In January 1967, at the opening session of the 90th Congress, the Houseleadership told Harlem representative Adam Clayton Powell that he would notparticipate when the other newly elected members took their oath of office. TheHouse refused to seat Powell pending an investigation of his conduct, includingpossible misuse of public funds. In February, the Select Committee assigned to thecase recommended to the full House that Powell be seated but censured for hisconduct. The House, however, rejected the Select Committee’s recommendation. Itvoted to exclude Powell and declared his seat vacant. Soon after, Powell andthirteen voters from New York’s eighteenth congressional district sued Speaker ofthe House John W. McCormack and other House members and officers. Theplaintiffs argued that McCormack and his co-defendants had violated the Constitutionbecause Powell met all the qualifications for House office and had been chosen bythe voters as their representative. The Supreme Court ruled in Powell’s favor inDecember 1969.
In December 1970, a German court convicted army Privates Nathaniel HolmesJr. and Bernard Tucker for the rape of a sixteen-year-old woman. Two months later,the court sentenced them to three years in jail. While the case was on appeal, theU.S. Army Eighth Infantry Division took custody of Holmes and Tucker. The twomen, however, escaped to the United States. In early June 1971, they sought theassistance of New York congresswoman Shirley Chisholm. On June 8, Holmes andTucker, accompanied by Chisholm, turned themselves in to army officials at thePentagon building in Arlington, Virginia. The army told Chisholm that it wouldinvestigate the case before taking any further actions but also placed Holmes andTucker in the confinement facility at Fort Belvoir, Virginia. On June 10, 1971, CaptainJ. Clay Smith, the army lawyer assigned to the case, informed RepresentativeChisholm that the military planned to put Holmes and Tucker on a 5 a.m. flight thenext day back to Germany. Chisholm contacted NAACP lawyers who immediatelybrought the case to U.S. District Court Judge Barrington Parker. Parker issued atemporary restraining order preventing military officials from returning the accusedmen to Germany. For the next year and a half, the case stayed in U.S. courts whileHolmes and Tucker remained confined at Fort Belvoir. In March 1972, Chisholm andthirty fellow Congress members, including presidential candidate Hubert H.Humphrey, sent a letter to army secretary Robert Froehlke appealing for action in thecase. The New York Post reported that the military was procrastinating because itwas “worried about the political repercussions in Germany” (Reel 6, Frame 0700).

Finally, in February 1973, the army sent Holmes and Tucker back to Germany wherethey were imprisoned until October 8, 1973. On October 9, the army dishonorablydischarged Holmes and Tucker.
The cases of Adam Clayton Powell and of Nathaniel Holmes and BernardTucker are just two of the many interesting cases reproduced in this edition ofPapers of the NAACP, Supplement to Part 23: Legal Department Case Files, 1960–1973, Series B: The Northeast, Section I: Connecticut, Delaware, District ofColumbia, Maine, Massachusetts, New Hampshire, New Jersey, Pennsylvania, andRhode Island. The documents in this section consist of the working case files of theNAACP’s general counsel and legal department staff for Connecticut, Delaware, theDistrict of Columbia, Maine, Massachusetts, New Hampshire, New Jersey,Pennsylvania, and Rhode Island. The cases from these states primarily relate toemployment discrimination and school desegregation. The cases are organizedalphabetically by state and within each state alphabetically by case name.
The NAACP had been concerned with employment discrimination since the1930s, but the cases in this edition are particularly interesting because they includeseveral early affirmative action cases. President John F. Kennedy first used the term“affirmative action” in Executive Order 10925, which created the Equal EmploymentOpportunity Commission. In September 1965, President Lyndon Baines Johnsonissued Executive Order 11246 requiring contractors to “take affirmative action toensure that applicants are employed, and that employees are treated duringemployment without regard to their race, creed, color or national origin” (Reel 24,Frame 0182). Over the next two years, the U.S. Department of Labor’s Office ofFederal Contract Compliance (OFCC) gradually worked out a system that requiredcontractors to meet certain numerical goals in hiring minority workers. In 1967 inCleveland, Ohio, the OFCC adopted minority hiring “goals” for all federal constructionin Cleveland. These goals became known as the Cleveland Plan. Later that sameyear, a similar plan was adopted in Philadelphia. The so-called Philadelphia Planrequired “meaningful minority group representation in all trades” and “adoptedmanning tables (specific goals)” as the method of ensuring that enough minorityworkers were hired (Reel 24, Frame 0176). In 1968, however, U.S. ComptrollerGeneral Elmer B. Staats ruled that the Philadelphia Plan “violated the principles ofcompetitive bidding” (Reel 24, Frame 0124). To combat Staats’s ruling, in June andagain in September 1969, Assistant Secretary of Labor Arthur A. Fletcher issued twoorders revising the Philadelphia Plan. These new orders set ranges for thepercentage of minority employment in various construction trades. In January 1970,the Contractors Association of Eastern Pennsylvania sued the secretary of labor,arguing that the revised Philadelphia Plan violated Title VI of the Civil Rights Act of1964. The contractors lost at the district court level and in the U.S. Court of Appeals,and the Supreme Court refused to hear the case. The files in this edition includebackground information collected by the NAACP, the decision by Judge WilliamHastie in the U.S. Court of Appeals for the Third Circuit, and the NAACP’s amicuscuriae brief supporting the Philadelphia Plan.

While the contractors case marked a victory for affirmative action programs,these programs were dealt a setback in two cases relating to employmentdiscrimination by the Philadelphia Police Department. In Commonwealth v. O’Neilland Commonwealth v. Rizzo, the commonwealth of Pennsylvania and twelveunsuccessful African American applicants for employment with the PhiladelphiaPolice Department challenged the written examination and a backgroundinvestigation that were part of the department’s hiring process. The plaintiffs arguedthat the written examination administered by the department discriminated againstAfrican Americans and was not related to job performance. Whites passed the examat twice the rate of African Americans. The plaintiffs also argued that the backgroundinvestigation considered “illegitimate factors,” such as “prior contacts with the policedepartment not leading to arrest or conviction,” juvenile records, and hearsayevidence to deny jobs to African American applicants. Further, the PhiladelphiaInquirer discovered that, between 1967 and 1970, former police commissioner FrankL. Rizzo had approved the hiring of twenty white applicants “deemed unfit byinvestigators” (Reel 23, Frame 0411). As a result of these practices, the proportion ofAfrican American police officers dropped from 25 percent in 1966 to under 20 percentin 1970, and the number of African American recruits accepted fell from 30 percent in1966 to less than 8 percent in 1970. District Court Judge John P. Fullam declaredthat the Philadelphia Police Department had to hire one African American for everytwo whites. On appeal, however, Fullam’s decision was reversed by the U.S. Courtof Appeals.
This edition includes several other employment discrimination cases fromPennsylvania, as well as cases from Connecticut, the District of Columbia,Delaware, New Jersey, and Rhode Island. The other Pennsylvania cases are Boldenv. Pennsylvania, Commonwealth v. Glickman, Commonwealth v. Sebastian, ErieHuman Relations Commission v. Tullio, Farmer v. Philadelphia Electric Co.,Goodman v. Lukens Steel Co., Jones v. United Gas Improvement Corp., NAACP v.Pennsylvania Public Utilities Commission, and Walton v. Eaton. The Connecticutcases are Bridgeport Guardians v. Members of the Bridgeport Civil ServiceCommission and Stallworth v. Park City Hospital, Inc. The Delaware employmentdiscrimination case is Stanton v. E. I. Du Pont de Nemours & Co. The cases fromthe District of Columbia are Harrison v. Butz and NAACP v. District of Columbia FireDepartment. Finally, Rhode Island cases are Delgado v. Veterans AdministrationHospital and Grace v. M. A. Gammino Construction Co.
School desegregation remained an important issue for the NAACP in the 1960sand 1970s. Three cases in this edition are noteworthy because each raised differentissues, illustrating the complexity of school desegregation. Blakely v. Bostonrepresented the first stage in a battle to desegregate Boston’s schools that lastedover fifteen years, a battle that, in the mid-1970s, made Boston a symbol of whiteresistance to school desegregation and busing programs. The Boston case began inthe early 1960s when African American parents, joined by the Boston NAACPbranch, organized demonstrations against inferior education for their children. In

August 1963, the Boston NAACP branch submitted a statement to the Boston SchoolCommittee that summarized their reasons for protesting. The statement referred tothe Supreme Court’s landmark decision in Brown v. Board of Education in which aunanimous court declared that “separate educational facilities are inherentlyunequal.” The Boston NAACP acknowledged that Brown applied to schoolsdeliberately segregated by law but argued:
This historic decision went further to describe in unmistakable languagehow harmful separation is to Negro children. Unfortunately in our societytoday, a man’s color determines his status. This attitude is reflected in theassociation made with Negro schools. Thus as the school becomespredominantly Negro, it is viewed as a lower status school. Therefore, it isimpossible … to discuss the educational problems pertaining to Negropupils in Boston without first attacking the source of these problems … defacto segregation (Reel 13, Frame 0200).
The Boston School Committee, however, was intransigent. Louise Day Hicks,who would be at the center of the school controversy for the next decade, “dared”the NAACP to sue. Hicks and fellow committee member Joseph Lee even used afavorite tactic of southern segregationists blaming the troubles in Boston on “outsideagitators.” Hicks also attacked Boston’s suburban residents. During a televisionappearance in February 1964, Hicks cautioned: “Before the people of suburbiapontificate on conditions in the Boston school system, they would do well to makesure that conditions in their own school and communities are not in need of anyremedial action” (Reel 13, Frame 0263). In April 1965, the NAACP filed suit againstthe Boston School Committee demanding an end to segregation in Boston’s publicschools. This particular case was abandoned after the passage of theMassachusetts Racial Imbalance Law in August 1965, but it was only the start of thebusing controversy in Boston.
Meanwhile, in Montclair, New Jersey, several different cases culminated in themid-1970s in a desegregation battle pitting the Montclair Board of Education againstthe town’s mayor, Peter J. Bonastia, and the Town Commission. As in Boston, theMontclair case grew out of demonstrations by African American parents. InSeptember 1961, African American parents picketed in front of the Glenfield JuniorHigh School protesting against segregation and the inferior education provided totheir children. In 1967, in Rice v. Board of Education, the commissioner of educationordered the Montclair Board of Education to devise a school desegregation plan.After several other court cases and political maneuvering, finally, in April 1972, theNew Jersey commissioner of education approved the Montclair board’sdesegregation plan. The plan, which included busing of children, was to beimplemented in September 1972. In May 1972, five persons opposed to busing wonplaces on the Montclair Town Commission. One of those five, Peter J. Bonastia, wasselected as mayor. Led by Bonastia, the Town Commission tried various ploys tocircumvent the busing order. They appealed to the governor of New Jersey todismiss the state commissioner of education. They also expanded the school board

in order to gain a majority that would oppose busing. In March 1973, the TownCommission reduced the school board budget by $150,000, including $50,000 thathad been set aside for busing. Board of Education v. Bonastia grew out of thisbudget cut.
NAACP v. Greater Johnstown School District involved still another issue. In1970, officials from the Pennsylvania State Department of Education and thePennsylvania Human Relations Commission ordered the Greater Johnstown SchoolDistrict to devise a plan for ending “racial imbalance” in the Greater Johnstownschools. The Greater Johnstown Board of Education decided to close WashingtonElementary School and to bus the school’s African American students to otherschools. The NAACP and parents of the students sued the school district, arguingthat the plan to close the Washington school was arbitrary and placed “anunjustifiable burden on black students” (Reel 25, Frame 0001). In July 1973, U.S.District Court Judge J. Weber dismissed the case. Weber found that more whitestudents than black students were being bused. He noted that because of factorssuch as traffic patterns near the school and the poor physical condition of the school,the board’s decision to close Washington Elementary made sense from both aneducational and economic perspective.
Other school desegregation cases in this edition are Crumpton v. Chop(Bridgeport, Connecticut); Lumpkin v. Meskill (Hartford, Connecticut); NorwalkCORE v.
