Chairman Dave O'Brien called the February 7 th 2006 Township Meeting toorder. The minutes to January were reviewed. Denny Beyer motioned to approvethe minutes as reported. Brian Hervey seconded the motion and it carried 3-0.

Robert Owens gave the treasures report for the months ending December 2005and January 2006 for the General Fund, Money Market Account and Planningand Zoning (see attached). Hervey motioned to accept and Beyer seconded themotion. The motion passed 3-0.

Jim Stoddard, Olmsted County feedlot supervisor, addressed the Board regardingLeslie Hack's request to declare his grandfather's farm an existing feedlot).Stoddard stated that if the property had history of being used as a feedlot that itwould indeed be considered a feedlot. To be a registered feedlot and have aneffect on planning and zoning would be determined by the number of animals thatit has held in the past. Leslie Hack of 1700 W. Center St. Oronoco spoke onbehalf of the renters of the Prokasky farm, Art and Brian Kaul. Hack stated therehad been an ongoing feedlot operating at the farm and gave a history of such (seeattached). Brent Buegner of 6715100 th St NW addressed his concerns to theBoard. He stated that the feedlot was not properly registered as a feedlot andthat if it were a registered feedlot it would adversely effect his current subdivisiondevelopment. O'Brien stated that it was not the Boards duty to determine if itwere a registered feedlot but to decide if there was a history of a livestockoperation at that particular property. Beyer motioned to declare there has been ahistory of a livestock operation at the Prokasky farm. O'Brien seconded themotion and it carried 3-0.

Ann Malley of 10549 Co. Rd. 3 NW Oronoco would like to rent the Town hallFriday March 2h d, 2006 for a Teen Dance. There would be approximately 40 –50kids with 10 to 20 chaperones, food and a Di Most of the kids are from NewHaven and Pine Island. O'Brien motioned to approve the request with a $50dollar fee instead of the usual $250. Beyer seconded the motion and it carried 3-0.

O'Brien announced there will be an audit of the Township books on SaturdayFebruary 11 th at 9:00 am. Tonight's meeting will be recessed instead ofadjourned. Further announcements include the fact that Excel energy has tore up105 St. and 85th St. while setting poles. Beyer will put up signs warning of thedanger.

Olmsted County has declared our Keller's Quarry rock unusable because theproximity to the Decorah Edge (see attached report).

O'Brien met with Willy Holm of Holm Brothers and they would like to crush morerock which would mean they would take about 12 more feet. This would mean theburm would be that much closer to the town hall.

Judy Ohly, our County Commissioner, spoke of the next legislative session andwill with us if there is anything we would like to address.

Gary West presented the Conditional Use Permit NH06-01 Home Occupation/Farm Tractor Repair and Restoration. The applicant is Dale McNamara of11814 Co. Rd 5 NW Pine Island MN 55963 (see attached). O'Brien asked forpeople who wanted to speak for the CUP. Dale McNamara was the first to speakon his own behalf. Todd Kennedy of Pine Island and New Haven Township wasnext saying that Dale and his business would be an asset to our Township. VinceFangman of 11724 Co Rd 13 also spoke in favor of Mr. McNamara saying he hasrun the business successfully in Pine Island and would see no problems with thenew location.

Chairman O'Brien then asked for those who wished to speak against. He asked 3times and no one came forward. Beyer motioned to close the public hearing witha second by Hervey. The motion carried 3-0. Discussion of the public hearingwas next with Beyer speaking in favor of the CUP. He then motioned forapproval. Hervey seconded the motion with vote 3-0 to approve.

West then brought up a request from Ride Ability for a gambling permit for theirfund raising barn dance. Beyer moved for approval and O'Brien seconded themotion. The motion was approved 3-0.

Gary West spoke about a request to allow the King property on County Rd. 12 tobecome a subdivision. O'Brien stated that this property was not in the long-rangeplan for development in the Township. It was also not proper procedure to go tothe County with this request and would have to be addressed by the PlanningCommission.

Vince Fangman of 11724 Co. Rd 13 addressed the Board with some concerns hehas as a businessperson with our Planning and Zoning policies. He sees us asconstantly butting heads with the County. He thinks that New Haven Townshiphas too much A-2 and seems closed to development. He feels that non-conforming parcels do not get a fair shake or are penalized because of it. Hequestions the variance procedures and thinks there needs to be more housingdistricts. Finally he would like to see platting instead of metes and bounds

O'Brien announced the flagpole is still in the Townships future and recessed themeeting until Saturday February 11 at 9:00 am.

Chairman Dave O'Brien reconvenes the February 7th Board meeting. The Boardof Audit the General Fund and Planning and Zoning checking accounts.Everything was found in order. Hervey motioned to approve the audit for 2005General Fund and Planning and Zoning accounts. Beyer seconded the motionand the motion was approved 3-0.

The 2006 budget payable in 2007 was discussed and it was decided not to ask foran increase of the $120, 00 for General Fund or $60, 000 for Road and bridge.

There was a letter from Hidden Valley Game Farm for a year ending specialevent. Also an annual review for 2006 was done for their CUP. Everything wasfound in order (see enclosed).

Beyer motioned to pay all bills and Hervey seconded it. The motion carries 3-0.

A job description for the Planning and Zoning Administrator, Gary West wasdiscussed. It was felt a written job description was long over due; it had beentalked about in the past but never acted on. As a result of some recent deviationin procedures it was decide that West needs to have more direction from theBoard and needs to keep them advised of his actions. A rough draft wasdiscussed.

The 60th Ave repair was discussed and a letter should be sent to Terry Ward, MNDOT, Jeff Taylor, Zumbro River Construction, and Mike Sheehan, OlmstedCounty. It is their responsibility to begin repairs as the portion of the 52 projectis done and the quarry will not be used as much. The 60 th Ave repairs shouldinclude but not be limited to the following: The shoulders need to be reshaped, anew 6 inch rock base should be installed from the bridge to the entrance of thepit. This base should be 24 feet wide with end slopes of 6 to 1. Also there are 4major soft spots that need to be repaired.

Denny Beyer will notify Peoples Coop Electric to not put there poles in the middleof the ditch on 60th as well as some dead trees need to be removed.

Rick Lorenz of Rochester Construction will get prices to black top township roadsto have on file if any one should ask about the cost.

Chairman David O'Brien called the March 21 st 2006 Township Meeting to

order. The minutes of the February 7th 2006 meeting were reviewed and a

motion to approve was made by Denny Beyer. Brian Hervey seconded the

motion and it passed 3-0. Robert Owens gave the February month ending

Treasures Report for the General Fund, MMDA Account, and the Planning &

Zoning. Hervey motion to approve and Beyer seconded it. Motion passed 3-

0. Beyer made a motion to pay all bills and Hervey seconded it. Motion

carries 3-0. The Hassler Road and Ditch bill was discussed and it was asked

that Mr. Hassler itemize the bill when he returns from vacation.

Jesse Preston from QED Engineering of Rochester approached the Board on

behalf of Linda King. They are planning a Sub- division on Co. Rd 12 outside

of the New Haven and Olmsted Development District. It was suggested they

follow proper procedure and go before the Planning Commission and a

Public Hearing first.

Sally Kolhmeyer of New Haven Township approached the Board to ask

permission to use the Town hall on July 21 st for a class reunion. Beyer

motioned was made to waive the usual fee and they would instead make a

$100 donation to the Township. Hervey seconded the motion and it passed 3-

0.

Al Prestiguard of New Haven approached the Board to thank them for the use

of the Town hall and give them $150.00 rental. He said the Saddle Club

would like to use the hall next winter as well.

Jeff Lee of 8125 75th Ave NW approached the Board to ask their thoughts

about a neighbor 's chronic barking dog. He has approached the neighbor

with little success. O'Brien stated the Board would take the problem under

advisement and see if there is any thing it can do.

The Olmsted County's rejection of the Keller Quarry rock was discussed and

it is still a mystery why it has been rejected by Olmsted County. The Clerk

and Chairman O'Brien will draft the letter that was approved at the Annual

Meeting.

Mary Andrist Chairwomen of the Board of Adjustments reported on

recommendations for re-alignment. They were to appoint Al Prestiguard to

another 3-year term and make Craig Kolp a permanent member to replace

the late Walt Kolhmeyer. Ron Titus would then be appointed an alternate.

Beyer motioned and Hervey seconded it. Motion carried 3-0.

The Board would also like to have Leslie Hack start attending the Planning

Commission meetings to ease into Walt Kohlmeyer 's appointment.

West reported that MN Dot has $600 for the Township's farm tenant for crop

that was destroyed by the Tower Construction. The City of Rochester should

be out soon to install the Civil Defense Siren.

The Deputy Clerk Robert Lindahl asked for the reorganization of the

Board of Supervisors called the meeting to order. Motion to nominate

David O'Brien, Chairman, was made by the Clerk and seconded by

Hervey. Motion was carried 3-0. Motion to approve the last meetings

minutes with an amendment was made by Beyer. The amendment was to

recognize, Jesse Preston, of QED as the spokes person for Linda Bandel

King as stated by Chairman David O'Brien. The motion was seconded by

Hervey and passed 3-0.

Motion to pay all bills was made by Beyer and seconded by Hervey. The

motion carries 3-0.

Mary Andrist reported on the Board of Adjustment meeting. There was a

discussion on having 3 different posting places for notices. Beyer motion

to have the posting places be the Town hall door and the light pole by the

Church in Douglas.

Chairman Al Prestaguard reported on the last Planning and Zoning

meeting and its plans to reorganize. Discussion on planning member

Zoning Commission as an advisor. Beyer motion to have Dan Stussy as

an alternate on the Planning Commission. Hervey seconded the motion

and it carried 3-0.

Beyer reported on the Olmsted County Road meeting. He stated that there

would be a vote on the spending of State Road Tax monies on the roads

only.

Gary West reported on the money owed by MN Dot to Keith Maxson the

lessee of the Township land. He is owed 636.25 and it was motioned by

Beyer to have the clerk bill this amount to MN Dot. Motion seconded by

Hervey. The motion carried 3-0. West also sent a letter to Jesse Preston

of QED explaining the procedures and fees for the proposed King land use

change. West further reported on the increase in Township real estate

taxes. Beyer motion to pay all taxes with a second by Hervey. Motion

carried 3-0.

Rick Lorenz, of Rochester Construction, spoke on the condition of

Township roads. He stated the roads are firming up very well. The

Munson Pit needs inspection as well as some driveways on Riverside.

Gary West will inspect the pit and report back to the Board.

There was some discussion on the road maintenance and rock quotes. The

Clerk will advertise and they should be ready to open on the first meeting

in May.

Chairman David O'Brien called th April 18th wnship Meeting to order. Clerk, JeffEastman, read the minutes to the Apri 4 Board Meeting. A motion to approve theminutes was made by Brian Hervey and seconded by O'Brien. The motion passed 2-0.

Hervey motioned to pay all bills and O'Brien seconded it. The motion passed 2-0.

O'Brien opened a discussion on the Munson pit on 60 th Street. West is to inspect the pitand report back in May. The repair to the road was discussed and nothing has been heardfrom Mike Sheehan and the others involved with the repair.Gary West's job description and review was discussed and West will decide if he wantsan open or closed meeting.

2006 Spring Road Inspection was discussed and it was decided to schedule the inspectionfor Saturday May 13 th at 9:00 am.

Dale Fox approached the Board for a refund of his money for a metes and bounds he hadordered but didn't need. Beyer will speak with Gary West about the matter.

Rick Lorenz spoke about the problem on 59th St. with the water coming out of the culvertin to the field. He said that he needs to move some dirt around to redirect the water.Lorenz went on to discuss that 105 th needs some blade work by Fuch's driveway.O'Brien wants the pond bulldozed because it is in the road right-of –way. Hervey willcall Mr. Books to advise them.

Denny Beyer excused himself from the Board while Hervey made a motion to have theBeyer family mow the Township grass this spring and summer at the same rate as the lateWalt Kohlmeyer. There was a second by O'Brien and the motion carried 2-0.

With Beyer back with the Board he stated the chloride stakes should be blue and orangethis year. The price per patron is $55.00. Beyer and West will send out the post cards inthe next week.

Meeting to order. The minutes to the April 18 th 2006 meeting were

reviewed. Denny Beyer motioned to accept the minutes as written with a

Brian Hervey second. Motion carries 3-0. Robert Owens gave the

Treasures report for April. Hervey motioned to approve and Beyer

seconded it. The motion carried 3-0. Hervey motioned to pay all bills and

Beyer seconded it. The motion carries 3-0.

O'Brien motioned to have Planning and Zoning pay $20, 000 in rent to the

Township. Beyer seconded the motion and it carries 3-0.

Beyer spoke on the dog bite that occurred in Genoa and will contact the

County to sit in on the court date and report back top the Board.

O'Brien opened the Public Hearing for Conditional Use Permit #NH06-

02, Anne Maley Home Occupation/Photography Studio. After some minor

discussion Beyer motioned to close the Public Hearing with a Hervey

second. The motion carries 3-0. Hervey Motioned to approve the

Conditional Use Permit with an O'Brien second. The motion carried 3-0.

There was then discussion about accepting the County's 8.04 commercial

use ordinance. Thought not to be a good idea because it allows Adult

Entertainment.

Rock quotes were next with Holm Brothers Construction receiving the job.

Road Maintenance quotes were discussed and O'Brien said he needed

more time to study the entries.

Beyer motioned to accept all quotes and Hervey seconded it. The motion

carried 3-0.

Road Inspection will be May 13 th at 9:00 am. The DNR wants to widen

the Douglas Trail and needs to approach the Board for Drive-way

permits. O'Brien is to meet with County Engineer Mike Sheehan to sign

the 60th St. Bridge contract. Dick Pressnell is working on the Town Hall

Flag Pole.

The Regular Board meeting was recessed for a closed meeting with

Planning and Zoning employee Gary West. Meeting was opened by

O'Brien to discuss the Planning and Zoning Administrator 's job

description. The Board went over a list of duties and responsibilities of

which there are 14 items. It was also recommended by the Board to hire

Jane Krause to help with file reorganization. Treasure Owens then added

a 15th directive to supply a receipt with all P and Z checks.

Chairman Dave O'Brien called the May le, 2006 meeting to order.

Absent were Brian Hervey and Robert Owens. The minutes of the May 4th

meeting were reviewed. Denny Beyer motioned to accept the minutes as

written and O'Brien seconded the motion. The motion carried 2-0.

Beyer moved to allow the Clerk to make the PERA payment in a timely

fashion as to avoid the $10.00 late fee. O'Brien seconded the motion and

Larry Stoddard and Jane Krause were on hand to present the electronic

filing system and the updating of the New Haven filing system. They spoke

on scanning the old files and Stoddard put a bid together for the hard

Willie Holm has the rock bid and talked about spotting some roads before

he applies rock in July. Larry Stoddard talked about a constructing a web

site for the Township. He charges $65 an hour and the price will be

dictated on what we want the site to say and do. Alvy Bruce suggested

that we look at other Township Web sites to see what we would like for

our site.

Alvy Bruce, of New Haven was present to discuss the new culvert needed

on 88th Ave. O'Brien has a line on 2 - 36" culverts.

Rick Lorenz of Rochester Construction presented a letter to the Clerk that

terminated its lease on the Hoehne Pit. It was agreed Rochester

Construction doesn't have to reclaim the pit.

Keith Maxson was present to pay the 2006 farm rent less the money owed

to him by the State for the destruction of Crop during the construction of

the Homeland Security Tower. The total acres were also lowered to 38

acres.

A motion was made by Beyer to hire Jane Krause to help with the new

filing system @ $12.00 dollars an hour. O'Brien seconded the motion and

it passed 2-0.

Chairman Dave O'Brien called the June 6 th 2006 meeting to order. O'Brien made amotion to accept the May 18 th minutes as written. Hervey seconded the motion and themotion carried 2-0. Hervey motioned to pay all bills and O'Brien seconded the motion.The motion carries 2-0.

The Clerk will contact Culligan to change the exchange rate for the water filter frommonthly to every 4 months.

The Sanford property is being mined of black dirt by Rochester Sand and Gravel who hasa temporary construction to do so.

In the absence of Treasurer Robert Owens the Clerk gave the April bank reports (seeattached). A motion to accept was made by O'Brien and seconded by Hervey. Themotion passed 2-0.

O'Brien had a meeting with Dave Rossman and Mike Scheehan from the county aboutthe design plans and signage for closing 5 side roads along Hwy 52 (85th to 59th). By

closing these pass thru roads at this time will speed up the Federal funding process foroverpasses.

There is also a County Committee looking into dispersing some county roads and turningthem back over to the Townships. O'Brien wants every one to think about which roadswe will take.

There was discussion on the new computer and scanner system for updating theTownship's filing system. West reported we could save $500 or so compared to thequote given by Larry Stoddard. O'Brien asked for the quote from Staples to compare. Itwas decided that it will be decided which way to go at the next meeting when both quotescould be compared.

Mike Hassler gave a chloride report and said all went very well.

Vince Fangman of 1172 Co Rd 113 NW addressed the Board about a concern he has witha County Ordinance dealing with property splits and an additional 17-foot easement thecounty wants before it will approve the new parcel or split. He feels the County hasabused the ordinance and wanted to bring it to our attention.

Chairman Dave O'Brien called the June 22' 1 2006 New Haven Township Board Meetingto order. Brian Hervey made a motion to approve the minutes to the June 8 th meeting andDenny Beyer seconded the motion. The motion passed 3-0.

Treasurer Robert Owen had no new financial report at this time but explained the PineIsland Bank was offering a 5.25% interest 9 to 16 month CD. The Board chose to wait tosee where we are at financially because of some big bills coming due.

Beyer motioned to pay all bills and Hervey seconded it. Motion carried 3-0.

The Byron Snow Bears approached the Board for approval of their temporary conditionaluse permit for their annual snow mobile races and fundraiser. Approval was so moved byBeyer and seconded by Hervey. The motion passed 3-0. Beyer also motioned to approvethe temporary malt beverage license with Hervey offering a second. The motion carried3-0.

Mike Hassler was told of some old tires dumped at the end of 85 th St. on the east side.

O'Brien reported that the Assessors office will adjust 1.9% of the disputed real estatetaxes. There will be some people not receiving their adjustment because there are morethan 1.9% of the people that reported mistakes or errors in their taxes. The clerk will besending a letter to our county commissioner asking for an explanation of the situation.

The County has given use permission to mow a 3-foot swath on the road ditches. MikeHassler will be out mowing as a result.

Lynn Brooks of 28720 75 th Ave. spoke to the Board about the chloride being covered bythe new gravel. Jim Bugnen of 7337 120 th St NW had a similar complaint from him andsome of his neighbors regarding the chloride being covered by new gravel.

O'Brien explained we are in a tough situation with timing of both the Chloride and gravelapplicator because they do it on there own schedule that we have no control of. Theboard will look at possible getting more chloride on those sections.

Next up was the John P. Wheelock Conditional Use Permit NH 06-03, Home Occupation(see attached). Chairman O'Brien explained the procedures used in a Public Hearing fora Conditional Use Permit. It was time for those to speak in favor of the Permit. JohnWheelock spoke on his application for his small engine repair business. O'Brien thenasked for those who would like to speak against and after asking 3 times there were notakers. Beyer moved to close the Public Hearing and Hervey seconded it. The motionpassed 3-0. The Board then went into discussion phase. Beyer asked the applicant if hewas okay with the terms of the application and Wheelock stated he was. Beyer thanexplained the County still has to approve the driveway access. Therefore Beyer motionedto table the hearing until the next meeting and Hervey seconded it. The motion carried 3-0.

Gary West reported on the Douglas Forney situation with the abandoned vehicles. Hehas written a letter but has received no response.

West also reported on the new computer that he purchased for the Township. O'Brientold West that the computer was might have been a good deal but West's purchase wasnot warranted because he bought it without Board approval. O'Brien further stated thatWest needs to follow all procedures when acting on Township business.

Beyer motioned to accept the computer but agreed that procedure must be followed in thefuture. Hervey seconded the motion and it passed 3-0.

The July 18 th 2006 Chairman Dave O'Brien called Board Meeting to order. Denny Beyerto accept the amended minutes to the June 22 nd 2006 Board Meeting. Brian Herveyseconded the motion and it passed 3-0. Robert Owens gave the month ending June 2006financial report for the General Fund, Planning and Zoning, and MMDA accounts (seeattached). Owens explained the difficulties we have experienced with duel accounts,which were set up to make the Township more interest. The trouble has come from thetransfers and the bank depositing monies in the wrong account. Clerk Jeff Eastmanstated the bank has agreed to automatically sweep the MMDA account for funds neededin the General Fund. Beyer motioned to accept the June Treasurers report. Herveyseconded the motion and it passed 3-0. Hervey motioned to pay all bills and O'Brienseconded. All bills were approved except the Holm Bros. invoice that will be furtherreviewed. Motion carried 3-0.

Gary West was asked to open up the Public Hearing, a land use change for John Fuchs.Mr. Fuchs then read a statement to withdraw his request for a land use change from A-2to A-3 (see attached). Hervey motioned to close the Public Hearing. It was seconded byBeyer and passed 3-0. O'Brien requested an itemized statement on the Fuchs request tosee if there would be a possible refund. West will provide the documentation. AlPrestiguard also spoke on the Fuchs hearing saying the discussion was favorable at thePlanning Commission hearing, which resulted in a close vote. Robert Lindahl spoke onthe Commission's efforts to change the Township's land use plan to include more A-3 orsuburban subdivision. Lamond Bruce added there is a need to bring our A-2qualifications up to date.

O'Brien stated a letter had been sent to Judy Ohly about the inequities of the Truth inTaxation findings.

Arlene Meyers of New Haven Township would like to rent the Town Hall for a weddingreception Friday October 13 th. It was agreed to for the fee of $25.

The Forney abandoned vehicle situation seems to now be in compliance.

O'Brien brought up a clear cut operation on the Frank Bement property that seems to bein violation of soil and water procedures. The County has been asked to look into thesituation.

O'Brien asked about the status of our records update. West responded by saying our newemployee, Jane Krause, has not yet begun work.

Harold Searles is retiring and will be on call at an advisory capacity. Dan Stussy willreplace Searles.

The John Wheelock Conditional Use was up next but was again tabled because MikeSheehan's lack of response from the County level concerning the driveway.

West stated the Civil Defense siren should be installed soon and the electrician is waitingfor permission to use a certain bracket.

New Haven Town Board Meeting

September 19, 2006

The meeting was called to order at 7:02 pm by Supervisor O'Brien.

Minutes were reviewed from last meeting. Correction of date changes needs to be madefrom August 17 to August 15 and August 3 to August 1. Brian Hervey motioned toapprove the minutes with the corrections as noted. O'Brien seconded the motion. Themotion carried 3-0.

Treasurer Robert Owens gave the month ending August report. O'Brien motioned toapprove the Treasurer's report; seconded by Hervey. Motion carried 3-0.

Matt Flynn, Olmsted County Commissioner for District IV presented the Swimming PoolProposal for Olmsted County to raise funds and requested the Township support. Aftermuch discussion, O'Brien motioned to accept the resolution; Beyer seconded the motion.Motion carried 2-1. (see attachments)

LaDonna Thorum from Genoa took the floor and discussed the complaints against herson riding his dirt bike on road in Genoa. She would be meeting with Gary West todiscuss issues related to this.

Don Broskoff presented an estimate to fix up the small shed next to the Town Hall.Estimation was $900 for materials and $450 for labor; total cost $1350.00. (seeattachment)

Rick Lorentz discussed the cost for the culvert on 88 th Avenue. Discussion concerningcost share with Dick Pressnall and LB Bruce. Board will discuss with Dick to see if he iswilling to go a third of the cost and will have a decision by the next meeting on October3.

Lorentz also discussed an old dead tree on the Campground Road (120th Street) on thenorth side of the road. Beyer will talk to the landowner regarding this.

O'Brien presented a letter received from the Olmsted County Sheriff's Office regardingthe adoption of new rules in the Township on exotic animals. Mr. West is to review theseand report back to the Board. Will discuss further at the October meeting. (attachment)

Resolution No. 06. Approximately a year ago, we made a motion to agree to giveOlmsted County $20,000 for bridge (concrete, pipe) on 60th Avenue and 100th Street,County Road 12. Beyer made a motion we agree with the resolution; O'Brien seconded.Motion carried 3-0. (attachment)

Chairman David O'Brien opened the October 3 rd 2006 Township Board Meeting. TheClerk read the minutes to the September 19 th meeting. Denny Beyer motioned to approveand Brian Hervey seconded. The motion passed 3-0. Treasurer Robert Owens reportedhe had just received the September statements and will give a report next meeting. Hedid report that the Township received a rock royalty check from Holm Bros. for$6743.50.

Clerk Jeff Eastman presented the budget #'s for Road and Bridge Fund so far this year.We are at $126,183.32 and over budget $6183.32.

Rick Lorenz, Rochester Construction, spoke on the Presnell - Bruce field drive culvert.He said the site work and the installation of the culvert provided by Presnell would beabout $ 1800 dollars. The Board will review at the site during road inspection 10/07/06.

O'Brien brought up the Town hall shooting and the fact that the estimate was way low forthe amount of repair needed. Beyer will procure 2 other bids.

Gary West reported on the exotic animal ordinance and didn't think we need to adopt oneif the state law is observed. Beyer will speak with the county.

The Board will attend the Hoehne Annexation informational meeting in Pine Island justto listen.

West brought up the question of who is responsible for septic field inspection in anannexed area. Beyer thought it was the City's responsibility after an area was annexed.

order. The minutes to the 10/03/06 meeting were reviewed and Denny Beyer

Treasurer Robert Owens gave the last 2 months financial report for the General

Fund, Planning and Zoning, and the Money Market Account (see attached).

Geoff Griffin, representing Tower Properties addressed the Board about the

orderly annexation agreement between the City of Pine Island and New Haven on

the property formerly known as Hoehne Elk Farm. After some State Law changes

in the annexation process and a new agreement was presented, with the

appropriate changes. Beyer motioned to approve the new agreement and Hervey

seconded it. The motion carried 3-0.

Gerald Meyer of 10236 95 th Ave. NW approached the Board on the matter of the

Township Road, 95th Ave. NW, encroaches on his property and is not marked

properly. He requested to make a slide presentation to show his case (see

Dan Stussy of 12523 Hwy 52 Pine Island came forward to address the Board

about the road medium closing on Hwy 52. He doesn't think this is necessary and

hurts the value of his property. He would like to have the Boards support in this

matter in his discussions with MN DOT. The Board could not give him their

support but would like to investigate further.

Alvy Bruce would like to reserve the Town hall on December 296 2006 from

10:30 am to 4:00 pm. Beyer motioned to waive the usually fee for a donation and

Hervey seconded. The motion carried 3-0.

Robert Lindahl spoke to the Board about the last Advisory Committee meeting

that was attended by Olmsted County's Planning Chairman Phil Wheeler. The

Advisory Committee shared their work on a new land use plan with Mr. Wheeler

who thought they were on the right track and praised the Committee for their

work over the years.

The Clerk brought up the problem with the Civil Defense Siren. The Board will

review the CUP.

Beyer spoke on the Exotic Animal Control Procedure and said that New Haven

needs to appoint a warden. Beyer moved to appoint Jeffrey Eastman as the new

Exotic Animal Control Warden. Seconded by Hervey and the motion carried 3-0.

Gary West spoke on the county and MPC 's discussion on defining Animal Units.

West also would like to see the implementing of a petty cash fund of $300.

New Haven Town Board Meeting

November 21, 2006

The meeting was called to order at 7:00 pm by Chairman O'Brien.

Minutes were reviewed from November 6, 2006, meeting. Beyer motioned to approvethe minutes. Hervey seconded the motion. The motion carried 3-0.

Treasurer Robert Owens had nothing to report.

From the floor, Mr. Frank Bement, 8750 85th Street NW, brought up discussionconcerning the recent snowfall and the fact that the township roads did not get plowed.He would like to see the township plows out every time the county/state plows are out. Itwas recommended by the Board that Mr. Bement present this at the annual meeting inMarch, 2007.

From the floor, Mr. Bruce Eckloft, 9040 County Road 3, asked the Board to follow up onthe land renter and others who use the road by his place to not access the fields via hisroad. He does have a No Trespassing sign posted, but not a private drive sign. O'Brienrecommended that we put the fence back up. Eckloft would prefer not to have the fenceup. In the future, it will be put in the contract for the renter that they should not use hisdriveway.

From the floor, Gerald Meyer asked if there was any follow-up. O'Brien indicated thatwe did not receive anything back yet and would hopefully have something by ourDecember meeting. Meyer asked about the stakes in the ground. O'Brien told him thesecould be pulled.

O'Brien reported that the Orderly Annexation Agreement with the City of Pine Islandwas signed at our last meeting (November 6). It has been returned by the City with theirsignatures as well. Will be kept in our files.

Report from Gary West:

1) Civil Defense Siren-- O'Brien gave a brief background on the siren issue, i.e,placing it on a telephone pole versus tower.

2) On-site Sewage Seminar – MCPA. November 28. Changed location to RochesterPublic Utilities Building.

3) Hall rental – 4-H Club has rented hall for Saturday, November 25, 2006.Retirement party booked for April 13, 2007. Saddle Club needs to be reminded toclean up and take their garbage when they use hall.

4) Trophy Lakes update.

O'Brien gave an update on the "bullet hole" incident. We have received a check from theadjuster. Have also received one estimate from Schoeppner for repair. Are awaitinganother bid to come in.

The Olmsted County Association of Townships Meeting is Wednesday, November 29,7:30 pm, at the Rochester Township Town Hall.

At the next meeting in December, we will discuss rock bids, maintenance, and land rent.Also will need to review Rochester Construction bill with Alvy Bruce.

Chairman Dave O'Brien called the December th 204 meeting to order. November 21 stminutes were reviewed and Denny Beyer motioned to approve with a second by BrianHervey. The motion carried 3-0.

Treasurer Robert Owens gave the month ending November Treasures report (seeattached). Beyer moved to accept and O'Brien seconded it. The motion carried 3-0.

The Clerk presented all bills for payment. Hervey motioned to pay all bills and Beyersecond the motion. The motion carried 3-0.

Beyer brought up the installation of stop signs in Genoa. There is still brush that needs tobe trimmed so the sign will be visible and the intersection safe.

Gary West spoke on the Township land valuation and taxation. It was also decided thatGary will contact Jane Krauss and get back all documents and materials that she mayhave. He will then start to scan, record, and organize all of the Townships old documentson the new computer that was purchased for this task.

The letter to the Township Board regarding the Meyer Township Road question wasdiscussed and it was decided to have the Clerk contact the attorney to see how we shouldproceed.

The matter of the farm rent was discussed and it was determined the amount of tillableland was 35 acres more or less. The Clerk will publish this and the call for roadmaintenance, gravel and ditch mowing/weed control the last week in December and the1 St week of January in the Zumbrota and Rochester papers. All bids will be due by 7:00pm January 16th at the Board Meeting.

January 2, 2007 -

Chairman David O'Brien called the-December 19th 2006 Township Board meeting toorder. The 12/05/2006 minutes were reviewed and- BiranHervey motioned to approve aswritten. Denny Beyer seconded the motion and it carried 3-0.

The Clerk presented bills for payment. Beyer motioned to pay all bills with a second byHervey. The motion carried 3-0.

Geoffrey Griffin of GGG, representing Tower Investments, stated they would be sendingthe Township a check for the Hoehne annexation before the end of the year. He alsobrought up the possible annexation of the Elmer Stock property 300 plus acres. Griffinstated this would be done over time but would like to annex the 49.2 acres on the eastside of 52 right away. It was brought up that variances would be needed for the phasingof the Stock Property. O'Brien stated he thought a rezoning of the property couldaccomplish the same thing with out the hassle of obtaining variances.

Lynn Kelly of 9213 115 th St. NW Pine Island approached the Board about shot falling onhis house from the direction of the Hidden Valley Game Farm. He stated his wife andson had seen hunters on the game farm west of his home at approximately 4:00 pm. Theyheard shots and BB's landed on his porch. Supervisor Hervey researched the situation atthe game farm and found there were hunters in the field west of Kelly's but the guidedhunt ended at 2:30 pm according to the guide. Hervey was also showed where thehunters had hunted which was a good distance away from the Kelly property line.Hervey was also told by Butch Owens that he had heard the shots and had went toinvestigate on 2 occasions to see who the shooters were. There was some discussion onthe public hunters that circle the game farm and might have been responsible. O'Briensaid the game warden should be called immediately if it happens again. O'Brien will tryto get the game warden out for a future meeting to answer any questions Kelly may haveabout the incident. O'Brien further stated that each hunter at Hidden Valley signs arelease form and is responsible for his or hers conduct and Kelly could contact the gamefarm to find out who is hunting if there is another incident.

Mary Andrist, 11145 Co Rd 3 NW Pine Island MN said she has seen numerous publichunters hunt the ditches and roads around the game farm. She has on occasion

confronted hunters encroaching on their property. She went on to praise the game farmoperation and stated she was unaware of any other complaints, ever, with the game farmin the Township.

The construction company Kimball Paving will complete the Millering Bridge Project inspring of 2007.

Beyer stated that Gerald Meyer had called him about the township road question on 95 th

St.. Meyer was going to be out of town and wanted to hold off on any decision the Boardmight have. In the mean time Meyer had receive the letter from our attorney addressingthe situation.

O'Brien asked Gary West about his progress with getting township records back fromJane Krause and if he had began scanning records yet. He sent an e-mail to Krause buthadn't heard back yet.

MN Dot will be out to discuss the Stussy access of 52 situation.

The Township Christmas party will be January 27th . It will be pot luck.
