TENDER BRIEF Reagent Rental System: It is a method in which any reputed multinational company may put up a latest new brand instrument free of cost, in Civil Hospital, Ahmedabad with free maintenance for the satisfactory performance of HPLC analyzer of tests as per decided by the Civil Hospital, Ahmedabad during the RC period laid down by Civil hospital. General Terms and Conditions

1. The tenderer should invariably submit his tender in three sealed covers separately namely

[1] Document Fee, [2] E.M.D. covers [3] Technical Supporting Documents Cover

2. Document Fee and EMD COVER

a. Payment should be made by DD Only, payable at Ahmedabad at any schedule

bank.

b. Payment should be made in favour of Medical Superintendents, Civil Hospital,

Ahmedabad,Gujarat, India.

c. Payment made towards document fee will not be refunded

d. Non-payment of the document fee will make the tenderer liable for

disqualifications.

e. EMD of qualified/accepted bidder will be held as a part of security deposit for

tenure of said RC.

f. Non- payment of the EMD will make the tenderer liable for disqualifications.

g. Wrong/ Fraudulent data submission may lead to disqualification / debar. Please

ensure that you furnish correct data.

3. Those tenderers who are exempted for payment of EMD must enclosed necessary

documents like SSI Registration [Gujarat State] along with NSIC/DGS&D/CSPO

Registration.

4. Those firms registered under small scale industries of Gujarat State and holding

subsequent registration with CSPO/NSIC for the item under tender will be eligible for

exemption from payment of EMD on submission of attested copies of their SSI &

CSPO/NSIC/DGS&D registration certificates in EMD cover. Participants not covered

under this category shall have to pay EMD compulsorily as prescribed, failing which the

tender will be treated as rejected at the time of opening of Bid in such cases; Technical

Bid as well as Commercial Bid will be ignored. Any basic document with regards to

EMD will not be acceptable after closing time of tender.

5. Technical Bid Submission

(a) The envelope should be marked as "Technical Supporting Documents". It should

be noted that no physical submission of Commercial bid should be done.

(b) If the suppliers fail to submit the supporting documents offline within time limit,

the bidder is entitled for immediate disqualification.

6. Commercial Bid Submission

(a) IN NO CASE, RATES/CPRT SHOULD BE QUOTED IN ANYWHERE EXCEPT

ONLINE. The commercial bid submission should be done on the website only

The tender will be summarily rejected without any further processing or reference if

the rates/CPRT are quoted or written at any place except at the relevant place in

Commercial Bid,On-line.

(b) The bids should be submitted on or before the time stipulated in tender notice at

the website https://www.ch.nprocure.com

(c) No tender will be accepted after prescribed closing time for submission of the

same. The delay will not be condoned for any reason whatsoever including

postal/transit delay. However, if the last date of submission of tenders is declared

as a holiday by the Government, the last date of submission of tenders will be

extended to the next working day.

7 The tender should preferably be submitted by the manufacturer. In case when the

subsidiary company of their foreign manufacturer with authority letter is submitting the

tender, the subsidiary company will have to produce documents that they are 100%

subsidiary company of their foreign manufacture whose reagent/testing

kits/consumables/Medical equipment/other laboratory items is quoted. In case when the

manufacturer is authorizing the dealer to quote the item/items in the tender, the

authorized dealer will have to submit the authorization letter from the manufacturer for

the same.

8 The authority letter should be issued by the National Head/Competent Authority of the National Registered Office only. The Authority letter must be fresh authority letters (After the date of Tender Notice) from manufacturer in prescribed format & should be notarized.

9 The manufacturer must authorize only one dealer for quoting all the items in the tender.

And when the authority letter is submitted by the authorized dealer of the manufacturer,

the manufacturer cannot participate in the tendering process. If such a situation arises the

decision of the Medical Superintendent, Civil Hospital will be final & binding to all.

10 The authorized dealer shall be regular supplier of quoted product of that manufacturer before the date of opening of technical bid and authority letter (As per format Annexure- I), valid import license & other requisite documents (where ever & whichever applicable) should be submitted along with tender.

11 The tenderer must satisfy that they are in possession of the requisite permissions

/authority /licenses /permits required for the manufacture / supply / sale / distribution of

the items as per the specifications for which the offer is made.

12 The manufactures quoting items directly or through authorized dealer should have

experience of manufacturing and selling of quoted products for three year preceding the

date of opening of technical bid. For this purpose, they have to submit Chartered

Accountant’s certificate in original showing year wise production and sales for quoted

product for last three years.

13 If applicable, the tenderer should confirm that the detailed specifications i.e. standard,

composition, packing, minimum batch size, WHOGMP (as per the Government Rules &

Regulation if required) of the items offered are strictly in accordance with the

specifications shown in the tender.

14 In case where item is required with ISI Mark, manufacturing and selling experience of

product having ISI mark will only be considered. But, in such a case, certified copies of

licenses to use ISI mark for last one year as well as latest and valid license are to be

submitted with tender. The license should be valid during the period of tender. It will be

the sole responsibility of tenderer to ensure that necessary certificate and permission must

be valid till the expiry of the tender. If the tenderer is awarded the Rate Contract of the

items, it will be the sole responsibility of R.C. Holder to ensure that necessary certificate,

license and permission must be valid till the expiry of the Rate Contract.

15 In case, the certificates / licenses / permission are outdated or the validity period is over,

the valid proof of applying for renewal should also be attached. Such certificates will be

considered if the renewal has been applied for within the time limit prescribed for the

renewal of that permission / license / certificate under the relevant rules and further if

such application for renewal is not specifically rejected by the competent authorities. In

case any certificate is still awaited from the competent authority, the proof of making the

application should also be attached which will be considered if the application is not

specifically rejected by the competent authorities.

16 The tenderer should read this document very carefully and comply with the instructions /

terms / conditions and specifications / grade / quality / packing of items therein. Any

tender which does not confirm with the instruction / terms / conditions there in is liable to

be rejected without any reference.

17 No conditional offer/ quotation will be accepted. Quotations with errors will be, rejected.

No variation in the terms and conditions of the tender, including deviation from

standards / specifications / terms of supply will be accepted.

18 Before submission of any tender, the tenderer must verify that they have submitted all

relevant certificates / permissions / license/documents in proper format along with tender. No

intimation of missing documents will be given by this office. No documents will be

accepted thereafter and the tenders will be processed on the basis of available

documents / certificates. If the requisite documents are not submitted or even if submitted

are not in proper format, the tender is liable to be rejected.

19 The detailed required specifications of the items to be purchased on Rate Contract are

shown in Technical Bid. The tenderer should either confirm whether the items offered are

conforming to these specifications clearly OR specifications available in offer product

should shown against each specification along with name of manufacturers, Brand /

Model only in the format provided in technical bid. Please note that tenderer should not

write 'As per Literature enclosed'. In such a case, offer shall not be considered

20 No modification should be done by the tenderer in the name of item, and in the

specifications / grade / quality / packing of the item given in the enquiry document. In

Technical Bid all information asked / required including specification available in offered

items should be mentioned clearly. Additional specifications / features if any available in

the offered items shall be provided in additional sheet.

21 As per Govt.’s prevailing purchase policy, a order / price preference shall be available to

Gujarat based SSI / SMALL / COTTAGE Industries registered for quoted items subject

to providing required documents like respective registration certificate issued by

concerned authority. For this purpose, a guide lines given by the Govt. of Gujarat,

Industries and Mines Dept., resolution No.SPO/1095/2636 (97)/CH dated 23/09/1997

amended from time to time will be followed. In such a case the decision of Purchase

Committee shall be final and implemented forthwith.

22. Commercial Bid: The rates of test shown as, on-line in commercial bid should be

inclusive of all taxes & F.O.R bases. The rates of test should be inclusive of the cost of

all the kits, calibrators, controls,consumables, tips, reaction cuvettes, reagents, etc. for

performing the tests as per the specification. The rates of test once accepted will be

freezed for the RC period.

Method of Commercial Bid Evaluation: The price evaluation will be done on the basis of

total expenditure on all the tests. If the number of individual test/parameter will increase,

the Medical Superintendent will review the cost of respective test/parameter mutually after

one year on pro-data basis.

The tax exemption certificate if any required will be provided by the concern authority.

23 The quoted rates of test will be valid for the tenure of the said RC from the date of

opening of technical bid/commercial Bid. Rates of test once quoted will be final and will

not be allowed to be increased during the validity period under any circumstances and for

any reason whatsoever.

24 The legible and certified copies of the following Technical supporting documents MUST be

submitted physically.

1) Shop Act Registration Number / in Corporation Certificate of the firm, 2) Professional Tax Registration

3) VAT Registration Certificate ( For Tenderer Registered In Gujarat State)

4) Central Sales Tax Registration Number (for Out State Tenderer)

5) Tenderer are requested to fill all the pages of tender form as/ if required and duly sign & stamp, which must be submitted physically (hard copy). Tender not so signed will be rejected.

6) Photo copy of PAN Card of tenderer.

7) Valid Manufacturing licence with product & Product Permission (as the case may be);

8) Manufacturing license (P.M.T. SSI No. / Industrial license / I.S.I. Certificate / Factory

Inspectors license) / Product permission. {if applicable}/ Registration certificate with C.S.P.O./ S.S.I./K.V.I.C./N.S.I.C./D.G.S.&D {which ever is applicable};

25 In the first instance, only "technical bid" will be opened online on the date of opening the

tender and taken into consideration for finalization. Subsequently, the "commercial

bid" will be opened online only of those tenderers whose quotations satisfy the technical

requirement of the indenter and are otherwise acceptable.

26 The technical scrutiny of the Items will be carried out by a committee of experts

nominated by the Medical Superintendent, Civil hospital, Ahmedabad. If required the

committee may also asked the tenderer for inspection/demonstration / sample testing of

the quoted items and the report of the scrutiny committee shall be final and binding upon

the tenderer.

27 Inspection & Sample testing: Inspection of the offered Items shall normally be carried out

in the premises of the consignee. The sample of the material/item/items offered by the

tenderer shall be collected by the consignee & will be tested for its compliance to the

specification. The decision of the testing/inspecting authority will be conclusive and final and

binding to the tenderer. However Medical Superintendent, Civil Hospital, Ahmedabad

reserve the right to inspect the offered material/item/items in the factory premises &/or

testing of the material/item/items by external competent authority. In such a cases all

expenditure shall be borne by the tenderer. Inspection charges, including the expenses for the

experts &/or testing charges will be payable by the tenderer as mutually decided before the

inspection &/or testing by both the renderer & consignee.

ACCEPTANCE OF TENDER

28. The tender is liable for rejection due to any of the reasons mentioned below:

1. Non-Submission of tender within stipulated time online.

2. Non-Submission of Tender Documents duly filled & signed on each page.

3. Tender is unsigned OR not initialed on each page or with unauthenticated corrections.

4. Submissions of tender documents in unsealed envelop.

5. Tender not submitted in separate envelopes as per conditions and the envelopes are not

superscribed with details of the tender enquiry and part enclosed. 6. Non-payment of Earnest Money Deposit {if not exempted.}

7. Non-submission of required documents.

8. Conditional and / or vague offers

9. Unsatisfactory past performance of the tenderer.

10. Rates/CPRT have been shown elsewhere than On-line 11. Items with major changes / deviations in the specifications / standard / grade / packing /

quality are offered. 12. Offering an accessory as optional even though it is required to operate the instrument/use the

item.

13. Submission of misleading / contradictory / false statement or information and fabricated /

invalid documents.

14. Tenders not filled up properly. 15. Non-submission of notarized authority letter/necessary other documents in prescribed format. 16. Non-submission of applicable essential certificates by the tenderer

29. The Medical Superintendent, Civil Hospital, Ahmedabad does not pledge himself to accept

the lowest or any tender and also reserves the right to accept the whole or any part of the

tender against any item at his discretion. The tender will be accepted if The Medical

Superintendent, Civil Hospital, Ahmedabad, is satisfied about the production, sale, quoted

price technical details, utility of products and past performances of

tenderer.(Manufacturer and/or authorized dealer as the case may be & as the requirement

applicable)

30 The Medical Superintendent, Civil Hospital, Ahmedabad reserves the right to consider or

reject any or all tenders or close the tender enquiry without assigning any reason at any

time at any stage.

31 The accepted tender rate contract (RC) holder should supply the items as per specifications

and packing approved by the Medical Superintendent, Civil Hospital, Ahmedabad.

Otherwise the stores will not be accepted and penal action will be taken against the RC

Holder. All supply orders issued by the indenting officers issued on or before the last date of

the existing /currency of the R.C. will have to be accepted by the R.C. holder and the delivery

for all such orders will have to be effected as per the schedule specified in the order, even

though the date of actual supply may fall beyond the last date of the R.C. 32 The tenderer will be accountable & responsible for Performance of reagent, Stability of

open & reconstituted Reagents, Calibrators, Controls and Precision & reproducibility. The Cold Chain must be maintained for all reagents, Controls and Calibrators during transport to the buyer.

33 The tenderer should provide reagent or any other laboratory items etc of long expiry

period. The stores which have already lapsed shelf life should be replaced without any

charge. The stores with unpacked or in loose condition will also be not accepted under any

circumstances.

34 All containers i.e. bottles, tins, cartons, tubes etc. must be secured with pilfer proofs seals to

ensure genuineness of the products packed and the correctness of the contents. "A" type

plastic container should conforms to IS:7803 (Part I): 1975 and Polythene plastic bag should

conforms to IS:10141 : 1982.

35 The R.C. Holder shall have to supply the material in the Original Company's packing which

shall indicate packing details and other particulars as required under the statutory provisions.

Inner and outer packing of boxes / cartons should be standard design as prescribed by the

Medical Superintendent, Civil Hospital, Ahmedabad from time to time. The final packing of

cartons of corrugated boxes shall be complying with IS:9313 : 1979 of November,1980 &/or

as per the guideline issued from time to time. A packing slip shall indicate clearly and legibly

the name of the product, batch number, quantity, date of manufacture, date of expiry, gross &

net weight, and consignee's name & address and other particulars as required.

36 In the event of breakages or loss of stores during transit against requisition order the said

quantity will have to be replaced by R.C. holder. The purchaser will not pay separately for transit insurance and the supplier will be responsible for the stores for any

loss or damages to the stores that might / should have occurred during the transit.

37. Delivery Period: Unless specified in the order or instructed by the Medical Superintendent,

Civil Hospital, Ahmedabad the delivery of kits, calibrators, controls, consumables, tips,

reaction cuvettes, reagents etc. to perform the test, as and when asked by the buyer by any means of communication so as testing will not be affected. The tenderer should keep the

item/items ready in an enough quantity at his store/go down to be delivered in any situation

of exigency / epidemic / calamity in a time as mentioned in an order. The failure to supply

the items by the tenderer in a time as mentioned in an order may lead to penalty and/ or

disqualification of the tenderer.

39. Penalty: As per the Government laws.

40. Inspection before accepting the ordered items during the RC period: Every time inspection of the Material/Item/Items supplied by the RC holder against each order may be carried out in the premises of the consignee & will be tested for its compliance to the specification. The decision of the testing/inspecting authority will be conclusive and final and binding to the R.C. Holder. However Medical Superintendent, Civil Hospital, Ahmedabad reserve the right to inspect the material/item/items supplied by the RC holder material/item/items in the factory premises &/or testing of the material/item/items by external competent authority. In such a cases all expenditure shall be borne by the R.C. Holder, Inspection charges, including the expenses for the experts &/or testing charges will be payable by the RC holder as mutually decided before the inspection &/or testing by both the RC holder & consignee.

41. Replacement Clause: If any stores supplied against the R.C. are found to be of not of

standard quality on inspection and / or testing by the consignee, the tenderer shall be liable

to replace the entire quantity of the relevant batch immediately or make full payment of the

entire consignment against the particular invoice, irrespective of the fact that part or full

quantity (batch) of the stores supplied may have been consumed.

42. After the initial three months of analyzing the performance of tests/equipment, the contract will be extended up to one year and subsequently after annual performance of the tenderer

will be reviewed by Medical Superintendent, Civil Hospital, Ahmedabad based on which

continuation of the contract will be allowed & can be extended for further period as decided by the

Medical Superintendent up to three to five years. The review of performance of tenderer will be based

on accuracy of test, Service provided by the company for supply of kits, calibrators, controls,

consumables, tips, reaction cuvettes, reagents etc. to perform the test, maintenance of

equipment & support including resolving discrepancy in tests & correcting breakdown of equipment in

a day or two etc.

44. The Risk Purchase will be done as per the Govt. Rules & regulation during the RC period.

45. The R.C. can also be terminated by the Medical Superintendent, Civil Hospital, Ahmedabad in the following circumstances:

1) If the firm is debarred or disqualified or ceases to exist or convicted of any offence.

2) If the quality of the item to be supplied is found not upto the standard and

multiple samples are found to be not of standard quality.

3) If supply position of the firm is not satisfactory

46. The installation of latest new brand equipment is to also to be completed within a stipulated time

as decided by the Medical Superintendent & should be maintained free of cost during RC period.

if the tenderer fails to provide the services during RC period or installation within the stipulated

period, penalty clause will be applicable as per the Govt. rules. RC holder has to provide all kits,

calibrators, controls, consumables, tips, reaction cuvettes, reagents etc. to perform

the test, free of cost.

47 Payment Terms: The payment of the bill shall be made as per the Govt. Rules &

Regulation.

48 Standard Breach Clause: The Medical Superintendent, Civil Hospital, Ahmedabad shall,

in addition to his powers under other clauses to terminate the contract, have powers to

terminate his liability there under of the time by giving one month’s (or such shorter

period as may be mutually agreed) notice in writing to R.C. holder of his desire to do so

and upon expiry of the notice, the contract shall be terminated without prejudice to the

right accrued to the date of the termination. However, if the Medical Superintendent,

Civil Hospital, Ahmedabad decided to put an end to the business relations on breach of

any conditions of the contract no such notice shall be necessary and on event of the

Medical Superintendent, Civil Hospital, Ahmedabad deciding to terminate the business,

and the R.C. shall stand terminated with immediate effect.

49. (i) Warranty Clause: The R.C holder Shall be subjected to the following warranty

clause that the goods/stores/articles supply to the buyer under this contract shall be of the

best quality and workmanship and shall be strictly in with the specifications and

particulars contained / mentioned in the acceptance of tender notwithstanding the fact that

the purchaser may have inspected and / or approved the said goods / stores / articles and

shall operate and function as specified for a period not less than the rate contract period.

The decision of the purchaser in that behalf will be final and conclusive and he will be

entitled to reject the said goods / stores / articles or such portion there as may be

discovered not to confirm to the said description and quality. On such rejections the

goods / stores / articles will be at the seller’s risk.

(ii) Tenderers will have to provide kits, calibrators, controls,consumables, tips, reaction

cuvettes, reagents etc. to perform the test in time & free services for maintenance of the

equipment during the rate contract period. If any advancement in technology is available or

launched by the manufacturer of the said approved machine on Rate Contract, tenderer regarding

the tests mentioned in the tender ,the same should be provided free of cost replacing the installed

previous one immediately, for which neither additional cost/charge will be given nor rate of tests

cost will be revised.

(iii) Tenderer is required to impart training to operate equipment & performance of tests at the

place of installation within seven days of its installation.

Annexure-III Commercial Bid: The rates of test shown as, on-line in commercial bid should be inclusive of all

taxes & F.O.R bases. The rates of test should be inclusive of the cost of all the kits,

calibrators, controls,consumables, tips, reaction cuvettes, reagents, etc. for performing

the tests as per the specification. The rates of test once accepted will be freezed for the

RC period.

Method of Commercial Bid Evaluation: The price evaluation will be done on the basis of

total expenditure on all the tests. If the number of individual test/parameter will increase,

the Medical Superintendent will review the cost of respective test/parameter mutually after

one year on pro-data basis.

The tenderer must quote the cost per test of the all the tests/parameters in the commercial

Bid.
