PROJECT BACKGROUND

A. Background

1. The Rural Road Improvement Project (RRIP) II or referred to in this report as” the Project” will rehabilitate about 1,200 km of priority rural roads in ten provinces (Tboung Khmum, Kampong Cham, Kampong Thom, Siem Reap, Banteay Meanchey, Battambang, Pursat, Kampong Speu, Kampong Chhnang, and Takeo). Most of these roads are located around Tonle Sap Basin. The project will provide a reliable all-year road access from provincial towns and agricultural rural areas to markets, employment centers, and social services in the area of influence. Over a million rural residents will be benefited by the project. The rehabilitated roads will provide the poor rural provinces with a safer, cost-effective rural road network with all-year access to markets and other social services. The Project is being implemented by the Ministry of Rural Department.

2. ADB approved the loan for the abovementioned Project on 8 August 2014 for $54 million (equivalent to SDR34,918,000 from ADB’s Special Funds resources by paving 729 kilometers (km) of rural roads in 10 provinces. The ADB loan funds the civil works, related consulting services, equipment, and project management. The Government of Australia, through the Department of Foreign Affairs and Trade or DFAT, finances all outputs except the Connectivity Improvement of the Mekong River Islands and Efficient Project Management, through a $ 6.67 million grant. Korea Eximbank (KEXIM) of the Government of Korea finances the civil works and related consulting services through a $41 million loan, while the Nordic Development Fund finances the output of climate change adaptation framework of investments under the Connectivity Improvements of the Mekong River Islands Output through a Euro 4.5 million ($5.4 million equivalent grant). Loan effectivity of the ADB loan was on 23 December 2020 and will close on 31 December 2020.

3. On 8 December 2015, ADB approved additional co-financing for rehabilitating further 471 km of rural roads, in the amount of $74.48 million, which makes the total Project costs of $192.71 million. Of which the Government of Cambodia finances the local taxes and duties amounting to $17.79 million for the entire project.1 Overall physical progress for the civil works under the original financing portion is almost completed with 98.79% and over 45% for the additional financing portion as of end of 4th quarter 2019. For the combined original and additional financing portions was 82.85%.

4. Under the RRIP II, additional roads with a total length of 79.29 km located in 16 communes within five provinces (Kampong Speu, Kampong Chhnang, Kampong Thom, Kampong Cham, and Tboung Khmum) are proposed for improvement from its existing laterite condition to DBST/ concrete road. This due diligence report (DDR) for social safeguards is for the existing additional rural roads being proposed by MRD for improvement under the RRIP II. The projects under the original an additional financing portions of the Project is Category C for Involuntary Resettlement as per ADB Safeguards Policy Statement (SPS), 2009. The roads for improvement under the project are existing, and the additional proposed 79.29 km roads for improvement are also the existing rural roads.

PROJECT DESCRIPTION AND OUTPUTS

5. The RRIP II including the additional roads have five key outputs, namely: Output 1: Rural Road Rehabilitation. The project will pave 1,200 km of rural roads using double bituminous surface treatment (DBST) and reinforced concrete. This output also includes DDIS consulting services.

6. Output 2: Rural Road Asset Management. The project will improve rural road asset management in a sustainable manner through a strong capacity-building program, including an

axle load control program. 7. Output 3: Rural Road Safety and Community Awareness Program. The awareness and application of road safety and safeguards will be increased by: (a) implementing a rural community-based road safety program; b) implementing an HIV/AIDS and human trafficking prevention program; and (c) conducting a sex-disaggregated baseline socioeconomic survey of beneficiaries.

8. Output 4: Efficient Project Management. The project also includes project management support for MRD. The project will have substantial positive employment and gender impacts in the rural communities. The project therefor includes a labor and gender mainstreaming action plan that is associated with all the project outputs.

9. Output 5: Connectivity Improvements of Mekong River Islands. Connectivity to and within highly vulnerable Mekong River Islands will be improved with concrete roads and jetties. A climate change adaptation framework will also be designed with complementary investments to be implemented to support the isolated islands.

B. Description of the Additional Roads Under the RRIP II by Location

10. The proposed additional roads with a total length of 79.29 km are located in 16 communes within 5 provinces (Tboung Khmum, Kampong Cham, Kampong Thom, Kampong Speu, and Kampong Chhnang). It will benefits a total of 166,797 population including 85,208 (or 51%) women, and with a total of 34,208 households (38,969 families)2 and of which 6,132 are women headed households. The project will also benefits around 2,423 poor households (level 1 poor) and 3,772 level 2 poor households (see Appendix H: Socio-demographic data of the project areas under the additional roads located in 16 communes of 5 provinces.

DETAILED ENGINEER DESIGN

C. Proposed Road Width

11. The proposed roads can be classified into 9 types based which was designed considering the regional topographic condition, inundation and local traffic pattern such high portion of motorbike as shown below:

The width of the carriageway of the Project road was planned in consideration such factor as proposal and technical Assistance Report, the existing road width by route, traffic volume, design speed, construction cost, etc. Carriageway widths were designed to be different ranging from 4.0m to 6.0m, and nine types were proposed.

13. Road shoulder is important road facilities which have such functions as prevention of traffic congestion by separating disabled vehicles and temporary pullout vehicles from the main carriageway and as protection of the ends of the road pavement structure. Shoulder widths were designed to be different ranging from 1.0m to 0.5m for 4 types road. In particular, margin of 0.5m both sides of the 3 Mekong Islands was planned for protection the concrete pavement carriageway.

14. Designed pavement type including double bituminous surface treatment (DBST) and continuously reinforced concrete pavement (CRCP) had been considered. The CRCP type which is resilient to the climate change will be applied to the proposed roads which are located at the flood prone area and downtown area without rise up the road elevation (project roads at 5 Mekong Island and Peam Chilaing). The DBST pavement type will be applied to normal condition of the proposed roads (see Table 1).

15. As shown in Table 1 below, there will be 28 additional roads proposed for improvement from its existing condition which is made of laterite or earth works to DBST and or concrete reinforced type of road (CRCP) for the specific roads to be improved located 12 roads in Tboung Khmum,11 roads in Kampong Cham, 1 road in Kampong Thom, 1 road in Kampong Speu and 3 roads in Kampong Chhnang.

16. The proposed road improvement varies by road section as the project will improve only the existing roads with a road width ranging from an average of 5m to 6m, while some roads that are already existing which are wider have a width from 6.5m to 9m.

17. The DBST and CRCP typical cross section with 8m width, 1 vertical:2 horizontal and the approximately Corridor of Impact (CoI) 9m~12m function with rise-up elevation along the roads section. However, this typical cross section will not rise-up and submerge during flooding. The CoI has been confirmed within the existing road boundary with no impacts and has been discussed during consultation meetings held in the project area.

18. The DBST and CRCP typical cross section with 7m width, 1 vertical: 2 horizontal and the CoI approximately at 8m~11m function with rise-up elevation along the roads section will not rise-up and submerge during flooding. The CoI has been confirmed within the existing road boundary with no impacts and has been discussed during consultation. Likewise, the CRCP typical cross section with 5m width, 1 vertical:2 horizontal and the CoI approximately at 6m~7m function with rise-up elevation along the roads section will not rise-up and submerge during flooding. 19. The summary of the additional roads for improvement presented by road, road section, district commune name, and the description of the length (in km) and width (in m), and the proposed design are presented in Table 1 below. The detailed description of the proposed improvements is presented in Appendix F.

METHODOLOGY USED FOR THE DUE DILIGENCE

21. The scope and objective of this due diligence report (DDR) is to present the findings from field verification of all proposed additional roads that there will be no potential IR and IPs related impacts in the project area according to the proposed detailed engineering design (DED). The original and additional financing portions of the project is category C as per ADB Social Safeguard Policy (SPS, 2009) for Involuntary Resettlement (IR). The roads proposed for improvement are existing rural roads and did not require land acquisition (LA). However, a Resettlement Framework was prepared for the RRIP II in 2014 to serve as a guiding document for project implementation, specifically on the management of any potential impacts related to social safeguards that may arise during the civil work stage.

22. During the preparation of this DDR, the social safeguards team, MRD’s project management unit (PMU)/ social and environment office (SEO) conducted site visits in all proposed roads for improvement under the RRIP II. The DDR involved the direct site visits, transect walk or ocular visit in the project areas, public consultation meetings, interviews, focus group discussions, and consultation meetings with the PMU and SEO, DDIS technical team, and other stakeholders. In addition to these, site demarcation based on the DED has been conducted by the project team and SEO officers, in the presence of the commune/ village leaders and community residents. 23. In addition to the information about the project discussed during the consultation meetings, the following information were also discussed: (i) grievance redress mechanism (GRM), (ii) the people’s perception of the proposed project, their worries and concerns, if any, and (iii) mitigation measures to address concerns and issues. A flyer or public information booklet which describes the project, the GRM process and whom to contact should people have complaints or clarifications were distributed to the commune leaders, and copy of the flyer posted in the Commune Council Office’s Public Notice Bulletin Board. 24. The village and the commune chiefs are the contact persons for the GRM at the village commune level. The people interviewed are already aware of the GRM and to whom to raise complaints, because the village/ commune leaders discuss this information and the existing GRM exists in-project area will be used for the project. Issues if not addressed at the commune level will be elevated to the district level. Details on this GRM with diagram are included in the flyers distributed to the commune leaders. The commune leaders keep records of complaints raised, and action taken. The MRD SEO Social safeguards officers, and the Provincial Department of Rural Roads (in each province) assisted by the project implementation consultants are actively involved in conducting consultation meetings with the local communities, and timely addressing any issues or concerns raised. by the commune leaders and residents in the project’s areas. 25. The safeguards team also gathered socio-demographic data from the commune councils of the project areas, and carried out consultation meetings with the commune and village leaders, school heads and students, and local villagers for the period September 2019 to December 2019.

DUE DILIGENCE FINDINGS

D. Land Acquisition

26. The additional roads proposed for improvement located in 16 communes in 5 provinces are existing roads which have a road width ranging from 5 m to 6 m. The road width varies by road location because the proposed improvement (design) has been adjusted according to the existing road length in order to avoid LAR impacts. These existing roads are commune roads, and some were maintained or improved using the commune development funds. However, the existing roads are made of laterite which is difficult to access or use during rainy season and when the water level of the Mekong River rises up that causes flooding in communes / villages within the Mekong islands. The roads are in bad condition due to mud and slippery which is not

safe for road users during rainy season. Also, the road is very dusty during dry season which is not convenient for the community residents especially among the children, women and elderly people, and those with respiratory health problems, aggravated by heavy dust during dry season.

27. No land acquisition is required in the additional roads under RRIP II because the roads are existing, and are already wide enough for the proposed detail engineering design. There may be few shrubs and small public trees that may be affected during the clearing stage, but these are located on the right of way (RoW) and are public lands. Overall, the safeguards team’ assessment consisting of the SEO and the DDIS consultants concluded that there will be no land acquisition and no adverse impacts to private assets of the households, and livelihoods of the people along the existing roads.

28. MRD and DDIS technical team have thoroughly assessed all proposed additional roads and the number of proposed roads reduced to 28 road lines of the 5 provinces (contract packages) with a total length of 79.29 km. The commune councils/ villagers wanted that the roads improvement to DBST should last longer up to 30 years. This is the reason why they sought for assistance from MRD/PDRD. Overall, the people, commune leaders and other stakeholders had expressed that they are happy to hear that the roads are going to be improved soon, and they are hoping that all the proposed roads will be upgraded to DBST. They have expressed full support to the project, and they will do whatever they could do to cooperate during project implementation, and even in road maintenance, if participation will be needed. The proposed road improvement is also an opportunity for household members including women of legal age with low income and/ or have no jobs, and are interested to work and earn income during civil works.

E. Involuntary Resettlement

29. The project Categorization for involuntary resettlement (IR) as per ADB SPS 2009 criteria is category C, as the road proposed for improvement in the additional roads will make use of the existing rural / commune roads, thus no road widening is required. Social safeguard impact assessment, demarcation based on the DED during site visits, and consultation meetings were conducted in the project area. The Screening Checklist for IR has been prepared (see Appendix A).

F. Indigenous Peoples

30. The categorization for indigenous peoples (IPs) as per ADB SPS 2009 criteria is category C. Social safeguard impact assessment in the project area has been conducted during the site visit, consultations with commune/ village leaders, and FGDs/ meetings with other stakeholders. There are no IPs in the project area. See Appendix H: Socio-demographic Characteristics of the People in the Project Areas and Appendix B the Screening Checklist for IPs.

G. Brief Socio-Economic and Demographic Profile of the Project Areas

31. The proposed additional roads with a total length of 79.29 k are located in 16 communes within 5 provinces (Tbong Khmum, Kampong Cham, Kampong Thom, Kampong Speu, and Kampong Chhnang). It will benefits a total of 166,797 population including 85,208 (or 51%) women, and with a total of 34,208 households (38,969 families)3 and of which 6,132 are women headed households. The project will also benefits around 2,423 poor households (ID poor 1) and 3,772 level 2 poor households (see Appendix H: Socio-demographic data of the project areas under the proposed additional roads located in 16 communes of 5 provinces.

32. Almost 98% primary sources of the households incomes are farming with additional sources of incomes derived from selling or business (vegetables, cooked foods, fish and meat, and various products for households’ daily needs or use. The farmers grow paddy rice, vegetables, root crops, and other crops. In some road sections in Tboung Khmum / Kampong Cham, there are rubber trees, black pepper, mangoes, and cassava grown. These all trees which

will not be affected by the proposed road improvement. The road will be a great help to the farmers to transport agricultural products, children would be able to travel faster and safer to go to school, as well as the local people when accessing to basic facilities such as health center/hospital, markets, working place, place of worship, and other areas. Besides that, the road will have less dusts during dry season which may aggravate the health condition of the children and elderly; unlike the roads condition during rainy season which is muddy and slippery, is risky for the lives of the road users especially those using bicycles and motorcycles.

33. The project will not cause adverse impacts for the local people including women and there is no cultural heritage, and forest that will be affected. During the civil works there will be minimal impacts that may arise from dust and noise but these are temporary disturbances, and will be mitigated under the EMP/CEMP. Overall, the project will provide long-term benefits for the local people. People expressed full support to the project 100% among consulted persons and are in favor of the project, and they would suggests to have the civil work starts as soon as possible.

34. Details of the observations and data gathered during the site visits and consultation meetings are shown in Appendices C and D. The registry of participants is shown in Appendix E.

CONSULTATION, PARTICIPATION AND INFORMATION DISCLOSURE

35. Information disclosure and consultation activities were carried out during the due diligence. Public information brochures or flyers were distributed to the commune leaders including project location maps prepared by the DDIS team were also shown to the commune leaders and community residents during the consultation meetings. Data were gathered through site visits, transect walk or ocular visit in the project areas, public consultation meetings, informal interview and focus group discussions, and public consultation held in the communes and villages. The focus group discussion was conducted following the guide questionnaire as shown in Appendix K.

36. The purpose of the consultation meetings and site visits is to inform the public (local people) about the proposed project (additional roads that will be improved), elicit their views and suggestions about their worries or concerns during the road construction, assess potential safeguards, social and gender related impacts that may arise during project implementation, and identify and or propose mitigation measures to avoid, mitigate or prevent potential safeguards and other social related impacts that may arise during project implementation.

37. The participants were asked about their perception on the project and how they will be benefited; potential safeguard impacts (environmental and social) that may arise during the construction period, either temporary or long-term and safeguards mitigation measures that will be implemented including job opportunities for local people (men and women, poor and other vulnerable groups) during the construction period.

38. A total of 14 public consultations had been conducted over 28 proposed roads at the commune/ village level in five provinces, participated by a total of 574 villagers, of which 193 (34%) are females. Consultation meetings in some road sections located adjacent to each other and located within the same commune or village, or in the same island with connecting roads had been combined or held in one venue. These include the consultation meetings in the following road sections: (a) TBK1, TBK1A, TBK2, and TBK3 located the same commune or village; (b) PI11, PI12, and PI13 are closed and located in an island; (c) MI1E and MI1F are closed and located in an island; (d) T1C, ST1D, ST1E, ST6, ST7, ST8, ST9, and ST10 are closed and located in an island; and (e) KCH13 and KCH13A are connected. Overall, 100% of the villages/ communes included in the 28 proposed roads for improvement were represented in the consultation meetings. Table 2 below shows the summary of the total number of participants during consultation meetings presented by road section, location (village, commune and province).

39. Duirng the consultation meetings, the participants were asked about their perception on the project and how they will be benefited; potential safeguard impacts (environmental and social) that may arise during the construction period, either temporary or long-term and safeguards mitigation measures that will be implemented including job opportunities for local

They were also informed about the proposed DED for the project, safeguard policy specifically on the IR related policy including objective and principles, importance of consultation and participation, cut-off date, entitlement matrix, GRM, and construction schedule. There was open forum in each consultation meeting to ensure that the participants will be able to raise questions and/ or clarify information.

40. No major concerns nor impacts were raised by the people during the consultation meetings. All are in favor of the project as it will provide them easier access when going to health center/ hospitals, they when transporting agricultural products from farm to market, and when buying goods from the markets to their villages for selling business by households in the villages/ communes; a great help to children when going to school, and work place. If the road is improved, it would be convenient for the people in going to pagoda for the Buddhists or mosques for the Cham, and other places. During consultation meetings, the local people mentioned that they have been waiting to have a DBST or concrete road for more than 30 years. See Appendix I for the summary table of the Question and Answers, and other information discussed and/ or raised during the consultation meetings held in December 2019.

41. The existing rural roads are made of laterite and is very dusty during dry season and muddy during wet season. It is very difficult for the farmers and households whose primary source of income is selling to transport goods and agricultural products because some road sections are flooded, very muddy and not accessible during heavy rains. Having improved roads is essential for the local people and will benefit all residents and those in adjacent areas (or villages located in interior areas or not along the main road but will have access through the roads that will be improved). Likewise, the road will be a great help to elderly, people with disabilities, sick people and pregnant women as they would have better access to health facilities, and other places. Overall, the participants have expressed that their household income will be improved after the road has been improved.

42. The people consulted are not worried on potential environmental impacts such as noise and dust during the construction period because they consider those as temporary in nature and could be mitigated. When asked if there will be local people including women interested to work in order to earn additional income, they replied yes because they need additional income after the planting and/ or harvest season. No social and gender related impacts were identified and raised by the people during the consultation meetings, and during the field visits by the project safeguards team.

43. The project has a resettlement framework (RF), gender action plan (GAP), EMP prepared that includes mitigation measures should there be problems or issues that may arise during project implementation. The GAP serves as guide to ensure effective gender mainstreaming, core labor standards will be complied with by the contractor. The EMP outlines the mitigation measures to ensure health and safety measures, and other measures and procedures to address complaints that may be raised by the local people during the construction phase.

GRIEVANCE REDRESS MECHANISM

44. A grievance redress mechanism (GRM), consistent with the requirements of ADB SPS (2009) has been established since the time of the implementation of the ADB funded RRIP II projects. The new additional roads to be included in the project are located adjacent or link-up to existing roads rural roads which have already existing GRM. The commune leaders were already informed about the project, and they are aware of the GRM, how to keep records should there be complaints, and whom to contact in case there will be grievances that will not be resolved at the commune level. The GRM is an integral part of the monitoring and

information system. It aims to ensure that feedback is received, that the voices from the poor and marginalized groups are heard, and that the issues raised are resolved effectively and expeditiously.

45. The GRM will be accessible to diverse members of the community and stakeholders. Multiple types of media, including face-to-face meetings, written forms, telephone conversations, or e-mail, will be available for raising issues, concerns and grievances. The existing GRM and approach in managing complaints about local issues for the RRIP will be applied and/ or adopted in this project. Flyers/ PIB with information on the GRM, whom to contact should local people have complaints are included in the information material, which are also posted or displayed in the Commune Council’s Office. The commune chief explained to the local people about the project including the GRM process, to whom to contact should they have questions or complaints (as shown in the photographs below).

46. The overall purpose of a Grievance Redress Mechanism (GRM) is to reduce risks for the project, offer communities an effective platform for expressing concerns, and achieving solutions to their concerns that will promote a constructive relationship between the people/local communities, project implementers including contractors, and other stakeholders. A GRM is

essential to ensure that the local people including women, project beneficiaries, affected persons, if any, and low-income households will have access to project benefits during implementation and operation stage in all project outputs/activities.

47. In this context, a project level grievance redress mechanism will be utilized which is already existing the GRM committee. The GRM committee is essential to allow appeals against any disagreeable decision, practice or activity arising from livelihood related or any other assets compensation. The people in the communities located within the project will be fully informed during the consultations of their rights and of the procedures for addressing grievances, both verbal and written. Any verbal grievance/complaint will need to be recorded and authenticated by a designated GRM official based on the existing GRM procedures (stated in the flyer/ brochure on GRM and other information relevant to the project).

48. Communities located along the road sections within the additional roads were already consulted, and community leaders as well. They are aware of the GRM process, and whom to consult as this has been discussed under RRIP II project, and reiterated during the consultation meetings in the communities identified for the additional roads. Care will be taken to prevent grievances rather than going through a redress process by ensuring active consultation with and participation of APs. If grievances still arise, all attempts will be made to resolve informally at the local village/commune level. All complaints will be recorded on a logbook that will be kept at the commune office and under the supervision of the commune chief, being the focal person for GRM at the commune level.

49. If issues are not resolved at the commune level, the next step is at the District level. Both the Commune and District levels of the GRC will have 15 days each upon receipt of a complaint to resolve it. Should there be grievances unresolved at the district level, these will be elevated to the Provincial level and will have 30 days. If not resolved or no satisfactory solution is found at any of these stages, following the requirement of ADB’s SPS, an aggrieved person is free to take the complaint to the Provincial Court and even higher court, which are not a part of the project level GRM, and whose decision would be final. However, according to the country’s legal provisions, an aggrieved person can approach a court of law only when the decision of the third step (Provincial Level) is unsatisfactory. The GRM levels are illustrated in the flow chart below (see Figure 4) and Appendix J presents the GRM logbook complaints form.

INSTITUTIONAL ARRANGEMENTS

50. The Ministry of Rural Development (MRD) is the executing agency for the project and at the provincial level, the Provincial Department of Rural Department (PDRD) in each of the ten project provinces will be the contact points.

51. The project will be implemented by the MRD under the overall guidance of the Project Director of the Project Management Unit (PMU) and assisted by the Project Manager. A DDIS (Detailed Design) Team (the consultant) will assist the PMU in administering all project activities, design, monitoring and supervision during the entire period of civil works and other related activities. The DDIS consultant will be based in Phnom Penh, headed by the Project Team Leader; and, resident engineers and team will be based at the construction sites/provinces.

H. Project Management Unit (PMU

52. A dedicated Project Management Unit (PMU) has been established in the MRD for the RRIP to carry out the day to day tasks in the overall implementation of the project. The SEO officers will be responsible for ensuring that all safeguard requirements will be implemented by the contractor/ project implementers guided by the ADB SPS policy 2009. The SEIO has been established in 2012 by the MRD when the RRIP was implemented. The SEO officers were provided capacity building by ADB, DDIS consultants on specific areas related to environmental safeguards, social safeguards involuntary resettlement), and other social and gender related topics.

CONCLUSIONS AND RECOMMENDATIONS

53. IR Classification for all proposed road section. The IR classification for all proposed road section is category C as per ADB SPS 2009. The proposed additional roads for improvement will not require LA and no adverse impacts identified during this due diligence.

54. IR impacts and impact on income/livelihood. No impacts on livelihoods and other assets of the people living along the project road alignment has been identified as the improvement will be done on the existing roads. Temporary disturbance, dust and noise that might be experienced by the community residents in the project area will be mitigated guided by the RF, EMP/ CMP prepared for the proposed project.

55. Consultation, information disclosures and GRM. Information disclosures about the proposed project, project impacts and mitigation measures have been done through consultation meetings with the community residents, community leaders, and other stakeholders in the areas located along the project road alignment (additional roads). Public information material with the GRM procedures and contact details whom to contact should there be grievances related to the project has been distributed during consultation meetings. Flyers on GRM were distributed to commune leaders and are posted at the Commune Council office. Likewise, village and commune leaders disseminate the information to the residents through meetings. GRM Committee has been set up and existing in the project area and the community residents were already informed.

56. Registration and recording of complaints. A GRM logbook, commplaints form has been prepared (see Appendix J) should there be complaints that will be raised by the people relevant to the proposed project.

57. Monitoring and reporting during implementation. The MRD SEO assisted by the PIC will conduct regular monitoring at the site, consultation with the community residents, contractors and workers, and other stakeholders during project implementation. Follow-up consultation meetings with the community residents will be conducted prior to start of civil works. Monthly consultation meetings or more frequent meetings, if required, will be conducted with the

contractors during project implementation. Monthly and quarterly progress reports about the project will be prepared and submitted to ADB; and semi-annual social safeguards monitoring report will be prepared and submitted to ADB.

58. Measures to be taken if there are IR impacts during civil works construction. Prior to civil works, social safeguard assessment will be conducted, and public consultation meetings with the community residents. The contractors will be provided orientation on the ADB SPS 2009, RF, EMP/ CEMP, GAP to ensure that they are aware and know how to avoid, mitigate and or prevent LAR impacts. Should there be IR impacts that may arise during civil works construction, detailed assessment will be conducted including inventory of losses, and an RP will be prepared, if necessary.

59. Mitigation measures are discussed in the RF and EMP/ CEMP, and GAP has been prepared in the RRIP II project which includes the following (i) conduct public consultation meetings with the community leaders and residents in areas located along the road alignment for the additional roads, copies of the GRM flyers will be distributed and posted on the commune council’s office; (ii) capacity building/ training on safeguards will be carried out for the project implementers including contractors by the PMU/SEO assisted by the DDIS project team during project implementation; (iii) commune council leaders headed by the commune chiefs will be re-oriented on the GRM including recording of complaints, and actions taken, and communicating in a timely manner the action taken to the complainant; (iv) SEO and DDIS team will monitor contractors’ compliance of safeguards as stated in the EMP/ CEMP, and aligned with ADB SPS 2009 and how to avoid or mitigate impacts during the construction stage; details on this are discussed in the RF approved in the project (RRIP II); (v) discussed issues and concerns during regular monthly meetings; (vi) regular monitoring and reporting will be done which will be included in the semi-annual social monitoring report; monthly progress meetings with the contractor will be conducted by the MRD/DDIS/ SEO; and regular monitoring by the SEO team at the project sites; and (vii) providing guidance to contractors on safeguard measures. Assessment of impacts will be done during the construction stage, and guidelines as stated in the RF and in compliance with the ADB SPS 2009 will serve as guide for project implementers including contractors.

- Most of road is passed farm fields and village gardens

- No school, pagoda, and sensitive receptors are located along the road side.

TBK5: in Tuol Sophy Commune, Oraing Uv District, Tboung Khmum Province

- This road is laterite, needs repair and still in poor condition. During dry season, the road is very dusty and muddy in rainy season; and very difficult to travel for for livelihood activities; when going to school, hospital, and market and work place.

- People are very happy to hear that the road will be improve to DBST road.

- Most people are farmers, grow rice and farm crops.

- A few vegetation and shrubs are on RoW and in public land (community land).

- Local people strongly support the project.

- One school and pagoda are located along the road side.

- Will save time and travelling will be convenient if road is DBST (no mud/ dust).

- The impacts can be minor occurred during construction (dust, muddy, and noise) is temporary and no serious problems.

- This road improvement should be widened the same size for both road sides.

- People asked when the road will be constructed? They want the DBST road to be constructed soon.

TBK6: in Rumchek and Trapaeng Pring Commune, Memot and Dambe District, Tboung Khmum Province

- This rural road has very poor condition. During dry season it very dusty and slippery / muddy during rainy season. Some parts of road, the water flows over the road (rainy water) during heavy rain.

- People are very happy to hear the project will be improved to DBST.

- Almost all of the HHs’ primary livelihood is farming. They grow rubber, cassava, pepper, cashew, mango, corn, and banana and other vegetables.

- There are some trees and vegetation along the road but may not be affected by the project.

- One school and one pagoda are located near the road.

- This road is important for local people to go: school, hospital, markets, and others business purposes.

- The DBST road is very good for safe traveling and for improving local economic activities.

- No protected areas and sensitive resources, located on the RoW.

- People strongly support the project. No land acquisition is required.

- Air pollution, noise, and dust is minimal and temporary only during construction.

- Generally, the impacts are minor, but the benefit from the project is greater and will have long-term positive impacts.

- No protected and conservation areas are located near the road project.

- People suggested that proper design of the culverts (big sites) to ensure proper water flow.

TBK7: in Rumchak Commune, Memot District, Tboung Khmum Province

- We are very happy, if this road will be improved to DBST. Local people use this road to markets, to school, to health center/hospital, transport agricultural products to markets.

- The present rural road is made of laterite, in bad condition; dusty road during dry season and slippery muddy during heavy rains. Some parts of the road are temporary flooded by run-off.

- Very difficult to travel on this road when going to school, hospital, and markets.

- DBST road is very good for safe traveling and will help local HHs improve livelihoods and living condition.

- No school, pagoda, health center, and sensitive receptor are located on RoW or near roadway.

- There are no protected areas, sensitive forest resources, and structures located on the RoW.

- A few vegetation (rubber, pepper, and cashew trees) are located along the existing, but will not be affected. The people expressed that in case it will be affected during the construction, they will strongly support the project. They want a DBST road as it will have long-term benefits for the HHs/ local people.

- No land acquisition in the road section.

- Air pollution, noise, and dust is minimal and temporary only during construction. People will not complain of dust because for over 30 year, they are already get use to dust which is bad for their health. They prefer a DBST road to address the dust problem and muddy / slippery roads during rainy season, and some road sections are not accessible.

- No conservation forest and water conservation area are located near the road.

- During rainy season, water flows on some parts of road (flash flood). Need to design the appropriate culverts (big sites) for water flow and reduce temporary flow.

- Some local people wants to work, including women to earn additional income.

- They asked when construction will commence.

6 16 December 2019

TBK8: in Chan Moul Commune, Memot District, Tboung Khmum Province.

- We have been waiting for this project a long time. -We are very happy that the road will be improved (DBST road).

- A few rubber trees, mango, and shrubs are located along the road, may not be affected as the existing road is already wide. The project will improve the existing road.

- The Health Center and school are located along this road.

- Local people use this road when going basic facilities such as markets, schools, health center/hospital; markers; when transporting agricultural products local and international (Vietnam) market.

- This is one of the access roads going to the border of Vietnam. The road is not yet improved.

- The people are happy and support to this project 100%.

- This is an existing road; very difficult to travel in raining season. This road floods, when big flood from Mekong Flood August-September. So we proposed improving to concrete road.

- Almost people are farmers, most they plant rice, corn, tobacco, bamboo, pomelo, and fruit trees.

- No protected area and sensitive resources are located near the road project.

- A few fruit trees and structures are located on RoW, but for concrete road with the width 5-6m will not affect these properties. No LAR issue has been identified.

- People are highly in favor of the project.

- We need to improve the earth road to concrete road in Koh Pi for our people to go school, market, transport products, safety travel, and increasing price of agricultural products in this Island.

- The communities are not concerned with air and noise impact during construction stage, as these are only minor and temporary.

- They asked: A few road sections are curving; can the project improve to straight road for local safety traffic? And when the project will starts?,

• Highlights of the Consultation Meeting and Relevant Information Gathered

1. The commune and village chiefs are very happy that the existing road has been considered or included in the additional roads to be improved under the RRIP II. There is an existing concrete road in the commune, however the existing road going to the government high school is not yet improved or made of concrete. The Commune/ Village leaders approached PDRD and local government authorities to seek for assistance by having the road that is linked to the school be improved because there are may students enrolled in that school, from the commune and adjacent areas. It is far from the houses and the students have a problem going to school during wet season.

2. The road project will benefit the people in two communes, namely: Kaoh Soutin and Kaoh Mitt. The commune through commune funds had been improving the road the past years using the commune funds because the know that the road is a great help to the students. If the road is improved many students will be able to finish their studies, and other students far from the school including girls, wold be motivated to go to school using bicycles and/ or motorcycles.

3. During the road construction (if the road section will be improved), local people including women would like to work after planting and / or harvest season.

4. The High School Director provided the following information:

- Total number of students enrolled in the school is 643 including 345 girls or 54% of the total number of students.

- Total number of teachers is 40, of which 22 are women (55%).

- The school has been existing since 1985.

- The road once improved will be a great help to the students, school personnel, parents when attending meetings, and villagers because the road is a main road where there are many people/ commuters that use it daily. Many students use bicycles and motorcycles when going to school. The road is very muddy during wet season and when the island is flooded. The school is located on a high ground and serves as an evacuation center or temporary place where some households in flooded areas could take refuge (the school has a big

campus).

5. Separate consultation with over 30 students (more than 50% girls):

- All of the students consulted during the consultation meeting were very happy after knowing that the road going to their school has been included in the proposed roads that will be improved (concrete).

- They have expressed gratitude to MRD/ Local Authorities/ ADB, etc. In advance. They really would like to have an improved road because the students have difficulty going to school if the road is muddy. They have to wash their school uniforms daily which is time consuming.

- The students would like to finish their studies so that they could help their parents improve their living condition, whom they described their economic condition as poor. Most of the students would like to be teachers because they want to serve the villages is the islands; others would like to be a doctor, policemen/ women, have car repair shops and business in the future.

- They appeal to the government to start the road improvement in the road section going to their school as soon as possible, and had expressed thanks in advance.

- There are Cham (muslim) students enrolled in the school.

6. No LAR impacts in the said road section as the existing road is already wide; commune maintained the road using commune funds. The proposed road will connect the end point of the concrete road in Kaoh Soutin to the High School. 7. No social/ gender related issues are expected to arise during the road construction. The road once improved will provide greater benefits to the students, school personnel and local people. More than 50% of the students and teachers are girls using bicycles and motorcycles. The school provides information to students on road safety awareness, HIV/ AIDS awareness, had expressed support these programs during the construction of the project. 8. Overall recommendation for the Road section: Strongly recommended for road improvement.

KC 18, Kampong Cham Province

The road is wide and is a busy road. Many villagers use the road when going to the market. Many

trucks and other kinds of vehicles use the road. NO LAR impact as the existing road is wide.

One shop owners along the existing road has many customers (villagers) who buy meat, vegetables and other goods for daily needs. There are many shops along the road, and the road once improved will provide them better access to markets where they buy goods for sale in their small shops in the village. Likewise, the villagers will have easier access to basic facilities; the farmers as well when transporting

Local villagers are very happy of the plan to improve the road because they said it is very dusty, not good for the health of children and elderly people. During wet season or heavy rains, the road is not also accessible due to mud. They would like the road to be improved (DBST or concrete) as soon as possible. They said they had been waiting for the road to be

- If 10m width will be enough for the DBST road project?

- The road will be improved to DBST; connects from RRIP 2 road (s0me roads are linked up to RRIP 2-AF).

- Will improve the existing road.

- DDIS engineer to prepare the design; from 5-6m for DBST.

- No need to move back if the existing roads width stay in 10m. Not affected.

KCH13 and KCH13A: in Khna Chhmar and Chrey Kaong Commune, Sameakki Meanchey District, Kampong Chhnang Province

- What is the width of DBST road that will be improved?

- We had been waiting for long time on improving this road, could you commence this dry season?

- We need this DBST road section, it is very important for our people to go to school, hospital, market, transporting products, and to work for garment factories.

- According to the existing roads will be 5-6m width for DBST, however the engineer will need 1-2m for each side for benching and shoulder.

- MRD and DDIS consultant will try to completed the document as soon as possible and submit to ADB for review and approval.

What is grievance mechanism?

► Grievance mechanism is a method or process to resolve the complaints from affected people of RRIP. This mechanism is used by Provincial GRM Committee. The objective of mechanism for resolving the complaints as soon as possible in local level for negotiating this process. If this mechanism could not resolve, the transparent methods is used for continuing these complaints.

When we can use the grievance mechanism?

► You can submit grievance, if you were affected by RRIP and did not satisfied with supporting from committee or compensation or any agreements for losing your properties.

Where we can submit the grievance mechanism?

► You can grievance in writing letter to provincial committee or working group of committee in your commune/village. You also can request local NGO for supporting.

► There are 03 stages of grievance mechanism for resolving or redressing RRIP. These stages are presented on the pictures next page.

If in these 03 stages can’t resolve the grievances, you can submit the complaint to provincial court.

FOCUS GROUP DISCUSSION- CONSULTATION GUIDE QUESTIONS

FOR THE RRIP II - ADDITIONAL ROADS

A. Objectives of the FGD/ Consultation Meetings

Focus Group Discussion (FGD) is one of the participatory methods being used when communicating with the key stakeholders in the project area. It helps to inform the participants, consult and engage then in a meaningful process. It also encourages the participants to express their views or opinions and/or raise suggestions that could be used in the design, implementation and operation & maintenance of the projects.

1. Procedures and Pointers in Conducting FGD / Consultation Meetings

1.1 Physical Arrangements and Consideration The number of participants should be manageable for the FGD Facilitator to handle.

Encourage the participants to express their views and/ or engage them in a meaningful consultation. If necessary, conduct separate consultation for women.

Speak language that the participants could understand very well. The voice of the facilitator should be loud enough for all the participants to hear.

Have eye contact with the participants (and the person sharing). Be sensitive to the time (the participants have many things to do); consider the time most

preferred or convenient for a particular group of participants (such as women/ mothers; business people, etc.). Be culturally sensitive to the time and day of the FGD. Limit FGDs to at least 45 minutes to 1 hour only.

2. FGD Process

Start the FGD by explaining the objective/purpose. Participants introduce each one, including the FGD facilitator. Assign an FGD documenter to assist the facilitator; including taking pictures. Don’t record or video the FGD/ conversation without asking permission. Be culturally sensitive, including use of language/ words that may not be appropriate. Set a schedule ahead of time; inform the community/ district leaders. Conversation should be focused on the objectives; facilitator should have the skills of

redirecting or trafficking conversation which are not relevant to the topic. Facilitator should be mindful of participants who dominate the group and would always

want to talk. Ensure that all participants have expressed their respective views or participate actively in the discussion.

Wrap-up the salient points before the session ends, and express thanks to the participants for the time and active participation.

B. FGD / Consultation Meetings’ Guide Questions

The Facilitators will start by introducing herself/ himself (or the members in the Team). Mention the name, agency/ position of the people in the team.

Mention the purpose of the Meeting. Note: Some of the participatory approaches in conducting consultation and participation are focus group discussion (FGD), meetings, public consultation/ community forums, etc.

Stakeholders may include project beneficiaries, affected population/ HHs, women,business sector, and other groups (who will be directly affected and/ or benefited by the project); community leaders, local government authorities, government

agencies, NGOs, and other groups with interest on the project (including road users/ commuters, school children and teachers, vendors, drivers, etc.).

C. Purpose:

1. To inform the participants about the Project (RRIP II- additional roads); implementing agency and sources of funds / development partners (ADB, etc.), project impact/ outcome and outputs; design features (length and width of the proposed road improvement, etc.), project implementation duration, etc.

2. To gather information from the participants on the project impacts (i.e. advantages and/ or disadvantages, if any), their worries or concerns, if any; and suggestions (or recommendations).

3. To encourage the participants to express their views on the project, increase their level of understanding about the project, and ensure that their questions are answered properly (with accurate information).

Suggested Questions (specifically for the affected persons, and project beneficiaries):

Listed below are some questions that could be asked during the FGD. Additional questions (not included in the list below) may be asked during the process.

The sequence in asking the questions may be changed. The FGD facilitator should be a very good listener (in addition to facilitating skills); should know the appropriate sequence in asking relevant questions to ensure smooth flow of the discussion. The people being consulted should be allowed to voice out or express their views openly; ensure that their views/ concerns raised are properly/ correctly documented (this will be included in the Minutes of the Meetings).
