IPR

The base customs legislation in the field IPR is Council Regulation (EC) No 1383/2003 concerning customs action against goods suspected of infringing certain intellectual property rights and the measures to be taken against goods found to have infringed such rights.

In Slovak Republic we have taken national act No 200/2004 on measures against infringing intellectual property rights at the import, the export and the re-export.

On the basis of the request of right-holders to strengthen the competence of the customs administration in the field of intellectual property rights is amendment of the national law available since January 2010.

According that amendment the customs officials should carry out inspection of goods suspected of infringing intellectual property rights on the internal market.

Strengthening the competence to carry out inspection on the internal market by the authorities responsible for the security market such as Customs authorities also gives a presumption to reduce counterfeiting of products and increase consumer safety.

Within the frame customs inspection Slovak Customs

Administration cooperate mainly with private sector - right-holders.

Cooperation with private sector is on high level. Some right-

holders are often training customs officials on the field recognition

counterfeiting or piracy goods.
