You will have seen in the last issuethe names of the successfulcandidates in the second round. There were a total of 104candidates who reached therequired standard, 14 who did notreach the standard in any of thethree elements and 64 who havebeen offered the chance to re-takethe one or two elements in whichthey did not reach the requiredstandard.
The comments from the assessorshave highlighted the fact that, again, many candidates have notgiven the specialist portfolioassignments and the coreassignment the attention required. This would appear to be the case, particularly, with candidates takingthe Advocacy, Ancillary Relief,Children and Cohabitationspecialist portfolio assignments. The SFLA Accreditation Scheme isnot, and is not intended to be, easy.It is designed to identify the trulyexpert family lawyer and shouldonly, therefore be undertaken bythose willing to commit the time
46
and energy into completing theassignments in an expert manner.
The assignments should show anordered, logical mind, skills inanalysing the facts and law, goodwriting and presentation, as well asknowledge and experience of thelaw. Candidates are given 8 weeksto complete the specialist portfolios- which should be ample time to
consider the set case study, do anyresearch necessary, plan theanswers, write the answers andcheck them to ensure that everypoint has been covered, and tocomplete the two examples of casesdealt with. What happens is thatmany candidates decide to leavethis until the weekend of the coreassignment, thinking that they willbe able to do it all in a weekend. This is not recommended by theAccreditation ManagementCommittee.
On the core assignment, the mostcommon criticisms were:
Question 1 on the matter of achild's religious upbringing andcircumcision - failure to mentionspecific issue orders and Re j; onthe threat of taking the child to
Turkmenistan - failure to checkFamily Law to see whetherTurkmenistan is a Conventioncountry; and on the grandmother'Swish to apply for residence - failureto mention need for leave to makean application
Question 2 on ancillary relief -failure to mention the Piglowskaand White cases, limited discussionof pensions, clean break, the
Question 4 on Family Law Act,Part II - some candidates still gotthe time limits wrong and some didnot put forward ideas forimproving the Act.
Copies of past papers withguidelines for the answers areavailable from Mary I'Anson for£25.
