Section III.A Paragraph 5 of the RFP states: All personnel assigned by the Contractor to the contract shall be employees of the Contractor or a subcontractor, and shall be fully qualified to perform the work required herein. Personnel employed by the Contractor or a subcontractor to fulfill the terms of the contract shall remain under the sole direction and control of the Contractor or the subcontractor respectively. Section III.A Paragraph 7 of the RFP states: If the Contractor intends to utilize any subcontractor, the subcontractor's level of effort, tasks, and time allocation should be clearly defined in the contractor’s proposal. The Contractor shall agree that it will not utilize any subcontractors not specifically included in its proposal in the performance of the contract without the prior written authorization of the State. 6.     8. Do the trails that lead to the plaques

    near the mountain have to be

    mowed?

    Yes, mow one pass on each side of the trail.

    9. How serious is the rattlesnake

    infestation? Is the NDOT planning

    to mitigate this problem?

    There has been only one incident in 20 years. Rattlesnakes are very rarely seen; however, as a precaution there are warning signs posted.

    10. Can the toilet rolls be converted

    from small rolls to large rolls? Yes, larger toilet paper rolls may be used, but in the past the larger toilet paper rolls have been vandalized. The contractor shall be responsible for the expense of loss or replacement of toilet paper in the event it is vandalized.

    11. Is there a history of vandalism at the

    rest areas due to their remote nature?

    There have been 2 major incidents in the past 20 years and both incidents occurred at the eastbound rest area.

    12. Does the State Police

    monitor/surveil these rest areas for

    vandalism?

    The Nebraska State Patrol does drive thru and stop occasionally but rest areas are not patrolled on a regular basis.

    13. Since the east bound rest area will

    be shut down in May of 2021 that

    will increase the amount of

    supervision costs per site. Can the

    cost proposal bid sheet be revised to

    reflect the closure and the effect that

    will be had on the contract?

    The State is unclear on why the amount of the supervision cost per site would increase upon the closure of the Sidney Eastbound rest area. The cost proposal bid form is hereby revised as per the attachment to this addendum and is posted on the NDOT website at: http://dot.nebraska.gov/business-center/business-opp/procure-service-opp/. Sections III.F., V., V.O., and V.Y. of RFP #R15-20 are hereby amended per Attachment 1A.

    This addendum will become part of the proposal and should be acknowledged with the Request for Proposal.

    Section III.F. PRICES, is hereby replaced and superseded with the following:

    Prices quoted shall be net, including transportation and delivery charges fully prepaid by the contractor, F.O.B.

    destination named in the solicitation. No additional charges will be allowed for packing, packages, or partial delivery

    costs. When an arithmetic error has been made in the extended total, the unit price will govern. Fixed Price

    Contract: All prices, costs, and terms and conditions submitted in the cost proposal bid form shall remain fixed and

    valid commencing on the opening date of the proposal until the contract terminates or expires.

    Section V. PROJECT DESCRIPTION AND SCOPE OF WORK, is hereby replaced and superseded with

    the following:

    The Nebraska Department of Transportation (NDOT) is requesting proposals for the provision of Rest Area

    Maintenance Services for the District 5 rest areas along Interstate 80. Locations of the facilities are as follows:

    Sidney Eastbound Rest Area is located at approximate Milepost 51.40

    Sidney Westbound Rest Area is located at approximate Milepost 61.37

    NDOT plans on reconstructing the Sidney Eastbound Rest Area tentatively in May of 2021 and the project is

    scheduled to take approximately two (2) years to complete. During this period, this rest area will be closed

    and rest area maintenance services will not be required. The contracted amount for the Sidney Eastbound

    shall be pro-rated for services provided and days worked prior to the rest area closure based on a 365

    calendar year. NDOT shall provide a thirty (30) day written notice to the contractor prior to the start of the

    reconstruction project. Upon completion of the reconstruction, the rest area maintenance services for the

    Sidney Eastbound Rest Area will be rebid. The Sidney Westbound Rest Area will not be affected by the

    reconstruction project and will remain open and shall require rest area maintenance services.

    Section V.O. REST AREA CLOSURES, is hereby replaced and superseded with the following:

    In the event, a rest area(s) is closed for a definite period of time due to acts of nature, road construction, building

    repair/reconstruction or for any other reason deemed necessary by NDOT, the duties and responsibilities of the rest

    area personnel shall be redirected by NDOT to include landscaping maintenance during the closure. If reconstruction

    prevents landscaping maintenance or there is insufficient amount of work for the rest area personnel to perform, the

    contracted amount shall be pro-rated for services provided and days worked based on a 365 calendar year.

    NDOT plans on reconstructing the Sidney Eastbound Rest Area tentatively in May of 2021 and the project is

    materials, management and supervision of required or essential personnel necessary to ensure effective completion

    of all work and services as specified in this RFP. The bid prices submitted by the contractor on the cost proposal

    form for the initial contract period and optional renewal periods shall remain fixed and valid commencing on the

    opening date of the proposal until the contract terminates or expires.
