DescriptionA productive arable holding with a multi-purpose farm building. The land has been growing combinable crops, sugar beet, carrots, parsnips and potatoes in recent years.
The holding benefits from three reservoirs and two irrigation licences.
Location The farm is located to the south west of the City of Lincoln and south and west of Carlton le Moorland. The land lies in 4 distinct lots, but has been farmed as a whole for many years.
Situation and AmenitiesThis is a good arable farming area with mainly clay loam soils, around 20m above sea level.
Lincoln is a cathedral city and the administrative centre of Lincolnshire with an urban population of 130,200 (mid 2014 est). It offers a good range of facilities and amenities with boutique shopping in the cathedral quarter, restaurants and pubs, sports facilities, golf courses, supermarkets, leading retailers, medical and educational facilities. The University of Lincoln was established over 20 years ago and brings vibrancy to the life of the city.
Carlton Le Moorland is an attractive village with a church and public house. There is a wide range of good quality housing in the locality.

Method of saleThe farm is offered for sale by formal tender, as a whole or any combination of 4 lots.

Lot 3 - 254.22 acres (102.87 ha) Brigg Lane, Carlton le Moorland, LN5 9HX
Lot 4 - 12.54 acres (5.08 ha) Broughton Road, Carlton le Moorland, LN5 9HP
TENDER DATE: MONDAY 31ST JULY 2017 BEFORE 12 NOON
The land is to be sold by contractually binding formal tender on the following terms:
1. All tenders must reach the office of JHWalter, 1 Mint Lane, Lincoln, LN1 1UD no later than 12 noon on Monday 31st July 2017. No late tenders will be considered.
2. Tenders should be submitted in writing on the prescribed form complete with the signed tender form and contract and placed within a sealed envelope marked “Land at Carlton le Moorland”.
3. Tenders must be for a precise sum of pounds sterling. It is advised that tenders should be for an odd figure to avoid the possibility of identical bids.
4. No tender will be considered which is calculated only by reference to another tender.
5. The seller does not undertake to accept the highest or indeed any tender.
6. Full name and address of both the prospective buyer and their solicitor must be provided with any tender.
7. Confirmation of finance for the purchase should be included with the tender.
8. Tenders are to be accompanied by a Solicitor deposit cheque of 10% payable to the seller’s Solicitor. The successful buyer(s) will be notified via a signed contract by the seller no later than 5pm on Monday 7th August 2017, at which time the sale will be exchanged. Completion will take place on 1st September 2017.
9. Copies of supporting legal documentation referred to as a ‘Tender Pack’ is available from the Seller’s Agent preferably on request by the Solicitor/Agent acting for the prospective buyer. This includes; Tender Form, Conditions of Tender, Contract of Sale, Search Results, Relevant Title Documents.
The Land & Farm BuildingThe land - divided into parcels well suited to modern machinery, and capable of growing good yields of combinable crops, root crops and sugar beet. The holding benefits from three reservoirs and two irrigation licences, which serve land in the locality, in addition to the farm. There is a small area of amenity woodland, and two sugar beet pads.
The land is shown on the MAFF land grading plans as classified grade 3.
The soil is a mix of the following Soil Associations:
Evesham 2 - Slowly permeable calcareous clayey soils. Some slowly permeable seasonally waterlogged non-calcareous clayey and fine loamy or fine silty over clayey soils. Suitable for growing winter cereals.
Wickham 2 - Slowly permeable seasonally waterlogged fine loamy over clayey, fine silty over clayey and clayey soils. Small areas of slowly permeable calcareous soils on steeper slopes.Suitable for growing cereals.
Blackwood - Deep permeable sandy and coarse loamy soils. Groundwater controlled by ditches. Suitable for growing cereals; potatoes and sugar beet.
The Farm Building - approximately 70ft x 65ft (21.4m x 19.8m)Steel portal frame building with grain walling to two sides and cladding to two sides. Concrete floor and roller shutter door to front elevation.
Basic Payment SchemeIncluded in the sale are Basic Payment Entitlements relating to the eligible land, which will be transferred to the buyer after completion. The value of the entitlements will be apportioned from the sale price for the land in the contract. The entitlements will be valued at £140 per entitlement.

Environmental SchemesThe land is part of a larger Entry Level Stewardship Agreement which will continue until 31st December 2017. The seller will retain the right of holdover for management of features within the agreement until it expires. The buyer will not interfere with the agreement in any way. A copy of the agreement is available in the tender pack.
Sporting RightsThe shooting rights are included with the freehold but will be reserved by the seller until 2nd February 2018. The seller has drilled game cover plots, details and location of which can be found in the tender pack.
Mines and MineralsThe mines and minerals are included, in so far as they are owned.
TenureThe land has been farmed by H W Smith & Sons (Carlton) Ltd and vacant possession will be given on completion, other than on land where seasonal cropping licences have been granted to third parties for the current cropping season.
Restrictions and Development ClawbackThere is a Development Clawback of 20% of the uplift in value on the grant of planning consent for non-agricultural use within 50 years on field no. 3829 in Lot 1; field nos. 4657 and 6759 in Lot 2.
ServicesThere is mains water and electricity to the Farm Building.
HoldoverThe seller reserves the right to holdover on the land drilled with game cover plots until the 2nd February 2018.
Licences are in place for the growing of potatoes, sugar beet and wheat by third parties and will continue until their agreed end date. The licence fees for the full term of occupation are reserved to the seller.

Easements, Wayleaves and Rights of WayThe property is sold subject to and with the benefit of all easements, wayleaves and rights of way whether public or private and whether or not mentioned in these particulars of sale.
An overhead electricity line crosses field 3748.
Public rights of way cross the following fields: 5450, 9944, 8916, 4759, 3728, and 3748.
DrainageDrainage rates are payable to Upper Witham Drainage Board. A copy of the most recent invoice and any drainage plans can be found in the tender pack.
VATIt is not thought that the sale will attract VAT. However, in the event that any of the property is sold subject to VAT, this will be payable in addition to the purchase price.
Growing Crops and ingoing valuationIn addition to the purchase price, the buyer will be required to pay to the seller the full amount of the ingoing valuation due to the outgoer. There will be no counterclaim whatsoever of any kind.

IrrigationThe land is sold with the benefit of two abstraction licences. and underground irrigation mains.
Licence A - Licence to abstract with one pump, between two points on the River Witham to fill and top up two storage reservoirs on Lot 1. Water may be transferred from the reservoirs to the River Witham for re-abstraction. A total of 91,000 cubic metres per annum may be abstracted. There is no restriction on the land which can be irrigated.
The benefit of Licence A will be transferred to the purchaser of Lot 1.
Lot 1 benefits from underground irrigation mains. The route is shown on a plan in the tender pack. A main from each of the two reservoirs on Lot 1 head north, one crossing Norton Disney Road before heading west to the River Witham, the other heading east towards Carlton le Moorland before turning north again.

The irrigation main, which is served from Abstraction Point A on the River Witham crosses third party land. There is an agreement in place for the underground pipework which transfers water from the River Witham to the reservoirs and back again.
Licence B - Licence to abstract 22,727 cubic metres per annum from an un-named drain flowing into Little Syke to be transferred to a storage reservoir on Lot 3. Water can be used for spray irrigation of crops upon any of the land shown outlined red on the plan attached to the licence. (The land outlined red incorporates Lot 3, part of Lot 2 and land owned by third parties.)
The benefit of Licence B will be transferred to the purchaser of Lot 3.
Fixtures and Fittings All fixtures and fittings are excluded unless specifically mentioned in these particulars of sale.
Town and Country PlanningThe land is within North Kesteven District. Planning policy for the district is the recently adopted Central Lincolnshire local plan.

DirectionsFrom the A17/A46 at Newark take the A17 towards Sleaford. In 2 miles, take the first left off the roundabout signposted Stapleford. Follow the road for around 5.5 miles. You will pass through Stapleford village. You will reach a sharp right hand bend where Carlton Le Moorland will be signposted 1 mile. Once you have crossed the River Witham Lot 1 will begin at the second field on your right.
For Lot 2, continue into the village and take the first right onto Wheatley Lane. You will reach Clay Lane and Lot 2 will be directly in front of you.
For Lot 3, from Wheatley Lane turn left onto Clay Lane and continue until you reach a right turn onto Brigg Lane. Follow Brigg Lane and the land will be on the right hand side.
Lot 4 is located to the East of Carlton Le Moorland on Broughton Road.
