Q. I recently attended an eviction hearing because my tenant did mot pay rent. The judge

told e that he could not hear my case because I had not served a notice to vacate and he dis-missed my complaint. I know that we properly served a default notice and even had a copy with me at the hearing. I am thinking of appealing. What are your thoughts?

A. First, if your complaint was dismissed, that is no judgement was entered for or

against you, you may not be able to appeal. An appeal is proper when you are unhap-py with the judgement that the court entered. If there is no judgement, the Court of Common Pleas, to whom the appeal is filed, may not accept the appeal. In this case, your only recourse would be to serve the notice to quit and re-file at the Magisterial District Court. Second, it appears that you may be confusing a default notice with a notice to quit. They are very different things, serve two entirely different purposes, and may both be required in order to give the judge the ability to hear an eviction case. A default notice serves to notify your tenant that he is in default because, in your case, he has not paid rent. Whether you need to serve a default notice, and how it is served, depends on the language in your lease. Some leases DO NOT require a default notice. For example, a lease might specifically say not notice is required, or the lease may be silent on a default notice. In either case, you would not be required to serve a default notice. In other cases, the lease may be required a default notice, and may even provide the tenant a period of time to “cure” his default. In this case, a default notice would be required. By contrast, a notice to quit serves to notify a tenant that, because of a default or the end of the lease term, he must vacate the property. Absent the serving of a notice to quit, the Magis-terial District Court does not have the jurisdiction to hear an eviction case. Importantly, notices to quit must be in a certain format, be served a certain number of days before you file an eviction complaint, and be served in a certain manner. First, a notice to quit cannot be conditional and cannot invite the tenant to settle the dispute. It must simply instruct the tenant to vacate. For example, a notice to quit that says “if you don’t pay your rent within ten days, you must vacate” or “If you don’t contact us to resolve this dispute, you must va-cate” would be improper. Second, the notice to quit must be served before you file the evic-tion complaint according to the following timeframes: 5 days in the case of drugs on the prop-erty, 10 days in the case of non-payment of rent, 15 days in the case of a breach other than nonpayment when the lease is less than or equal to one year, and 30 days I the case of a breach other than nonpayment when the lease is greater than one year. Third, the service of the notice to quit must be accomplished in one of the following ways: (1) personally handing it to the tenant, (2) posting it conspicuously on the apartment (such as on the front door), (3) posting it somewhere else on the property where the tenant is certain to see it )although I do no recom-mend this manner of service). Curiously, service by certified mail is not proper. Having said all of this, the tenant can waive the notice to quit. In other words, you can avoid having to give the notice to quit if the lease clearly and conspicuously says that you do not have to serve one. In this case, you can simply show the judge the waiver in the lease, and you should be ok. In summary, default notice and notices to quit are two different animals, both of which may be required (or not), depending on the language of the lease. Once you determine in your case what is required, I suggest that you start over, serve the required notice(s) and re-file the evic-tion complaint.

PAA West began discussion with our sister affiliates, PAA Central and PAA East in 2018 to discuss the

possibility of unifying our three separate associations into one large state association creating a better

experience for our members in terms of advocacy, education and networking events. We are happy to

announce that all three affiliate boards have approved the merger with governance structure between

the three associations.

UPDATE: We are pleased to announce that PAA Central, East, and West Boards have approved the new governance structure for a unified PAA. There is much work to be done before December 31st to bring unification to a reality. Over the next few months we will be hosting town hall webinars where we will share the new structure and welcome input and feedback from our members. We appreciate the support and encouragement we have received from our members thus far but are mindful that some may still have reservations and questions. We want this process to be open and transparent. Please reach out to your regional staff and leadership to discuss any issues or questions. Vision 2020 – A Unified PAA – We Can See the Future

Original Announcement: On January 14, representatives from each regional affiliate (PAA West, Central and East) came together in Camp Hill to agree on a framework for the governance of a unified PAA. Our goal was to assure that the members needs and concerns from all three regions was represented and respected. If you start with the premise that creating a statewide association would benefit our members and industry, then the path to success is much straighter. Unification recognizes the uniqueness of the three regions joining together so that large scale strategic goals can be set while localized needs are met. We are creating something new, something better, maybe even something we have not envisioned. We will respect and understand our history while not letting it tie us to prior traditions and processes. In the next few weeks we will share the proposed governance structure for a unified state association as well as the timeline to achieve this goal. Through-out the year, we welcome your feedback and encourage dialog to assure we are creating the best association for our members. Vision 2020 – A Unified PAA – We Can See the Future
