Dear Sir(s) 1. Your offer for the above work for Rs.8,92,92,098/‐ (RUPEES EIGHT CRORE NINETY TWO LAKH NINETY TWO
THOUSAND AND NINETY EIGHT ONLY ) is accepted by the competent authority. The accepted schedule of items showing the rates and quantities is enclosed herewith. The completion period of the work is 12 (TWELVE) months from the date of issue of this letter. This Letter of Acceptance constitutes a binding contract between you and the Railway Administration. Please quote UCC in all further correspondence.
2. The Security Deposit (SD) for the contract is Rs.44,64,605/‐ (RUPEES FORTY FOUR LAKH SIXTY FOUR THOUSAND
SIX HUNDRED AND FIVE ONLY ). The Earnest Money Deposit of Rs.6,20,400/- remitted vide FDR No.614041 dated 27/09/2016 issued by BANK OF BARODA, SHOLAPUR, by you along with the offer is adjusted towards a part of the SD. The balance SD of Rs.38,44,205/-will be recovered from the running bills of the contract @ 10% of bill amount from each bill. Please note that no interest will accrue on the Security Deposit.
3. A Performance Guarantee (PG) for Rs.44,64,605/‐ (RUPEES FORTY FOUR LAKH SIXTY FOUR THOUSAND SIX
HUNDRED AND FIVE ONLY) is to be submitted by you within 30 (thirty) days from the date of issue of this letter in the forms mentioned in clause 4.0 (b) of Special Conditions of Contract. The PG shall be valid up to 60 days beyond the stipulated date of completion.
4. Please report to Dy. Chief Engineer/I/CN/UBL along with the detailed programme of work. Other conditions,
details and milestones are mentioned overleaf. This letter consists of two enclosures as given below. Please acknowledge the receipt of this letter.

Other conditions and details: 1. Extension of time for submission of PG beyond 30 (thirty) days and up to 60 (sixty) days from the date of issue of this letter may
be accorded by the Contract Agreement signing Authority. However, a penal interest of 15% per annum shall be charged for the delay beyond 30 (thirty) days on a daily basis i.e., from 31st day of the date of issue of LOA. In case you fail to submit the requisite PG even after 60 days from the date of issue of LOA, the contract shall be terminated duly forfeiting the EMD and other dues, if any payable against the contract and you shall also be debarred from participating in re‐tender for the work. The PG will be released after satisfactory completion of the work as per the contract conditions. If the contract is rescinded, the SD shall be forfeited and, the PG shall also be encashed. Further, you will be debarred from participating in the tender for executing the balance work
2. You shall execute an agreement for the work within seven days from the date of receipt of notice by Railways regarding
readiness of the agreement. The detailed programme of work to be submitted by you in conformity with the milestones given below or even earlier, shall be as stipulated in the special conditions. The programme shall indicate the time schedule of various items of works in the form of Bar Chart/PERT Chart/CPM Chart. The programme should also include the details of organization (in terms of labour and supervisors), plant and machinery intended to be utilized from time to time for execution of the work within the stipulated date of completion. In case of non‐submission of acceptable programme of work within 15 days of issue of this letter, you are liable for penal action including levying fine up to Rs. 50,000/‐.

The rails / rail panels have to be unloaded in such a way as to not infringe the movingdimensions. The rate includes any minor lateral shifting of rail panels (after they have been unloaded), if required, to clear infringement to moving dimensions. Such a shifting shall be doneimmediately before passage of trains as directed by the Engineer‐in‐Charge; 3. Demurrage / Wharfage charges levied, if any, due to delay in unloading of rails shall be borneby the contractor; 4. (i) Providing barricading without rail traffic block with contractor's wooden bullies / posts of minimum 75 mm dia. and minimum 2.1 m length by fixing vertically at every 3.0 m interval or asdirected duly excavating in all types of soils a pit of size 450 mm X 450 mm X 600 mm and fillingthe entire trench with M10 grade cement concrete with contractor's supply of cement (OPC 53 grade), 20 mm graded granite coarse aggregate, fine aggregate etc. duly embedding the postprojecting at least 1.5 m above ground level and at least 0.6 m below ground level, compactingthe concrete with vibrator, fixing 5 rows of 12mm dia. contractors nylon rope of approved colorand quality spaced equally in between the vertical members, painting the posts from top tobottom with red and white colour bands 100 mm wide and 100 mm apart withcontractorsapproved quality enamel paints as directed, fixing contractors yellow colour retro‐reflective tape of 50 mm width of approved quality on the posts on top white band. (ii) Removal of entire barricading without rail traffic block duly clearing it from site aftercompletion of all P Way works at the location after obtaining written permission of Dy. All of the above shall be executed with contractor's skilled personnel, tools and plant, vehicles,machinery, fuel, consumables, loading, unloading with all incidental charges and in all kinds ofweather conditions and site conditions including crossing of tracks wherever required duly observing all safety precautions and including all ascent, descent, taxes, duties, cess, surcharges,fees etc. completely as per the special conditions / specifications / regulations, as directed by theEngineer‐in‐Charge and as per the note(s) below. Notes: 1. This item consists of 3 stages of payment as mentioned in the sub‐items. The first 3 stages are for a lead of 150 m, the next 3 stages are for a lead between 150 m and 750 m and the last 3stages are for a lead between 750 m and 5000 m. Dumping shall be undertaken in these 3 stagesas instructed; 2. While operating sub‐items d, e and f, sub‐ items a, b and c need not be and shall not be operated as sub‐items d, e and f are all‐inclusive and not extra over sub‐ items a, b and c. Similarly while operating sub‐items g, h and i, sub‐ items a, b and c need not be and shall not be operated as sub‐items g, h and i are all‐inclusive and not extra over sub‐ items a, b and c; 3. Stage 1 i.e. dumping of ballast shall be done in two phases a) initial spreading and b) further dumping after laying the sleepers and linking the track as directed; 4. Stage ‐2 i.e. boxing of ballast to the required BG standard ballast profile as per the cushionspecified as per IRPWM includes finishing to the specified BG profile; 5. Payment shall be done as per stack measurement without deduction for any voids; 6. Stack wise prior written permission of Engineer‐in‐Charge shall be taken for dumping of ballast. No payment shall be made in case no such prior written permission is obtained by the contractor. In addition, penal action shall be taken for disturbing the ballast stacks without thepermission of the competent authority of Railway; 7. The rate includes leading and lifting / lowering of ballast at the top of steep cuttings or at the bottom of high banks on either side of the bank / cutting to the formation.
