submitted that still a large amount remains to be recovered from

respondent on behalf of petitioner bank.

Keeping in view of order of Ld. DRTI dated

04.05.2016 and submissions made by counsel for petitioner bank,

receiver appointed by the court is directed to take possession of

property in question subject to filing of affidavit by Authorized

Officer of petitioner bank of dismissal of SA filed by respondent

before Ld. DRTI and detailing exact liability as on 31.05.2016 of

respondent.

However, it is directed that receiver will take

possession of property in question in terms of order dated

18.09.2014 after giving fresh possession notice to Authorized Officer

of petitioner bank and borrower 15 days in advance. Rest of other

terms and conditions of order dated 18.09.2014 would remain to be

the same.

SHO concerned is directed to assist receiver in case

of requirement for taking possession of property in question.

date, no police official has started from PS Kankarbagh to take

custody of accused.

Counsel for accused has submitted that with regard

to same transaction, accused herein through his company M/s

Unique Tourism Pvt. Ltd. has got lodged FIR No. 910/13, PS

Mehrauli u/sec 406/467/468/471/474/120B IPC lodged against

Sabita Sinha, Shailender Kumar (complainant in FIR No. 332/13, PS

Kankanbagh) and Pawan Kumar. He has submitted that copy of FIR

is appended with bail application. Heard.

Record perused.

Counsel for accused has submitted that accused

has his own place of abode in Delhi within territorial jurisdiction of

PS Neb Sarai and is ready to furnish surety bond to satisfaction of

this court containing undertaking that he will surrender before

concerned court at Patna within 10 days from today and will also

intimate in this regard to court exercising jurisdiction over PS Neb

Sarai. Heard.

SI Vinay Kumar on inquiry has admitted that

accused has his own residence (ancestral) within jurisdiction of PS

Neb Sarai.

In view of the fact that no police official has started

from concerned PS to take accused into custody, lack of details

which should have been sent with warrants as provided u/sec 78 (2)

Cr. P. C., prima facie it appearing that accused through his

company has got lodged FIR No. 910/13, PS Mehrauli against

complainant of present FIR and address of accused being verified, I

am of the view that liberty of accused shall be curtailed without any

reasonable ground before this court to further detain him in

custody, I am of the view that application of accused should be

allowed and is accordingly allowed.

Accused Bhavender Jha is granted bail subject to

furnishing bail bond in the sum of Rs. 50,000/ with two local

sureties of like amount.

Bail is granted subject to following conditions:

1. Accused shall appear before concerned court of Smt.

Suchitra Singh/Duty Magistrate/Link Magistrate at Patna

within 10 days from today.

2. Accused shall inform in writing to court exercising

jurisdiction over PS Neb Sarai without delay in this regard.
