India has a parliamentary system. Yet the presidenthas authority to occasionally enact legislation (orordinances) without involving parliament. This bookis a study of ordinances at the national level in India,centred around three themes. First, it tells the storyof how an artifact of British constitutional history,over time, became part of India’s legislative system.Second, it offers an empirical account of the waysin which presidents have resorted to ordinances inpost-independence India. Third, the book analysesa range of ordinance-related questions, includingsome that are yet to be judicially adjudicated. In theprocess, the book explains why much of the IndianSupreme Court’s jurisprudence is mistaken and whatshould take its place. Overall, the book explains whythe fate of parliamentary reforms in India may betied to the reform of the provision for ordinances.Standing at the intersection of constitutional law andpolitical science, Presidential Legislation in Indiaoffers a new frame through which to assessexecutives’ legislative powers in both parliamentaryand presidential systems.
