6. Toll Road Designation 113312 Dallas County - Designate the SH 183 Managed Lanes Project, from just west of SH 161

to near I-35E/Trinity Parkway in Dallas County, as a toll project on the state highway system (MO) (A/V)

The Texas Department of Transportation (department) received final environmental clearance from the Federal Highway Administration on SH 183 from SH 161 to I-35E/Trinity Parkway as a toll facility on February 10, 2004 and concurrence of the environmental assessment re-evaluation on April 9, 2012. This minute order designates SH 183 Managed Lanes Project from just west of SH 161 to near I-35E/Trinity Parkway, as a toll project on the state highway system.

7. Discussion Item (A/V) Update on current projects and future work programs and priorities from Regional

Mobility Authorities. Representatives from the following Regional Mobility Authorities have been invited to provide an update to

the Texas Transportation Commission: a. Alamo RMA (PRESENTATION) b. Cameron County RMA (PRESENTATION) c. Camino Real RMA (PRESENTATION) d. Central Texas RMA (PRESENTATION)(VIDEO) e. Grayson County RMA (PRESENTATION)

f. Hidalgo County RMA (PRESENTATION) g. North East Texas RMA (PRESENTATION) h. Sulphur River RMA (PRESENTATION)

As appropriate, the RMAs will provide an update on the status of ongoing efforts to procure Comprehensive Development Agreements for projects authorized by the 82nd Legislature and action plans for implementation of these projects and other RMA priorities.

8. Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: (A/V) a. Final Adoption 113313 (1) Chapter 1 - Management (MO) New Subchapter G, Alternative Dispute Resolution New §§1.101 - 1.108 TxDOT's sunset bill (Senate Bill 1420), enacted during the 82nd Regular Session, added

Transportation Code, §201.118, which in part requires the commission to develop and implement a policy to encourage the use of alternative dispute resolution for internal and external disputes. These rules add new subchapter G to Chapter 1 of TxDOT’s rules to provide that policy.

(2) Chapter 9 - Contract and Grant Management (MO) 113314 Amendments to §9.1, Claims for Purchase Contracts and New §9.7,

Protest of Contract Practices or Procedures (General) These amendments broaden the scope of §9.1 to cover all types of contract claims, other

than those addressed by Transportation Code, §201.112, which are covered under §9.2. The amendments also add new §9.7 which provides a general protest process related to the award of a contract for which TxDOT rules do not currently provide a protest process.

8. Promulgation of Administrative Rules (continued) 113315 (3) Chapter 16 - Planning and Development of Transportation Projects (MO)

Amendments to §§16.1 - 16.4 (General Provisions), §§16.51 - 16.56 (Transportation Planning), §§16.101 - 16.105 (Transportation Programs), §§16.151 - 16.160 (Transportation Funding), and §§16.201 - 16.205 (Project and Performance Reporting) TxDOT's sunset bill (Senate Bill 1420), enacted during the 82nd Regular Session, included new requirements for the department's transportation planning, programming, funding, and project/expenditure reporting functions. The amendments to Subchapters A-E in Chapter 16 will implement the requirements of Senate Bill 1420 and make additional changes to clarify the existing rule provisions.

b. Proposed Adoption 113316 (1) Chapter 9 - Contract and Grant Management (MO)

Repeal of §§9.30-9.43, and New §§9.30-9.39 (Contracting for Architectural, Engineering, and Surveying Services)

The amendments reorganize the current rules and remove information deemed to be overly prescriptive. In addition, two new provider selection processes are established. The federal process will target provider selection requirements for engineering and design related contracts reimbursed with federal-aid highway program funds to aid the department in ensuring compliance with these requirements. The small contract process will benefit the small business community by providing a simpler, more expeditious method by which to compete for architectural, engineering, and surveying contracts of limited scope and dollar value.

113317 (2) Chapter 12 - Public Donation and Participation Program (MO) New Subchapter K, Acknowledgment Program, New §§12.351 - 12.355

This new subchapter establishes the provisions for a state Acknowledgment Program. This program will allow the department to acknowledge donations for certain transportation purposes such as mowing the right of way, litter pick-up, and maintenance of rest areas with federally approved acknowledgment signs in the state right of way. These new provisions prescribe the policies and procedures for implementing the Acknowledgment Program and allow the department to contract for its development.

113318 c. Rule Review In accordance with Government Code, §2001.039, Readoption of Title 43 Texas Administrative Code Chapter 26, Regional Mobility Authorities, Chapter 30,

Aviation, and Chapter 31, Public Transportation (MO) State law requires a state agency to review each of its rules every four years. After the review, the

agency must readopt the rule, readopt the rule with amendments, or repeal the rule. The department reviews its rules on a rotating basis.

9. Office of Compliance and Ethics Report (A/V)

State law requires the commission to establish a compliance program, which must include a compliance office to oversee the program. The compliance office is responsible for acting to prevent and detect serious breaches of department policy, fraud, waste, and abuse of office,

including any acts of criminal conduct within the department. The compliance office is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations.

113319 10. Unified Transportation Program Approve updates to the 2013 UTP (MO) (A/V)

The UTP is a 10-year statewide plan for transportation project development. The commission approved the 2013 UTP in April 2012 and revisions to the 2013 UTP in June 2012 and August 2012. This minute order addresses the department’s plan for the redistribution of unobligated 2003-2006 federal earmark balances. The updates also include revised funding allocations based on funds transfer requests in multiple categories, including applied carry-over amounts from fiscal year 2012 and revised allocations to address federal funding levels. In addition, this minute order updates project specific program lists, revises the tiered projects exhibit, and other minor revisions or technical corrections.

113320 11. State Infrastructure Bank Various Counties – Concurrence with the Regional Transportation Council (RTC) of the

North Central Texas Council of Governments' allocation of a portion of the payments received from the North Texas Tollway Authority (NTTA) for the right to develop, finance, design, construct, operate and maintain the SH 121 toll project (Sam Rayburn Tollway) to pay certain costs of the President George Bush Turnpike, Segments I-IV (PGBT) project, allowing the State Infrastructure Bank (SIB) loan the NTTA received for the PGBT project to be repaid, and authorize the executive director of the department to enter into agreements with the RTC and the NTTA to effectuate agreed conditions for the use of the SH 121 payments (MO) (A/V)The department has established a separate fund to account for and track projects and project costs funded with the SH 121 payments. This minute order authorizes the funding of additional project costs with those payments. In Resolution R12-07, the RTC agreed to "purchase" the SIB loan by allocating funds from the SH 121 payments that effectively will be used to repay the SIB loan and provide additional capital for the SIB. The NTTA will continue to make payments to the department in accordance with the SIB loan repayment schedule. Those payments will be deposited in the state highway fund and committed for use in the region served by the RTC through an allocation of Category 12 funds in the Unified Transportation Program equal to the repayment amounts, plus interest earned on those amounts.

12. Contracts (A/V) Award or reject contracts for maintenance, highway and building construction These proposed minute orders contain information concerning the receipt of bids for highway

improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal

13. Eminent Domain Proceedings 113323 Various Counties – Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see

attached list) (MO) (A/V)Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.

14. Routine Minute Orders (A/V) a. Donations to the Department 113324 (1) Administration - Consider a donation from Experience Arlington for

rental of the Hall of Fame Theater in the Rangers Ballpark for the Texas Transportation Commission Meeting on November 15, 2012 (MO) The donation will allow the department to meet in Arlington and increase regional participation in transportation decision-making.

113325 (2) Bridge Division – Consider a donation from the American Segmental Bridge Institute for a department employee’s travel expenses to attend the American Segmental Bridge Institute (ASBI) Convention in Miami, Florida on October 28 – 30, 2012 (MO)

This convention will showcase the latest in research, design and construction of segmental bridges from North America and around the world. Attendance at this meeting allows the department to collect information regarding segmental bridges and further advance the designs of these structures.

113326 (3) Bridge Division – Acknowledge a donation from the Precast Concrete Manufacturers Association of Texas for a department employee’s travel expenses to participate in site visits to projects using new technology for sliced precast concrete U-girders in Denver, Colorado on September 17-19, 2012 (MO)

Participation at the site visits will allow observation of fabrication, erection and in-service bridges using sliced precast concrete curve U-girders, which will help the department improve safety, durability, economy and constructability of future curved and straight long span bridges.

113327 (4) Construction Division – Acknowledge a donation from the Precast/Prestressed Concrete Institute (PCI) for a department employee’s travel expenses to attend the PCI 2012 Committee Meetings, “Prestressed Concrete Plant Certification” and “Prestressed Concrete Personnel Training and Certification,” in Nashville, Tennessee on September 27–29, 2012 (MO) Texas is one of eight states chosen to participate in this research and attendance at this meeting will allow the department to discuss these research projects through participation in knowledge transfer, networking and communication which will help the department become a best-in-class agency.

development of professionally prepared set of construction plans and construction costs to improve safety associated with two (2) proposed signal installations on BU 71 at the intersection of FM 609 and the proposed Walmart driveway in LaGrange, Texas within the department’s right of way (MO) The donation will enable the State to address safety concerns and access issues related to the donor’s development.

b. Right of Way Dispositions and Donations The commission must approve the sales, transfers and exchanges of state rights of way and other real properties that are no longer needed for a state highway purpose. It must also approve, accept and acknowledge donations to the state of real property that is valued at $500 or more. 113336 (1) Childress County-FM 94 realignment southwest of Childress - Consider

the transfer of surplus right of way easements to the county (MO) The district has determined that surplus land resulting from a realignment is no longer

needed for highway purposes. The cost of future maintenance exceeds the value of the surplus land. The county has requested to acquire the surplus land, and it may be transferred to the county at no cost.

113337 (2) Harris County - I-10 at Mason Road in Katy - Consider the sale of surplus right of way to the abutting landowner (MO)

The district has determined that the surplus land is no longer needed for highway purposes. The abutting landowner has requested to purchase the surplus land, and it may be sold to the abutting landowner.

113338 (3) Polk County - US 190 east of Long King Creek in Livingston - Consider the sale of surplus right of way to the city of Livingston (MO) The surplus land was acquired as part of a whole taking to avoid an uneconomic remainder. The district has determined that the surplus land is no longer needed for highway purposes. The city has requested to purchase the surplus land, and it may be sold to the city.

113339 (4) Tarrant County - SH 199 at North Commercial Street in Fort Worth - Consider the exchange of right of way and acceptance of a donation to the state (MO) The city, state and Tarrant Regional Water District (TRWD) are partnering in the rebuilding of a bridge for a Trinity River project. The district has advised that an exchange of land with TRWD will allow the project to be accomplished and that the surplus land will no longer be needed for highway purposes. The value of the new land from TRWD is more than $500 greater than the value of the surplus land.

c. Release of Access Rights 113340 (1) Fort Bend County – SH 99, immediately south of Fry Road in Katy –

Consider the designation of a location on the highway at which access will be permitted to the abutting property (MO) The designation of a 35-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the northbound frontage road. The district has determined that access may be permitted at the designated location.

113341 (2) Jefferson County - Authorize the re-designation of access control along FM 364, immediately South of US 90, in the city of Beaumont in order to move the two access points on FM 364 for the property owned by Magna Properties, LTD, from its original location to two new locations (MO) FM 364 in the city of Beaumont is a non-controlled access facility and Magna Properties, LTD is requesting that its property's two existing points of access to FM 364 be relocated south approximately 225 feet each from the existing location. The original access points will be removed and access will be denied at those locations.

d. Finance (1) Obligation Limit Report

Quarterly status report on the FY 2012 Obligation Limit, the actual obligations utilized through the current month, proposed remaining highway maintenance and construction contract letting for the fiscal year and an update on motor fuel tax receipts This report will provide the current overall obligation status, by district and metropolitan planning organization, of the FY 2012 Obligation Limit and will also provide the anticipated effect on the obligation limit of remaining proposed highway maintenance and construction letting. The report will also provide an update on motor fuel tax receipts, including estimated versus actual receipts fiscal year to date, and any potential impact on letting volume.

(2) Quarterly report on FY 2012 State Highway Fund 6 cash status This report updates the commission on the year-to-date cash balance and activity of Fund 6. The report will include original projections and actual revenues/inflows and expenditures/outflows on a cash basis.

113342 (3) Accept the Quarterly Investment Report (MO) This minute order accepts the quarterly investment report for investments of funds relating to financing of the Central Texas Turnpike System and held by the Bank of New York Mellon, acting as trustee.
