Mr Nicolas SARKOZY (PPE/F)

submitted his resignation as a Member of the European Parliament with effect as at 15 September1999.

Parliament took note of that resignation at its plenary sitting of 4 October 1999.

Mr SARKOZY had been a Member of the European Parliament since 20 July 1999, and belongedto the Group of the European People’s Party (Christian Democrats) and European Democrats (PPE).

He had also been a Member of the Committee on Budgets.

Declaration by the Presidency on behalf of the European Unionon the Sharm-El-Sheikh Memorandum

Brussels, 7 September 1999

The European Union congratulates Prime Minister Barak and President Arafat for the conclusion ofdifficult negotiations between the parties of the Wye River agreement. The memorandum is animportant step which re-establishes confidence and gives new optimism for accelerated final statustalks.

The EU is firmly committed to the Middle East Peace Process and is ready to facilitate talks andimplementation of the existing agreements.

The EU hopes that the memorandum opens the way for a final, just, lasting and comprehensivepeace within a reasonable timeframe. All tracks of the peace process should now be activated bytaking concrete steps.

Foreign Minister Tarja Halonen has sent today a letter on behalf of the European Union to PresidentArafat in order to support the Sharm El Sheikh Memorandum.

The Central and Eastern European countries associated with the European Union, the associatedcountries Cyprus and Malta and the EFTA countries, members of the European Economic Area,declare that they share the objectives of Common Position 1999/604/CFSP defined by the Councilon 3 September 1999 on the basis of Article J.2 of the Treaty on European Union amendingCommon Position 1999/273/CFSP concerning a ban on the supply and sale of petroleum andpetroleum products to the Federal Republic of Yugoslavia (FRY), and Common Position1999/318/CFSP concerning additional restrictive measures against the Federal Republicof Yugoslavia. They will ensure that their national policies conform to that Common Position.

They will ensure that their national policies conform to that Common Position.

Declaration by the Presidency on behalf of the European Unionon the outcome of the referendum on civil concord and peace in Algeria

Brussels, 21 September 1999

The European Union welcomes the outcome of the referendum, held on 16 September in Algeria,which expressed the support of the Algerian people for President Bouteflika΄s vision of nationalreconciliation and peace.

The European Union hopes that Algeria will finally be able to emerge from the violence its peoplehave suffered for a number of years and embark on a process of national reconstruction that willyield the political stability necessary for the fostering of economic and social progress. The European Union confirms its readiness to support and encourage the reform process inAlgeria, particularly by way of Euro-mediterranean co-operation, including the speedy resumptionof negotiations on the conclusion of an Euro-mediterranean Association Agreement. The EUattaches great importance to continuing the political dialogue entered into with Algeria and looksforward to the ministerial level meeting with the EU troika scheduled for November 3rd this year inAlgiers.

Declaration by the Presidency on behalf of the European Unionon the Democratic Republic of Congo

Brussels, 22 September 1999

In her declaration 3 of September 1999, the European Union acknowledged the completion of thesigning of the Lusaka agreement and expressed her readiness to support the implementation of theagreement, provided that all the parties themselves implement it in accordance with its terms.

However, the EU remains deeply concerned of the delays in the implementation of the agreementby the parties, and the continued military activities and hostile propaganda. The essentialrequirements for the implementation of the agreement have not been fulfilled: for instance, theselection of the representatives for the Joint Military Commission has not been completed and thefacilitator for the national dialogue has not been agreed upon by all the parties.

The EU therefore strongly urges all parties to fully abide by the contents and time-table of theagreement, which is the negotiated instrument for a peaceful solution of the conflict. The EU alsoencourages the UN and the OAU to make all necessary efforts to support the implementation of theagreement.

The EU continues to be willing to support various components in the implementation of theagreement, such as the peace-keeping operations by the UN and the OAU, the Joint MilitaryCommission, the national dialogue, the reintegration of refugees and displaced people in theircountries of origin and the process of democratisation, rehabilitation and reconstruction in theDemocratic Republic of Congo.

Declaration by the Presidency on behalf of the European Unionon the situation in East and West Timor

Brussels, 21 September 1999

The European Union welcomes the progress in the deployment of the International Force in EastTimor. It shows the willingness of the international community to find a peaceful and lastingsolution to the question of East Timor based on the self-determination of the people of East Timor.Fear is giving way for hope in East Timor.

We commend and continue to support the work of the Secretary General and the United NationsMission in East Timor in pursuing the consultation process towards the independence of EastTimor.

The European Union praises the contribution of those UN Member States who have given troopsand material support to the International Force. The participation of regional states is especiallyimportant for the success of the operation. We wish to pay tribute to those Asian and, in particular,ASEAN states who have contributed to the establishment of the international force. It clearly showstheir interest in the maintenance of peace and security in the region.

In this context we commend the cooperation of the Indonesian Government with the internationalforce. Complete and early withdrawal of the Indonesian armed forces from East Timor as well asrapid containment and disarmament of any paramilitary elements in the territory are crucial for theoperation to achieve its immediate objectives, namely to protect the civilian population and allowan immediate and full-scale beginning of humanitarian assistance.

The EU remains gravely concerned over the humanitarian situation in East Timor and, particularly,in West Timor. The EU repeats its earlier appeals for allowing immediate safe access forinternational humanitarian organisations to both East and West Timor. Refugees in West Timormust be free to decide themselves whether they want to return to East Timor. Indonesian authoritiesremain responsible for their safety and humanitarian needs. The international community standsready to help the Indonesian authorities.

The EU supports calls for establishing an international Commission of Inquiry to investigate casesin which international humanitarian law has allegedly been violated. Impunity for atrocities cannotbe tolerated.

Declaration by the Presidency on behalf of the European Unionon the disappearance of Mr. Victor Gonchar,

Deputy Chairman of the 13th Supreme Soviet of BelarusBrussels, 23 September 1999

The European Union is deeply worried by the disappearance of Mr. Victor Gonchar, deputychairman of the 13th Supreme Soviet of Belarus, on the evening of 16 September.

Referring to the assurances given during discussions held in Minsk between the representatives ofthe EU and Belarusian authorities, the European Union calls upon the Belarusian authorities to doeverything in their power to locate Mr. Gonchar's whereabouts and ensure his safety. The EUexpects the results of these investigations to bring early results. The EU also reminds them of thefact that the previous disappearances of Ms Tamara Vinnikova, former Central Bank chairwoman,and General Yuri Zakharenko, former interior minister, are still unclarified.

The Central and Eastern European countries associated with the European Union, the associatedcountries Cyprus and Malta, and the EFTA countries members of the European Economic Areaalign themselves with this declaration.

Declaration by the Presidency on behalf of the European Unionon the demilitarisation of the KLA

Brussels, 23 September 1999

The European Union welcomes the announcement by KFOR command that the Kosovo LiberationArmy have completed their disarmament obligations. The European Union also welcomes theformation of the multi-ethnic Kosovo Protection Corps, under the political authority of the UnitedNations Mission in Kosovo and under the operational control of KFOR, to assist UNMIK inprotection against civil emergencies. This humanitarian and rescue structure will facilitate theadaptation of the former KLA members into the civilian society.

The European Union expects full and unconditional observation of the agreements and fullysupports KFOR in the implementation of the agreements. This will pave the way for a process ofstabilisation and demilitarisation of Kosovar society, development of civilian institutions and inter-ethnic co-operation. The European Union remains firmly committed to assisting the people ofKosovo in their efforts to establish a democratic, multi-ethnic and pluralistic Kosovo, based on therule of law and full respect for human rights, and re-establishing confidence among the peoples ofKosovo.

Declaration by the Presidency on behalf of the European Unionon Korean Peninsula

Brussels, 29 September 1999

The European Union welcomes the recent statement by the DPRK to freeze missile test-launcheswhile the talks between the United States and the DPRK continue. The EU expects that this move willbe a start for concrete results in the field of non-proliferation.

Dialogue is the best way to reduce tensions and enhance regional stability. The recent constructivetalks between the United States and the DPRK have had a positive effect towards normalisation ofrelations between the US and the DPRK.

The EU recalls that meaningful North-South-Korean dialogue is vital for any lasting peace on thePeninsula. The EU reconfirms its support for the policy of engagement and invites the two Koreas toresume their direct dialogue without preconditions. The EU for its part is prepared to continue tosupport international efforts to promote stability and peace in the area and is prepared to have anotherround of dialogue with the DPRK.

Declaration by the Presidency on behalf of the European Unionon the forced removals of civilians in Burundi

Brussels, 8 October 1999

The European Union strongly deplores the renewed outbreak of violence and internal conflict over thepast few weeks in Burundi, mainly in the southern part of the country and around the capital,Bujumbura.

The European Union is disturbed by the renewed rebel attacks the first victim of which has been thecivilian population.

It is also particularly concerned about the recent forced removals by the Burundi army of some260 000 civilians in the countryside round Bujumbura.

The European Union deplores the violation of human rights, the loss of human life and the destructionof property which have been the hallmark of this operation. It regrets the anguish and suffering towhich the civilian population was subjected during their forced transfer to the assembly areas.

The European Union calls upon the Burundi Government to call a halt to the policy of forcedremovals and to allow the people to return to their property as quickly as possible. In the meantime iturges that Government to provide the people with improved sanitary and temporary accommodationconditions.

It notes that the Burundi Government has assured United Nations representatives and internationalnon-governmental organisations free access to all of the camps concerned to enable them to providehumanitarian assistance. It asks the Burundi authorities to continue to afford the Office of the HighCommissioner for Human Rights in Burundi and its observers the same access.

The European Union hopes that all Burundi rebel movements will join the Arusha peace process andthat all the parties in the Burundi conflict will choose the path of negotiation rather than that ofviolence and conflict.

Declaration by the Presidency on behalf of the European Unionon the Presidential Election and Referendum in Abkhazia

Brussels, 6 October 1999

The European Union regrets that the authorities in Abkhazia, Georgia held so-called PresidentialElections on 3 October together with a referendum on the Constitution of Abkhazia. The electionswere described as unacceptable and illegitimate in UN Security Council Resolution 1255 of 29 July1999. The European Union considers the elections and the referendum null and void and the holdingof them detrimental to the efforts to find a peaceful solution to the conflict within the Geneva process.

Simultaneously the EU wants to reiterate the necessity of finding a definitive and just solution to theAbkhazian problem by political negotiations. The solution should show respect for the territorialintegrity of Georgia and the necessity of granting maximum autonomy for Abkhazia which wouldpermit the Abkhazians to express their identity within Georgia.

It must be underlined that it is equally essential to ensure a safe return for the refugees.

Declaration by the Presidency on behalf of the European Unionon the intra-Togolese dialogue and its facilitation

Brussels, 12 October 1999

The European Union welcomes the progress made in the talks on the political situation in Togo inJuly by the Togolese parties and assisted by European Union and OIF (Organisation Internationalede la Francophonie) facilitators and security experts. The progress resulted in the Lomé FrameworkAgreement of July 29, 1999.

The European Union appeals to all Togolese parties for an efficient implementation of the terms ofthe Framework Agreement. The implementation should be made in good faith and with respect forhuman rights.

The European Union is ready to support the facilitators' mission, within the scope and in accordancewith the rules of the Lomé Convention, trusting that it will lead to the restoration of democracy inTogo and consequently to the normalisation of the relations between the European Union and Togo.

Declaration by the Presidency on behalf of the European Unionon the peace process in Guatemala

Brussels, 11 October 1999

1. The European Union welcomes the "Encounter for Peace" convened by the "Comission deAcompanamiento" as a further expression of the joint efforts by different sectors of Guatemalansociety to promote the implementation of the Peace Agreements. The EU congratulates all thoseinvolved with the achievements so far in the peace process.

2. The peace process started more than ten years ago hand in hand with the process ofdemocratisation. The end of the armed conflict and the signing of the Peace Agreements werebrought about by the efforts of various successive governments in cooperation with social,economic and political organisations. Equally, the implementation of the Peace Agreementsrequires the joint efforts of all sectors of Guatemalan society for a sustained period to turn theagreed measures and objectives into lasting reality, including full respect for human rights, equalopportunities for the indigenous population, reform of the judicial system, fiscal reform, andreconciliation based on truth, among others.

The EU has fully committed itself to support the implementation of the Peace Agreements, whilstrecognising that the bulk of the efforts to eradicate the underlying causes of the armed confrontationhave to be shouldered by the Guatemalans themselves. The EU stands ready to continue its effortsto help bring about the profound changes needed to secure lasting peace on the assumption thatGuatemala is fully prepared to go ahead with the peace process.

4. The EU therefore calls upon all Guatemalans to clearly commit themselves to the continuation ofthe peace process and to full implementation of the Peace Agreements.

Declaration by the Presidency on behalf of the European Unionon the Democratic Republic of Congo

Brussels, 11 October 1999

On 16 July 1999, the European Union expressed its willingness to support the Lusaka Agreementprovided that the parties themselves complied with the terms thereof. It again declares itself firmlyresolved to support implementation of the agreement, in its various components, including the JointMilitary Commission and the national dialogue, the peace-keeping operations by the UN and theOAU, the reintegration of refugees and displaced people in their countries of origin and the processof democratisation, rehabilitation and reconstruction in the Democratic Republic of Congo.

The European Union remains concerned at the slow pace at which the main provisions of theAgreement are being applied and at which the bodies and mechanisms for implementing it are beingestablished. It urges the parties to support this fragile peace process and to avoid returning toconflict.

The European Union welcomes the fact that the first meeting of the Joint Military Commission, akey element of the Lusaka Agreement, is to be held on 11 October 1999 and is considering thepossibility of providing it with financial support as soon as it is able to function.

Declaration by the Presidency on behalf of the European Unionon the killing of members of a humanitarian mission in Burundi

Brussels, 18 October 1999

The European Union strongly condemns the renewed outbreak of indiscriminate violence in Burundi,the main victims of which continue to be the people of that country.

The European Union is particularly outraged at and condemns the attack on a humanitarian missionin Rutana province on Tuesday 12 October. It is shocked by the massacre of several members ofthat mission, Burundians and expatriates, including two representatives of UN agencies, and offersits condolences to the victims’ families.

It calls for the perpetrators of this massacre to be brought to justice.

The European Union wishes to make a further, urgent appeal to all the Burundian parties to put an endwithout delay to all acts of violence and to reach an early agreement on the terms of a ceasefire and areturn to civil peace, reconciliation and democracy in Burundi.

The European Union reiterates its appeal to both parties to proceed to a permanent andcomprehensive humanitarian cease-fire and to a prompt resumption of the peace negotiations inNairobi as decided in the last round of talks within the IGAD peace process.

on East TimorBrussels, 21 October 1999

The European Union welcomes the decision of the Indonesian People’s Consultative Assembly(MPR) on 19 October to declare as void the 1978 decree incorporating East Timor to Indonesia. Thisdecision is an important step in the UN-led process to pursue arrangements for a peaceful and orderlytransfer of authority in East Timor to the United Nations.

The EU, together with the international community, looks forward to a smooth and peaceful transitionof East Timor to full independence and trusts that the Government of Indonesia will fully co-operateto this aim.

The European Union condemns in the strongest terms the violence which took place at thedemonstration in Minsk on 17 October.

The European Union calls for the immediate release of the political figures arrested after thedemonstration, in particular Mr Statkevitch, and of those previously detained.

The European Union reiterates the importance it attaches to a genuine political dialogue, yet to beestablished in practice, designed in due course to create the conditions for the holding of free anddemocratic elections, with international observers. Such elections are the only way for the peopleof Belarus to achieve genuine political legitimacy.

The European Union rejects the one-sided version of events claiming that the opposition was solelyto blame and accusing the West of helping to finance the demonstration.
