John Howard, MD, MPH, JD, LLM Director, National Institute for Occupational Safety and Health Opening Keynote John Howard serves as the Director of the National Institute for Occupational Safety and Health in the U.S. Department of Health and Human Services in Washington, D.C. He served in this capacity from July 2002 to July 2008 and was re-appointed in September 2009. Prior to his appointment as Director of NIOSH, Dr. Howard served as Chief of the Division of Occupational Safety and Health in the California Department of Industrial Relations from 1991 through 2002. Dr. Howard received his Doctor of Medicine from Loyola University of Chicago in 1974, his Master of Public Health from the Harvard School of Public Health in 1982, his Doctor of Law from the University of California at Los Angeles in 1986, and his Master of Law in Administrative Law from the George Washington University in Washington, D.C. in 1987. Dr. Howard is board-certified in internal medicine and occupational medicine. He is admitted to the practice of medicine and law in the State of California and in the Dis-trict of Columbia, and he is a member U.S. Supreme Court bar. He has written numerous

articles on occupational health law and policy.

Lourdes Gonzalez, MBA, CIHM, CLCS, AFIS Director of Human Resources - Gowan Company Luncheon Keynote: The Changing Landscape of HR Profession in Agriculture Lourdes Gonzalez has worked in the industry as a Safety Director, Loss Control Consultant, HR Consultant and Account Executive in California and Arizona. Lourdes has extensive expe-rience in safety and supervisory training, HR management as well as consulting on risk man-agement and operational productivity in various industries. She has lectured on labor rela-tions, human resources, safety and organizational development to companies, associations and organizations in California, Arizona and Colorado. She is a frequent speaker for SHRM chapter in Yuma, AZ. She contributes as a writer to various newsletters and magazines on topics related to human resources, safety and risk management. She is a member of the Society of Human Resources Management (SHRM), the American Society for Training & Development (ASTD), AgSafe and APMA. Tom Knowles Outreach and Liaison Officer - Cal State Threat Assessment Center Friday Keynote: The World We Live In, the Threats Are Real & What We Need to Know Tom Knowles is an internationally experienced Senior Manager with over 30 years of suc-cess in sensitive and complex law enforcement assignments involving both local and federal law enforcement agencies. A native Californian and former police officer, Mr. Knowles is a retired FBI executive who has spent the past nineteen years, of a thirty-four year career investigating and/or managing international acts of terrorism. Mr. Knowles has lived or worked foreign assignments in locations such as Israel, Lebanon, Cypress, Syria, Turkey, Greece and Uzbekistan. Immediately following the events of 9/11, Mr. Knowles was tasked to lead a team of FBI personnel into Kandahar Afghanistan where they worked hand-in-hand with both members of the U.S. Intelligence Community and Department of Defense, Special Operations personnel pursuing al-Qaeda.

Since retiring from the FBI, Mr. Knowles has worked for SRA International of Fairfax Virginia as both a consultant and counter terrorism instructor assisting elements of California Homeland Security. His course “The World live in, the threats are real & What we need to know “ are derived from his personal experiences, as well as current government predictions and analysis which includes information on how you can assist in preventing further attacks.

Ronald H. Barsamian

Attorney - Barsamian & Moody Presenter for Workshop M: Emergency Plan for Union Activity Ron Barsamian’s far reaching practice of over three decades involves all aspects of agricultural labor and employment law. He represents agricultural employers before the National Labor Relations Board, Agricultural Labor Relations Board (California), U.S. Department of Labor, Department of Fair Employment and Housing (California), Equal Employment Opportunity Commission, the California Labor Commissioner, Cal-OSHA as well as various other state and federal administrative agencies. His litigation expertise in both state and federal courts includes many cases of both state and nationwide significance to the agricultural industry. Mr. Barsamian represents employers in labor relations matters, ranging from union organizational activities to collective bargaining. Mr. Barsamian is a member of the prestigious Western Growers Association Legal Forum and the United Agribusiness League Legal Forum, and is designated counsel for the Farm Employers Labor Service as well as various regional agricultural associations throughout California. Mr. Barsamian teaches Agricultural Labor and Employment Law at California State University, Fresno. He is on the Board of Directors of the Big Fresno Fair (21st District Agricultural Association). He is a Past President of the Board of Directors of the Agricultural Personnel Manage-ment Association and a Past Chairman of the Board of Directors of the Chamber of Commerce of Clovis, California. Mr. Barsamian has au-thored various articles on agricultural labor and employment and lectures at industry seminars throughout California.

James W. Bogart

President & General Counsel - Grower-Shipper Association of Central California

Panelist for Workshop F: On Farm Transportation Jim Bogart is the President and General Counsel of the Grower-Shipper Association of Central California. The Association represents some 300 growers, shippers, packers, processors, cold storage facilities and other entities affiliated with, or connected to, the vegetable industry in the counties of Monterey, Santa Cruz, San Benito and Santa Clara. Mr. Bogart received his undergraduate degree in 1973 from the Uni-versity of Southern California (B.A. History). He earned his law degree in 1977 from the University of the Pacific, McGeorge School of Law. He has specialized in labor and employment law since his admission to the California State Bar in 1977. Since 1980, he has served as the attorney for the Grower-Shipper Association of Central California counseling and representing agricultural employers in virtually all aspects of labor and employment law including wrongful discharge, discrimination, sexual harassment and labor management litigation; unfair labor practice charges and other proceedings before the National Labor Relations Board and the California Agricultural Relations Board; organizing campaigns; collective bargaining; union contract administration, grievances, and arbitrations; pro-ceedings before the Equal Employment Opportunity Commission, the California Department of Fair Employment and Housing, and other wage/hour and worker safety compliance agencies; disability accommodation; family and medical leave; employment contracts and person-nel policies. He has spoken to several groups and organizations over the years and has written numerous articles on various labor and em-ployment law matters. He also served as an editor and technical reviewer of the University of California’s published text, Labor Management Laws In California Agriculture. He is a member of the Monterey County Bar Association, American Bar Association, and the California State Bar Association where he serves on both the Labor and Agribusiness Committees. Mr. Bogart serves, or has served, on many charitable and philanthropic boards including

HR Roundtable Panelist: The “E” Ticket Ride – The New Normal in Ag HR Ignacio “Nacho” Compean graduated from San Jose State University where he majored in Foreign Languages and Psychology. He spent 18 years in Human Resources management working in Silicon Valley for ROLM, Synertek-Honeywell, Prometheus and Intel. He moved to the central valley in California where he worked for ConAgra Foods, Atwater Canning and Ratto Bros. For the past eight years he has been the Human Resources Manager at Constellation Brands where he provides human resources strategy, services and management for Estancia Winery, Blackstone-Gonzales Winery, Wild Horse Winery, Grower Relations and all vineyards in California. Constellation Brands is the larg-est Premium wine company in the world. The company portfolio includes over 100 brands like Svedka, Paul Masson, Robert Mondavi, Simi, Clos du Bois, Black Box and Black Velvet. In addition, Constellation Brands also makes and sells Modelo, Corona, Victoria and Pacifico. He lives in Marina, California with his wife Cindy who teaches computer science and works in Assistive Technology at CSU-Monterey Bay.

For the past eight years, Trish has worked as the Director of Risk Management for Diageo Chateau & Estate Wines (DC&E) located in Napa, California. DC&E owns 7 winery properties in Cali-fornia and owns, farms, and oversees the farming of over 2,000 acres of wine grapes across the state. Dax B. Deason

Founder - Deason Law, PC Co-Presenter for Workshop B: “Is H-2A the Future of Farm Labor?” Born in the border town of El Paso, Texas, Dax Deason is the founder of Deason Law, PC. Even during his clinical studies in law school, Mr. Deason has been dedicated to providing effective representation to companies and individuals from across the United States. From Hawaii to Florida, he has traveled extensively to represent clients in various labor intensive industries, such as agriculture, steel plants, food pro-cessing, engineering, farming, ranching and professional outsourcing. Mr. Deason is also a favorite speaker during client training sessions or at seminars before agricultural trade associations. Mr. Deason's primary practice area is devoted to defending companies from overzealous government regulation, which includes assisting companies with I-9 audits, litigating Department of Labor H-2A audits and other government inspections concerning the labor and immigration regulations. He also guides companies through the transactional process of hiring profes-sional and skilled employees, assists investors who seek to establish new ventures and represents agricultural companies who sponsor hun-dreds of foreign agricultural workers each year under the H-2A program. His Spanish fluency and familiarity with the Mexican culture pro-vides companies with an added benefit when companies hire the firm to sponsor workers from south of the border. Mr. Deason also dedi-cates time in assisting individuals with their immigration status, including the filing of petitions for undocumented students under the DACA program. Mike DeMore, CEBS Managing Director - United Ag

Presenter for Workshop E: The Affordable Care Act: The Bottom Line Facts Mike’s background includes over 30 years’ experience, both on the insurance carrier and broker/consultant sides of the field. He began his benefits career at Blue Cross of Northern Ohio, progressing through various client services, sales, and sales management positions before leaving to take a regional position with Partners’ National Health Plan’s Third Party Administrator (TPA), a joint venture company between Aetna and the Voluntary Hospital Association. In 1992 Mike was offered a position in the major accounts department of Foundation Health Plan in Rancho Cordova, CA. He was subsequently promoted to Director of Sales for Foundation Health’s TPA. Mike began the broker/consultant phase of his career by taking a position with Keenan & Associates in Sacramento, and later in San Diego, as Vice President of Sales. Upon his move to Orange County, he took a Consultant position with Gallagher Benefit Services, a division of the world’s 5th largest broker/consultant. Subsequent promotions resulted in Mike becoming the Orange County Employee Benefits Area President, where he re-mained until recently. His position at United Ag began in December 2012 and entails responsibilities related to delivery of services to the membership of United Ag, along with vendor partner management. He participates in strategic planning with the senior management team and as well as issues related to the Affordable Care Act. Mike also heads up Superior Insurance Services, United Ag’s TPA. Mike has an MBA and a CEBS designation.

Rick and his team of Wellness Consultants provide assess-ments and strategic planning to employers with a focus on creating a sustainable culture of health at the worksite, with an emphasis on get-ting people to eat better, move more and manage their stress. Rick has over twenty-five years of strategic leadership in the health care in-dustry, with extensive experience in behavioral health and wellness. He is a licensed clinician (MFT) and holds a Master’s degree in Psycholo-gy with post-graduate certification in Gerontology, and Chemical Dependency. Rick also has a Master’s in Business Administration and Facul-ty-status certification from the Wellness Council of America (WELCOA).

Morgan LeBlanc

Safety Manager, O’Neill Vintners and Distillers Safety Roundtable Panelist: Strategies for Reaching Safety Success

Morgan LeBlanc is a career safety professional that has worked for several international companies; Eastman Kodak where he worked as an Industrial Hygienist, Pfaudler US, Inc. as the Environmental Health and Safety Engineer, and Frontier Telecommunication where he was the Corporate Environmental and Safety Manager. Morgan worked for Constellation Wine Company as Director of Safety covering the West Coast Operations from 1996 to August of 2013. While at Constellation Brands, he guided Mission Bell Winery and Gonzales Winery to Voluntary Protection Participants certification as well as several Vineyard Operations toward Golden Gate Certifications. Morgan holds a Special Team Member Certification (STM) through Cal/OSHA. Currently Morgan works for O’Neill Vintners and Distillers, a privately owned winery in the Central Valley of California. O'Neill Vintners has grown to become the 8th largest U.S. winery and has earned a reputation as one of the premier custom wine producers in California. As Safety Manager, Morgan is responsible for all Safety, Environmental and Security program activities at the winery. The winery is preparing to step up the the next level in safety as the winery continues to grow and increase produc-

tion of wine and brandy. During his time in California Morgan has served on the on the Executive Board for the National Voluntary Protection Participants Association and have previously served as Vice Chairman on the Executive Board of Directors for Region IX VPPPA. He served on the Board for the Agricultural Personnel Management Association (APMA). Morgan served on several organization boards including: ASSE as President for the Genesee Valley Chapter, and the Board of the Alliance of Hazardous Materials Professionals in Rochester NY.

C. Bryan Little

Chief Operating Officer – Farm Employers Labor Service Moderator for Workshop F: On Farm Transportation Bryan Little, a labor-affairs specialist with extensive experience in both government and agriculture, is the Chief Operating Officer of Farm Employers Labor Service. Bryan also serves as Director of Labor Affairs for California Farm Bureau Federation, representing members on leg-islative, congressional and regulatory issues involving immigration and labor policy. Bryan formerly served with the U.S. Department of Labor, as Deputy Assistant Secretary for Occupational Safety and Health. Prior to joining OSHA, Little was Senior Director for Governmental Affairs for American Farm Bureau Federation in Washington, D.C. Bryan earned a Bachelor's Degree in political science and public administration from James Madison University in Harrisonburg, VA.

Joseph Mallobox

Corporate Director of Human Resources – Taylor Farms HR Roundtable Panelist: The “E” Ticket Ride – The New Normal in Ag HR Joseph Mallobox is Corporate Human Resources for Taylor Farms. In this role, he is responsible for development of long-range strategy with a focus on national recruitment projects, HRD, staff development and retention. He also serves as the company’s compliance resource for their nine locations in the United States and one in Guanajuato, Mexico. His career began with Taylor Farms as their first California/Arizona HR Manager in 2001, where he built their Human Resources Department and implemented policy and procedures. Prior to that, he held the position of District Development for Manpower Staffing Services agricultural sector for 6 years. His family has been involved in agriculture for many years as labor contractors, truck drivers and field inspectors. Back in the 1960’s, his mother was one of the first women in the Ag In-dustry to be a Field Manager. Among other accomplishments, Joseph serves on the Board of Directors for APMA, Rob’s Run, Center for Com-munity Advocacy and a volunteer at Hospice of the Central Coast, The American Cancers Society, and Rancho Cielo.

Patrick S. Moody is a shareholder with Barsamian & Moody, a law firm solely dedicated to repre-senting employers. Mr. Moody provides the firm’s management clientele with solutions and advice for complying with the numerous stat-utes and regulations relating to labor and employment law, as well as the intricacies of handling union organizing campaigns and working within the confines of collective bargaining agreements. He has represented employers before most state and federal administrative agen-cies, in judicial and labor grievance arbitrations, as well as in both state and federal trial and appellate courts. Mr. Moody earned his under-graduate degree from the University of Florida, and his J.D. degree, with honors, from the California Western School of Law, where he served as a Staff Writer and was on the Executive Board of the California Western Law Review and the California Western International Law Journal. He was admitted to the California State Bar in 1991, and is also admitted to practice before all United States District Courts in CA, and the Ninth Circuit Court of Appeal. He is the Valley Area Director of the Board of Directors of the Agricultural Personnel Manage-ment Association. Mr. Moody frequently speaks on many different topics related to labor and employment law, regularly contributes arti-cles to a wide variety of publications, and is the author of several regularly published columns on topics relevant to employers.

Kimberly Naffziger

Assistant Vice President - Zenith Insurance Company Moderator for Safety Roundtable: Strategies for Reaching Safety Success

Kimberly Naffziger is an Assistant Vice President and Agricultural Specialist with Zenith Insurance Company. A California native, Kimberly has been involved with the agricultural industry for most of her life. Her background includes serving as Program Development Specialist at California State University, Fresno’s Center for Agricultural Business from 1990 to 2008. In her role at the University she conducted applied research and was involved in the dissemination of information through educational outreach programs for the agricultural industry. In 1997, she assumed the role as Executive Director for AgSafe, a non-profit organization dedicated to reducing injuries, illnesses and fatali-ties in agriculture. Presenter for Workshop L: Equitable Food Initiative Peter O’Driscoll directs the Equitable Food Initiative, an exciting new partnership that helps workers, growers and major food buyers col-laborate to grow safer food. As farms comply with the EFI standard for improved working conditions, pest management and food safety, the initiative creates additional value throughout the food system. From 2006-11, Peter was Executive Director of ActionAid USA, the US affiliate of ActionAid, an international anti-poverty organization. He was an advocate for global food system reform at the Center of Con-cern from 2000-2006, and from 1997-2000 served as Latin America Director for Ashoka, an international network of social entrepreneurs. Peter worked with Jesuit Refugee Service in El Salvador from 1987-94, and was Country Director for the last three years. In 2002 Peter was selected as a Fellow in The Rockefeller Foundation’s Next Generation Leadership Program, which brought together 24 leaders from across the country to explore critical social issues. Peter earned a master’s degree in economic development from Columbia University's School of International and Public Affairs, and a bachelor’s degree from Harvard College. Concentrating in labor relations and employment law, including management representation in counter-organizing campaigns, unfair labor practice defense, grievance and arbitration defense, and collective bargaining negotiations. Represents employers in state and federal courts in actions ranging from harassment and discrimination to wage and hour disputes. Defends employers in administrative agency pro-ceedings and investigations including the National Labor Relations Board, the Agricultural Labor Relations Board, the California Labor Com-missioner, U.S. Department of Labor, Cal/OSHA, EEOC, and others. The son of Mexican immigrants, he is a former farmworker, and has over 25 years of experience in the field of workplace health and safety, and personnel management. Mr. Sandoval has presented at many conferences at the national, state, and local levels. DLSE changed its position; The California courts have regarded that time since the DLSE changed its position; The California Court of Appeal ruled in Gonzalez v. Downtown LA Motors and Bluford v. Safeway Stores; Employers using piece-rate compensation plans are affected by Gon-zalez and Bluford; Employers using piece-rate compensation plans can adjust to Gonzalez and Bluford.

B: Is H-2A the Future of Farm Labor? Presenters: Dax Deason & Jason Resnick With persistent labor shortages and Immigration Reform stalled in Congress, the H-2A program is the only guest worker solution currently available to agricultural employers. This class will explore the pros and cons of using the H-2A program.

C: Drugs, Sex & Violence Presenter: Greg Coulter This session will provide an overview and discussion of three critical areas for employers: harassment, drug related issues and violence.

Keeping the workplace safe and secure is the theme of this topic and is of critical importance. Knowledge, planning and training can prevent or lessen liability. Learn to identify and address harassment, deal with drug related issue and prevent or address violence in the workplace.

D: Tricky Terminations Presenter: Patrick Moody In this session, Patrick Moody will discuss how to prepare for and execute employee terminations, particularly those termination that you antic-ipate might be troublesome, and those that become troublesome during the termination. We will cover anticipating and preventing potential

violence, use of injunctions and restraining orders, when to call the police, and more. Bring your most challenging situations to share with the group, so that we can all learn to deal with this very tricky subject effectively.

E: The Affordable Care Act: The Bottom Line Facts Presenter: Mike DeMore A review of the major provisions of the Affordable Care Act that affect both large and small employers as of the date of the Forum. A discus-

sion of the ramifications of the law to employers of all sizes. An outline of how the exchanges will affect employers’ compliance with the law. Audience Q&A.

F: On Farm Transportation Moderator: Bryan Little. Panelists: Jim Bogart, Jason Resnick, Joel Sherman (invited) For years, growers have used transportation platforms to move irrigators around the farm to spare them walking long distances. For a time, it

was widely believed this practice was compliant with Cal/OSHA regulations, but recently the agency has taken the position that their use is a violation of their tractor safety regulation. Some large farms have applied for temporary variances to this requirement through Cal/OSHA and

for permanent variances at the Cal/OSHA Standards Board. The Board recently voted to create an advisory committee to examine the possi-bility to permanently revise the tractor safety regulation to permit the use of transportation platforms. Grower groups and farm operators are

expected to participate in the advisory committee.

G: Joint Employer Liability -Times Are Changing Presenters: Jason Resnick & Terrence O’Connor Historically, growers of agricultural commodities have used labor contractors to provide employees for farming and harvesting. It has always been assumed that the workers supplied by the labor contractor were those of the contractor, not the grower. Contractors are hired by grow-

ers so that the contractor will assume all employer responsibility as well as liability. Unfortunately, as a result of recent litigation and court decisions, the line between growers and labor contractors has become blurred. An example of this is a California federal court ruling in Arre-

dondo v. Delano Farms where a “joint employer” relationship was found to exist between the grower and the labor contractor and the grower arguably being liable for wage and hour claims made by the contractor’s employees. The session will address: Current status of litigation

involving the “joint employer” issue addressed in the Delano Farms case; An analysis of various statutes, both state and federal, where this concept would be applied; Practical tips in grower contractor relationships to avoid joint employer liability; Judicial trends addressing agricul-

tural joint employer relationships.

J: Electronic File Keeping and HR Technology Presenter: Richard Daley In general, employers are free to maintain their records in any format. Current technological advances now allow employers to maintain their

employment records in an electronic format to maximize efficiency, reduce costs and minimize physical storage space. Additionally, many companies are electing to go paperless as part of their commitment to sustainability. When implementing such a conversion, however, em-

ployers must follow the guidelines published by the U.S. Department of Labor and other record keeping requirements. This presentation will give you an overview or such requirements, as well as practical information on how to select a system and implement it in your workplace.

the value chain in its governance. The Equitable Food Initiative (EFI) is a new project that brings together workers, growers and retailers in the effort to produce better fruits and vegetables. As produce farms comply with the EFI Standard—for improved working conditions, pesticide management, and food safety—the entire food system sees benefits, all the way from farm workers to consumers.

M: Emergency Plan for Union Activity Presenter: Ron Barsamian A petition for an election is served on you late in the day on a Friday, and an ALRB agent is calling to tell you that your written response and employee name and address list is due Monday at noon…and your direct-hire and farm labor contractor employees are not working during the

weekend. Are you ready for this? Are your supervisors, foremen and those of your farm labor contractors trained in what they can and can-not say? Who will talk to the press? Where is your office staff? During this session, Mr. Barsamian will take you through the step by step

process for being ready and able to deal with union organizing, access violations, responding to petitions and all of the things that you proba-bly did not know where going to turn life upside down without notice. The real story…not just what the law says.
