Specif ical ly ,on th e day the Court entered the plea of gui l ty , defendant had cometo Court prepared to plead not guil ty and under the impression thathis attorneys were prepared fo r t r i a l .     ..1. My name is John Wiley Price. I am over the age of18 and competent to make th i s statement.

    2. On March 15, 1976, I entered a plea of guil ty to anindictment charging tha t I knowingly made a ma te ri al ly f al se s ta te -ment to the Guaranty Bank o f Da lla s, Texas fo r the purpose o finfluencing the bank to approve a home improvement loan.

    3. I now believe tha t th is plea of gui l ty was improperand resul ted in manifest in jus t ice to myself.

    4. In fac t , a t the time I entered the p lea of guil ty Ihad not been advised by roy attorneys and did not know tha t i t was alega l defense tha t the al legedly fa lse statement was made in goodfa i th and with no i nt en ti on t o mislead. Had I known th i s , I couldand would have alleged and proved such a defense.

    5. The so-called false statement wasva home improvementcontract purported to be signed by Roger S. Mullins. At tha t t ime,Mullins was sharing an apartment with me While I was separated frommy wife. I lef t a message with MUllins' gi r l f r iend tha t I neededMullins to sign the contract and tha t I would leave it a t the apart-ment. When I returned to the apartment, th e c on tr ac t bore What Ibelieved to be his s ignature. I did not know then and do not know now

    : 6. When the case was se t for t r i a l on March 15, 1976, wewere unprepared to d e ~ e n d ' M r . Price . We were also concerned t ha t i fhe pleaded not guil ty but was found to be,guil ty, .he 'would be l ikelyto receive a prison term.
