Barbara Speedling, a quality-of-life specialist,provides education, training and support to long-term-care providers in the development of pro-grams and services to meet the needs of individu-als with dementia, mental disorders, brain injury,and complex psychosocial needs. In 2014, sheauthored, “Why is Grandma Screaming?” a guideto improving the quality of life for the elderly. Sheis a master trainer for the OASIS dementia educa-tion program.

With the push toward interoperability, electronicmedical records have become ubiquitous in thedelivery of skilled-nursing care. While the burgeon-ing use of eMRs holds great promise, it also pre-sents new challenges that can be traps for theunwary. The upsurge in the use of electronic discov-ery in litigation intensifies the risks. This sessionidentifies the potential pitfalls and describes thenew rules of the road. It identifies the key featuresof eMRs that distinguish them from paper recordsand explains how these features are transformingnot only the delivery of healthcare, but also the pro-tocols for maintaining privacy and asserting privi-lege. It examines best practices for the developmentand maintenance of digital information. It also sug-gests strategies to safeguard digital data from pry-ing eyes, whether through inadvertent oversight,deliberate overreaching, or malicious cyber-theft.

SPEAKER: JANE BELLO-BURKE, ESQ.

Jane regularly counsels hospital, nursing-home(SNF), assisted-living-facility (ALR and ALP), con-tinuing-care-retirement community (CCRC), andhome-care agency (CHHA and LHCSA) providers,as well as social-services agencies and individualpractitioners, in meeting their regulatory obliga-tions. She focuses on operational, regulatory, reim-bursement, and compliance issues. A seasoned liti-

gator, Jane also represents healthcare providers infederal and state litigation, including Article 78proceedings, and administrative hearings beforethe Health and Human Servic es DepartmentalAppeals Board (DAB), and the ProviderReimbursement Review Board (PRRB). In addi-tion, she guides providers in the implementationand operation of effective compliance programsand represents them in Medicaid audits, investiga-tions, and appeals.

With the unprecedented change and uncertaintyin the area of labor and employment law, it hasbecome increasing difficult to effectively managehealthcare workforces. During this 90-minute pro-gram, Mike will examine a number of significantchanges at the federal and state level that requireoperators to re-assess their handling of employees,workplace policies and labor relations priorities.

Michael Heckle is a principal in the White Plainsoffice of Jackson Lewis P.C. He received undergrad-uate degrees in Liberal Arts (1994) and Education(1996) from the University of Manitoba in Winnipeg,Canada and a Juris Doctorate degree from HofstraUniversity School of Law (2001). He was a JonathanFalk Labor Award recipient and a member of theWagner Labor Moot Court. He came to JacksonLewis PC in 2001 and has been an active memberin the firm’s labor practice group since that time.

11:00AM – 12:30PMCMS FINAL RULE PHARMACY SERVICESUPDATE: WHAT YOU NEED TO KNOW!

In this session, Dr. Hallett will review the recentlyreleased update of the “State Operations ManualAppendix PP,” which was implemented in CMS’sPhase 2 rollout of the regulatory reform of theMedicare and Medicaid Requirements forParticipation Final Rule. He will specifically high-light important aspects of the Guidance toSurveyors in the newly renumbered F-Tags forPharmacy, as well as touch on the role of the con-sultant pharmacist in antibiotic stewardship as high-lighted in the guidance document.

Dr. Hallett founded Guardian ConsultingServices, Inc., which is dedicated to providingconsultant pharmacist services to nursing homes,adult-day programs, assisted-living facilities, andgroup homes for the disabled. His company cur-rently provides clinical-consultant pharmacist ser-vices for more than 40,000 patients in over 250

healthcare facilities and programs throughout theNortheast and Mid-Atlantic.

1:30PM – 3:00PMNYSHFA AND LEGAL UPDATES

New York’s healthcare administrators are facinga number of legal, legislative, and regulatoryissues that could directly impact their ability todeliver high-quality, cost-effective, long-term carethroughout the state. This session will shed lighton the key legal, legislative, and regulatory issuesfacing providers and examine their practical opera-tional implications as well as their impact on thedelivery of care.

SPEAKERS: STEPHEN B. HANSE, CORNELIUS D. MURRAY, AND DANIEL HIEM

Stephen B. Hanse serves as vice president ofgovernmental affairs & counsel for the New YorkState Health Facilities Association (“NYSHFA”)and the New York State Center for Assisted Living(“NYSCAL”). Prior to joining NYSHFA/NYSCALin early 2013, Stephen was with the firm ofFeatherston, Haugh, Wiley & Clyne, LLP inAlbany, New York where he represented numerousFortune 500 companies, healthcare organizationsand healthcare providers and professionals beforeNew York’s Executive, Legislative and Judicialbranches of government.

Cornelius D. Murray is a senior partner in thelaw firm of O’Connell and Aronowitz, in Albany,New York. He is a member of the firm’s HealthLaw practice and supervising partner of itsAppellate Law, Constitutional Law, and IndianGaming practices. He has represented many clientsin the healthcare industry and is currently generalcounsel for the New York State Health FacilitiesAssociation where he focuses on issues involvingcomplex Medicare and Medicaid reimbursementissues, regulatory compliance and certificates ofneed.

Dan Heim is executive vice president ofLeadingAge New York (formerly the New YorkAssociation of Homes and Services for the Aging).He oversees the association’s public-policy effortsincluding policy development, regulatory affairs,member communications, and litigation activities.LeadingAge New York represents nearly 500 not-for-profit and governmental providers of senior-living services throughout the state.

4:00PM – 5:30PMMEDICARE REIMBURSEMENT UPDATE: RCS-I

The new Medicare Part A payment system is tar-geted for implementation on October 1, 2018. Thisis not a “refinement” as we’ve experienced in thepast. The Resident Classification System adds sig-nificant complexity, with five distinct paymentdomains including a diagnosis-driven therapycomponent and length-of-stay-weighted per diemrates. Mastering the system will require facility-wide changes in care management and documenta-

SNF environment. Achieving outstanding short-term rehabilitation outcomes, avoiding rehospital-izations and staying in compliance with the regula-tion of psychotropics all require state-of-the-artpsychiatric and psychological care woven intooverall medical care.

The appropriate management of psychiatric con-cerns with evidence-based treatment has alwaysbeen essential to a facility’s ability to operatewithin the regulatory environment while maintain-ing an attractive climate for residents, families andstaff. But modern SNFs are confronted by newimperatives that require fundamental shifts in carein order to avoid potentially devastating conse-quences.

Case studies and clinical presentations will high-light effective strategies for implementing evi-dence-based GDRs, non-pharmacologic interven-tions for managing difficult behaviors, clinicalprotocols for avoiding re-hospitalizations, andother essential ideas for succeeding in the currentregulatory and financial landscape.

SPEAKER: DR. RICHARD JUMAN

Dr. Richard Juman is a licensed clinical psy-chologist and the national director of psychologi-cal services for TeamHealth, which provides inte-grated medical, psychiatric and psychological ser-

tion. This program will provide early insight intothe most significant payment reform in 20 years.Presenters will also review new regulations spe-cific to the MDS, SNF value-based purchasing,alternative-payment models and reimbursementpenalties.

SPEAKERS: SHERYL ROSENFIELD, RNAND MARC ZIMMET

Sheryl Rosenfield has been active in the nation-al SNF community for over 30 years. She is amember of the Health Care ComplianceAssociation’s Long-Term-Care Committee, work-ing with representatives throughout the UnitedStates on protocols and policies effecting medicalreview and payment concerns. As a trainer of theMDS since 1990, she was a founder of AANAC, anational organization serving over 15,000 mem-bers associated with the assessment and careprocesses in skilled-nursing facilities. Sheryl hasworked with the Centers for Medicare & MedicaidServices (CMS) on multiple projects, includingserving on the Technical Expert Panel to evaluatethe implementation and impact of the RUG PPSon SNFs. She was a member of the clinical-stan-dards-and-training team for the federal DAVE pro-ject and served as a Data Monitor for the federalSTRIVE project. She also served as an “MDS 3.0Manual” reviewer and continues to contribute tothat project.

Marc Zimmet entered the skilled-nursing indus-try in 1993, at the onset of the national “sub-acute”care movement. Medicare cost-report appeals werea key component of a successful short-term reha-bilitation program, and Zimmet & Company (theprecursor to ZHSG) quickly emerged as a nationalleader in the space. As skilled-nursing facilitiestransitioned to prospective payment in the late1990’s, Mr. Zimmet applied his experience fromNew York State’s participation in the NursingHome Case-Mix & Quality Demonstration projectto develop early reimbursement-compliance-man-agement strategies for his clients. He now leads theeven more challenging transition tovaluebased/alternative-payment and managed care.

Recognizing the market and regulatory changestransforming the healthcare landscape, Marc struc-tured the firm’s “Advanced Healthcare Initiatives”program in 2015. His vision has been realizedthrough the four Zimmet Healthcare “spectrum”companies, establishing the firm as a leader in SNFdata analytics, care management/transitions tech-nology and outsourced case management.

8:15AM – 9:45AMIMPROVING FINANCIAL AND CLINICAL OUT-COMES WITH INTEGRATED BEHAVIORAL HEALTH

Successful integration of behavioral-health ser-vices has become indispensable to survival in the

vices in thousands of post-acute and acute facili-ties in the U.S. He is an expert in the psychothera-peutic and behavioral treatment models utilized inpost-acute care. Dr. Juman lectures on a variety ofissues pertaining to the populations found inpostacute care as well as on specific problems ofaging.

Shelly Glock is the deputy director, Division ofNursing Homes and ICF/IID Surveillance, NYS-DOH. Ms. Glock is a LNHA and brings a varietyof experience with her to this position. Mostrecently she held the position of quality improve-ment specialist with IPRO’s Care Transitions pro-ject team under the CMS 10th Scope of Work. Shewas responsible for the design, implementationand evaluation of community-care-transition ini-tiatives to decrease unnecessary hospitalizationsand improve the experience of Medicare benefi-ciaries and caregivers as they transition acrosshealthcare settings.
