Applications for leave to remain under the Points Based System will fall for refusal if you have overstayed for more than 28 days on the date of application unless there were exceptional circumstances which prevented you from applying within the 28 day period The 28 day period of overstaying is calculated from the latest of

bull theendofthelastperiodofleavetoenterorremaingranted

bull theendofanyextensionofleaveundersections3Cor3DoftheImmigrationAct1971 or

bull thepointawrittennoticeofinvalidityisdeemedtohavebeenreceivedinaccordancewithparagraph34Cor34CAoftheImmigrationRulesinrelationtoanin-time application for further leave to remain

IfthereareexceptionalcircumstanceswhichpreventedyoufromapplyingintimeyoumustsubmitevidenceoftheexceptionalcircumstanceswithyourapplicationThethresholdforwhatconstitutes lsquoexceptional circumstancesrsquo is high and will depend on the individual circumstances ofthecasebutforexamplemayincludedelaysresultingfromunexpectedorunforeseeablecircumstances such as the following

bull seriousillnesswhichmeantthatyouoryourrepresentativewereunabletosubmittheapplicationintime(wheresupportedbyappropriatemedicaldocumentation)

bull travelorpostaldelayswhichmeantthatyouoryourrepresentativewereunabletosubmittheapplicationintime

bull inabilitytoprovidenecessarydocumentsThiswouldonlyapplytoexceptionalorunavoidablecircumstancesbeyondyourcontrolsuchastheHomeOfficebeingatfaultinthelossofordelayinreturningtraveldocumentsordelayinobtainingreplacementdocumentsfollowinglossasaresultoftheftfireorflood(wheresupportedbyevidenceofthedateoflossandthedatereplacementdocumentsweresought)

1 ThisdocumentprovidespolicyguidanceforfamilymembersofapBSmigrantItreflectspolicyatthedateofpublicationandwemaychangeitItshouldbereadtogetherwithparagraphs319Ato319KoftheImmigrationRulesForthepurposeoftheseguidancenotesthetermslsquowersquolsquousrsquoandlsquoourrsquorefertotheHomeOfficeWhenwerefertorsquoyoulsquoorrsquoyourlsquothismeansthepBSdependant

2 YoucanapplyasapBSDependantifyoumeetthecriteriasetoutinthisguidanceandtheImmigrationRulesandyouarebullthefamilymemberofapersonwithorapplyingforleaveunderTier124or5ofthepointsBased System or

10 WeonlyneedevidencethatisdirectlyrelevanttotheapplicationassetoutintheImmigrationRulesandthisguidanceWewillnotconsiderunrelatedevidence

11 IfyouarethedependantofaTier4StudentswhoqualifiesforourdifferentiationarrangementsbecauseyouareconsideredtobeldquolowriskrdquoyouwillberequiredtoprovidefewerevidentialdocumentswhensubmittingyourapplicationWhereyouareexemptedfromhavingtoprovideadocument-oragroupofdocuments-underourdifferentiationarrangementsthiswillbespecificallystatedinthisguidanceTheUKBorderAgencyreservestherighttorequestthesedocuments from you in all cases

bullYouareapplyingforleaveatthesametimeastheTier4studentand

bullYou are applying for entry clearance in your country of nationality or for leave to remain in the UKand

bullYouholdthesamenationalityastheTier4studentandbothofyouarenationalsofoneofthecountrieslistedatAppendixHoftheImmigrationRulesYoucancheckthisatwwwgovukgovernmentcollectionsimmigration-rules

Verification and other checks

13WeaimtoconsiderapplicationsquicklyHoweverwemustalsobeconfidentthatapplicationsmeettherequirementsoftheImmigrationRulesandthattheinformationyouprovideisatruereflectionofyourbackground

14Wewillaskforavarietyofverifiabledocumentstoenableustoconsideryourapplication15WemaywanttocheckthesupportingdocumentsyousendwithyourapplicationThereforeyoumustensurethatalltheevidencecomesfromasourcethatcanbeclearlyidentifiedandthatitcanbeindependentlyconfirmedasbeinggenuine

16 Therearetwosituationsinwhichwewillundertakeacheckbull Verification checksndashwherewehavereasonabledoubtsthatthedocumentsaregenuineor



bull other checksndashwherewecarryoutfurtherchecksforexamplewherewehavedoubtsaboutanapplicationorthedocumentssentwiththeapplicationbutthedoubtsarenotseriousenoughforustomakeaverificationcheck

Verification checks17 Wherewehavereasonabledoubtsthataspecifieddocumentisgenuinewemaywanttoverify

the document with an independent person or government agency18 ThepurposeofthesechecksistoensurethatthedocumentprovidedisgenuineandaccuratelyreflectsstatementsmadeinyourapplicationIfthedocumentisbeingusedasevidencetosupportyourapplicationwealsowanttoensurethatitmeetstherequirementsoftheRules

19 Verificationmaydelayourdecisiononyourapplicationsowewillonlydoitwhenthereareclear reasons for it

Reasonable doubt20 TherearemanyreasonswhywemaydoubtthataspecifieddocumentisgenuineandwhatweconsidertobeareasonabledoubtwilldependonanindividualapplicationHoweverourjudgmentswillbebasedonthefactswehave

Outcome of verification check21 Therearethreepossibleoutcomesofaverificationcheck

bull Document confirmed as genuineIfwecanconcludethatthedocumentisgenuinewewillconsider your application as normal

bull Document confirmed as falseIfwecanconcludethatthedocumentisfalsewewillrefusetheapplicationwhetherornotthedocumentisessentialtotheapplicationIfadocumentisconfirmedasfalsewewillnormallyrefusetheapplicationformorethanonereasonForexampleifyousendusabankstatementtoshowthatyouhaveenoughfundsavailableandwehaveevidencethatthestatementisfalsewewillrefuseyourapplicationbecauseyoudonotmeetthefundsrequirementandbecauseyouhavesentafalsedocument

bull Verification check inconclusiveIfwecannotverifythatthedocumentiseithergenuineorfalsethenwewillignoreitasevidenceIfyouhavesentotherspecifieddocumentsasevidencethatyoumeettherequirementsoftheRuleswewillconsidertheseasnormalIfyouhavenotsentanyotherdocumentsyouwillnotmeettherequirementsoftheRules

Refusing applications without making verification checks22 WemayrefuseanapplicationwithoutmakingverificationchecksintwocircumstancesbullWhereweareconcernedaboutapieceofevidencebutwouldinanyeventrefusetheapplicationforotherreasonsthosereasonswillformthebasisoftherefusalWewillnotmakeverificationchecksinthesecircumstancesHoweverwewillalwaysverifypassportsifwedoubtthey are genuine

bullWherethereisevidencethatprovesaparticulardocumentisfalseIfwecanconfirmthatadocument is false we will normally refuse the application for more than one reason For example ifyousendusabankstatementtoshowthatyouhaveenoughfundsavailableandwehaveevidencethatthestatementisfalsewewillrefusetheapplicationbecauseyoudonotmeetthefundsrequirementandbecauseyouhavesentafalsedocument



other checks23Wewillmakeothercheckswhereforexamplewehavedoubtsaboutanapplicationorthedocumentssentwiththeapplicationbutthesearenotseriousenoughforustomakeaverificationcheck

24Thesechecksmaydelayourdecisiononanapplicationsowewillonlymakethemwhenwehave clear reasons to do so

extra checks25SometimeswewillhavesuspicionsaboutadocumentbuttheywillnotbeenoughtomakeusdoubtthatitisgenuineForexamplethismaybebecausepreviousverificationcheckshavefound that some supporting evidence is invalid and some is genuine or where evidence provided contradictsinformationwealreadyhaveInthesecaseswemaycarryoutmorechecks

outcome of other checks26 Therearefourpossibleoutcomesofthesechecks

bull Document confirmed as genuineIfwecanconcludethatthedocumentisgenuinewewillconsider the application as normal


bull check inconclusiveIfwecannotverifythatthedocumentiseithergenuineorfalsethenwewill consider the application as if the document is genuine

bull Check gives us cause to have reasonable doubt about the genuineness of a specified document Ifwecannotverifythatthedocumentiseithergenuineorfalsebutasaresultofthecheckswefindotherreasonstodoubtthegenuinenessofaparticularspecifieddocumentwemaydecidetomakeaverificationcheck

Procedure for verification and other checks27 Theproceduresforbothverificationchecksandothercheckswillusuallybesimilarandwillvaryfromcasetocasebuttheymayinvolvebullcheckingthedetailsorgenuinenessofdocumentswithemployerstherelevantembassyorhighcommissionothergovernmentdepartments(intheUnitedKingdomandoverseas)and

bullcheckingtheaccuracyandauthenticityofdocumentswithbanksuniversitiesandprofessionalbodies

applying as the Family Member of a tier 1 2 or 5 migrant in the uK

31IfyouarethefamilymemberofaTier12or5migrantyoucannotapplyintheUKifyou

bullwerelastgrantedleavetoenterorremainasavisitorunlesstherelevantpoints-basedsystemmigrantwhoyouareapplyingtobedependantofhasorisbeinggrantedleavetoremainasaTier5(TemporaryWork)migrantinthecreativeandsportingsubcategoryor

bullare on temporary admission or temporary release

applying as the Family Member of a tier 4 (general) Migrant in the uK

32IfyouarethefamilymemberofaTier4(General)applicantwhetherornotyoucanapplyforthepBSDependantcategoryintheUKdependsonthetypeofpermissiontostaythatyouhaveandtypeofcoursetheTier4(General)studentisstudyingorwillbestudying

33YoucanbethefamilymemberofaTier4(General)applicantwheretheyareapplyingfororhavebeengrantedentryclearanceleavetoenterorleavetoremainintheUnitedKingdomasaTier4(General)Studentif

(i) theTier4(General)applicantisagovernmentsponsoredstudentwhoisapplyingfor orwhohasbeengrantedentryclearanceorleavetoremaintoundertakeacourseof study longer than six months or

(ii) theTier4(General)applicantis

a) applyingfororhasbeengrantedentryclearanceorleavetoremaininorderto undertakeacourseofstudyatpost-graduatelevelfor12monthsorlonger and



b) issponsoredbyasponsorwhoisaRecognisedBodyorabodyinreceiptof funding as a higher education institution from either

I theDepartmentforemploymentandLearninginnorthernIreland II theHighereducationFundingCouncilforengland III theHighereducationFundingCouncilforWalesor IV theScottishFundingCouncil or

(iii) theTier4(General)applicantisapplyingfororhasbeengrantedleavetoremainas aTier4(General)Studentonthedoctorateextensionschemeor

(iv) thefollowingconditionsaremet

a) theTier4(General)applicantisapplyingforentryclearanceleavetoenteror leavetoremaintoundertakeacourseofstudythatislongerthansixmonths and either

(1) hasentryclearanceleavetoenterorleavetoremainasaTier4 (General)Studentorasastudenttoundertakeacourseofstudylonger than six months or

(2) lasthadentryclearanceleavetoenterorleavetoremainwithinthe threemonthsprecedingtheapplicationasaTier4(General)Studentor asastudenttoundertakeacourseofstudylongerthansixmonthsand

b) You(thefamilymember)musteither-

(1) haveentryclearanceleavetoenterorleavetoremainasafamily memberofaTier4(General)Studentorastudentwithentryclearance leavetoenterorleavetoremaintoundertakeacourseofstudylonger than six months or

(2) havelasthadentryclearanceleavetoenterorleavetoremainwithin thethreemonthsprecedingtheapplicationasthefamilymemberofa Tier4(General)Studentorasastudenttoundertakeacourseofstudy longer than six months and

c) theTier4(General)applicantMigrantandyou(thefamilymember)mustbe applying at the same time

34ToapplyintheUKyoumustnothavelastbeengranted

bullleave to enter or remain as a visitor or

bulltemporary admission or temporary release

35Tier4(General)studentswhowillbestudyingintheUKforsixmonthsorlesscannotbringtheirpartnersandorchildren(alsoknownasdependants)totheUnitedKingdomwiththem



additional evidential requirement for dependants of PBS migrants whose last grant of leave was not in this capacity

36IfyouareapplyingasafamilymemberofapBSmigrantandyourlastgrantofleavewasnotastheirdependantoryouareachildbornintheUKyouwillneedtodemonstrateyourrelationship WhereyouaremarriedorinacivilpartnershiptoapBSmigrantyoumustprovideyourmarriageorcivilpartnershipcertificatetosupportyourapplicationWhereyouareapplyingasthepartnerofapBSmigrantbutarenotmarriedorinacivilpartnershipwiththemyouwillneedtoprovidedocumentstoshowthatyouhavebeenlivinginarelationshipakintomarriagecivilpartnershipforaperiodofatleasttwoyears-documentsshouldthereforecoverthewholeofthisperiodDocumentswillonlybeacceptedwheretheyarefromofficialsourcessuchasutilitybillsornHSregistrationSuggested Documents

Partners (including spouses and civil partners)marriageorcivilpartnershipcertificatesbankstatementsCounciltaxbillsmedical registrationutilitybills

37You will have the following conditions attached to any leave

bullRegistrationwiththepoliceifthisisrequiredbyparagraph326oftheImmigrationRules

bullnoemploymentasaprofessionalsportsperson(includingasasportscoach)

bullnoemploymentasaDoctororDentistinTrainingunlessyou

haveobtainedaprimarydegreeinmedicineordentistryfromaUKinstitutionthatisaUKrecognisedorlistedbodyorwhichholdsasponsorlicenceunderTier4ofthepointsBasedSystem or

areapplyingforleavetoremainandhaveorhavelastbeengrantedentryclearanceleavetoenterorleavetoremainthatwasnotsubjecttoaconditionrestrictingyouremploymentwhetherthatisemploymentasaDoctororDentistinTrainingorotherwiseandhavebeenemployedduringthatleaveasaDoctororDentistinTraining



38IfyouarethefamilymemberofaTier4(General)Studentifthemainapplicantrsquosgrantofleaveisforlessthan12monthsyouwillnotbeallowedtoworkwhilstintheUKunlessthemainapplicant is a Government Sponsored Student

39IfyouarethefamilymemberofaTier4(General)studentyouwillnotbeallowedtoworkwhilstintheUKifthemainapplicantrsquosgrantofleaveisforacourseofstudybelowdegreelevelunlesstheTier4migrantisagovernmentsponsoredstudent

40Inordertobegrantedentryclearanceasaspousecivilpartnerunmarriedorsamesexpartneryouandthemainapplicantmustbeaged18oroveronthedateyouareduetoarriveintheUnitedKingdom

46IftheTier1MigrantisoutsidetheUnitedKingdomorhasbeenpresentintheUnitedKingdomforlessthan12monthsyoumustshowthatyoutheTier1Migrantor(forchildren)yourotherparentwhoisalsolegallypresentintheUnitedKingdomhaveatleastpound1800tosupportyouthisis in addition to any funds the Tier 1 Migrant needs to prove they have enough money to support



themselves47IftheTier1MigranthasbeenintheUnitedKingdomfor12monthsormoreyoumusthavepound600tosupportyourself

48ForexampletheTier1MigranthasbeenintheUKfor6monthsandismakinganapplicationatthesametimeastheirspouseandtwochildrenTheymustshowthattheyhavepound1800fortheirspouseandafurtherpound1800foreachchildinadditiontopound900requiredfortheirownsupportIntotalthefamilywillrequireevidencethattheyholdpound6300inavailablefunds(pound1800x3=pound5400+pound900)

49IfthesameTier1MigrantandtheirfamilyhadbeenpresentintheUKfortwoyearstheywouldrequireevidencethattheyheldpound2700(pound600x3=pound1800+pound900)inavailablefunds

50IfyouareapplyingasthefamilymemberofaTier1(entrepreneur)migrantyoucannotusethesamefundstomeetthemaintenancerequirementthattheTier1(entrepreneur)usedtomeettheattributesrequirement(appendixAoftheImmigrationRules)
