heard by an independent appeal panel.

There are 2 different types of appeal hearing; ordinary prejudice and infant class size prejudice appeals. Please read the School Appeals Factsheet which explains the different types and then only complete part A or B below;

You should include any information you consider is relevant to your appeal. If you have anything you want the Panel to read, you should send it to the Panel beforehand.

You should submit all supporting evidence with this form. If this is not possible any additional paperwork you wish to submit should be provided at least 7 working days before the hearing. The purpose of this stage is for the panel to judge whether the individual circumstances of your child should outweigh the prejudice which might arise to the school should more children be admitted. Proceedings will continue in the following order:

1. Representatives of the governing body will put the particular case for their decision not to admit your child.

2. You may question the representative of the governing body.3. You or your representative will put the case for your appeal.4. The representative of the governing body may question you.5. The representatives of the governing body may sum up.6. You may sum up.

The panel members may ask questions at any time if they require clarification of what is being said or if they need information in order to reach a decision

The Appeals Panel will make a decision on your appeal in private once it has heard the cases of all appellants. You will be informed of the decision in writing by the clerk to the panel, usually within a week.Please note that the Clerk is not a member of the panel. THE GOVERNORS’ CASE IS THAT THE ADMISSION WOULD CAUSE CLASS SIZE PREJUDICE1. GENERAL REASONS FOR REFUSING ADMISSIONThe law states that, subject to certain limited exceptions, no infant class with a single school teacher present may contain more than 30 pupils.The School’s Standard Admission Number of ** is based on nationally recognised procedures for assessing the capacity of a school measured by the local authority.This category of appeal can only be upheld if an appeal panel is satisfied that one of the following grounds apply:

Ground A – the child would have been offered a place if the school admission arrangements had complied with the requirements of The School Admission code.

Ground B – the child would have been offered a place if the admission arrangements had been properly implemented.

Ground C – the decision was not one which a reasonable admission authority would have made in the circumstances of the case.

2. THE PRESENCE OF PREJUDICEIn this context the word ‘prejudice’ means only the prejudice that arises by reason of measures required to be taken in order to ensure the governors comply with the limit on infant class sizes.3. 1. GENERAL REASONS FOR REFUSING ADMISSION

The law requires that a child cannot be refused a place unless it can be shown that the admission would prejudice either the provision of efficient education or the efficient use of resources. This can be taken to mean the following:

A. That overcrowding or excessive class sizes would adversely affect the education of existing pupils and prejudice opportunities for all pupils in the school.

ORB. That the admission would impair the learning environment and limit the access of

pupils to resources.

The School’s Standard Admission Number of 30 in each class is based on nationally recognised procedures for assessing the capacity of a school. It is considered therefore that numbers in excess of the Standard Admission Number are indicative of overcrowding.

2. THE PRESENCE OF PREJUDICE

In this context the word prejudice means only the prejudice to the provision of efficient education or the efficient use of resources caused by the admission of additional pupils to a school.

3. SPECIFIC REASONS FOR REFUSING THIS APPLICATION

The standard admission number for the Year 3 age group is 30 and the actual number of pupils on roll in the Year 3 age group is 32. The additional 2 pupils were admitted following an admission appeal hearing. The age group is organised in one class of 32 pupils.

It is the view of the Governors that the admission of a further child would prejudice the provision of efficient education and the efficient use of resources by impairing the learning environment at the school and limiting the access of pupils to resources.

Year 3 is full, it has 32 pupils and the school is full overall. The Welsh Government is concerned that class sizes are maintained at reasonable levels.

The following should be noted: The school budget allows for only one teacher for the age group

All classrooms are currently in use.
