A guide to CDM 2015 Factsheet: CDM 2015 The new Construction (Design and Management) Regulations 2015 come into force on 6th April 2015. These changes are far-reaching and will represent a significant change in the way that Health and Safety is managed in the construction industry. Are you ready? The key changes proposed in the new CDM Regulations are as follows: Key changes How this affects you How we can help The CDM Co-ordinator role is replaced by the new role of ‘Principal Designer’. The Principal Designer and the Client will now be responsible for the management of Health and Safety risks arising from the project, duties which were previously undertaken by the CDM Co-ordinator. Clients are required to appoint a Principal Designer for all projects where more than one contractor will be on site at any one time. The Principal Designer will be required to assist the client to identify, obtain and collate preconstruction information and ensure this is passed to those who may need it. We offer a service aimed at discharging both Principal Designer and Client duties. Client duties will be increased. Several previous duties of the CDM Co-ordinator will be undertaken by the Client. We can provide independent CDM advice and assistance to support Clients in the discharge of their duties. Duties will be applicable to domestic projects. For domestic projects involving more than one contractor the Principal Contractor will normally assume the Client duties. The domestic Client can choose to appoint a Principal Designer for the project. However, if this appointment is not made, the Principal Designer role is assigned by default to the first Designer during the preconstruction phase. As an independent and experienced construction safety specialist, we can act as CDM advisers, offering guidance to all parties within the project team, be it Client, Principal Designer, Designer, Principal Contractor or Contractor. Principal Designer and Principal Contractor appointments are required for all projects where more than one Contractor will be on site at any one time. Clients must appoint both the Principal Designer and Principal Contractor in writing. Failure to do this will result in the Client incurring the duties of these roles by default. A Construction Phase Plan will be required for all projects. The Client must ensure a suitably developed Construction Phase Plan from the Contractor or Principal Contractor is in place before any construction works commence. We can evaluate and assess the Construction Phase Plan to ensure the Client fulfils their responsibilities correctly. Additionally, we can assist the Principal Contractor or Contractor with the development and provision of a fully compliant Construction Phase Plan. The notification threshold will be amended. Notification to the HSE will be required for any project exceeding 30 construction days with 20 or more workers, or if the project exceeds 500 person days. Responsibility for raising the notification now rests with the Client. We can ensure the Client fulfils their legal obligations to inform the HSE where projects fall within the notification requirements. The explicit ‘Appendix 4’ competency requirements will be removed. The new Construction (Design and Management) Regulations 2015 come into force on 6th April 2015.

CDM 2015 is not changing what is delivered but how it is delivered. Its aim is to protect the health and safety of people in construction and others who are affected by their activities.
