Dear Fellow Conservatives,

We are pleased to present the American Conservative Union Foundation’s ratings for the 2016 meeting of the Missouri General Assembly. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The Missouri legislators with the highest scores voted most consistently with the ideals articulated in the U.S. Constitution: limited and transparent government, individual rights, personal responsibility, and lasting cultural values.

In 2015, ACU Foundation was proud to make history by being the first organization to rate every single state legislature across the full spectrum of issues, helping each voter understand how his or her state ranks among the rest.

Ultimately, we are trying to help people understand what conservatism is and how it improves the lives of everyday Americans. Conservatism is the political philosophy that sovereignty resides in the person. We think that understanding this idea is essential if Americans are to successfully govern themselves again.

Working with our policy centers and fellows, the ACU Foundation engages in deep policy analysis to help create our annual state scorecards. We have enhanced the vote descriptions this year to show this effort more clearly.

By examining all 50 of our State Ratings, we can see which states have most effectively promoted conservative solutions and which have struggled. Our ratings also help identify legislators who have courageously fought against liberal majorities. We hope that this guide helps you learn how well, or poorly, your legislators work to preserve the values we share.

SELECTING THE VOTES

ACU researched and selected a range of bills before the Missouri General Assembly that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Missouri’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. SB 919 Beer Sale Regulations. This bill allows retail stores to sell containers of beer that are more than 32 ounces, which are known as “growlers.” Currently, sales of growlers are restricted to breweries and brew pubs. ACU supports the ability of retailers to fully compete in the free market and supported this bill. The Senate passed the bill on March 3, 2016 by a vote of 18-14.

2. SJR 39 Religious Freedom. This resolution proposes a state constitutional amendment that prohibits the government from imposing a penalty on anyone who refuses to participate or provide goods and services or a facility for a wedding that violates their religious beliefs. ACU supports the Constitution’s first amendment that states “Congress shall make no law prohibiting the free exercise of religion” and supported this resolution. The Senate passed the resolution on March 10, 2016 by a vote of 23-7.

3. SB 786 Voter Fraud Investigations. This bill allows the Missouri Secretary of State to investigate cases of voter fraud. Currently, these cases are referred to local jurisdictions. ACU supports efforts to prevent voter fraud and supported this bill. The Senate passed the bill on March 31, 2016 by a vote of 25-4.

4. SCR 46 Minimum Wage Mandate. This resolution suspends a rule issued by the state Department of Health and Senior Services that sets a wage level for home care employees above the minimum wage without the approval of the state legislature. An increase in the minimum wage results in higher unemployment. High rates of unemployment hinder family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes these artificial wages that costs jobs and harms those that need employment the most and supported this resolution. The Senate voted to override the Governor’s veto of the resolution on April 6, 2016 by a vote of 24-8.

5. HB 1698 Convention Subsidies. This bill creates a new government entity that provides up to $1 million in taxpayer funds to organizations planning a convention within the next five years, provided they meet a series of requirements and they are approved by the Director of the Department of Economic Development. ACU opposes these corporate subsidies that favor one organization over another and opposed this bill. The Senate passed the bill on April 25, 2016 by a vote of 27-4.

6. HB 1631 Voter ID. This bill requires a photo ID for voting at the polls. Under the bill, if a person does not possess a photo ID, the state will provide a free ID and pay for the documents needed to obtain it. ACU supports efforts to protect the integrity of the ballot and prevent voter fraud and supported this bill. The Senate passed the bill on May 3, 2016 by a vote of 24-8.

7. HB 1565 Nasheed Amendment Obamacare Implementation. The Nasheed amendment – SA #3 – to a bill amending the Missouri state healthcare system expands Medicaid under Obamacare. ACU opposes expanding a program rife with waste and fraud with no reforms and opposed this amendment. The Senate defeated the amendment on May 10, 2016 by a vote of 7-24.

8. HB 1891 Paycheck Protection. This bill requires that a union employee give permission before union dues and fees are deducted from the employee’s pay. ACU supports the right of employees to decide how they will pay union dues and supported this bill. The Senate failed to override the Governor’s veto of the bill on May 12, 2016 by a vote of 22-10 (23 votes were required).

9. SB 608 Medicaid Reform. This bill allows a Medicaid provider to impose a missed appointment fee for patients who fail to cancel an appointment 24 hours in advance. The fee ranges from $5 for a first missed appointment to $20 for a third missed appointment. The bill also provides for the right of the provider to refuse to schedule another appointment until the fee is paid. ACU supports reform of a program rife with waste and fraud and supported this modest reform as a step in the right direction. The Senate voted to override the Governor’s veto of the bill on September 14, 2016 by a vote of 24-7.

10. SB 656 Constitutional Carry. This omnibus Second Amendment rights bill allows most people to carry concealed firearms without a permit, expands the “castle doctrine” for self-defense, at home and strengthens “stand your ground” laws, among other provisions. ACU supports the founders’ belief in the Second Amendment and supported this bill. The Senate voted to override the Governor’s veto of the bill on September 14, 2016 by a vote of 24-6.

11. SB 844 Liability for Livestock Trespass. This bill attempts to provide a reasonable legal standard of requiring the owner of livestock to be proven “negligent” if his or her livestock trespasses onto another’s property. The current standard holds that livestock owners are “strictly liable”, a standard associated with inherently dangerously animals like lions and tigers. ACU believes in due process for all and supported this bill. The Senate vote to override the Governor’s veto of the bill on September 14, 2016 by a vote of 24-7.

12. SB 847 Tort Reform. This bill changes the law in personal injury cases so that the award reflects the actual cost to the injured person. Currently, the rules exclude evidence showing that the injured person has received other compensation from insurance or worker’s compensation. ACU supports tort reform and supported this bill. The Senate voted to override the Governor’s veto of the bill on September 14, 2016 by a vote of 24-6.

1. HB 1795 Welfare Reform. This bill allows the Department of Social Services to hire an independent company to verify eligibility for welfare programs. ACU supports increased oversight of government spending programs and supported this bill. The House passed the bill on February 11, 2016 by a vote of 129-27.

2. HB 2011 Dunn Amendment Obamacare Implementation. The Dunn amendment – House Amendment #2 – to the Department of Social Services appropriations bill eliminates a provision that prohibits using funds to expand Medicaid under Obamacare. ACU opposes expanding a program rife with waste and fraud with no reforms and opposed this amendment. The House defeated the amendment on March 8, 2016 by a vote of 40-116.

3. HB 1738 Rizzo Amendment Wage Mandate. The Rizzo amendment to the water main liability bill removes the homeowner exemption from paying the “prevailing wage” for extending a water main to connect to the water supply. ACU opposes these artificial wages that are set above the market rate and unnecessarily increase the cost of projects and opposed this amendment. The House defeated the amendment on March 14, 2016 by a vote of 57-81.

4. HB 1370 Parental Notification. This bill requires both parents of a minor to be notified before an abortion is performed. The state already requires the written consent of one parent or guardian. ACU believes abortion is a human tragedy, supports restrictions on the practice, and supported this bill. The House passed the bill on March 17, 2016 by a vote of 121-34.

5. HB 1786 Powdered Alcohol. This bill bans the sale or serving of powdered alcohol. ACU opposes banning a product found to be safe and is banned primarily to reduce competition and opposed this bill. The House passed the bill on March 31, 2016 by a vote of 95-56.

6. HB 2499 Job Training Subsidies. This bill provides taxpayer funds to pay for up to 50 percent of the cost of employee job training for companies selected by the government that are creating new jobs. Job training funds are prohibited if the employees are replacing those on strike. ACU opposes these subsidies that favor one business over another and opposed this bill. The House passed the bill on April 5, 2016 by a vote of 141-7.

7. HB 1413 Ethanol Subsidies. This bill extends the states’ ethanol subsidy program by five years, to 2020. ACU supports all forms of energy, does not believe government should favor one form of energy over another, and opposed this bill. The House passed the bill on April 5, 2016 by a vote of 104-47.

8. HB 1464 Motorcycle Helmets. This bill allows anyone who is 21 years or older to operate a motorcycle without wearing a helmet as long as the operator fulfills a list of requirements, including a safety course, having possessed a license for two years, and having the proper insurance. ACU supports the right of motorcycle operators to make their own decisions on personal safety and supported this bill. The House passed the bill on April 7, 2016 by a vote of 103-43.

9. HB 2330 Ride Sharing Regulations. This bill provides a regulatory framework to allow ride sharing companies, such as Uber and Lyft, to operate in Missouri. The bill prevents local governments from imposing a tax or requiring a license for ride sharing companies. It also allows taxicabs to follow the lower regulations outlined in the bill. ACU supports a free market for ride sharing companies and supported this bill. The House passed the bill on April 7, 2016 by a vote of 115-34.

10. HB 1466 Licensing Reform. This bill begins the process of licensing reform by establishing guidelines for future regulations, including the right of individuals to engage in the occupation of his or her choice, and stipulating that regulations should only be imposed when there is an interest in protecting the public welfare. Expanding entrepreneurship promotes economic growth, which leads to greater family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes the proliferation of licenses in many states and supported this bill as a step in the right direction. The House passed the bill on April 11, 2016 by a vote of 113-36.

11. HB 1951 Right of Contract. This bill nullifies contractual provisions in homeowners associations' agreements that prohibit the construction of outside antennas for amateur radio operations. ACU supports the right of private contracts and opposes this bill. The House passed the bill on April 11, 2016 by a vote of 86-66.

12. HB 1718 Arbitration Regulations. This bill clarifies Missouri arbitration agreements that have been weakened by court decisions. The bill states that the arbitrator must make all initial decisions as to whether arbitration has been agreed to by the employer and employee and whether specific claims can be settled by arbitration. ACU supports the right to settle disputes through arbitration rather than costly lawsuits and supported this bill. The House passed the bill on April 12, 2016 by a vote of 86-68.

13. HB 1427 Government Transparency. This bill requires all school districts and charter schools to develop and maintain a web portal that makes available budget, income, and expenditure information. ACU supports government transparency in the spending of public funds and supported this bill. The House passed the bill on April 12, 2016 by a vote of 85-69.

14. HB 2065 Corporate Subsidies. This bill permits municipalities to enter into loan agreements that provide special tax relief for technology business facilities if, “in the judgement of the governing body of the municipality, the project will produce economic benefits to the municipality.” ACU opposes government benefits for one business over another and opposed this bill. The House passed the bill on April 25, 2016 by a vote of 112-34.

16. HB 1679 Insurance Mandate. This bill requires health insurance plans that provide coverage for contraceptives must cover the cost of a three month supply for the first dispensing and a 12 month supply for the second dispensing even if the insured was not enrolled in the plan at the time of the first dispensing. ACU opposes these mandates that drive up the cost of insurance for everyone and opposed this bill. The House passed the bill on April 26, 2016 by a vote of 97-50.

17. SB 765 Fraker Amendment Municipal Broadband Regulations. The Fraker amendment to a bill concerning local law enforcement requires local governments to conduct a feasibility study before they agree to set up and run taxpayer-funded broadband services. They then put the project up for a vote. ACU opposes government agencies competing with private enterprise for broadband services and supported this amendment. The House adopted the amendment on May 2, 2016 by a vote of 106-36.

This resolution proposes a state constitutional amendment to declare that unborn children have a natural right to life at every stage of biological development and that the state of Missouri must protect that life to the extent permitted by the U.S. Constitution. ACU Foundation’s Center for Human Dignity engages heavily on these issues and believes abortion is a human tragedy and supports the rights of the unborn. ACU supported this resolution. The House passed the resolution on May 5, 2016 by a vote of 110-37.

23. SB 786 Voter Fraud Investigations. This bill allows the Missouri Secretary of State to investigate cases of voter fraud. Currently, these cases are referred to local jurisdictions. ACU supports efforts to prevent voter fraud and supported this bill. The House passed the bill on May 12, 2016 by a vote of 103-32.

24. SB 608 Medicaid Reform. This bill allows a Medicaid provider to impose a missed appointment fee for patients who fail to cancel an appointment 24 hours in advance. The fee ranges from $5 for a first missed appointment to $20 for a third missed appointment. The bill also provides for the right of the provider to refuse to schedule another appointment until the fee is paid. ACU supports reform of a program rife with waste and fraud and supported this modest reform as a step in the right direction. The House voted to override the Governor’s veto of the bill on September 14, 2016 by a vote of 110-45.

25. SB 656 Constitutional Carry. This omnibus Second Amendment rights bill allows most people to carry concealed firearms without a permit, expands the “castle doctrine” for self-defense at home, and strengthens “stand your ground” laws, among other provisions. ACU supports the founders’ belief in the Second Amendment and supported this bill. The House voted to override the Governor’s veto of the bill on September 14, 2016 by a vote of 112-41.

26. SB 844 Liability for Livestock Trespass. This bill attempts to provide a reasonable legal standard of requiring the owner of livestock to be proven “negligent” if his or her livestock trespasses onto another’s property. The current standard holds that livestock owners are “strictly liable”, a standard associated with inherently dangerously animals like lions and tigers. ACU believes in due process for all and supported this bill. The House voted to override the Governor’s veto of the bill on September 14, 2016 by a vote of 114-40.

27. HB 1631 Voter ID. This bill requires a photo ID for voting at the polls. Under the bill, if a person does not possess a photo ID, the state will provide a free ID and pay for the documents needed to obtain it. ACU supports efforts to protect the integrity of the ballot and prevent voter fraud and supported this bill. The House voted to override the Governor’s veto of the bill on September 14, 2016 by a vote of 115-41.
