Try AASP-MN!

I hope everyone has had a busy summer with their busi-

ness. Things have really picked up here in my shop. August

was a little slow, but I attributed that to customers taking their

last summer vacations and the Minnesota State Fair. I should

know, as all three of my employees have taken a full week of

time off between the last week in July and the first week in

September.

Right now I am in the final planning stages of celebrating

40 years of family ownership, with an Open House in early

October. In 1974, my father and his partner formed a corpora-

tion. My father bought out his partner in 1984 and I took over

the business in 1998. We have been fortunate to stay in busi-

ness for the last 40 years. But we couldn’t have done it without

the dedication, hard work, great employees and, most impor-

tantly, the long-time customers that have supported us over the

years.

I have always believed that taking care of your customers

by being honest and charging a fair price is what keeps them

coming back. We are now working on the cars of a lot of our

original customers’ grandchildren. Of course, we always have

to attract new customers as well. This is where AASP-MN

comes in. I have learned many things from other shop owners

by attending the convention, training seminars and even the

golf outing. I usually will pick up some type of an idea. So if

you are looking for an idea, please consider attending an event

that the AASP-MN is hosting. Talk to other shop owners and

you will be surprised how many of us are having the same is-

sues.

LEGISLATIVE UPDATE

Representatives of AASP-MN and theInsurance Federation of Minnesota met inearly September to discuss each organiza-tion’s priorities for the 2015 LegislativeSession. These meetings have been held ona regular basis for many years. Typically,the two organizations’ interests differ at theCapitol – but Legislative leaders expect theorganizations to communicate with one an-other to try to address differences beforeproposals are debated at the Capitol.

One of the AASP-MN priorities thatwas discussed is proposed legislation to pro-hibit insurers from requiring that an insuredhave their automobile inspected at a partic-ular motor vehicle repair shop designatedby the insurer.

The bill also would prohibit insurersfrom specifying or requiring that a repair

shop use a specific vendor, distributor, man-ufacturer, supplier, business platform or in-ternal process in order to carry out vehiclerepairs for an insured. The AASP-MN pro-posal would also prohibit insurers frommandating that repair shops comply withthird party pricing agreements negotiated byan insurer with manufacturers, distributorsor suppliers.

Insurance officials expressed concernthat some language in the AASP-MN pro-posal was overly broad and created prob-lems with interpretation. The AASP-MNproposal will be refined in the comingweeks through our Committee process inorder to make our objectives clear.

The Insurance Federation identifiedauto glass costs as a significant legislativepriority for 2015. Their data indicates that

Minnesota is the second highest state in thecountry for auto glass costs. Based on theconversation between members of the As-sociations, it is not collision repair shopsthat are driving auto glass costs.

The Insurance Federation will have alegislative proposal this year that addressesthe “batching” of auto glass claims for pur-poses of arbitration. AASP-MN will watchthis legislation closely – although it mightnot ultimately be a major concern for theAssociation.

The parties agreed to share informationin advance of the Session. While we don’texpect the Insurance Federation to embraceour proposals, it is better to know the objec-tions they will raise and the arguments theywill make before we bring our proposalsforward in the legislative process.

There’s Help on the Way for Hiring the Right PeopleA challenge for all mechanical and collision repair shops is to

recruit and hire employees who not only have the skills needed forthe job, but who will also be a good fit with the culture and workenvironment of the shop. Many AASP-MN members have foundvaluable help in this process by utilizing employee assessment toolsto not only screen job applicants, but also to improve performancein current employees. AASP-MN would like to expand and buildon those success stories by offering its members the opportunity toprovide information that will benchmark the traits and behaviorsof high-performing employees and then utilize that information toimprove their own hiring and performance evaluation processes.

• The Association is partnering with Assessment Associates International (AAI) to conduct a study that will help AASP-MN members identify job applicants that are likely to be long-tenured employees, provide high-quality work, and contribute to the shop’s bottom line.

• The study data will be used to develop an Internet-based, pre-employment screening tool that will help member businesses identify the right people to hire.

• The jobs being studied are: Service advisors, estimators, mechanical techs, body techs and painters.

• Data collection will start on October 1 and conclude on November 15, 2014.

Landmark Minnesota Supreme Court Decision May Mean More Workers’

Compensation Retaliation Claims Against EmployersOn August 27, 2014, the Minnesota Supreme Court held that

employees are entitled to jury trials in cases alleging they were re-taliated against by their employers for seeking workers’ compen-sation benefits, and where they were seeking only money damages.Although workers’ compensation claims themselves are not eligibleto be tried by a jury, the court held that workers’ compensation re-taliation claims are similar to other types of retaliatory dischargeclaims, and thus are similarly entitled to determination by a jury.

This decision closely follows a recent amendment to the Min-nesota Human Rights Act, allowing for jury trials of state law dis-crimination and retaliation claims. This trend toward providing jurytrials for more types of employment cases generally favors plain-tiffs, who may be able to evoke sympathy from jury members moreeasily than from more seasoned, potentially dispassionate judges.More importantly, as plaintiff lawyers find these claims more lu-crative, employers can expect more “wrongful discharge” claimsby employees alleging they were terminated in an attempt by theiremployer to avoid workers’ compensation claims or liability.

2014 Is Record-Setting Year for Industry-Sponsored Scholarships

The Class of 2014 set a new record in the scholarships awardedthrough the Global Automotive Aftermarket Symposium (GAAS)scholarships, University of the Aftermarket (UAF) scholarships andcollaborating organizations at the automotivescholarships.comwebsite: 295 awards for a total of $320,050. The previous recordset in 2013 was 250 awards for $264,050. This year’s recipients in-clude 241 US students and seven Canadian students.

AASP-MN’s scholarship program has been linked to theGAAS platform since 2012. By completing a single application atthe automotivescholarships.com website, students can be consid-ered for multiple scholarships. A total of 34 of the 2014 GAASscholarship recipients received two awards, and five recipients re-ceived three awards.

In fact, Minnesota has the distinction of one of its students re-ceiving a total of four awards and also marking a first in the historyof the GAAS scholarship program: The first-ever father and sonscholarship winners. Matthew Bisbee, a US Army veteran, is thefour-award winner, including $1,000 from AASP-MN for his fall2014 tuition. He is currently enrolled in the collision training pro-gram at Lake Superior College in Duluth. Bisbee’s son, Courtney,also an AASP-MN scholarship winner, is enrolled in the automotiveservice technology program at Lake Superior College.

This year, AASP-MN awarded $15,000 in scholarships to helpMinnesota post-secondary automotive students pay for tuition dur-ing the 2014-15 school year. The scholarships are in the amount of$1,000 per student and were made possible by a successfulfundraising drive within the AASP-MN membership, as well as agenerous donation from the Minnesota State I-CAR Committee.

The DEG (www.degweb.org) is an initiative that was devel-oped to help address collision repair estimates data, through proac-tive feedback from the collision repair industry to the informationproviders (IPs) that supply the databases for the various estimatingproducts. The DEG was created - and is equally funded and main-tained - by the Alliance of Automotive Service Providers (AASP),the Society of Collision Repair Specialists (SCRS) and AutomotiveService Association (ASA). It is a perfect example of how these or-ganizations put membership dollars to work to address real issuesin the industry. The DEG has processed more than 7,000 inquiriesfrom the industry, many of which have resulted in changes to theestimating system database, or necessary explanations of how theywork.

The process is simple: The shop submits the inquiry to theDEG and the administrator works with representatives from the IPsto bring the inquiry to resolution. Here are some great recent ex-amples of responsive results from DEG submissions:#7112 - 2004 VW Beetle Left Door Skin: After review, the

estimated work time applied to the Outer Panel has been adjustedto 6.5 hours from 4.5 hours.

#6939 - 2013 VW Beetle Roof Panel: The PANEL, ROOFTRIM (GN 0358,359) labor time has changed from 0.3 hours to5.9 hours. The text NON-REUSABLE has been added to the

PANEL, ROOF TRIM (GN 0358,359). The HEADLINER, ROOFR&I (GN 0348) is not required per the current service procedures.The illustration for the part has been updated to more accuratelyreflect the physical part appearance. All times are before optionconditioning or overlap considerations.

1. EPL covers both actual and ALLEGED acts of discrimination, harassment, retaliation, wrongful termination and other similar employment practices violations.

2. Three out of five employers are sued by former employees every year.

3. Over 40 percent of EPL claims areagainst firms with fewer than 100 employees.

4. Some Federal and State employmentlaws apply to all employers regardless of employee count - any size companyhas exposure!

5. The Equal Employment OpportunityCommission (EEOC) recorded nearly 93,000 charges in 2013 and obtained more than $365 million in administrative settlements forclaimants.

6. The financial ramifications of not having EPL insurance can be crippling, especially for small firms because they do not have the operatingbudgets to handle the defense costs, let alone settlements or judgments, of an uninsured claim.

7. The median cost of an EEOC lawsuit in 2011 exceeded $250,000.

8. There is no EPL coverage under otherinsurance policies such as General Liability (GL). Any endorsement to another policy generally provides insufficient limits, does not provide the breadth of coverage of a separateEPL policy and erodes the limit available for the GL exposure.

9. Based on recent data gathered by the Federal Judicial Center (a federaland research agency for the US courts),

an increase of 10 percent in the 2013 statistic was seen. The agency reported that there were only 7,064 wage and hour complaints in 2012, while in 2013, that number jumped to 7,764.

10. Recent Supreme Court decisions have lowered the standard of what constitutes retaliatory treatment. Retaliation has become the #1 most frequently cited form of discrimination, beating out race discrimination. Monetary benefits totaled just under $170 million. However, this number does not include monetary benefits obtained through litigation.

Do body techs have to wear respira-tors? Do detailers? Does everyone whowalks through the shop? (One sales repre-sentative claimed that was the case. It’snot.)

Who must wear a respirator is based,first, on exposures – both what is in the airand how much is in the air. That will varyfrom shop to shop, but because nearly allshops have similar operations, we can makesome educated guesses. We’re helped in thisby research done by NIOSH (the NationalInstitute of Occupational Safety and Health)and others, who have measured exposuresin a number of shops.

From that research, we know peoplewho paint or prime need to wear respiratoryprotection. When they spray, they canbreathe in the paint mists and vapors, evenif the booth is well-ventilated. The levelsof individual solvents, such as xylene, areoften below exposure limits. But paints andprimers may contain a number of solventswith similar health effects. When those lev-els are added together, they can be highenough to require respirator use. Of evenmore concern: The isocyanates in the clearcoat, which can cause asthma.

Sanding creates a lot of dust. If thepaint is old, that dust may contain lead orchromium, which can cause serious long-term harm. We don’t see those metals usedin paints today. If people are sanding offbody filler, the dust will be mainly poly-styrene, polyester and talc – substances thatdon’t have specific toxic effects. Measure-ments of dust levels have shown brief ex-posures to high levels, but levels averagedover the full workday have been below legaland recommended exposure limits. Basedon that, we recommend respiratory protec-tion against dust, but we can’t say it’smandatory.

Most of detailers’ work isn’t dusty anddoesn’t involve solvents. About the onlytask detailers might do that causes respira-tory problems is spraying wheel brightener.Some of these products contain hydrofluo-ric acid, a very corrosive substance. (Youcan check the label or Safety Data Sheet forchemical contents and precautions.) Lungprotection against that would be an acid gasrespirator with a particulate pre-filter. But a

much better option is to change products toone less likely to cause severe eye and skinburns.

So if we advise that respirator use whensanding is recommended but not mandatory,what does that mean for you? Your options:You can require anyone sanding to wear arespirator. You can tell employees that res-pirator use is not mandatory, but you’ll pro-vide respirators for those who choose towear them. You can provide dust capturesystems (the best option), so dust levels stayrelatively low.

Keep in mind that the two-strap papertype of mask, also called an N95 filteringface piece, is a respirator. If you require use of a respirator (dustmask or cartridge type), employees need an-nual training and fit testing. They must beclean-shaven wherever the respirator sealsto the face. They need medical approval, toensure wearing the respirator won’t causetoo much stress on their heart and lungs.And you need a written program specifyinghow respirators are to be taken care of.

The cost: Roughly $30 perperson, if no additional evaluation is needed.

A quick summary: Anyone who uses any typeof respirator (the paper-type dust mask, a cartridgerespirator or even an air-supplying respirator) needsto have had medical approval to wear it.
