What emerges from the preliminary provisionandsections1through7inthenewCodeisanoriginalciviljustice,unknown intermsofwhathasbeenfamiliar thus far. It requires learninganumberofnew foundationsandprinciples, suchas self-determination,communicationandcooperation.ThisworkshopprovidesuswithabettergraspofthephilosophyofthenewCodeandhelpstogaugeitsimpactonourpractice.

HOW TO MAKE THE MOST OF THE NEW DISPUTE SETTLEMENT PROVISIONS

WhenthenewCode of Civil Procedure(CCP)comesintoeffectinJanuary2016,itwillrequireadifferentapproachtodisputeresolutionandprevention. Essentially,itwillcallforavisionthatisresponsivetoachangingsocietyandthatputscitizensbackatthecentreofthejusticesystem.

Howarewetounderstandthesenewprovisionsandanticipatetheirimpactonourareasofpractice?Shouldwebequestioningourcurrentapproaches? Whatisbeingdoneelsewhere?

Comeandfamiliarizeyourselfwiththeseupcomingchanges:theyaregoingtoshiftthewaypeopleaccessjusticeinQuebecandwillsignificantlyimpactthewaythesystemevolves.Presentersatthesymposiumwillclarifythelaw,withregardforourdiverseareasofpracticeandvariedapproaches.

In 2011, Australia took an innovative step by adopting the Civil Dispute Resolution Act. This new legislation obliges mediation practitioners and prosecutorstoshowthateffortshavebeenmadetotrytoresolveissuesindisputebeforeproceedingsareinstitutedintheFederalCourtofAustralia.Thisishowthelegislatorhasensuredthat“genuinestepstoresolvedisputes”aretakenbeforelegalaction.
