• Question Time will be for a period of 30 minutes.

• Questions submitted must begin with the submitters name and address.

• No person may submit more than 2 questions at any 1 meeting.

• If 2 questions are submitted, the second question may be deferred until all other questions have been asked, or may not be asked if the time allotted for public question time has expired.

• A question may be disallowed if the Chairperson determines that it:

• Relates to a matter outside of Councils responsibility; • Is defamatory, indecent, abusive, offensive, irrelevant, trivial or

objectionable in language or substance; • Deals with a subject matter already answered; • Is aimed at embarrassing a Councillor or a member of Council staff; • Relates to personnel matters; • Relates to the personal hardship of any resident or ratepayer; • Relates to industrial matters; • Relates to contractual matters; • Relates to proposed developments; • Relates to legal advice; • Relates to matters affecting the security of Council property; or • Relates to any other matter which Council considers would prejudice

Council or any other person. • A Councillor or the Chief Executive Officer may require a question to be put on

notice. If a question is put on notice, the answer to it must be incorporated in the minutes of the meeting at which it was asked and a written copy of the answer sent to the person who asked the question.

• A Councillor or the Chief Executive Officer may advise Council that an answer should be given in a meeting closed to members of the public and why.

• Submitters must register by 4.30pm on the day of a Council Meeting by

contacting the City of Ballarat Governance Unit on 5320 5543 of 5320 5535. No unregistered public submitters will be allowed to speak.

• The submitter will be given three to five minutes to address the meeting, with extension of time at the discretion of the Chair;

• Any councillor can ask questions of the submitter;

• The Chair may limit the number of submitters on any particular agenda item;

• All submissions must relate to items on the agenda and will be heard prior to each respective agenda item

SUMMARY This report provides Council with the agenda and minutes for the Audit Special Committee held on 18th June, 2008. BACKGROUND Council’s Audit Committee Charter states:- “The Audit Committee shall after every meeting forward the minutes of that meeting to the next ordinary meeting of the Council, including a report explaining any specific recommendations and key outcomes.” ISSUES The items considered by the Audit Special Committee at this meeting were as follows:-

14.1 FEE STRUCTURE AT GILLIES STREET TRANSFER STATION IN COMPARISON TO OTHERS IN THE REGION Division: City Infrastructure Director: Leigh Ditchfield Author/Position: Leigh Ditchfield - Operations Manager

SUMMARY At the Council meeting of 23 April 2008, Cr Fletcher requested a report be presented to Council to consider the fee structure at the Gillies Street Transfer Station in comparison to other facilities operating in the region. BACKGROUND The Gillies Street Transfer Station is owned by Council and the operation is contracted to SITA Environmental Solutions. The fees and charges are reviewed and determined each financial year during the budget process. The Highlands Region Waste Management Group (HRWMG) comprises the City of Ballarat and the Shire Councils of Central Goldfields, Golden Plains, Hepburn, Moorabool and Pyrenees. The other Shire Councils operate Transfer Station facilities at the following locations:-

1. Central Goldfields: Bealiba, Dunolly and Talbot 2. Golden Plains: nil 3. Hepburn: Creswick, Daylesford and Trentham 4. Moorabool: Bacchus Marsh and 5. Pyrenees: Beaufort, Avoca, Landsborough and Snake Valley

ISSUES The following issues are considered relevant to this report.

1. The hours of operation and specific services provided vary across the region due to the requirements of the respective Councils and the fee structures have not been standardised within the region. It is for this reason that it is very difficult to compare fees across the different sites.

2. The comparative fees are detailed in the attachment “Overview of charges

and services 2007_08”. Due to the timing of this report being prepared, these fees are based on 2007/08 data as provided by HRWMG.

3. Note that the EPA fees for the deposition of Category C Prescribed Industrial

Waste increased from $50 to $70 per tonne as from 1 July 2008. This increase will be reflected in Council’s 2008/09 charges.

4. Any changes to the existing facility would need to comply with the reviewed

Guide to Best Practice at Resource Recovery Centres, prepared by Sustainability Victoria.

5. Any waste that can be reused or recycled, for example scrap steel, timber, furniture, white goods and computers are removed from the waste stream at the Transfer Station by the contractor. Council provides direction to the community on responsible disposal of E-waste including computers, phones and batteries.

6. Gillies Street is a “waste transfer station” and the future direction of

Sustainability Victoria is focusing on Resource Recovery Facilities to ensure that we divert more waste from landfills. Ballarat also provides a number of ancillary services that private operators do not include in their normal service. These activities include Detox Your Home, DrumMuster, mattress recycling and ChemClear which are responsible services that provide benefits to communities within the region.

7. Privately operated facilities usually handle a smaller range of waste types in

order to sell recycled bulk product back to the public. RELEVANT POLICIES The extent to which the issues covered and the directions proposed – are in line with policy, as expressed through the Council Plan, HRWMG Business Plan and Council’s Waste Management and Sustainability Strategies. OPTIONS Note the report as received. SOCIAL IMPLICATIONS It is considered that there are no social implications within this report. Human Rights Consideration Matrix No decision or recommendation is being made in relation to this report that impact on human rights. ENVIRONMENTAL IMPLICATIONS It is considered that there are no environmental implications within this report. FINANCIAL IMPLICATIONS It is considered that there are no financial implications within this report. CONSULTATION Prior to adoption of the 2008/09 Council budget, the draft budget inclusive of all fees and charges of Council was placed on exhibition and no public submissions were received in relation to fees and charges relating to the operation of the transfer station. The Waste Management Strategy adopted by Council in late 2007, was placed on public exhibition prior to being adopted. IMPLEMENTATION AND MARKETING PLAN It is considered that an implementation and marketing plan is not required. CONCLUSION The Transfer Stations and Material Recovery Facilities within the HRWMG have been in operation for many years. Their fees and charges have been levied according to the respective Shires/Councils budget preparation practices. SUMMARY This report provides information in relation to the current audit of Council’s public art practices and processes and has been developed in response to a Councillor request to explore the achievements of the Brisbane City Council’s Street Art Program. BACKGROUND Brecknock Consulting were commissioned in May 2008 to undertake an audit of public art and current practices at COB. The audit (to be completed by the end of 2008) will assist Council to deliver a strategic and coordinated ‘whole of organisation’ approach that supports high quality work, industry best practice and the development of an overall vision for public art in Ballarat. Final recommendations will be used to inform an issues paper in preparation of the Municipal Public Art Framework. As part of the consultation, Brecknock Consulting will benchmark examples of different approaches to public art including Brisbane and their Suburban Centre Improvement Program together with other public art initiatives that Council is undertaking. Brisbane City Council - Street Art Program Brisbane City Council’s Living in Brisbane 2026 sets a vision for the future of Brisbane with eight strategic directions. The development of a creative Brisbane is fostered through the Councils’ Creative City Strategy. This Strategy “facilitates new ways of thinking and solving problems, not only in the arts and cultural fields, but in urban development and renewal, in ensuring an ecological balance and sustainability, in the creation of wealth and social cohesion.” The Art in Public Places Policy incorporates these themes as a framework to guide curatorial approaches, design and commissioning of artworks. The Art in Public Places Policy applies to:

• All Council programs that are concerned with the built and natural environment, such as capital works, urban design, integrated planning and design, development assessment, environment and parks, roads, transport corridors and major transport links such as tunnels and bridges.

• All Council programs that are concerned with the cultural life of the city, such as libraries, festivals and events, sport and recreation, history and heritage, cultural institutions, youth, elderly, multicultural and Indigenous programs.

Guided by this policy Brisbane City Council has developed a range of Street Art initiatives including for example, “Art Force”, a program that focuses on the reduction of crime and graffiti. Queensland Urban Ecology (QUE) on behalf of Brisbane City Council manages this program and claim “artworks promote community ownership and an increased sense of well being and personal orientation. Research has shown

that public art decreases littering and infrastructure damage.” Art Force paints Traffic Signal Boxes (TSB’s) across Brisbane. There are over 1000 TSB’s on the streets and 900 have been painted so far. Evaluation of the project by QUE (“Brisbane’s Unique Anti Graffiti Strategy – an empirical report”) demonstrated an 85% reduction in graffiti. ISSUES Preliminary results from the audit by Brecknock Consulting have raised a number of issues regarding Council’s current public art activity.

1. Initiation of public art projects - The extent and reach of public art across the organisation and subsequently, the identified need for a coordinated and strategic approach through a Public Art Framework.

2. Understanding contemporary public art – A diverse range and level of understanding of contemporary public art practice and development exists, the need for defined processes and role clarification has been identified.

3. Identification of projects and sites – An overall vision to deliver public art in Ballarat and the identification of key sites/opportunities is required with a long term timeframe.

4. Managing the Public Art process - The role and intent of public art; the

significance of a single project versus an overall citywide vision for public art; sourcing of artists and due process; how decisions are made and the current lack of guidelines.

SOCIAL IMPLICATIONS The development of a Public Art Framework will provide the Ballarat community with a clear understanding for the processes and intention behind the investment in public art in Ballarat. It will highlight Council’s commitment to high quality artistic endeavour, opportunity for skills development and employment, industry best practice and consistency and transparency of process. Participation and access to high quality arts and cultural activity whether through direct participation or appreciation will have direct bearing on:-

• Personal wellbeing and development via creative expression • Knowledge and skills development • Strengthening communities and promoting community wellbeing through

social interaction and participation • Enhancing the liveability of Ballarat • Stimulating the local economy through; supporting and stimulating innovation,

A considered and strategic approach to public art has the potential to also address social issues for example, graffiti and vandalism of public sites through the development of strategies such as the Brisbane City Council initiative “Art Force”. ENVIRONMENTAL IMPLICATIONS Environmental implications will be addressed through the consultancy and in the development of the Public Art Framework. CULTURAL IMPLICATIONS Council’s Arts and Cultural Development Strategy creates a basis by which to strengthen cultural planning and development within the community. Council’s approach over the coming five years aims to ensure that:- “Ballarat will be known for its rich arts, cultures, histories and contemporary activities. This will be achieved by engaging local people, mobilizing diverse resources, developing projects which express our shared cultural values and by nurturing creative talent” (page 23 Arts and Cultural Development Strategy 2005). RISK MANAGEMENT IMPLICATIONS All operational/legislative and planning requirements pertaining to Public Art activity will be thoroughly investigated through the consultancy and the development of a Public Art Framework. FINANCIAL IMPLICATIONS The public art audit currently being undertaken by Brecknock Consulting was financed through the Arts and Cultural Development Unit’s recurrent budget 07/08 at a cost of $4,700.

SUMMARY This report outlines the assessment process undertaken for applications to Council’s Community Development Grants Program 2008 / 2009. Eighty three applications were received with total funds requested of $340,517.63. All applications were evaluated against the assessment criteria endorsed by Council on 14th May 2008 (Item 14:8). This information is provided to Council to inform its decision making in relation to the Community Development Grants 2008/2009 allocation. BACKGROUND Council annually allocates $150,000 in community development grants to local not-for-profit organisations. As part of the 2008 / 2009 process, each application was assessed against the Council endorsed criteria and ranked by officers from an internal Assessment Group. The Assessment Group then met on the 25th June to undertaken an initial ranking exercise. Membership of the Assessment Group was as follows: Senior Accountant Finance & Shared Services (Chair) Coordinator Community Planning & Development Coordinator Maternal & Child Health Manager Recreation & Open Space Planning RuralAccess Coordinator Arts & Cultural Development Coordinator Following the production of an assessment report which prioritised applications, an Evaluation Panel met to discuss each application in relation to; ranking, assessment score, part funding considerations, and community benefit. Membership of the Evaluation Panel was as follows: Senior Accountant Finance & Shared Services (Chair) Manager ICT & Governance Strategic Planner Manager Community Strengthening & Services The Evaluation Panel met on the 2nd July to consider the work of the Assessment Group. A second meeting was held on the 4th July to further clarify the priority ranking of a small group of applications. ISSUES 1. Eighty three applications were received in 2008 / 2009. The level of applications and total requested for the 2008 / 2009 Grants Program was consistent within the previous year where eighty six applications were received. 2. Council officers facilitated two community grant workshops providing some basic training in bid writing and fundraising. Thirty three community members participated, representing 25 voluntary and community sector organisations. Through survey responses, 95% of participants rated the session as “very good”. RELEVANT POLICIES The application guidelines have a direct link to themes and strategies that have been identified in Blueprint Ballarat and the Council Plan. Organisations are invited to submit applications that address Blueprint’s key themes; Our People, Services and Infrastructure, Health and Resilience, Learning and Knowledge, Environment and Heritage and Our Connections. On May 24th 2006 (Item 13:4) Council adopted the Community Development Grants Program Policy in line with the Internal Auditors Report (2005-2008), completed in February 2006 and in accord with Council’s commitment to good governance. OPTIONS

1. That Council considers the prioritised list of applications for Community Development Grants 2008/2009 and allocated funds as determined appropriate.

SOCIAL IMPLICATIONS The Community Development Grants Program is a function of Council which enjoys a high and long standing profile within the community. The program also clearly enables Council to partner groups and organisations in delivering a range of benefits to the Ballarat community. The grants reinforce Blueprint Ballarat’s commitment to community development and participation through stimulating action in areas such as health, safe and inclusive communities, cultural rich and vibrant communities, and democratic and engaged communities. Human Rights Consideration Matrix Council’s Community Development Grants Program is open to all voluntary and community sector organisations to apply. It is considered that there are no specific Human Rights Considerations within this report. ENVIRONMENTAL IMPLICATIONS Whilst not the main focus of the Community Development Grants Program, a small proportion of the applications assessed demonstrate a strong capacity to support local environmental activities.

CULTURAL IMPLICATIONS The allocation of community grants has traditionally supported a wide range of cultural activities that promote local arts, culture and multiculturalism, and celebrates the evolving diversity of the Ballarat community. Through the alignment of the program guidelines with the aspirations of the community expressed throughout Blueprint Ballarat, Council can be confident that the funds it has available to distribute to voluntary and community sector organisations, will support and reflect important cultural activity in the community. RISK MANAGEMENT IMPLICATIONS As a result of the Internal Auditors Report 2005-2008 (Reported at Council on 24th May 2006 Item 13:4) a number of actions to improve the efficiency and effectiveness of the program has been undertaken. At the Council Meeting on 14th May 2008 (Item 14:8) Council endorsed that all recommendations and actions as identified with the Internal Audit Report 2005-2008 for its Community Grants Program have now been fully implemented. 14.5 BALLARAT-BURRUMBEET ROAD WORKS FUNDING AGREEMENT Division: Executive Unit Director: Anthony Schinck Author/Position: Anthony Schinck - Chief Executive Officer

SUMMARY The purpose of this report is to seek a resolution of Council that will delegate the authority to the Chief Executive Officer to enter into a funding agreement with VicRoads for $2.1 million (ex GST) that represents the City of Ballarat contribution towards the upgrade of Ballarat-Burrumbeet Road (commonly known as Sturt Street). The contribution is inclusive of $400,000 (ex. GST) capital works expenditure towards service road improvements that is the responsibility of Council) and $1.7 million of developer contributions that will be refunded to Council via future developments with a nexus towards the arterial road upgrade needs. VicRoads is responsible for the management and operation of this arterial road. The total project cost has an estimated valued of approximately $7 million, with the balance of the project funding being contributed to the works by other parties. The contract for the construction of the works will be between VicRoads (the responsible road authority for this road) and their preferred contractor for the works. BACKGROUND A detailed report was presented to Council 11 April 2007 (Section 89) that included all the relevant background information. Council adopted a net contribution of $400,000 ex. GST towards the project in the 2008/09 capital budget. A further contribution of $1.7 million has been allocated towards the project that is to be re-couped by Council in the next 3-4 years from developer contributions with a nexus to these road improvement works. In summary the project will deliver significant road safety benefits and capacity improvements to support the forecast growth of Ballarat West. The basic project elements for the upgrading of the road are as follows;

1) Construction of a roundabout east of the Arch of Victory at the intersection of Learmonth Street and Sturt Street;

2) Construction of a fully signalised intersection at the intersection of Sturt Street

and Ring Road; 3) Construction of two additional (new) traffic lanes to the north of the existing

road alignment to cater for all future east bound traffic;

4) Utilisation of the existing carriageway between the avenue of trees to cater for all west bound traffic with one full single lane of traffic capacity and the remaining road pavement used for both right hand and left hand turn lanes required for ingress and egress to adjacent development and the service road. Hence, the proposal provides for only partial duplication of the arterial

road in the west bound direction. The reasons being this proposal minimises disturbance to the avenue of trees in catering for the required turn lanes in accordance with meeting the relevant road design/safety standards;

5) Creation of two new entrances are proposed into the golf club redevelopment,

including one signalised entrance to the residential component of the development at the existing rail crossing of Sturt Street and a further unsignalised (protected, Type C treatment) entrance to the new golf club house facilities;

6) The road works would extend from the intersection with Learmonth Street to a

distance approximately 250m west of Ring Road tapering back into the existing road alignment; and

7) The existing service road is to be made one way in a west bound direction.

The support of VicRoads towards the project is conditional on this arrangement due to road safety conditions with ingress and egress to the main carriageways.

ISSUES Major issues for consideration include;

1. Relevant project planning approvals have been issued by Heritage Victoria and the City of Ballarat covering the entire scope of works;

2. The project delivers major road safety benefits;

3. The project is consistent with Council plans and strategies for servicing

growth in Ballarat West;

4. Council’s net contribution is limited to $400,000 ex.GST (this is attributed to the service road works) as the majority of the works is associated with an asset that is the responsibility of VicRoads and is to be funded by VicRoads and development contributions; and

5. It is expected the project will be delivered by VicRoads within the next 12-18

City of Ballarat will manage surveillance of Council related works and ensure appropriate communications are delivered to the relevant stakeholders. A number of potential risks have been identified in the project development phase and approvals process and appropriate conditions introduced to manage these risks. FINANCIAL IMPLICATIONS The project has been included for in the 2008/09 capital works budget adopted by Council. The Council contribution is capped to this amount as adopted in the budget. CONSULTATION Significant consultation has been undertaken during the development and approval process with all relevant stakeholders including but not limited to the Ballarat community, VicRoads, Heritage Victoria, Arch of Victory/Avenue of Honour Committee, Ballarat Golf Club and the City of Ballarat. VicRoads as the superintendent of the contract will assume all project delivery responsibilities. Council’s Infrastructure Delivery Team will be involved in the surveillance of works relating to Council areas of responsibility (i.e. the existing service road) and ensure appropriate communication protocols are established with adjacent businesses and residents along the service road. IMPLEMENTATION AND MARKETING PLAN If the recommendation of this report is adopted a letter will be prepared to enter into the proposed funding agreement between the City of Ballarat and VicRoads. CONCLUSION An upgrade to the Ballarat-Burrumbeet Road as outlined in this report is of strategic importance to the City of Ballarat in catering for future residential and industrial growth in Ballarat West and assists to mitigate a number of road safety and traffic congestion concerns and issues currently experienced by the community. Requested Council officers investigate the possibility of procuring a community events trailer. The trailer would contain equipment such as wrenches, hacksaws, tape, staple gun and so on. There was some discussion on this matter and it was noted that funding could be obtained for this. Cr Innes noted that there are some community trailers set up for bbq's and the like but Cr Jones advised that this was a slightly different set up. Cr Jones, Cr Innes and GM City Wellbeing Mr Tony Diamond will discuss this matter further and investigate the possibilities. (Requested – Cr Jones)

Call for a report - I had the good fortune last night to attend the Youth Strategy Forum. One of the issues canvassed was something that I would like Council to prepare a report on. I am looking to see a report on the development of a new resident function aimed at the youth of Ballarat. What I found last night was a certain amount of dislocation for people that come back to Ballarat that may have worked for three or four years in Melbourne, got a degree and come back to Ballarat. Their friends have moved on from Ballarat, their circle of interaction and getting out and about has changed and there is a level of disconnectivity. I'm looking to see if Council can lead to help people who relocate, I know that we have a new residents function, but I am looking for something more youth orientated so that we can engage across that sector. QT152/08 - Gary Fitzgerald - At a meeting of the Ballarat Police Association held last week. It was revealed Ballarat was 98 Police members short of providing adequate policing to the community. However that amount is too many or too less, any amount too less is unacceptable in a city the size of Ballarat and of its standing. Does Council agree with the findings from that meeting? If so will Council draft a letter of concern to the Police Minister? Status:- Letter has been forwarded to Mr Fitzgerald advising that Council will discuss this matter to determine a position on the issue.

insisting on a cause of action that would require self contained accommodation operators like myself and hundreds of others to go through the process and possibility failing in obtaining a planning permit. Gary Fitzgerald - 10 days ago I made enquiries with Council's planning permit department regarding what permits were issued to enable all MacDonald's restaurants to operate their drive through 24 hours a day service. I still have not received a reply from the particular officer, although I was told the archives had to be researched to find permits etc, I still find 10 days is a little too long for a request of this nature. 24hr operation at Bakery Hill, especially, is only going to add to the hoon factor that still takes place in the car park at Big W and Curtis St. To quote a police officer I spoke to "they sit in their cars drinking alcohol". Curtis St could become a drag strip up to MacDonald's for a burger with the association to noise and rubbish. My question is, does a permit need to be obtained for extended trading hours?

The Queen Elizabeth Centre have altered their parking arrangements. At the back of the Queen Elizabeth Centre in Eyre St there was a car park open for staff to park their cars, they have now fenced off this car park and are charging staff to park their cars within this car park. This car park is now empty which has lead to staff parking their cars in residential streets in Ascot, Talbot and Eyre Sts. Residents of these streets have raised concerns as they are no longer able to park their cars in front of their homes. Request for Council staff to look into this issue. (Requested – Cr Ruyg)
