By accepting this appointment, said administrator specifically acknowledges that this contract is
for a limited duration and that all rights and privileges herein shall terminate upon the expiration
date of this contract, unless voided earlier pursuant to the provisions of paragraph 17 below. The
parties agree that no rights of tenure or presumption of continued employment are conferred or
implied by this contract or by a number of consecutive contracts. The parties further agree that no
right to notice of renewal or nonrenewal of the contract is conferred or implied.
Gross salary for this period of employment will be $ ________, payable in ________ installments

(2) I agree to manifest by daily example the highest Christian virtue, serving as a Christian role
model (1 Timothy 4:12) both in and out of school to students (Luke 6:40), parents, and fellow

material, but even more powerfully through word, deed, example, and shared experience. I

have read the school’s lifestyle statement (signed and attached) and agree to follow it 24/7
during the entire time of my employment with this Christian school ministry.
(3) I have carefully read and fully agree that my life meets the requirements of the school’s
declaration of moral integrity (signed and attached) and that I will abide by the biblical
precepts set forth in the declaration of moral integrity regarding my personal sexual behavior.
I understand that failure to do so will result in dismissal from my position. I also accept the
school’s religious conviction that the unique roles of the male and female are clearly defined
in Scripture and that Romans 1:24–32 condemns the homosexual lifestyle (Romans 12:1–2;
1 Corinthians 6:9–20; Ephesians 4:1–11, 5:3–5; 1 Thessalonians 4:3–8; 1 Timothy 4:12; 2
Timothy 2:19–22; 1 Peter 1:15–16, 2:15–17; 1 John 3:1–3).
(4) I agree to faithfully participate in a local church whose fundamental beliefs are in agreement
with the statement of faith of this school (Hebrews 10:25).
(5) I affirm that I have read and will fulfill the administrator job description and the school’s
policies set forth in the employee handbook and the parent-student handbook. I also agree to
abide by any additions, changes, and deletions made to school policies at the sole discretion
of the school board without prior notice during this contract year.
(6) I agree to uphold the school’s constitution and bylaws, and to develop administrative policies,
procedures, and programs that will implement the directives of the governing board. I will
adopt day-to-day operational practices that are a consistent model of integrity, efficiency, and
accountability.
(7) I agree to observe appropriate confidentiality in matters regarding student, parent, and
personnel.
(8) I agree to inform the school board, without delay, of any fraud, false entry, substantial error,
embezzlement, or employee misconduct that I discover or know to have taken place in any
records, property, or funds of the organization, and to report to the board any transaction or
matter that seems damaging to the organization.
(9) I agree that any previous agreements, whether written or oral, are fully merged into this
agreement, and that no other agreement, statement, or promise other than those contained in
this contract shall be valid or binding on either party.

(10) Benefits. I understand that the school is not liable to reimburse me for any benefit not used in
the benefit package. I may not choose to receive cash in lieu of any benefit. The school
reserves the right to change benefit providers and plans during the contract year at its sole
discretion. I understand that the following benefits are available to administrators.
A. Personal days. Exempt employees shall be permitted ____________________
personal days per school year. These days may be used for personal or family illness,
and for professional activities. Should additional 1-year contracts be offered in the
ensuing years, up to ____________________________ unused personal days may
be allowed to accumulate beyond the annual allotment of
__________________________ days per year. These extra days may be used only if
needed for extended personal or family illness needs. A prorated payroll deduction will
be made for each day absent over the allotted days for both full- and part-time exempt
employees.
B. Holidays. School employees receive all standard school holidays including

example, the school would pay one-half of the school’s portion of the premium for an
exempt employee working 20 hours per week.
If the employee’s spouse has duplicate family coverage, and the school employee
signs a waiver forgoing insurance coverage, the employee will be given a taxable gift

D. Free tuition. A full-time exempt employee shall receive _____________________

(11) Performance, Discipline and Termination Issues. I agree to give the school board 30 days’
prior written notice of intended resignation unless a different termination date is mutually
agreed upon. I understand that payment shall be made of that proportionate part of the
salary which the number of days of actual duty bears to the number of days covered by the
contract for exempt employees that resign or are terminated. I agree that all fringe benefits
will terminate at the end of the month upon the last day of employment unless such benefits
are allowed to continue longer by a separate written agreement negotiated with the school
board.
(12) I agree that if there are deficiencies in my job performance or my personal performance, the
school board, at its sole discretion, may extend to me a progressive discipline plan to help
facilitate needed changes in my performance. I agree that the school board, at its sole
discretion, may determine that certain acts, deficiencies, or situations are so grave that they
may result in immediate dismissal and thus bypass this general procedure. I further agree

that the school board may modify or revoke the plan at its sole discretion, and that failure to
complete such a plan before the end of this 1-year contract does not obligate the school in
any way to extend another contact for a new year.
(13) I understand and agree that my employment may be terminated before the end of the school
year for cause and that there is no right to renewal of this contract. Where cause exists, the
school board may terminate this contract, provided that I have been informed of the cause
for discharge and have been given an opportunity to respond to it prior to final termination. I
agree that failure to request a meeting with the school board within 7 days of delivery of the
termination notice shall waive my right to such a meeting and the termination is final. I agree
that the school board has the sole right to make the dismissal immediate or with longer
notice, depending on the reason for dismissal. “Cause” as used herein includes, but is not
limited to, any conduct tending to reflect discredit upon the school or upon me by impairing
my continued usefulness as a Christian role model for the students. I agree that if my
employment is terminated for cause, my earned salary and benefits will be paid only through
the date of termination unless some other written agreement is reached with the school
board.
(14) I agree to attempt to resolve differences or conflicts by following the Matthew 18 principle,
the biblical pattern of addressing the conflict in private with my employer, my administrator,
or a coworker, consistent with Matthew 18:15. Should the issue remain unresolved with my
employer, I agree to be bound by the following mediation and binding arbitration agreement
in an attempt to resolve these issues and bring reconciliation.
Mediation and Binding Arbitration AgreementThe parties to this agreement are Christians and believe that the Bible commands them to
make every effort to live at peace and to resolve disputes with each other in private or within
the Christian community in conformity with the biblical injunctions of 1 Corinthians 6:1–8,
Matthew 5:23–24, and Matthew 18:15–20. Therefore, the parties agree that any claim or
dispute arising out of, or related to, this agreement or to any aspect of the employment
relationship, including claims under federal, state, and local statutory or common law, the
law of contract, and law of tort, shall be settled by biblically based mediation. If resolution of
the dispute and reconciliation do not result from mediation, the matter shall then be
submitted to an independent and objective arbitrator for binding arbitration.
The parties agree for the arbitration process to be conducted in accordance with “Rules of
Procedure for Christian Conciliation” (“Rules”) contained in the Peacemaker Ministries

booklet, Guidelines for Christian Conciliation. Consistent with these “Rules,” each party to
the agreement shall agree to the selection of the arbitrator. The parties agree that if there is
an impasse in the selection of the arbitrator, the Institute for Conciliation, a division of
Peacemaker Ministries of Billings, Montana (406-256-1583), shall be asked to provide the
name of a qualified person who will serve in that capacity. Consistent with the “Rules,” the
arbitrator shall issue a written opinion within a reasonable time.
The parties acknowledge that the resolving of conflicts requires time and financial resources.
In an effort to fully encourage and implement a biblically faithful process, _______________
____________________ School agrees to pay all fees and expenses, which may be
required by the mediator, case administrator, and/or arbitrator related to such proceeding.
The issue of final responsibility for such costs will be an agreed issue for consideration or
determination in the mediation or arbitration. The parties agree that they will endeavor to
exchange information with each other and present the same at any mediation or arbitration
pursuant to the ICC Rules of Procedure with the intent to minimize costs and delays to the
parties. They will seek to cooperate with one another and may request the mediator, case
administrator, and/or arbitrator to direct and guide the preparation process so as to
reasonably limit the amount of fact-finding, investigation, and discovery by the parties to that
which is reasonably necessary for the parties to understand each other’s issues and
positions, and to prepare the matter for submission to the mediator and/or arbitrator to
inform the mediator and/or arbitrator. In addition, the parties agree that in the event of
arbitration, they will use a single arbitrator who is experienced in the relevant area of law
and familiar with biblical principles of resolving conflict.
The parties to this contract agree that these methods shall be the sole remedy for any
controversy or claim arising out of the employment relationship or this agreement and
expressly waive their right to file a lawsuit against one another in any civil court for such
disputes, including any class action proceeding, except to enforce a legally binding
arbitration decision. The parties acknowledge that by waiving their legal rights to file a
lawsuit to resolve any dispute between them, they are not waiving their right to employ legal
counsel at their own expense to assist them in any phase of the process.

(16) For Church-Sponsored Schools Only.

Federal Unemployment Tax Act. Therefore, upon termination of employment, regardless of
the reason, I understand that unemployment benefits are not available.
(17) I agree that if any provision of this agreement is declared invalid, illegal, or unenforceable, its
invalidity or unenforceability shall not affect any other provision of this agreement.

the Christian community in conformity with the biblical injunctions of 1 Corinthians 6:1–8,
Matthew 5:23–24, and Matthew 18:15–20. Therefore, the parties agree that any claim or
dispute arising out of, or related to, this agreement or to any aspect of the employment
relationship, including claims under federal, state, and local statutory or common law, the
law of contract, and law of tort, shall be settled by biblically based mediation. If resolution of
the dispute and reconciliation do not result from mediation, the matter shall then be
submitted to an independent and objective arbitrator for binding arbitration.
The parties agree for the arbitration process to be conducted in accordance with “Rules of
Procedure for Christian Conciliation” (“Rules”) contained in the Peacemaker Ministries
booklet, Guidelines for Christian Conciliation. Consistent with these “Rules,” each party to
the agreement shall agree to the selection of the arbitrator. The parties agree that if there is
an impasse in the selection of the arbitrator, the Institute for Conciliation, a division of
Peacemaker Ministries of Billings, Montana (406-256-1583), shall be asked to provide the

name of a qualified person who will serve in that capacity. Consistent with the “Rules,” the
arbitrator shall issue a written opinion within a reasonable time.
The parties acknowledge that the resolving of conflicts requires time and financial resources.
In an effort to fully encourage and implement a biblically faithful process,
___________________ School agrees to pay all fees and expenses, which may be required
by the mediator, case administrator, and/or arbitrator related to such proceeding. The issue
of final responsibility for such costs will be an agreed issue for consideration or
determination in the mediation or arbitration. The parties agree that they will endeavor to
exchange information with each other and present the same at any mediation or arbitration
pursuant to the ICC Rules of Procedure with the intent to minimize costs and delays to the
parties. They will seek to cooperate with one another and may request the mediator, case
administrator, and/or arbitrator to direct and guide the preparation process so as to
reasonably limit the amount of fact-finding, investigation, and discovery by the parties to that
which is reasonably necessary for the parties to understand each other’s issues and
positions, and to prepare the matter for submission to the mediator and/or arbitrator to
inform the mediator and/or arbitrator. In addition, the parties agree that in the event of
arbitration, they will use a single arbitrator who is experienced in the relevant area of law
and familiar with biblical principles of resolving conflict.
The parties to this contract agree that these methods shall be the sole remedy for any
controversy or claim arising out of the employment relationship or this agreement and
expressly waive their right to file a lawsuit against one another in any civil court for such
disputes, including any class action proceeding, except to enforce a legally binding
arbitration decision. The parties acknowledge that by waiving their legal rights to file a
lawsuit to resolve any dispute between them, they are not waiving their right to employ legal
counsel at their own expense to assist them in any phase of the process.

do not request that my salary be spread over a twelve-month period.
(16) For Church-Sponsored Schools Only.
_________________________________________________ School has been classified as
a 501(c)(3) nonprofit church-related organization and has chosen not to participate in the
Federal Unemployment Tax Act. Therefore, upon termination of employment, regardless of
the reason, I understand that unemployment benefits are not available.

(17) I agree that if any provision of this agreement is declared invalid, illegal, or unenforceable, its
invalidity or unenforceability shall not affect any other provision of this agreement.

open position. The school administration reserves the right to withdraw the contract and offer of

Optional Contract Wording
ACSI believes that the wording used and positions taken in the suggested contracts, 3.5.1.1 and
3.5.1.2, represent the best model for Christian schools. Some other possible but perhaps not as
desirable ways to address the contract issues are as follows:
(1) I understand that given the possibility of enrollment fluctuation, the validity of this contract is
contingent upon adequate enrollment that makes possible a cost-effective program. If
reduction in staff becomes necessary, I agree that the administrator may use seniority,
effectiveness, and overall value of the employee’s gifts, strengths, and general qualifications
in making staffing recommendations to the board. If there is not a significant difference in
effectiveness or value to the school, seniority may be used to determine the decision. The
board, at its sole discretion, may accept, reject, or modify the administrator’s
recommendations regarding staffing. If I am released under this paragraph, the school agrees
to pay me 30 additional days of the salary as stated above, plus such payments as have
actually been earned and paid prior to the release from employment.
(2) The _______________________ and ________________________________ of each month
are paydays. However, the teacher understands that there may be times when employees
will have to wait for their paychecks until the necessary monies are secured to cover salaries.
(3) New teachers to the staff agree to an orientation period of 60 days in which to prove their
teaching ability and classroom leadership to the satisfaction of the administrator. The teacher
understands that if any areas need improvement, such will be communicated in a timely
fashion so that he/she can attempt to correct the deficiency before the expiration of the 60
days. Should such teaching not prove to be satisfactory as determined by the administrator,
the teacher understands that this contract terminates at that time without further obligation by
either party.
(4) The teacher agrees not to enter into responsibilities or other employment that will conflict with
his or her teaching assignment.
(5) The teacher understands that any staff or faculty member who is uncertain as to the Lord’s
leading by the deadline for returning contracts may be considered with other applicants for
the open position by submitting a written request to the administrator’s office by the due date
of the contract. As final applicants are considered, the current teacher who expresses this

interest will be notified. In the case of essentially equal qualifications between the current
employee and another applicant, the current employee will be given the first consideration.
(6) The teacher agrees that if at any time during the period of employment the teacher finds
himself/herself out of harmony or sympathy, or in discord or disagreement with the philosophy
standards, or administration of the school, the teacher will immediately make that fact known
to the administrator. The teacher further agrees to voluntarily withdraw from this employment,
or be subject to termination for cause, if the discord, disagreement, or lack of harmony
continues.
