The enclosed Permit No. 1443-AR-6 is your authority to construct, operate, and maintain the equipment andfor control apparatus as set forth in your application initially received on 4/25/2007.
After considering the facts and requirements of A.C.A. 58-4-101 et seq., and implementing regulations, I have determined that Permit No. 1443-AR-6 for the construction, operation and maintenance of an air pollution control system for Hiram Walker Pemod Ricard USA be issued and effective on the date specified in the permit, unless a Commission review has been properly requested under 52.1.14 of Regulation No. 8, Arkansas Department of Pollution Control & Ecology Commission's Administrative Procedures, within thirty (30) days after service of this decision.
All persons submitting written comments during this thirty (30) day period, and all other persons entitled to do so, may request an adjudicatory hearing and Commission review on whether the decision of the Director should be reversed or modified. Such a request shall be in the form and manner required by 92.1.14 of Regulation No. 8.

Section 11: INTRODUCTION
Summary
Hiram Walker Pemod Ricard USA owns and operates a beverage alcohol blending and bottling facility located at 7401 Highway 45 South, Fort Smith, Arkansas 72902. This modification authorizes the facility to add four 30,000 gallon process tanks (SN- 152, 153, 154, and 156), two 27,000 gallon process tanks (SN-155 and 157), and one 80,000 gallon process tank (SN-1 SX), all containing ethyl alcohol; to add one biotower (SN-159), one 22,500 gallon clarifier (SN-160), and one 134,700 gallon equalizer tank, all for wastewater treatment; and to update the insignificant activities list. These modifications result in 6.5 tpy of potential VOC emissions.
Process Description
Materials: City water is first filtered with a charcoal filter, and then de-ionized and pumped into storage tanks for processing use. Sugar brought into the plant by bulk railroad hopper car is unloaded pneumatically into a sugar liquefying hopper. The dry sugar is mixed with the de-ionized water and pumped to the sugar syrup storage tanks for future use. The concentrated beverage alcohol products and distilled spirits are brought into the plant by bulk railroad tank cars. They are then pumped into storage tanks for processing use.
Blending: The alcohol, flavors, product concentrated sugar syrup, and de-ionized water are pumped from the storage tanks to the blending tanks. The blended product is pumped to multi-use tanks for resting. After the resting period, the product is filtered and pumped into bottling tanks. The finished product is then pumped directly to the bottling lines.
All tanks, pumps, valves, and piping in the operation are stainless steel. After each transfer of liquid, all tanks, pumps, valves, and pipes are flushed with hot de-ionized water. The water is treated in the on-site Industrial Waste Treatment System and then eliminated through the City of Fort Smith sanitary water system.

The storage tanks at this facility are not subject to the New Source Performance Standards of Subpart Kb-Standards of Performance for Volafile Organic Liquid Storage Vessels (Including Petroleum Liquid Storage Vessels) for which construction, reconstruction, or modification commenced after July 23, 1984, due to the exemption for the storage of beverage alcohols in S6O. 1 10b(d)(7).

Section 111: PERMIT HISTORY
Permit No. 1443-A was issued to the facility on January 25, 1994. This was the initial air permit for this facility. This permit quantified emissions from each tank at the facility. Record keeping requirements were established on a tank-by-tank basis. VOC emissions were estimated at 16.2 tpY.
Permit No. 1443-AR-1 was issued to the facility on March 3, 1997. This modification was issued in order to simplify the record keeping requirements for the tanks located at the facility. This was accomplished by estimating an emission factor based on facility-wide throughput of ethyl alcohol. VOC emissions were estimated at 25.7 tpy.
Permit No. 1443-AR-2 was issued to the facility on April 21,2000. This modification was issued in order to allow for an increase in the permitted production rate of alcohol, as well as to add five new tanks for storage and blending operations. This modification resulted in an increase in particulate matter (PM) emissions to 0.6 tons per year (TPY) and an increase in volatile organic compound (VOC) emissions to 34.4 TPY.
Permit No. 1443-AR-3 was issued to the facility on September 12,2000. This modification was issued in order to allow for the addition of a second bag house for the sugar unloading system (SN-01) at the facility (two stacks). This installation was made in order to decrease the loading on the existing bag house by spreading the emissions from this source across 2 units. Additionally, the facility installed a 100,000 gallon activated sludge tank to the waste water treatment system. The emissions from this tank were deemed to be insignificant because the waste had already passed through the equalization tanks, bio-tower, and aeration tank prior to arriving in the activated sludge tank. There was no change in permitted emissions due to this modification.
Permit No. 144342-4 was issued on April 24,2002. This permit authorized the installation of a new diesel-fired emergency generator (SN-119) for backup protection in the event of power failure. This modification resulted in emissions increases of 0.1 tpy of PM/PMlo, 0.1 tpy of VOC, 0.2 tpy of SOz, 0.2 tpy of CO, and 0.7 tpy of NOx.
Permit No. 1443-AR-5 was issued on January 12,2004. This permit authorized the installation of a 6,000 gallon tank (SN-142), seven 12,000 gallon tanks (SN-143 through SN-149), and two 24,000 gallon tanks, all for ethyl alcohol processing. This modification resulted in 0.6 tpy of potential VOC emission increases. At the facility's request the permitted emission limits were unchanged.

Section V: 1NSIGNIFICANT ACTIVITIES
The Department deems the following types of activities or emissions as insignificant on the basis of size, emission rate, production rate, or activity in accordance with Group A of the Insignificant Activities list found in Regulation 18 and 19 Appendix A. Section VI: GENERAL CONDITIONS
Any terms or conditions included in this permit that specify and reference Arkansas Pollution Control & Ecology Commission Regulation 18 or the Arkansas Water and Air Pollution Control Act (A.C.A. §8-4-101 et seq.) as the sole origin of and authority for the terms or conditions are not required under the Clean Air Act or any of its applicable requirements, and are not federally enforceable under the Clean Air Act. Arkansas Pollution Control & Ecology Commission Regulation 18 was adopted pursuant to the Arkansas Water and Air Pollution Control Act (A.C.A. 58-4-101 et seq.). Any terms or conditions included in this permit that specify and reference Arkansas Pollution Control & Ecology Commission Regulation 18 or the Arkansas Water and Air Pollution Control Act (A.C.A. §8-4-101 et seq.) as the origin of and authority for the terms or conditions are enforceable under this Arkansas statute.
This permit does not relieve the owner or operator of the equipment andor the facility from compliance with all applicable provisions of the Arkansas Water and Air Pollution Control Act and the regulations promulgated under the Act. [A.C.A. 38-4-203 as referenced by A.C.A. 58-4-304 and 38-4-3 111
The permittee will notify the Deparhnent in writing within thirty (30) days after commencement of construction, completion of construction, first operation of equipment andlor facility, and first attainment of the equipment and/or facility target production rate. 7. The permittee will test any equipment scheduled for testing, unless stated in the Specific Conditions of this permit or by any federally regulated requirements, within the following time frames: (1) newly constructed or modified equipment within sixty (60) days of achieving the maximum production rate, but no later than 180 days after initial start-up of the permitted source or (2) existing equipment already operating according to the time frames set forth by the Department. The permittee must notify the Department of the scheduled date of compliance testing at least fifteen (15) days in advance of such test. The permittee must submit compliance test results to the Department within thirty (30) days after the completion of testing. a. Sampling ports adequate for applicable test methods;
b. Safe sampling platforms;
c. Safe access to sampling platforms; and
d. Utilities for sampling and testing equipment.
9. The permittee will operate equipment, control apparatus and emission monitoring equipment within their design limitations. The permittee will maintain in good condition at all times equipment, control apparatus and emission monitoring equipment. 10. If the permittee exceeds an emission limit established by this permit, the permittee will be deemed in violation of said permit and will be subject to enforcement action. The Department may forego enforcement action for emissions exceeding any limits established by this permit provided the following requirements are met: [§19.601 of Regulation 19 and/or 51 8.1 10 1 of Regulation 18 and A.C.A. 58-4-203 as referenced by A.C.A. 98-4-304 and 38-4-31 11
a. The permittee demonstrates to the satisfaction of the Department that the emissions resulted from an equipment malfunction or upset and are not the result of negligence or improper maintenance, and the permittee took all reasonable measures to immediately minimize or eliminate the excess emissions.

b. The permittee reports the occurrence or upset or breakdown of equipment (by telephone, facsimile, or overnight delivery) to the Department by the end of the next business day arter the occurrence or the discovery of the occurrence.
c. The permittee must submit to the Department, within five business days after the occurrence or the discovery of the occurrence, a full, written report of such occurrence, including a statement of all known causes and of the scheduling and nature of the actions to be taken to minimize or eliminate future occurrences, including, but not limited to, action to reduce the frequency of occurrence of such conditions, to minimize the amount by which said limits are exceeded, and to reduce the lenglh of time for which said limits are exceeded. If the information is included in the initial report, the information need not be submitted again.

a. To enter upon the permittee's premises, or other premises under the control of the permittee, where an air pollutant source is located or in which any records are required to be kept under the terms and conditions of this permit;
b. To have access to and copy any records required to be kept under the terms and conditions of this permit, or the Act;
c. To inspect any monitoring equipment or monitoring method required in this permit;
d. To sample any emission of pollutants; and
e. To perform an operation and maintenance inspection of the permitted source.
12. The Department issued this permit in reliance upon the statements and presentations made in the permit application. The Department has no responsibility for the adequacy or proper functioning of the equipment or control apparatus. [A.C.A. 38-4-203 as referenced by A.C.A. S8-4-304 and 38-4-31 11
13. The Department may revoke or modify this permit when, in the judgment of the Department, such revocation or modification is necessary to comply with the applicable provisions of the Arkansas Water and Air Pollution Control Act and the regulations promulgated the Arkansas Water and Air Pollution Control Act. 14. This permit may be transferred. An applicant for a transfer must submit a written request for transfer of the permit on a form provided by the Department and submit the disclosure statement required by Arkansas Code Annotated 58-1-106 at least thirty (30) days in advance of the proposed transfer date. The permit will be automatically

transferred to the new permittee unless the Department denies the request to transfer , within thxty (30) days of the receipt of the disclosure statement. The Department may deny a transfer on the basis of the information revealed in the disclosure statement or other investigation or, deliberate falsification or omission of relevant information.
