Dear Members:

It’s officially spring, and the legislative session continues. As of last week the deadline

for new bills has passed, and we made it to this point without any bills that are

detrimental to collective bargaining. However, it’s always possible that amendments to

bills can occur toward the end of the session, so we are watching this carefully.

It’s also time for local elections. The primary was held on Tuesday, April 4.

Councilman Stavros Anthony (Ward 4) and Judge Cedric Kerns (Department 5) won

their primaries with enough votes to avoid a runoff in June. Judge Susan Roger

(Department 2) ran unopposed. There are three races that will be determined in the

general election in June:

FMLA USE AND DISCIPLINE FOR ABUSE

As most everyone knows, the Family Medical Leave Act (FMLA), provides certain protections to

qualified employees who suffer from a serious health condition. As a preliminary matter, a “qualified” employee

is someone who has worked at least 1250 hours for an employer within the past year. A “serious health

condition” means an illness, injury or impairment that involves impatient care or continuing treatment by a health

care provider. “Continuing treatment” means that you have to be incapacitated for a period of more than three

consecutive calendar days and receive treatment by a doctor twice or once with a continuing regimen of care.

This obviously sounds somewhat convoluted (it was probably written by an attorney) but in practice it is fairly

simple. Any injury or illness that lands you in the hospital will be deemed a serious health condition. Also, any

time you are so sick/injured that you are forced to stay home for three consecutive days (and simply get seen by a

doctor such as your family physician) will be deemed a serious health condition. As most people know, if you

obtain certification from a physician that you have a FMLA covered serious health condition, you will be entitled

to twelve weeks per year of unpaid leave. The unpaid part doesn’t do much for you, but it is still helpful because

you get to continue to receive health insurance coverage from your employer while you are on FMLA leave.

Even more importantly, your employer cannot discipline you or take any other adverse

employment action against you just because you use FMLA leave. If the employer attempted to do so, it could be

sued in federal court for violating the FMLA. Moreover, you could contact the U.S. Department of Labor which

could investigate the matter and potentially sue the employer on your behalf. As employers such as the City of

Las Vegas are very well aware of this, they tread very lightly when it comes to employees’ use of the FMLA.

That being said, having an FMLA certified health condition does not give employees the right to

abuse sick leave. Just because an employee has FMLA leave doesn’t automatically mean that they can call in sick

with impunity. They actually have to be sick. This mainly applies to employees who have intermittent FMLA

leave. Intermittent FMLA leave is a serious health condition that requires ongoing medical treatment but which

doesn’t always affect the employee and only sometimes flares up. Examples would be migraines, serious sinus

problems, back problems, etc. Often the FMLA certification for such conditions allows the employee to miss a

specific number of days of work each month. So ultimately, when an employee calls in sick under the FMLA-

claiming for example that they are suffering from a dehabilitating migraine- they absolutely have to be truthful. If

they are not telling the truth, the employer can discipline them up through termination. Some employees aren’t

aware of this seemingly simple truth. They think that the mere fact that they have obtained an FMLA certification

for some health condition completely immunizes them from any discipline whenever they call in sick. The reality

is that the employer is still entitled to make sure that the employee truly is sick and to discipline them- often

severely- if the employee is found to be abusing the system. Thus, if you have an FMLA certified health

condition, please make sure you only rely on it and call in sick when you are actually sick. If you call in sick

based on an FMLA condition and then it is discovered that you actually went out dancing, you will wind up in

very hot water.
