MEMORANDUM

TO: Board of Selectmen FROM: Peter Lombardi, Town Administrator RE: Town Administrator’s Report DATE: October 2, 2017 Personnel The Town has hired Margaret Cahill as the new part-time Outreach Coordinator for the Council on Aging. Margaret has broad experience engaging seniors on the North Shore through a variety of innovative initiatives, and will be a great addition to continue to enhance the level and diversity of service offerings that Jim Reynolds has developed over the past several years. Community Compact Grant Funding In mid-August, the Board approved our commitment to two new best practices under the state’s Community Compact program this year, both of which are in line with our consensus priority goals for FY18. They are as follows:

• Understand projected changes in student enrollment and demographics and the impact of those changes on the school district’s budget and operations in order to provide a district with the needed information to develop a strategic plan for its future

• Engage residents to get their feedback on delivery of local services, direction of town initiatives, and preferred communication methods to better inform our outreach efforts and decision making processes

The Town received notice today that we have been awarded up to $45k in total grant funding in support of these two projects – up to $25k for the HWRSD enrollment study and up to $20k to enhance our citizen engagement efforts, via, at minimum, a resident survey. Since we plan to engage consultants to assist the Town in both of these projects, I am now working to refine each respective scope of work in order to receive final approvals from the state. We will have to engage with the Regional School Committee and Hamilton Selectmen to come to agreement on what the enrollment study will specifically entail. Composting Program Audit With the Town’s curbside composting program serving as a model for other communities in the region to try to emulate, our waste hauler, Casella Waste Systems, is looking to conduct an informal audit this month to ascertain our participation rates and variations in volume between households. We will share out the results at a future Selectmen’s meeting to see if there is anything the Town can do to further improve this program.

Program Overview

In a new community, we will:

1. Send a postcard to all households, about 3 weeks before collections begin

2. Mail a textiles recycling bag and a brochure shortly thereafter

3. Send another postcard the week that collections start

4. Mail a reminder 6-8 weeks later

Collection personnel leave behind replacement bags as full bags are collected.

Collection Dynamics

• Residents place pink “Simple Recycling” bags out for collection near their recycling.

• Of the material collected: − A fraction is reusable clothing that can be processed and resold at thrift stores

− The bulk of the material will supply the rag and insulation markets, as well as support re-use and reprocessing abroad

• The weekly set-out rate is about 1%, with the average household recycling 10-15 pounds/year curbside

FAQ’s

Questions Answers

What does the program cost? Nothing. There is no cost to the community or the residents. If no material is collected, there is still no cost.

Do donors get a tax deduction? No, but residents can continue to donate their textiles to Goodwill, the Salvation Army and others to get tax deductions if they like.

How does this impact donations to charities?

This program is designed to take textiles out of the trash, not compete with drop-off programs. People who donate textiles to charities often do so because they believe in the charity or they want the tax deduction. That won’t change. This program is designed to nudge the (majority of) people who would recycle textiles if only it were more convenient.

Do you collect more than textiles? While the primary focus is on textiles, Simple Recycling will also accept small household items that can fit in the pink bags.

What if a resident only has one bag, and a lot of stuff?

The textiles need to be bagged, but residents can use any bag as long as it’s clearly marked for textiles recycling.

What if a pickup gets missed? The resident can call and notify us. We’ll arrange for pick up.

Planning Board Vacancy Candidates Daniel Pasquarello or Ann Weeks Ms. Rogers called the Planning Board meeting to order at 6:35 pm Planning Board members present: Virginia Rogers; Steven Kavanagh; Don Killam Mr. Pasquarello and Ms. Weeks were both present. The purpose of the meeting was to interview candidates who submitted letters of interest to serve out the remaining unexpired term of Minot Frye through the next annual election at which time the position would be filled by election. In the absence of the Chair, Ms. Rogers called the Planning Board meeting to order at 6:35 pm. The candidates were both asked various questions regarding their related experience, professional background, and interest in serving on the Planning Board. The Planning Board agreed these were two very qualified candidates and that it was important for the Chair, David Geikie, to have a vote and action was deferred to the BOS July 11 meeting. The Planning Board unanimously adjourned at 6:53 pm. The BOS adjourned the joint meeting and continued with their meeting agenda. ANNOUCNEMENTS

REPORTS Town Administrator Cellular Phone Coverage Improvements - This February, the Planning Board unanimously voted to approve a request

for a waiver from site plan review for the installation and operation of a concealed Personal Wireless Service Facility to be located in the steeple of the First Church. The request was granted to Cellco Partnership d/b/a Verizon Wireless. Last month, a building permit was approved for 3 new Verizon antennas and other related components to be installed in the steeple, replacing antennas from other carriers. This project will continue the use of the steeple as a Personal Wireless Service Facility under the provisions of the Town’s Zoning Bylaw. Verizon will also be providing

Fire Chief Bob Blanchard was present and spoke to the Feasibility Study for the Wenham Fire Department (WFD). He noted that the proposed Fire Based Emergency Medical Services is due to the increase of medical calls, and not related to the services provided to Lyons Ambulance. The Town will have a separate protocol for emergency dispatch for Advanced Life Support; response-time data will continue to be collected. The proposed service: Aligns well with WFD’s current EMS system noting 21 of 31 firefighters are EMTs Continues high level of care for residents Quicker ambulance response – start transport quicker Saves wear/tear on fire vehicles Off sets the cost and would make medical calls revenue neutral.

Preliminary projections: Net annual income $123,510 – does not account for incremental operating expense increase or revenues from billing

for non-transports or refusals Billable revenue $149,800 - at 85% return Current cost of medical program – $121,000

The Fire Based Emergency Medical Services will start as a pilot program. Because this is a substantial change to the mission of the department; this will be on the next BOS meeting agenda. The Fire Department was recognized for the presentation. Recommendation on Award of Iron Rail Tenant Leases

The Selectmen each reviewed, graded, and gave input to the Chair for the Town Administrator’s annual performance. Those categories included in the evaluation were tied into the Town Administrator / BOS goals: A Successful Town Meeting; Annual Town Report; Budget Process Management / Oversight; Human Resource Management; Improve Communication; Initiate Strategic Planning Measures; Facilitate Economic Development The Chairman explained the evaluation process and summarized that Mr. Lombardi received a majority of highest scores being 4s & 5s. The BOS agreed it was a difficult format in which to evaluate such a complex job and that next year the goals be limited to the most important five or six. The Selectmen concurred that Mr. Lombardi does an outstanding job and that the Town is fortunate to have him as their Town Administrator. Mr. Lombardi recognized the work done on a day to day basis by the department heads and Town employees as a team approach make it all happen. Attorney Ilana Quirk, Town Counsel was present. Ms. Harrison gave an overview regarding the proposed temporary repairs to Longfellow Road as petitioned by the abutters. Longfellow Road is a narrow private way that is snow plowed when possible and receives trash removal services from the town. At the request of the BOS, Attorney Quirk reviewed the options to the Town, noting these issues go back to 1991. Attorney Quirk explained the difference between private and public ways is in part that public tax dollars cannot be used to aid private circumstances noting that there is no public right of access to private roads.

In the event the Town adopts the bylaws under chapter 40 specifically for snow plowing and temporary repairs due to the concern for the safety of emergency vehicles. The estimate for the temporary repairs by the DPW Director is $6,000. Other serious repairs observed was the eroding road at the ravine /steep drop off; Weston & Sampson provided an estimate of $30,000 for the necessary boring and surveying to prepare a plan. Attorney Quirk noted this may involve the taking of private property to meet requirements. The Town can seek special legislation to ask for permission to allow public dollars be expended. Making Longfellow Road a public way may be brought before Town Meeting; a 2/3 majority vote is needed. The meeting was open to the public for questions/comments. Linda Medeiros, Longfellow Road, spoke saying that the majority of abutters understand and support the betterment. It was noted the Town of Wenham owns property on Oak Street and 18 Longfellow (acquired from tax foreclosure) It was questioned if abutters can opt out and not pay towards the betterment, and how the cost is allocated. It was noted that there are four homes beyond the ravine. Attorney Quirk responded that one issue is that 80% under the bylaw is for temporary repairs, otherwise the bylaw does not speak about the requirements of permanent repairs. She reiterated that Town Meeting would need to approve a home rule petition or accept Longfellow as a public way. Because this is not a subdivision there is no plan and frontage does not incorporate the definition for zoning. But as an abutter for the purpose of the betterment, access and frontage would include all properties on Longfellow Road and Oak Street. A statutory private way option is to have it accepted at a private way for having public easement in a private way is makes a home rule petitions a stronger case. Mr. Lombardi suggested he continue to work with Attorney Quirk on some policy options to bring back to the Board to understand potential next steps for both short-term temporary and long-term permanent repairs including the repairs to the ravine and paving of the road. A South Street resident noted the potholes on Longfellow Road are destroying vehicles and asked this be addressed as soon as possible. Concern was also expressed for construction vehicles working at 21 Longfellow Road could cause additional damage and disrepair resulting in additional expenses to repair the road. EXECUTIVE SESSION #1 – Police Captain Contract Negotiation Mr. Wilhelm moved, and it was seconded, Executive Session #2 under M.G.L. Ch. 30A, § 21 (2) – To conduct strategy sessions in preparation for negotiations with nonunion personnel or to conduct collective bargaining sessions or contract negotiations with non-union personnel and to continue in executive session #2. EXECUTIVE SESSION #2 – Town Administrator Contract Negotiation Mr. Wilhelm moved, and it was seconded, Executive Session #2 under M.G.L. Ch. 30A, § 21 (2) – To conduct strategy sessions in preparation for negotiations with nonunion personnel or to conduct collective bargaining sessions or contract negotiations with non-union personnel and to return to open session for possible action. The Board returned to open session at 9:52 pm Mr. Wilhelm reviewed that after deliberating in es, the Selectmen agreed to approve a 2% COLA increase in the Town Administrator salary and to purchase short term and long term disability insurance for Mr. Lombardi. Vote: Mr. Wilhelm moved and it was seconded, to approve the FY18 salary for the Town Administrator, Peter Lombardi from $112,000 to $114,240 and to provide short-term and long-term disability insurance for Mr. Lombardi. the Economic Development Committee an updated coverage map to as we work to understand the Town’s current needs and look to make improvements to our coverage across the community.

Employee Health Insurance - A number of years ago, the Town decided to join the Group Insurance Commission (GIC) as a way to limit health insurance costs. As you can imagine, there have been numerous changes to this program since we initially joined. Every three years, the Town has the ability to opt of the GIC - we are next eligible to do so for FY19. I recently sent a letter to the GIC requesting our enrollment/experience data over the past 2 years, the first step in this evaluation process. At the same time, the GIC is currently in the process of soliciting proposals from vendors, with some potential for significant changes to the carriers and plans offered to employees and retirees in FY19. As long as our data supports it, we will work with the Public Employee Committee over the next several months to thoroughly vet our health insurance options. The Finance Director and I have met with a broker who we would likely contract with if we were to seriously consider other alternatives to the GIC. We have until December 1, 2017 to make our decision.

MAPC to Provide Technical Assistance on Feasibility of Shared Inspectional Services - We recently received notice that the Town has been awarded $20k in District Local Technical Assistance from the MAPC to assess the feasibility of a shared inspectional service model with Hamilton and Manchester. The goal of this study would be to determine how such a model would work from an operational and financial perspective for these three communities. The goal of this approach would be for the towns to build a sustainable staffing model that ensures we can deliver effective, professional customer service and be more efficient in managing our inspectional staff and resources. While maintaining or reducing personnel costs is a goal, it is not necessarily the top priority. As currently envisioned, this shared service model would cover building, electrical, and plumbing/gas inspections.

MBTA Commuter Rail Service Interruptions – Shuttle Bus Update: As you know, weekend service on the Newburyport/Rockport commuter rail line will be suspended from July 8th through September 30th of 2017 in order to bring this line up to federal safety standards by the end of the calendar year. Replacement of the Beverly Swing Bridge will also take place during this time period, with a complete shutdown of the rail line north of the Salem Commuter Rail Station for 28 days.

Representative Hill was recognized for his efforts to resolve concerns. Chairman Mr. Wilhelm announced that Former Police Chief Ed Harrington recently passed away. Chief Harrington was the first full time police chief in the Town of Wenham. Mr. Wilhelm met with the Hamilton BOS chair Bill Wilson to discuss opportunities to collaborate, and work together on the FY 19 budget and two-town issues. NEW BUSINESS Appointments: Fire Chief Blanchard was present and recommended the Provisional Firefighter’s appointments. Vote: Ms. Harrison moved, and it was seconded, to appoint Samantha Curran, Steven Koutrakis, Derek Marshall, Anthony Nickas, Michael Reynolds, Michael Scroeder as Provisional Firefighters for one (1) year terms beginning on July 1, 2017 and ending on June 30, 2018.
