10.0 Definition of terms:

In this tender the following words and expressions shall have meanings hereby assigned to them, except where the context requires otherwise:

10.1 The "Bid/Tender" shall mean the proposal/offer along with supporting

documents, submitted by the Bidder for consideration by the Institute. 10.2 The "Bid/Tender Document" shall mean the documents issued by the

Institute to prospective Bidders, containing various terms and conditions, Scope of Work, any requirements, etc., or generally laid out in various sections spelling out the basis, procedure, modes, methods and formats for the Bidders to prepare their Bids for submission to the Institute. The Bid document shall include the invitation to the Bid, instructions, proposal forms and all addenda/corrigenda/amendment issued by the Institute.

10.3 The "Contract" shall mean the agreement between the Institute and the

contractor, duly signed by the parties to the Agreement, through their authorized representatives, for the execution of the work included in the Bid document, Letter of Acceptance of the Bid, agreed variations to the Bid document if any, the Schedule of Rates and other relevant documents submitted by the contractor and as accepted by the Institute.

10.4 The "Tenderer/Contractor" shall mean the person or persons, the firm or

company whose Bid has been accepted by the Institute and includes the Contractor's legal representatives, his successors and permitted assignees.

10.5 The “Empanelment” shall mean enlistment of contractor for a limited period

of two years for award of work of running the Canteen/Mess at Student’s Hostel (DOH-1 and SOH-1) of the Institute at Jatni Campus.

10.6 The "Hostel" shall mean the NISER student’s hostels at DOH-1 and SOH-1

situated at its main campus, Jatni and the “Canteen/Mess” situated at DOH-1 and SOH-1 situated at its main campus, Jatni. The "Chief Warden” shall mean the person authorized by the institute from time to time and shall include those who are expressly authorized by the institute to act on their behalf including the "Administrative Officer-III” in charge of the hostel/estate management, for supervision of work. He shall have power to report in case there are violations of the provisions of the contract.

10.7 The "Institute" shall mean the National Institute of Science Education and

Research, Bhubaneswar and shall include its authorized representatives, successors and assignees.

10.8 The "Mess Secretary" shall mean the authorized representative of the

students Mess Management Committee, formally approved by the Institute, who will be authorized to regulate the activities related to the student’s canteen/mess on a day to day basis.

10.8 The “Mess Management Committee” shall mean the committee formed by

respective hostel inmates and authorised by NISER for managing day to day affairs of the canteen/mess located in their hostels and for regulation of the menu/food items/sanitation/cleanliness/etc. of the canteen/mess in accordance with provisions mentioned in the tender document.

10.9 The "Work" shall mean and include all works to be executed, all items and

things to be provided/done and services and activities to be performed by the contractor in accordance with the contract.

3.0 SCOPE OF WORK :

The Scope of Work, covered by the contract, is broadly but not extensively described below:

GENERAL:

The permanent campus of NISER is situated at Jatni, Khurda, comprises of Boys and Girls Hostels, Administrative and Academic Blocks, Residential complexes, etc. The Institute offers residential accommodation in its hostel blocks located inside its Jatni campus for around 400-450 students. There is Canteen/Mess in the Institute’s hostels (every hostel is having a canteen/mess) to cater to the need of students, including NISER faculty/guest faculties, staffs and employees and sometime trainees attending summer training programs and interviewees staying in the hostels. The Canteen/Mess located in every hostel in the NISER Campus, Jatni is proposed to cater to the requirements of faculties, officers, staffs, visitors, day scholars and boys/girl students staying in its hostels. The Canteen/Mess should also serve tea/coffee/cold drinks, snacks, high tea, lunch/dinner etc. in various official meetings, programmes, seminars and functions organized by the Institute from time to time. In addition, people visiting NISER campus in connection with various activities of the Institute may also avail these services. The caterer has to run two canteens/mess at two hostels located at DOH=1 and SOH-1, Jatni Campus, Khurda. THE CONTRACT FOR AWARD OF CANTEEN/MESS SERVICES THROUGH THIS TENDER SHALL COME INTO FORCE WITH EFFECT FROM January 2015 (tentatively)

3.1 The contract is essentially for running the Canteen/ Mess services to the

residents of NISER students’ hostel for around 450 people ( comprising of two hostels) through daily coupon system but strictly on a subsidized food/meal rate but not on commercial rate.

3.2 Please note that since all the infrastructural facilities such as Water, Electricity, Kitchen Equipments, Utncils, Cooking equipments, Dining Hall Facility, etc. are provided by the Institute at both the hostel canteens/mess, the contractor should quote his price in accordance with the basic costing of various food items that are to be sold in the canteens/ mess on subsidized rate only.

3.2 CONTRACT PERIOD: The contract shall be for a total period of 02 [two]

years. However, initially the contract will be awarded for 1 year only and the continuation of the contract after first year is subject to satisfactory performance during the first year of contract. The decision of the Institute in regard to satisfactory performance during the first year shall be final and binding.

3.3 MEAL PLAN: The contract is in respect of providing 3 (three) meals per day, that is, breakfast, lunch and dinner, besides evening tea with snacks. Each meal will be served for over a period of 2 1/2 (two and a half) hours. The institute will decide the timings for each meal on different days. The timings could be revised over the year as per the decision of the Mess Management Committee/ institute. The contractor will be informed about the changes in the timings well in advance.

3.4 The Mess Management Committee/Chief Warden/Mess Warden/Officer-in-

charge of the hostel in consultation with the Mess Secretary shall provide basic menu, which shall continue for a minimum period of one month once agreed upon mutually between the officials and the Contractor. For any additional requirement of food items other than the regular menu, the Mess Management Committee shall take a decision, please note that in the Canteens/Mess the Daily Coupon system on meal basis has to be adopted.

3.5 In addition to above, the contractor shall be required to provide extra facilities

against additional payment to be made by the residents in respect of items not covered under the Basic Meal Plan through Coupon System. Under such circumstances the contractor shall be required to proportionately enrich the dinner/lunch/breakfast, as decided by the Mess Management Committee/ institute. Menu once decided shall continue for a minimum period of one month.

3.6 The number of students will be at an average of 450 at both the canteens/mess

apart from staffs, faculty, visitors,etc. The number of students may vary depending upon academic sessions and vacations. However, a significant variation is not envisaged on a day to day basis.

3.7 The canteens/mess premises comprising, cooking and dining facilities,

furniture, kitchen/cooking equipments, containers/deep freezers/cold storage facility, appliances, utensils, shall be provided by the Institute (a tentative list of such items are provided in the tender document). However, raw materials, food articles, cooking fuel, cleaning/washing materials/tools and man power shall have to be arranged by the contractor at his/their own cost.

3.8 Infrastructure/ Electricity and Water Charges: The institute shall provide

Basic Infrastructure in the Kitchen and Dining Area like, Gas bank facility (except Gas cylinders)/ Gas Stoves/ Tawa/ Roti-Chapati maker/ Steam Cooking facility/Chairs and tables in the dining area/etc. apart from providing electricity and water, without any cost to the contractor at both the canteens/mess (DOH-1 and SOH-1). The Contractor has to incur the expenditure and make his own arrangement for procurement of cooking gas, etc.

Space: The contractor has to pay the User Fee/ License fee for the area that is

to be occupied for Kitchen purpose only, except dining area. The rate of

User/License Fee shall be in accordance with the fair rent policy of the govt. as revised from time to time.

PLEASE NOTE: NISER is a residential educational institution and for the purpose of running the Canteen/ Mess in the Hostels of the Institute, the caterer has to quote subsidized rate for the food items that are to be supplied to the students/ staffs of the Institute.

3.9 The inventory of articles shall be handed over to the contractor in good and

working condition at the commencement of the contract. The contractor shall be the custodian of this Institute property and all canteen/mess inventory during the period of contract and shall make good any loss to the inventory by way of misuse, breakage, theft, etc., at his own cost.

3.10 Similarly the inventory in good condition shall be handed over by the contractor to the institute on the expiry of the contract period. The security deposit shall be refunded only after a “No Dues Certificate” is granted by the Chief Warden/Administrative Officer-III in charge of the hostel.

3.11 The serviceability and repairing of the kitchen items, furniture and appliances shall be done and ensured by the contractor at his own cost and responsibility. Care must be taken to ensure that, while carrying out the work, no fittings, fixtures, furnishings, equipments provided by the Institute are damaged. Any damages done to the same or any other property will have to be repaired / replaced by the Contractor, failing which the same will be got done by NISER at the contractor’s risk and cost. In this regard, the decision of the institute shall be final and binding on the Contractor.

3.12 The contractor shall not be allowed to use electricity as a cooking fuel.

However, he shall be permitted to use toasters, refrigerators, geysers, water coolers, mixer/grinder, oven and other equipments for cutting/grilling vegetables, etc. Any other electrical cooking appliance may also be used by the contractor after obtaining prior permission of the Chief Warden/Mess Warden/A.O-III in-charge of the hostel, in writing.

3.13 The contractor shall procure food articles of good quality in consultation with

and to the satisfaction of the Mess Management Committee/ Chief Warden/ Officer in-charge of the hostel and the Chairman, HMC. The quality of some of the items is specified below:

The above list is only indicative in nature. The Hostel Management Committee/Chief Warden/Mess Warden/Officer in-charge of the hostel and the Chairman, HMC shall have the right to change any brand provided the cost does not exceed the specified brand.

3.14 The contractor shall procure only good quality fresh vegetables from the

market. He shall not be allowed to store the vegetables for more than 1 (one) day in summer months and 3 (three) days in winter months at a stretch. However, the contractor shall ensure that a sufficient stock of other raw material is stocked in the store for consumption for a minimum period of 15 (fifteen) days. The Mess Management Committee/Hostel Wardens/Chairman HMC/Officer in charge of the hostels shall have the right to check the quality of food articles and vegetables from time to time.

3.15 The food shall be cooked, stored and served under hygienic conditions. The

contractor shall ensure that only freshly cooked food is served, and that stale food is not recycled. Stale food shall be removed from the canteen/mess premises as soon as possible. Un-refrigerated cooked food, not consumed with in 6 (six) hours in summer months and 10 (ten) hours in winter months, shall be deemed to be stale and unfit for consumption.

3.16 The food shall be neither too spicy nor too oily. The food preparation shall be

wholesome and shall generally cater to the taste of the residents. 3.17 The oil that remains from deep frying at the end of the day shall have to be

destroyed and shall not be allowed to be recycled for the purpose of cooking again.

3.18 The food shall be cooked and served in clean utensils and no laxity shall be

permitted in this regard. The utensils shall have to be maintained sparkling clean at all time.

3.19 The contractor shall pay special attention to maintain the canteen/ mess in a

neat and tidy condition at all times. For this purpose, the canteen/ mess shall be cleaned thoroughly after each meal.

3.20 The contractor shall ensure that only fresh & hot food is served to the

residents. Complaints, if any, in this regard shall be dealt with severely.

4.0 JOB SPECIFICATION / STATUTORY OBLIGATIONS OF THE TENDERER (CONTRACTOR)

4.1 The Contractor shall be responsible for engaging adequate number of trained/semi-trained manpower required for providing good Canteen/Mess services in NISER Canteen/Mess located in Student’s Hostel (DOH-1 and SOH-1). The contractor shall ensure that sufficient man power is deployed for preparation and service of each meal including cleaning, washing and overall upkeep of canteen/mess assets and premises, by an overall minimum of following man power.

4.2. The employees of the Contractor should possess good health and should be

free from any diseases, especially contagious and frequently recurring diseases.

4.3 The Contractor will, prior to the commencement of the operation of contract, make available to NISER the particulars of all the employees who will be deployed at the Institute’s premises for running the Canteens/Mess. Such particulars, inter alia, should include age/date of birth, permanent address, police verification report and profile of the health status of the employees.

4.4 The Contractor shall be responsible for timely payment of wages to his/her workers as per Minimum Wages Act and fulfill all other statutory obligations, such as, Provident Fund, ESI, and Service Tax etc. in force from time to time.

4.5 The Contractor shall ensure proper discipline among his/her workers and further ensure that they do not indulge in any unlawful activity.

4.6 Employment of child labour is strictly prohibited under the law. Therefore, the Contractor shall not employ any child labour.

4.7 In the event of violation of any contractual or statutory obligations by the Contractor, he/she shall be responsible and liable for the same. Further, in the event of any action, claim, damages, suit initiated against the Institute by any individual, agency or government authority due to acts of the Contractor, the Contractor shall be liable to make good/compensate such claims or damages to the Institute. As a result of the acts of the Contractor, if the Institute is required to pay any damages to any individual, agency or government authority, the Contractor would be required to reimburse such amount to the Institute or the Institute reserves the right to recover such amount from the payment(s) due to the Contractor while settling his/her bills or from the amount of Security Deposit of the Contractor lying with the Institute.

4.8 The Contractor shall ensure compliance of all laws relating to cleanliness, sanitary, hygienic and health conditions and other laws in force from time to time with regard to the environment around cooking place, dining hall and surrounding etc.

4.9 The Contractor shall at all times keep indemnified the principal employer, namely, NISER, head of the Institute and its officers and designated/ concerned staff for and against all third party claims whatsoever (including property loss and damage, personal accident, injury or death of any person) and/or the owner and the Contractor shall at his/her own cost and initiative at all times, maintain all liabilities under Workman’s Compensation Act / Fatal Accident Act, Personal Injuries, Employees State Insurance Act, PF Act, etc. in force from time to time.

4.10 The workers employed by the Contractor shall wear uniform and name badge, which is provided by the Contractor and the agency, shall be responsible for the discipline of his workers. The Contractor shall ensure that they wear them all times and maintain them properly. The workers are not employees of the Institute and shall not have any claim whatsoever on the Institute and shall not act detrimental to the interest of the Institute. The workers shall have to follow the security regulations as directed by Security and fire fighting of the Institute. Workers shall not form union or carry out trade union activities in the campus.

4.11 The Contractor shall be personally responsible for conduct and behaviour of his staff and any loss or damage to Institute’s moveable or immoveable property due to the conduct of the Contractor’s staff shall be made good by the contractor. If it is found that the conduct or efficiency of any person employed by the Contractor is unsatisfactory, the Contractor shall have to remove the

concerned person and engage a new person within 48 hours of intimation by NISER. The decision of the Institute’s designated officer in this regard shall be final and binding on the Contractor.

4.12 The Contractor shall not appoint any sub-contractor to carry out his obligations under the contract.

4.13 The Contractor shall keep the Kitchen/Canteen/Dining/Mess and its surrounding areas clean and up to date sanitation every day after the services are over. The cleaning includes cleaning of kitchen, dining hall, floor, counter, benches, tables, chairs, etc. They will be washed with water and soap solution and moped, after every meal (breakfast, lunch, snacks and dinner) and will be disinfected once in a month or as and when required. NISER management will have 24-hour access to inspect the Canteen/ Mess premises at any time for ensuring the cleanliness and hygienic conditions of the kitchen and dining hall premises

4.14 The Institute reserves the right to inspect the quality of raw material, food and other items prepared and sold in the Canteen/Mess. Any defect(s) pointed out by Mess Management Committee/Chief Warden/Mess warden/Chairman, HMC/Officer in charge of the hostel or any such officers/officials appointed by the institute, during their visits shall be properly attended to by the Contractor.

4.15 The Contractor shall get the prices of all items approved by the competent authority in charge of the hostel/canteen/mess, and no changes what-so-ever shall be made without prior written approval of the competent authority.

4.16 IMP: Before submission of the Bid, the interested tenderers/contractors

may visit the premises of the two Canteens/Mess located at its Hostels, i.e DOH-1 and SOH-1 at NISER Campus, Jatni after obtaining due permission from the Estate Management Section of the Institute. They should take prior permission about the date and time of visiting the NISER Hostel premises at its main Campus at Jatni.

5.0 OTHER OBLIGATIONS: 5.1 The food has to be prepared in clean, hygienic and safe conditions as

per the menu.

5.2 The workers should have experience of working in large Canteens, hotels, canteens, messes of reputed educational institutes for a period of five years and should have the knowledge and aptitude for preparing food both vegetarian and non vegetarian.

5.3 The garbage collected from the kitchen, dining halls, dish wash area will

be disposed off every morning. The surroundings shall be kept clean and hygienic. The responsibility for cleaning and removal of the garbage (from kitchen/dining areas including leftover food materials by the users) lies with the contractor. In no case, the institute shall be responsible for such and in case of non-removal of garbages and waste materials, the shall contractor shall be penalized as deemed fit by the authorities of the institute.

5.4 Canteen/Mess Timing: The canteen/mess will be opened at 6-00 a.m.

by collecting key from the Security office and will be closed by 10-00 p.m. and key should be deposited at Security office on all seven days of the week. Any changes in the timings will be as approved by the concerned authorities.

5.5 Food is served through counters on self service basis. However, the used plates will be taken out from the dining tables through trolleys to the dish wash area.

5.6 Food should also be served to the hostel rooms and to the health center for sick students in the room as and when required.

5.7 Kitchen to be kept clean always and should be washed after cooking every meal with water and soap solution.

5.8 Water Coolers and purifier should be cleaned and maintained as per the instructions by the authority. The maintenance of the water coolers/aquaguards provided in the dining area by the institute, shall be the responsibility of the contractor. In case, the aquaguard/coolers should go bad for more than 48 hours, it should be repaired by the contractors immediately, in case of failure to do so the institute shall be at liberty to impose penalty as decided by the authority of NISER.

5.9 All work shall be carried out with due regard at the convenience of NISER. The

orders of the concerned authority shall be strictly observed.

5.10 The Contractor will deploy adequate manpower for work during late hours and on Saturdays/Sundays, including other holidays, according to the requirement of NISER and the guests/hostellers.

5.11 The Contractor will have to supply breakfast/lunch/dinner in the Canteen/ Mess/hostel premises as per requirement and schedule drawn for the purpose by the concerned authorities of the Institute.

5.12 The Contractor shall install his electronic fly – kill / insect repellent

equipment, emergency lighting / gas and fuel supply at his own cost; 5.13 Storing/supply/sale and consumption of drugs, alcoholic drinks, cigarettes or

any other items of intoxication are strictly prohibited in the Institute’s campus, including canteen/mess. Any breach of such restrictions by the Contractor will attract deterrent action against him/her as per statutory norms.

5.14 No minimum guarantee will be furnished to the Contractor towards consumption of food items. He/she is advised to maintain the highest quality at the minimum possible prices so as to attract the maximum number of students/hostellers/NISER personnel to avail Canteen/Mess services. The Coupon system has to be introduced for visitors and officials who may not avail the facility on regular basis.

5.15 The workers employed by the Contractor shall be directly under the supervision, control and employment of the Contractor and they shall have no connection what-so-ever with NISER.

5.16 The Contractor shall ensure that either he/she himself/herself or his/ her representative is available for proper administration and supervision at the works to the entire satisfaction of the Institute.

5.17 The Contractor will bring his own tools, cookers, hot boxes, steam boxes, trolleys, equipment, utensils, plates, jugs etc., in sufficient quantity as needed to maintain the canteen/mess services in addition to what is provided for by NISER (Annex.-V).

5.18 The Contractor shall not use the premises for any other activity except for the purpose for which it has been provided for.

6.0 TERMS AND CONDITIONS: (GENERAL)

6.1 Please read the Terms & Conditions carefully before filling up the document.

Incomplete Tender Documents will be rejected. 6.2 Tenderer/Contractor should be a registered and licensed contractor. Copies of

appropriate documents/Certificates issued by appropriate authorities should be enclosed.

6.3 Before submitting the tender, details of documents to be attached may be

verified from the Check List given in the Tender Document 6.4 The Contractor/Tenderer must write the name & complete postal address of the

bidding firm on the reverse side of the Demand Draft(s). 6.5 All pages of the Tender Document must be signed by the authorized signatory

and sealed with the stamp of the bidding firm as token of having accepted all the Terms and Conditions of this Tender. Duly filled in tender form should be supported by “Letter of Transmittal” as at Annexure-I of the Tender Document.

6.6 NISER reserves the right to obtain feed back from the previous/present clients

of the Tenderer/Contractor and also depute its team(s) to inspect the site(s) at present contract(s) for on-the-spot first hand information regarding the quality of food and services provided by the Tenderer. Decision of NISER with regard to award of the contract will depend upon the feed back received by it from the previous/ and present clients and also from its team(s) deputed for the purpose. The decision of the Institute in this regard will be final and binding on all bidders.

6.7 Tender shall be submitted in NISER’s official tender form only. If submitted in

any other manner, the same shall be summarily rejected. No bidder shall be issued more than one Tender Form.

6.8 Tenders received without the prescribed Earnest Money Deposit (EMD) of

Rs.1,00,000/- (Rupees one lakh only) shall be summarily rejected. 6.9 The services to be rendered by the contractor must not be altered by the

contractor. 6.10 No paper shall be detached from the Tender Document. 6.11 The name and address of the contractor/bidder shall be clearly written in the

space provided for the purpose and no over-writing, correction; insertion shall be permitted in any part of the tender unless duly countersigned by the bidder.

The tender should be filled in and submitted strictly in accordance with the instructions contained herein, other wise the Tender is liable to be rejected.

6.12 The Financial bids submitted by the bidders should be valid for at least for

a minimum period of 90 Days from the date of opening of Technical Bids. 6.13 The Institute reserves the right to reject any or all the tenders without assigning

any reason. 6.14 The Institute reserves the right to change any condition of the tender before

opening of the Technical Bids. 6.15 The successful bidder will have to enter into an agreement with the Institute as

per draft agreement given in Annexure-II before taking charge of the Canteen/ Mess and commencement of the work.

6.16 Canvassing in any form will make the tender liable to rejection. 6.17 Incomplete bids, Conditional and Part bids are summarily be rejected.

7.0 ELIGIBILITY CONDITIONS/ GUIDELINES FOR EVALUATION OF TECHNICAL

BIDS: 7.1 The Contractor should be in catering business (excluding beverage & Snacks

services) for more than 5 years. A Certificate of Performance should be enclosed duly indicating the period of contract. The certificate should also indicate the compliance of statutory requirements.

7.2 Experience of having successfully run the canteen/mess services during the last

five years as per following: successfully run 3 similar catering services each having not less than

200 persons on its dining strength. successfully run 2 similar catering services each having not less than

300 persons on its dining strength. successfully run 1 similar catering service having not less than 500

persons on its dining strength. Similar nature of work means the running of the canteens/messes of educational institutions / organizations / companies of national repute.

7.3 The Tenderer/Contractor should have a minimum annual turnover of

Rs.30,00,000 each (Rupees thirty Lakhs only) per year, during the last five years, duly audited by Chartered Accountant. Certified copy of the same shall be attached with the technical bid.

7.4 The tenderer should have CST/VAT/TIN/PAN Registration.

7.5 Financial Solvency: The bidder should have a solvency of 30% of the cost of the work. A certificate to this effect may be enclosed from the banker.

7.6 Tender should be accompanied with an EMD of Rs.1,00,000/- (Rupees One

Lakh only), by way of A/c Payee Demand Draft drawn in favour of Finance Officer, NISER. EMD will not carry any interest and the same will be refunded to the unsuccessful tenderer within 30 days from the date of tender opening or finalisation of the tender whichever is later. Any tender without EMD in PART-A will summarily be rejected.

7.7 Only successful tenderer’s/contractor’s EMD will be retained as a part of

security deposit and is refundable after termination of the contract without any interest after deducting dues if any, to the Institute.

7.8 Tenders received without proper documents, including demand draft,

shall be summarily rejected. 7.9 The tender document is non-transferable.

7.11 GUIDELINES FOR SUBMISSION OF TENDER:

The tender should be submitted under “Two Cover System”, the first cover is termed as Part ‘A’ with Tender documents, profile of the tenderer/contractor, EMD of Rs.1,00,000/- (Rupees One Lakh only) with superscription on the cover as “TENDER FOR PROVIDING CANTEEN/ MESS SERVICES FOR EMPLOYEES AND STUDENTS OF NISER” PART ‘A’. The second cover is termed as Part ‘B’, sealed with ““FINANCIAL/COMMERCIAL BID FOR PROVIDING CATERING/MESS SERVICES FOR EMPLOYEES AND STUDENTS OF NISER” PART ‘B’. 7.12 Quoted price should be inclusive of all taxes and duties. Rate of tax/duty

should be indicated separately.

7.12 NISER, reserves the right to reject any or all the tenders, wholly or partly without assigning any reason thereof. In all matters pertaining to this tender, the decision of the Director, NISER, shall be final and binding.

7.13 All tenders and covers should bear the name and address of the tenderer and all

the pages of the tender document must bear the seal and signature of the tenderer/contractor.

7.14 Request for any extension of the deadline for submission of the tender shall not

be entertained. Delayed and/or incomplete tenders shall not be considered.

7.15 The Tenders will be opened at 3.30 PM on at the NISER Estate Management Section, BHUBANESWAR. Representatives of the tenderers/contractors may attend the same. However, the exact date, time and place of opening of the same shall be intimated later.

7.16 On the above date, only Part-A of the tender will be opened. Tenders will be

short-listed based on the information provided in Part-A. 7.17 Where counter terms and conditions, printed or cyclostyled conditions have

been offered by the Contractor, the same shall not be accepted by the Institute. 7.18 If the Contractor fails to carry out the Jobs as per the terms and conditions

agreed upon, he is liable for forfeiture of EMD/Security Deposit in additions to penalty.

7.19 The Contractor shall be solely responsible either for any injury, damage,

accident to the workman employed by the agency or for any loss or damage to the equipment/property in the areas of work as a result of negligence/carelessness of its workers.

7.20 No accommodation will be provided in the campus for the workers and the

Contractor shall make their own arrangements. 7.21 The Institute reserves the right to terminate the contract by giving 3 months

notice, if the performance is not satisfactory. The Contractor can also terminate the contract by giving 3 months notice and clearing all the dues to the Institute, if he is not willing to continue the contract.

7.22 All the documentation in the tender should be in English.

7.23 Successful Tenderer/ Contractor shall execute an agreement on a prescribed format.

-------------------------- 8.0 Evaluation of Financial Bids: 8.1 The Financial Bids of only technically acceptable tenders will be opened for

further consideration. The decision of the Institute in this regard will be final and no requests etc. will be entertained from the bidders.

8.3 Financial Bid shall not be the sole criteria for award of contract. Any Feed

back received from the previous/present clients and data collected/gathered by the Institute shall also form the basis of selection. During evaluation of the financial bid, the Institute is at liberty to decide a suitable combination/blend of various food items (including the price quoted by individual contractors for individual items) which are to be served during breakfast/ lunch/ dinner depending upon the need and demand.

9.0 SKILL REQUIREMENT AND JOB DESCRIPTION OF VARIOUS

STAFF IN Canteen/Mess 9.1 MANAGER/CLERK/ACCOUNTANT:

Should be well qualified, preferably a Graduate and have the work experience of around 5 years in a reputed hotel or large catering establishment or in an education institute’s Canteen/Mess in similar capacity. Should be well versed with the environment and working culture of large canteens and students mess. Should have the basic knowledge of English and should be able to speak & understand oriya/hindi language. Should have the basic knowledge to interpret/understand and follow the official instructions.

9.2 COOK:

Skills: Should have worked for at least 5 years in a reputed hotel or large catering

establishment.

Should be specialized in all Indian dishes, both vegetarian and non-vegetarian dishes.

Job Description:

Should be able to take charge of the kitchen as a Head Cook and direct other Cooks in preparation of the menu desired.

Should be able to maintain hygienic, cleanliness and safety requirements.

Should be able to indent sufficient quantity of provision and other material for preparing the day’s menu and collect it from store keeper.

Should be able to guide assist cook and other kitchen staff in using the various

kitchen equipments, which are available in the kitchen.

Should be responsible for the safe custody of raw items and prepared food items during his duty timings.

9.3 KITCHEN STAFF:

Skills:

Should have worked at least 2 years in large kitchens.

Should have knowledge of the methods and practice of large-scale food preparation.

Should have knowledge of basic kitchen sanitation methods.

Should have knowledge in use, operation and maintenance of kitchen equipment. Ability to operate kitchen equipment. Ability to perform works requiring considerable standing and light - medium physical effort, under hot working conditions. Job Description:

Should be able to Wash/peel and/or cuts various ingredients to prepare for cooking or serving and inspects cooking equipments, kitchen equipments and work areas in order to ensure cleanliness and functional operations.

Should assist cook and prepare rice, sambar, rasam, vegetable curry, chapatti, puries and other dishes etc. in Students’ canteen/Mess Kitchen.

Job Description:

Should fill the Serving Counter with freshly prepared food, keep drinking water, rasam, buttermilk on each table and they have to bring freshly prepared chapattis, poories, dosa, idlies etc., from Kitchen to the Serving Table Counters.

Should help in preparing fruit salads, fruit juice, buttermilk, bread roast, whenever they are in day’s menu.

Should do any other duties assigned to them from time to time in Dining hall. 9.5 WASHERS: Job Description:

Washers have to wash with soap solution, hot water, all Plates, Spoons, SS Water Glass etc., after every meal.

Washers have to clean the dining tables and dining hall before every meal and also after every meal with water soap solutions.

Washers have to use perfume disinfectant while swabbing the dining hall after thorough washing.

Washers have to clear the trolley for washing purposes and bring back the trolley after cleaning to the dining hall.

Washers have to clean the dining tables soon after the boarder vacates the dining table after every meal.

Washers should keep the dining hall very clean and tidy at all times.

Washers have to do any other assigned duties from time to time.

9.6 GENERAL CLEANING STAFF: Job Description:

Should have to wash big vessels, after cooking. They have to clean the kitchen after preparing the food, free from oil, soot etc., with water and soap solution.

Should have to clean the exhaust system filters, burner stoves, Dosa Thava, atta kneader, wet grinder and other kitchen equipments after use.

Should Clean the Dining Hall, Kitchen and surrounding area.

Should perform any other duties assigned to them from time to time.

9.7 STORE KEEPER/HELPER: Job Description:

Store helper will get the key of the respective canteens/mess from the Security man at 6.00 a.m. and open the canteen/ Mess before 6.15 a.m.

Store helper will help the Store Keeper in getting the provisions, arranging, weighing and issue to the Head Cook.

Store helper will help the Store Keeper in keeping the store spick and span.

Store helper will help in the Kitchen or dining hall depending upon the requirements, after the duty in the Stores.

Store helper will switch off all the lights and close all the doors before locking the

canteen/mess.

Second shift helper will do the same duties and after locking the canteen/mess at 9.45 p.m. will handover the keys before 10.00 p.m. to the Security.

Store helper should do any other duty assigned from time to time. 9.8 SUPERVISOR: Skills:

Should have worked in a reputed hotel or large catering establishment for atleast five years.

Should have knowledge of cooking and serving for large number. Job Description:

The Supervisor is responsible for the attendance, deployment, work and conduct of the contract employees.

The Supervisor will make arrangements for substitutes, in case any Contract Staff is absent.

The Supervisor will also provide extra manpower, if required, at a short notice.

The details provided in Sl. No.9 are indicative in nature. 10.0 TERMS AND CONDITIONS AS PART OF AGREEMENT: 10.1 Dispute Resolution: All disputes that may arise shall be referred to the

Director, National Institute of Science Education and Research, Bhubaneswar whose decision shall be final. However, in case of persistence of the dispute the same could be resolved through arbitration to be appointed by NISER and the decision of the arbitrator is binding on both the parties. In case of any legal disputes, the same shall be subject to Bhubaneswar jurisdiction only.

10.2 Insurance to Employees: All employees engaged by the contractor shall be

comprehensively insured for accidents and injuries by the contractor at his cost.

10.3 There will be a periodical evaluation of the work done by Contractor from time

to time, and he will be informed about the same.

10.4 Payment Terms: The payment will be made on monthly basis on satisfactory completion of job contract services and related miscellaneous works mentioned in Scope of Work and Job Specifications. The bill should be collected from Individual students directly either on daily or monthly basis, to be decided between the Mess Management Committee and the contractor. The institute in no way shall be responsible for recovery of dues from the students/ consumers on behalf of the contractor.

In the event there is any query, objection, delay or dispute with regard to any

bill or a part thereof, the Contractor shall not be entitled to any interest to be paid by the Institute for late payment, the same shall be settled in consultation with the Warden/Mess Management Committee.

All payments and receipts would be rounded off, i.e., paise 50 or above will be

rounded off to the nearest higher rupee and paise less than 50 shall be ignored.

10.5 Security Deposit: The successful bidder will be required to submit with NISER Demand Draft/Pay Order/Fixed Deposit Receipt (in original) made in favour of Finance Officer, National Institute of Science Education and Research for a sum of Rs.3,00,000/- (Rupees Three lakh only) as Deposit on account of Performance Security. Security deposit shall be released on

successful completion of the contract period. This amount is on and above the EMD deposited by the contractor, however, the contractor may make a request to the institute for adjustment of his EMD against the Security Deposit. If the Contract is terminated by the Contractor without giving stipulated period of notice or fails to observe the terms & conditions of the Tender, Letter of Award for the Contract and the agreement signed by the Contractor with the Institute, the Security Deposit will be forfeited without prejudice to the Institute’s right to proceed against the contractor for any additional damages that the Institute suffers as a result of the breach of the aforesaid terms and conditions.

If the contractor fails to carry out the entrusted Services and related miscellaneous works within the stipulated time and as per the Scope of work and Job Specification, NISER reserves the right to impose liquidated damage/ penalty as specified in the liquidated damage/ Penalty Clause and has the right to get the work done through some other agency at the cost and risk of the contractor. The security deposit furnished by the contractor will not carry any interest and will be refunded:

a) On completion of the Contract entrusted to the contractor satisfactorily. If the work is not satisfactory he is liable for forfeiture of SD amount deposited.

b) The Security Deposit made by the Contractor to be released only after producing the proof of compliance and Provident Fund Act, Minimum Wages Act, etc.

The books of accounts regarding attendance, acquaintance, wages paid, PF Accounts etc., are to be maintained properly and produced for inspection to the Institute, whenever asked for and the Institute can take penal action for non-compliance. The contractor shall provide the required number of efficient and reliable workers, in the respective categories for all shifts on all the days of week. The contractor shall be responsible for the discipline of his workers.

The normal working hours of the canteen/mess will be from 6.00 a.m. to 10.00 p.m. However, the Institute may call for special services beyond these hours on special occasions, without any additional payments.

10.6 On all matters pertaining to this work order, the decision of the Director

of the Institute shall be final and binding and also subject to the dispute resolution mechanism as specified in clause 10.1 above.

11.0 LIQUIDATED DAMAGE/ PENALTY CLAUSE

11.1 The Institute reserves the right to impose liquidated damage/ penalty (@ 5% of the total monthly bill for each occasion/occurance of such event/ upto Rs.500/- per day, depending on the seriousness of the lapse on the part of the contractor, to be decided by the NISER authorities on case to case basis) on the Contractor for any serious lapse in maintaining the quality and the services willfully or otherwise by the Contractor or his staff or for any adulteration.

11.2 If the Institute is not satisfied with the quality of eatables served, services provided or behavior of the contractor or his/her employees, the Contractor will be served with 24-hour notice to improve or rectify the defect(s), failing which the NISER will be at liberty to take appropriate action as deemed fit.

11.3 Work not done satisfactorily would be recorded and rejected for payment.

Reasons for rejection would also be recorded.

11.4 The cost of execution of the work at the risk and cost as well as the penalty shall be recovered in the next bill that falls due and if the amount of recovery exceeds the bill amount, the same has to be made good within 15 days.

12.0 OTHER CONDITIONS:

12.1 Adequate number of manpower should be supplied so that the work is done in

specified time. Sufficient number of workers should be available to carry out the work at the Canteen/Mess.

12.2 All records shall be maintained by the Contractor as a part of record of day-to-

day work done, they shall be daily authenticated by the Mess Secretary designated for the work. They shall become the basic documents for preparation of bills on monthly basis. They shall be maintained in duplicate, one set with each of the supervisor of the Contractor and the Institute.

12.3 The works as specified in job specifications have to be carried out as per the

schedule and also within the stipulated time given. The contractor shall employ as much manpower as required (after approval) and utilize such quality and quantity of material as required for maintaining high standard of cleanliness within the stipulated time.

13.0 Termination of the Contract: 13.1 The Contract can be terminated by either party, i.e., NISER or the Contractor,

after giving three-month notice to the other party extendable by mutual agreement till alternate arrangements are made. However, NISER reserves the right to terminate the contract without giving any notice in case the Contractor commits breach of any of the terms of the contract. NISER’s decision in such a

situation shall be final and shall be accepted by the Contractor without any objection or resistance.

13.2 On termination of the contract, the Contractor will hand over all the

equipments/furniture/articles etc., supplied by NISER, in good working condition, as already stated in this document.

13.3 If the successful bidder withdraws or the services provided by the successful

bidder are not found satisfactory (say in a month or so) during the first year, NISER reserves the right to terminate the contract without giving any notice and initiate appropriate necessary action in the matter for making alternate arrangements.

14.0 FORFEITURE OF EMD

EMD of the successful bidder shall be liable to be forfeited if the contractor does not fulfill any of the following conditions:

Fails to furnish security deposit in the requisite form.

An agreement is not signed in the prescribed form within fifteen days of the receipt of the Letter of Award of the Contract;

The Contractor does not commence Canteen/ Mess services within seven days of the stipulated date for commencement of these services.

15.0 Jurisdiction:

15.1 Dispute, if any, arising out of the Contract, shall be settled by mutual discussion and the decision of the Director, NISER shall be final and binding, alternatively by arbitration failing which through legal recourse under jurisdiction of Bhubaneswar courts only, as specified in Clause 10.1.

AGREEMENT

This Agreement made this day the_____________between the National Institute of Science

Education and Research, Bhubaneswar – 751 005 (hereinafter called the Institute) of one part and

Shri/Mrs/Ms___________of M/s__________________of the other part (hereinafter called the

caterer) and whereas the Institute needs a caterer to run Two Canteens/ Mess for supply of tea,

coffee, cold drinks, juice, biscuits, snacks, high-tea, break-fast, lunch and dinner, etc. etc. mentioned

in the Tender Document invited by the Institute to the staff, students and guests of the Institute.

Whereas it is thought desirable to grant a Contract (not being a lease) to the caterer to prepare and

serve the aforesaid items to the Institute’s staff, students and guests in the Canteen/ Mess, office

complex and in the hostels/guest house (in special cases as and when required). The terms and

conditions mentioned hereinafter, it is hereby confirmed as having been agreed to between the

respective parties as under:

1. That the Caterer has been granted the contract to run two Canteen/Mess in the premises of

DOH-1 and SOH-1, of National Institute of Science Education and Research, Jatni Campus,

at Jatni, Khurda, initially for a period of two years w.e.f. …………………….on the terms &

conditions contained in the Tender Document (subject to the provisions contained at 3.2 and

other provisions mentioned elsewhere), Institute’s Letter of Award of the Contract and this

agreement read together. If during this period, the performance is found satisfactory, the

contract may be renewed for further specified period on the existing or mutually agreed to

terms & conditions. The contract is also terminable on three-month notice by either side.

2. That the items served by the Caterer shall be wholesome and hygienic prepared in the clean

atmosphere. The Director of the Institute and/or their authorized nominees may at any time

enter the kitchen area allotted to the caterer for the purpose of this contract and take away

samples of raw material, semi-prepared or fully prepared eatable items free of cost for the

purpose of inspection, trial or analysis, and the decision of the authorities of the Institute with

regard to the desirability or quality of the food articles offered for consumption shall be final.

If any item of the menu/provision of food is found defective or not fit for use/consumption,

the Institute’s authorities may - (i) issue warning; and / or (ii) get the said raw material/items

destroyed and ask the Caterer to purchase fresh stocks, without any payment of compensation

to the Contractor for the discarded material/items.

If, however, this problem recurs in spite of warning having been issued, the Institute reserves

the right to impose financial penalty as decided by the Institute’s authorities or the contract

may be cancelled without giving any notice.

3. The items of menu, which the Caterer would be expected to supply in the Canteen/ Mess, are

indicated in the Annex. The rates of items to be served by the Caterer shall be valid on

annual basis, i.e., from April to March every year and in-between revision shall NOT be

allowed. The Institute may, if considered necessary, revise the rates only after one year of the

contract in regard to the items of food/eatables and drinks. Till such time that the revised

rates become operative, the caterer shall charge the existing rates.

4. That the caterer shall use either OMFED Milk or any other reputed brand available locally. In

case he is unable to maintain supplies of OMFED milk for any reasons, he should arrange to

procure from other sources supplying good quality milk.

5. That the caterer shall not make any additions or alterations in the premises allotted to him for

providing Canteen/Mess services.

6. That the caterer has agreed to keep the premises and its surrounding area neat, clean and tidy

at all times and according to the Health/Hygienic conditions & bye-laws of the Bhubaneswar

Municipal Corporation/Food and Civil Supplies Department of Govt. of Orissa or any other

government/statutory body. In the event of violation of any of the aforesaid bye-laws in and

around the Kitchen/cooking area or dining hall, the caterer shall be responsible for any

penalty/fine imposed by the concerned authorities.

7. That in the event of BMC, Health Department or any other government/statutory body

authorities taking samples of raw material used by the caterer and those samples are not

found fit/up to the mark for human consumption, the caterer shall be fully responsible for any

fine/penalty imposed or legal recourse taken by such authorities.

8. That the contractor has agreed to pay to the Institute electricity and water charges on the

basis of actual units consumed.

9. That the caterer has agreed to provide sufficient number of personnel as given in the Tender

Document, such as manager, clerk/accountant, cooks, waiters and other support staff in the

kitchen and dining hall and shall take all reasonable precautions to ensure that these workers

attire themselves properly while on duty and are civil, polite, sober and honest in their

dealings with the Institute’s staff, students, visitors and guests. He shall also employ only

those workers whose antecedents have been verified by the police and are medically fit

in all respects.

10. That any employee deployed by the Caterer in the premises becomes liable for suspension or

dismissal by the Institute due to his actions, disobedience or misconduct, the caterer shall

accept the decision of the Institute as final and abide by such decision. In such an event, the

Institute shall not in any way be liable for any claim made by the concerned employee of the

caterer for wages or damages and the caterer shall keep the Institute’s authorities

indemnified.

11. The Institute will have the right to review the working of this contract from time to time and

if at any time it is found that the caterer has failed to fulfill any of the conditions of this

contract or that his working is unsatisfactory, the Institute may terminate the contract after

giving the caterer three-month notice, but no such notice will be necessary if the contract is

terminated on the ground of service of any undesirable commodity.

12. That the caterer will not transfer or assign any part of his interest under this contract and that

this contract shall also be liable to be terminated by the death or insolvency of the caterer

before the expiry of the period of this contract.

13. That it is agreed between the parties that no interest whatsoever in the premises has been

assigned by the Institute to the contractor and the possession of the premises will always that

of the Institute, even when the premises are in use or occupation of the caterer.

14. The Institute shall provide to the caterer necessary equipments, furniture & fixtures, as per

attached Annexures and he shall maintain them in good condition. He shall be responsible for

their maintenance, safe custody and return of the same in good condition.

15. The caterer shall provide all other implements for running the Canteen/Mess like crockery,

cutlery, table linen, flower posts, livery or the Canteen/ Mess Staff and these shall be of good

quality and of high standard. However, the items provided by NISER shall also be used.

16. The caterer shall be required to procure gas refills in sufficient quantity for cooking purposes

at his cost. The cooking equipments shall be provided in working condition by the Institute.

However, subsequently operational expenses will be borne by the caterer himself. The caterer

shall be responsible for any loss/theft of the equipment provided to him by the Institute.

17. The caterer shall also be responsible for the upkeep of equipments provided by the Institute.

In case of any damage to the furniture and equipments (list attached) by any person, he will

immediately inform in writing the concerned for recovery of such losses/damages from the

defaulters, failing which the caterer shall himself be liable to pay the cost as decided by the

Institute.

18. All the equipments, furniture/fixtures, including gas and electrical installation of the

Canteen/Mess kitchen/dining hall shall be given to Contractor in good working condition.

These shall be used carefully & cautiously by his employees. The repairs if any of the gas

and electrical appliances will have to be got done by the Contractor at his own cost.

19. That the Caterer shall maintain a Complaint/Suggestion Book for recording suggestions for

improvement of Canteen/ Mess Services. Such suggestions, as approved by the Institute’s

authorities, shall be forthwith acted upon. The suggestion book shall be kept open for

inspection by the Institute’s designated authorities.
