Compliance with Statutory Requirements in respect of the

Supplementary Orders and the Section 19 Notice

1.0 Introduction 1.1 This note confirms that there has been compliance with the relevant requirements in

respect of the making, advertising and notification of inquiry concerning the Devon County Council A380 South Devon Link Road (Kingskerswell Bypass) Supplementary Compulsory Purchase Order 2009, made on 6th July 2009 (CD 6.1) and The Devon County Council (A380 South Devon Link Road (Kingskerswell Bypass) Classified Road) (No. 2 Side Roads) Order 2009 (CD 6.2).

1.2 This note also confirms compliance in respect of the relevant requirements concerning the section 19 notice.

SUPPLEMENTARY ORDERS

2.0 Certificates in Support of Supplementary Order Publication 2.1 A copy of the General Certificate in Support of Order Submission for The Devon

County Council A380 South Devon Link Road (Kingskerswell Bypass) Supplementary Compulsory Purchase Order 2009 is shown at Annex 1.

2.2 A copy of the General Certificate in Support of Order Submission for The Devon County Council (A380 South Devon Link Road (Kingskerswell Bypass) Classified Road) (No. 2 Side Roads) Order 2009 is shown at Annex 2.

2.3 The period for objection to the Supplementary Orders expired on 1st September 2009.

3.0 Newspaper Notices 3.1 The Supplementary CPO Notices were published in the Herald Express and the Mid

Devon Advertiser. The No. 2 SRO Notices were published in the London Gazette, the Herald Express and the Mid Devon Advertiser.

4.0 Notification of Inquiry 4.1 Notification of the Inquiries was issued by the Secretary of State on 4th September

2009. The relevant Notices as shown at Annex 3 were posted on site on the 11th September 2009 and also published in the Herald Express and the Mid Devon Advertiser on 25th September 2009. Notices were also displayed at Torbay Council's offices, Kingskerswell Library, Newton Abbot Library, Newton Abbot Town Council offices, Kingskerswell Parish Council's notice board, Teignbridge District Council's offices and Devon County Council's Area South Highway Management office.

5.0 Statement of Case 5.1 The Statement of Case on the Supplementary Orders was issued to the Department

for Transport and all statutory objectors on the 14th September 2009. All non-statutory objectors were also served with the Statement of Case, notwithstanding the absence of any requirement to do so.

6.0 Proofs of Evidence 6.1 DCC’s Proof of Evidence (DCC/P/12) was dispatched to all objectors to the

Supplementary Orders on 5th October 2009.

7.0 Rebuttals 7.1 DCC’s Rebuttals to the seven objectors’ Proofs of Evidence were provided to the

relevant objectors on 21st October 2009.

SECTION 19 CERTIFICATE

8.0 Notices 8.1 The Secretary of State issued the Notice of Intention to issue a certificate under

section 19(1)(a) of the Acquisition of Land Act 1981 on 11th September 2009 (Appendix 1 DCC/P/13). The period of objection to the notice expired on 5th October 2009. The notice of intention was published in the Herald Express and Mid Devon Advertiser and displayed on site and at the locations referred to in 4.1 above.

8.2 The Secretary of State issued a Notice of Inquiry on the 15th September 2009, subject to representations being received (Appendix 3 DCC/P/13). This was published in the Herald Express and Mid Devon Advertiser and displayed on site and at the locations referred to in 4.1 above.

8.3 Confirmation of Notice of Inquiry was issued by the Planning Inspectorate on 6th and 7th October 2009 by letter to each representor (example provided in Annex 4).

9.0 Proof of Evidence 9.1 DCC provided its proof of evidence (DCC/P/13) to all representors on 21st October

2009.
