It is recommended that:

1. Legislation be sought to continue the present legislation pertaining to Moirs Limited with respect to its occupancy of real property for the year 1964 except that portion which is occupied by the said Company for the purpose of its Bakery Division as contained in the Acts of Nova Scotias 1961; Chapter 659 Section 403

2. Legislation be sought to continue the present legislation pertaining to W. H. Schwartz 3 Sons Limited with respect to its occupancy of real property for the year 1964 at 8l4~26 Barrington Street and l09~ll Cornwallis Street so long as the same are used for manufacturing purposes of the Company as contained in the Acts of Nova Scotia, 1961, Chapter 65, Sec. 33;

3. Legislation be sought to continue the present legislation pertaining to the Halifax Shipyards Limited with respect to its real property and business occupancy taxes for the year 1964 as contained in the Acts of Nova Scotia, 1961, Chapter 65, Section 34.

The foregoing to be effective so long as the plants are being used for the same purposes as at the time of the enactment of this legislation.

The purpose of this comunication is to present an interim report on the conclusions which I and my colleagues from Provinces 8 Central Properties Limited have reached, in regard to the proposals called for by your Council, jointly with, and with ins approval of, the Central Mortgage and Housing Corporation, These proposals were for tne development of certain land [which 1 shall refer to as ”1hs siie-? at Halifax, N, 3., forming part of the Downtown area iwhich I snail refer to as “the area J.

we are aware tnat an Advisory Board, consisting of independent experts, has been called in to advise your Council and Central Mortgage and Housing Corporation in regard to the proposals for redevelopment of the site, put forward by the woking Group, of woking, England, on our behalf, and that the Board 3 report is awaited, This communication must, therefore, be subject to publication of the observations and recommendations of the Advisory Board, and to any decisions which your Council and the Corporation may take following such depots.

Having had the advantage of detailed discussions with Your worship and staff members, we now wish to put forward for your consideration the following observations:

10 In submitting our proposals, we observed the terms of reference laid down by your Council and the Central Mortgage and Housing Corporation, We have, however, had certain reservations concerning the location of the site in relation to the business centre, and as to its suitability for some elements of the development proposals called for.

2. Your Council may wish to reconsider the land use of the area in general and of the site in particular, and to formulate a comprehensive development plan for the Downtown area.

3, Having regard to the substantial expenditure of time and money which we have already incurred, we would hope to have the opportunity of being concerned in the implementation of any revision of the development scheme which may be decided upon. We confirm that we would be prepared to modify or adapt our proposals already made, as may be desirable for the purpose of producing a scheme, satisfactory as regards planning considerations to Ybur Council and satisfactory economically to ourselves,

4, We would further hope that your Council would be prepared to negotiate exclusively with us on the above matters, to the intent that we should have reasonable rights of first refusal in respect of any development project emerging from such negotiations and our original proposals, As a token of our interest and good faith we will leave in your hands the deposit of $f0,000.00, pending conclusion of negotiations.

Sc Should your Council require it, we would be fully prepared to make available, for the purposes of formulating a comprehensive plan for the area, the professional advice and experience of the experts retained by us, on such terms as may be reasonable,

Aldenman Macdonald referred to the ice and snow conditions on

certain downtown streets such as Blower, Prince and George Streets where

because of the hilly conditions motorists have difficulty in pulling away

from the parking meters and he asked if the Acting City Manager and

Commissioner of works could take any action to obviate this difficulty.

His worship the Mayor stated that the Acting City Manager would

be directed to bring the matter to the attention of the Commissioner of

works for suitable action.

Alderman LeBlanc referred to the report submitted by the

Commissioner of Works respecting sidewalk snow plowing and asked if Council

Mr. H. H. L. Pratley, Consulting Engineer for the Commission has, through the kindness of your Uommissioner of works, been provided with aerial maps of the City of Halifax which are the property of the City. Mr. Pratley wishes to use certain information from these maps for reproduction in his

report to the Commission required under the amendment to the Bridge Commission Act, Chapter ll9 of the Acts of 1961, and requests approval of the City in writing to the use of the material. This report will eventually be filed with the City of Halifax and the other three interested governments and will be confidential in the hands of the Commission. Section 509-1 was amended by deleting lines 26 to 29 inclusive and the first 4 words in line 30. was amended by deleting the words "and purchase" in line 38. was approved after discussion and the City Solicitor was directed to report subsequently as to whether or not there has been a wrong interpretation of the law.

Section 5g5 — deferred and the City Solicitor directed to report at the meeting scheduled for February 19th as to whether or not there is any conflict with the British North America Act, after discussing the matter with Mr. Henry Muggah of the Attorney General's Department.

He said that if recommendation #4 were put into effect, it would

fiend to stiffle any further apartment construction and the present

rents would be increased because of the increased tax load.

No submissions were received with respect to Parts 9 to

13 inclusive.

Referring to the members of the Town Planning Board,

Mr, Roach was advised by the City Solicitor that they are appointed

by the City Council and the _present Law provides that four tax-

payers may be appointed as well as three Aldermen.

Mr. Roach felt that citizens should be appointed along

with tse Aldermen.

His Worship the Mayor stated that the Council has

general powers to establish Boards but not one which would make a

final decision. He said that it was suggested that a Board of

Zoning Appeals and Adjustments be established to consider such

matters as modifications of the Zoning By~Lew as well as Zoning and

Rezoninqs.

Mr. Roach asked what control the City had with respect

to tie design of a proposed building by a developer end was advised

by His Worship the Mayor that such design must receive the approval

of the Development Department and the Building Inspector before it

accepted by Council. |... {:1

Mr. Roach was of the opinion that buildings of certain

design were only being erected in the North End of the Gity and not

in the South End to which His Worship the Mayor stated that Council

would be glad to learn of any specific case he had in mind.

There were no submissions received with respect to

Parts 14 to 18 inclusive.

bnyor replied that the sum of $lfl600,000.00, Public Service Commission Bonds,

is available for public work projects and if the Alderman felt that these

buildings should be improved; Couoil could earmark some part of the fund for this purpose; The utilization of the fund eould be planned over the years;

Alderman LeBlanc stated that the Council is hindered in its longs

range planning because of the lash of information reports,and he referred

specifically to the Afriorille question and the improvements to the Commons,

a report of which is now being prepared by Project Planners of Toronto. He

suggested that a special meeting of Council be held to explore the entire

operation; He also suggested that reports be prepared by Staff well in ad—

Vance and that they be followed up by the appropriate offieialso The Alderman

stated he was not being critical but was looking for information and action.

and it should give some indication as to what areas will become substandard.

It was his opinion that the City Manager and Commissioners should submit more

longerange planning reports to Council.

The foregoing suggestions were referred to the Acting City Nhnager

and City Manager for consideration.

An adjourned meeting of the City Council was held on

the above date.

After the meeting was called to order; the members of

Council attending, led by the City Clerk; joined in reciting the

Lord s Prayer;

There were present His Worship the Mayorg Chairman and

Aldermen Dewolf, Abbots, Breeng Lane; Macdonald_ Butler, Meagher;

LeBlane_ Trainor, Healyp Wyman, Connolly, O Brien and Greenwood.

Also present were Messrs; L; Mu Romksy, Acting city

Manager; R. H. Stoddard, W; J. Clancey, Lu Mitchell, G. P. West:

J, L_ Leiteh, R; B. Grant; V. W. Mitchell and Dr. A_ R. Morton.

The meeting was called to further consider the 1963

Budqefi.

7:40 p;m_ Council convened so meet as a flommittee of

the Whole; CIVIL DEFENCE

MOVED by Alderman Abbont, seconded by Alderman Lane,

that the budget as submitted be approved. Motion passed.

§EGIONAL LIBRARY BOARD

MOVED by Alderman Lane_ seconded by Alderman O Brien,

that the budget as submitted be approved.

Considerable discussion took place with respect to

the establishment of a branch library and gigs cameron reported

that the Board has not yet decided on a site for such a branch

but is considering the possibility of a Bookmobile service in the

City.
