Notification

No……………………………………….. In exercise of the powers conferred under section 98 (2)(m) of

the Guwahati Metropolitan Drinking water and Sewerage Board Act, 2009 the Board is pleased

to make the following regulations regulating the employment and conditions of service in the

respect of all categories of employees of the Guwahati Metropolitan drinking Water and

Sewerage Board.

THE GUWAHATI JAL BOARD EMPLOYEES’ SERVICE REGULATIONS, 2015

Part I

1. Title and Commencement

(1) These regulations shall be called the Guwahati Metropolitan Drinking Water and Sewerage

Board Employees Service Regulations, 2015 herein after called the Guwahati Jal Board

Employees’ Service Regulations, 2015.

(2) They shall take effect from the date of their notification by the Government of Assam in the

official gazette.

2. Definitions

(a) In these Regulations, unless there is anything repugnant to the subject or context

(i) ‘Act’ means the Guwahati Metropolitan Drinking Water and Sewerage Board Act,

2009.

(ii) ‘Appointing Authority’ means the Guwahati Jal Board or its Managing Director as the

case may be.

(iii) ‘Board’ means the Guwahati Metropolitan Drinking Water and Sewerage Board, in

short called the Guwahati Jal Board.

(iv) ‘Chairman’ means the Chairman of the Board.

(v) ‘Director’ means the Director of the Board.

(vi) ‘Employee’ means an employee of the Board.

(vii) ‘Government’ means the Government of Assam.

(viii) ‘Managing Director’ means the Managing Director of the Board.

(ix) ‘Regulations’ means the Guwahati Jal Board Service Regulations.

(x) ‘Secretary’ means the Secretary of the Board.

(xi) ‘Selection Committee’ means the relevant Selection Committee of the Board.

(xii) ‘Service’ means the Guwahati Jal Board Service.

(b) All other expressions used in these Regulations even if not specifically defined above but

defined in the Act shall have the same meaning as assigned to them in the Act.

3. Class and Cadre

(1) The service consists of the following Class and Cadres.

3 (2) the posts equivalent to the posts in the cadres of the service as on the date of

commencement of these rules are mentioned in schedule-I

4. Strength of Service

The strength of each cadre in a class of the service shall be such as determined by the Board

with the approval of the Government from time to time. The strength of the cadres of the service

on the date of commencement of these regulations and also department wise cadre strength

shall be as shown in schedule II (A) and II (B) respectively.

Provided that the Board may held in abeyance any post, as and when considered necessary.

5. Method of Recruitment to the service.

Recruitment shall be made in the manner prescribed hereinafter:

(1) Recruitment to the following Cadres of service shall be made by direct recruitment only:-

i. Secretary

iii. 70% in the rank of Assistant Engineer.

iv. All post in the rank of Junior Engineer.

v. Internal Auditor

vi. Health & Safety

vii. Training and Development officer

viii. ERP Specialist

ix. GIS Specialist

x. Human Resource Officer

xi. Administrative Officer

xii. Assistant Laboratory Technician

xiii. In the rank of L D Assistant

xiv. Driver

xv. Peon (from outsource through service provider)

xvi. Distribution Maintenance Engineer

xvii. Service Connection Engineer

xviii. Water Meter Electronic Technician

xix. CAD Operator

(2) Recruitment to the following Cadres shall be made by promotion only:-

(3) Recruitment to the rank of Assistant Engineer shall be made

a. By direct recruitment against 70 percent of the strength of the cadre of Assistant

Engineer and 30 percent from the cadre of Junior Engineer rank against the cadre

strength of Assistant Engineer in accordance with these regulation and

b. By promotion in accordance with these regulations against 30 percent in respect of

Junior Engineer to that of Asst. Engineer

(4) Board may appoint against vacant sanctioned post by deputation from other services of

Government or Government undertaking or any other Board or on contract basis for a period of

1 year or by absorption.

6. Direct Recruitment

(1) Direct Recruitment

(a) All appointments to the services under the Board by direct recruitment shall be made

through competition only and on the basis of recommendation made by the Selection

Committees as stipulated under these Regulations.

(b) The Board shall follow the following approach and methodology for such recruitment:

(i) The Appointing Authority shall, in the month of December of each calendar year,

make an assessment regarding of the likely number of vacancies to be filled up by

direct recruitment during the next year together with the details on the reservation

of vacancies for candidates belonging to the Scheduled Castes, Scheduled Tribes and

various other categories as laid down by the Government as stipulated under these

Regulations and shall intimate the same to the Selection Committee(s) concerned

before the end of the calendar year, requesting them to initiate action on selection of

candidates against the vacancies and to recommend a list of candidates in order of

preference for recruitment.

(ii) The Selection Committee(s) concerned shall discuss and decide the methodology for

each cadre in which it would like to process the selection so that the same can be

broadly indicated in the advertisement to be published for the purpose.

(iii) The Board shall, keeping the Selection Committee(s) informed, notify such vacancies

to be filled up by way of

(1) Publishing an advertisement in at least two leading local dailies, one in

Assamese and the other in English, selected on the basis of their circulation in

the state

(2) Posting the advertisement in the website of the Board and any other website

the Board may deem fit and necessary

(3) Posting the advertisement on the notice boards, in conspicuous places, of the

Board and any other office or offices that the Board may consider necessary.

(iv) The advertisement, among others, shall clearly indicate

(1) The probable cadre and number of vacancies to be filled up

(2) Reservations against the vacancies

(3) Pay scales

(4) Qualification and experience required for each post along with preferences if

any

(5) Last date and time of receipt of applications

(6) The manner and the destination, where the application shall be received (like

the details of postal address, mail ID, website address as may be applicable)

(7) The method of selection, i.e., the type of test (written examination, interview,

practical or any one or all the three) to be conducted

(8) Any other requirements

(v) The last date of application shall preferably be not less than 4 (four) weeks from

the date of publication of the advertisement.

(vi) There shall be provision for applying online, for which the website address shall be

clearly indicated in the advertisement.

(vii) All applications received, either through hard copies or electronically, shall be

listed, scrutinized and a separate list of all eligible candidates shall be prepared.

Both the lists shall be put up to the Chairman of the Selection Committee for fixing

dates for the test.

(viii) The eligible candidates shall be intimated by the Board, in a manner as decided

by it and allowing not less than 3 (three) weeks between the date of intimation and

the date of test, to attend the test.

(ix) The Committee shall conduct necessary test(s) of all eligible candidates, for each

cadre separately and in a manner in which it has been decided earlier, prepare a

select list of all suitable candidates in order of preference with due consideration to

reservations as mentioned under these Regulations and recommend the select list

to the Managing Director for appointment.

(x) The order of preference in the select list of suitable candidates recommended by

the Committee shall be in order of merit for appointment to each post under the

appropriate cadre.

(xi) The number of candidates in the select list recommended as suitable for

appointment shall be equal to the number of vacancies notified.

(xii) The Managing Director shall place the list as recommended by the Selection

Committee for approval by the Board, only after which the appointment can be

made.

(c) The Appointing Authority shall appoint candidates into the services of the Board from

the select list only in as many numbers as advertised under each cadre and in the order

of preference as recommended by the Selection Committee.

(d) Any increase or decrease in the vacancies, if felt necessary after the advertisement, shall

be re-advertised prior to the commencement of the selection process like the written

examination, interview or practical as the case may be.

(e) The select list furnished by the Selection Committee(s) shall remain valid for a period of

12 (twelve) calendar months from the date of recommendation by the Committee, after

which it shall become invalid. No appointments shall be made from the select list after

the expiry of its validity.

(f) In case the Appointing Authority disagrees with the Selection Committee on the order of

preference in the select list and wants to deviate from it, he may do so after recording

the reasons for such deviation under his dated signature and place the same in the next

meeting of the Board held not later than 3 (three) months from the date of making such

a deviation. The decision of the Board on such deviation shall be final.

(g) After appointments, the Appointing Authority shall prepare a Gradation List of all

employees in each cadre, in order of which the appointments have been made, and use

this list as the seniority list in future.

(h) The mere inclusion of a candidate’s name in the list mentioned in (b)(ix) above shall

confer no right to a candidate for appointment, unless the Board is satisfied after such

enquiry as the Board may consider necessary, that a candidate was suitable in all

respects for appointment to the position considered, but was debarred from being

appointed due to some specific reason(s).

7. Age for Direct Recruitment

A Candidate for direct recruitment to the service shall not be less than 18 years or more than 38

years of age on the first January of the year of recruitment with relaxation in case of candidates

belonging to special categories like scheduled castes, scheduled tribes and any other category as

laid down by the Government in accordance with the orders of the Government in force for the

time being.

8. Academic Qualification

The academic qualification of a candidate for direct recruitment shall be prescribed by the

Board from time to time. The qualifications and experience prescribed as on date of

commencement of these regulations are given in schedule IV.

9. Physical Fitness

A candidate for direct recruitment shall be

(1) Of sound health, both mentally and physically and free from organic defect of bodily

infirmity likely to interfere with the efficient performance of his duties; and

(2) Required to undergo medical examination before appointment to the service by a medical

practitioner as may be decided by the Appointing Authority.

10. Character

A candidate for direct recruitment, contract or compassionate ground shall produce to the

Board a certificate of good moral character from

(a) The Principal/Academic officer of the university or college or such educational

institution in which he/she studied last and

(b) Two respectable persons who are well acquainted with (but not related to) the

candidate.

11. Recruitment

(1) Appointment by Promotion

(a) Subject to availability of vacancies and suitability of the candidates as may be decided by

the Board and the Appointing Authority and as set forth hereunder in this Regulation

and subject to possessing requisite qualifications and experience as prescribed under

these Regulations, an officer of the Board shall be eligible for promotion from one cadre

to another of the services of the Board.

(b) The categories of posts under the services of the Board, to which appointments shall be

made by promotion, are indicated in Schedule III.

(c) The number of years of service in the lower cadre required to make an officer eligible for

promotion to the next higher cadre shall be as shown in Schedule III

(d) The Selection Committees for appointment to various categories of posts as stipulated

under these Regulations shall function as the Promotion Committees for considering

these promotions.

(e) The Board shall follow the following approach and methodology for recruitment by

promotion:

(i) The Appointing Authority shall, as in case of direct recruitment, make an

assessment regarding the likely number of vacancies to be filled up by promotion

during the next year.

(ii) He shall request the concerned Promotion Committee(s) to initiate action on

selection of candidates against the vacancies and to recommend a list of

candidates in order of preference for promotion.

(iii) Along with the request, the Appointing Authority shall furnish to the Promotion

Committee the following:

(1) Information on the number of vacancies in the cadre, to which the

promotion shall be made

(2) A list of officers/employees, equal to 4 (four) times the number of vacancies

assessed, in order of seniority as per the approved Gradation List of the

employees in the cadre, from which the promotion shall be made

(3) Annual Confidential Reports, along with all related personal documents

including up-to-date information on commendations, remarks, etc. in

support of or suspension, disciplinary action taken, proceedings drawn up,

(5) Any other document or information as the Appointing Authority may

consider necessary.

(iv) The Promotion Committee, after having considered all documents and information

furnished by the Appointing Authority, shall complete the selection based on

merit-cum-seniority and recommend to the Appointing Authority, within 1 (one)

month of receipt of the request, a list of employees found suitable for promotion in

order of preference.

(v) The number of candidates in the recommended list by the Selection Committee

shall be 2 (two) times the number of likely vacancies intimated to them by the

Appointing Authority.

(vi) In case the Selection Committee does not consider an employee in the Gradation

List to be suitable for promotion, it shall record the reasons thereof in writing and

send the same along with the recommended list to the Appointing Authority.

(vii) In case the Appointing Authority disagrees in any case with the recommendations

of the Promotion Committee and wants a change, he shall bring to the notice of the

Promotion Committee the change proposed, which the later may review and act

upon if felt necessary.

(viii) Upon final receipt of the recommended list from the Selection Committee, the

Appointing Authority shall place the list for approval of the Board and publish the

same within 15 (fifteen) days of approval by the Board.

(d) Appointment by promotion shall be made from the approved list in order of preference.

(e) The recommended list furnished by the Promotion Committee(s) shall remain valid for a

period of 12 (twelve) calendar months from the date of recommendation by the

Committee, after which it shall become invalid. No appointments on promotion shall be

made from the recommended list after the expiry of its validity.

(f) The Promotion Committee shall have the right to call for any record or information, as it

may feel necessary, for the purpose of selection.

(g) Exclusion of a candidate from the recommended list for promotion once shall not debar

him for promotion during subsequent considerations for promotion.

(h) The mere inclusion of the name of a candidate in the recommended list of the Promotion

Committee shall confer no right to the candidate for promotion unless the Appointing

Authority is satisfied after such enquiry as may be considered by him necessary that the

candidate is suitable for promotion.

(i) Only the cadre experience of a person in service under the Board shall be counted for

promotion and no experience of a person during the period of a contract or otherwise

shall be counted for promotion.

(2) Appointment by Deputation

(a) In absence of suitable and experienced officer(s) at the various categories of posts under

the services of the Board, a person or persons may be appointed on deputation by the

Board against any post(s) on such terms and conditions as may be agreed between the

Board and the Agency, from which the person(s) shall be borrowed on deputation.

(b) Appointment on deputation shall be made only when the Board is satisfied that such

deputation is necessary in the interest of the public and for conducting activities of the

Board.

(c) The Board shall appoint a person on deputation only against a post under the Board,

which is considered equivalent to that in his/her parent department/ agency and only if

he or she is discharging similar nature of work in his/her parent department/agency.

(d) The posts under the State Government and undertakings considered equivalent to those

under the services of the Guwahati Jal Board Service for the purpose of bringing persons

under deputation are as indicated in Schedule X.

(e) The selection of officers to be brought under deputation, except for the Managing

Director, shall be made through the Selection Committee(s) as prescribed under these

Regulations.

(f) A person for appointment on deputation shall have at least two years of service

remaining before the age of superannuation in his/her parent department for Group A

Officers and five years for all others.

(g) Such deputation to the Board shall normally be for a period not exceeding three years.

(h) The Board may, with approval from the parent department/agency of the person

concerned, extend the deputation for a further period not exceeding two years.

(i) The terms and conditions of deputation to the Board shall be in accordance with the

prevailing Rules of Non-Central Staffing Scheme of All India Service Officers and the

Rules of the Finance Department of the state.

(j) An officer on deputation shall have the option to receive any deputation and other

allowances/incentives like Medical Allowance, Transport Allowance, and House Rent

Allowance etc. as the Board may consider paying.

(k) With a view to attracting and retaining talent on deputation from the Government and

other agencies, the Board may pay Deputation Allowance, to a person on deputation, to a

tune of up to 10 (ten) percent of his/her gross pay.

(3) Appointment on Contract

(a) The Board may appoint a person on contract against a vacant post on such terms and

conditions as shall be agreed upon by the Board and the person so appointed on

contract.

(b) A formal agreement, as suggested at Schedule XI, specifying the terms and conditions of

the contract service including the period for which the appointment is made shall be

signed, before the appointment is made, by both the parties, i.e., the Appointing

Authority or his authorised officer of the Board and the person appointed on contract.

(c) An appointment on contract by the Board shall be made only when the Board is satisfied

that such an appointment is necessary in the interest of the public for conducting one or

more specified activities of the Board.

(d) All appointments to the services under the Board by contract shall be made through

competition only and on the basis of recommendation made by the Selection

Committees as stipulated under these Regulations.

(e) The Board shall follow the same procedure for appointment of a person on contract as

for appointment of a person by direct recruitment as prescribed under these

Regulations.

(f) The Board may, for specific cases and for specific reasons to be recorded in writing,

waive any requirement of the procedure for appointment by direct recruitment for the

purpose of (d) above.

(g) A candidate for appointment on contract shall not be less than 18 (eighteen) years of age

as on date of application for the position.

(h) The academic qualifications of a candidate for appointment on contract shall be the

same as prescribed for a candidate for appointment under direct recruitment as

specified under these Regulations.

(i) The Appointing Authority shall appoint candidates into the services of the Board from

the select list only in as many numbers as advertised under each cadre and in the order

of preference as recommended by the Selection Committee.

(j) Any increase or decrease in the vacancies, if felt necessary after the advertisement, shall

be re-advertised prior to the commencement of the selection process like the written

examination, interview or practical as the case may be.

(k) The select list furnished by the Selection Committee(s) shall remain valid for a period of

12 (twelve) calendar months from the date of recommendation by the Committee, after

which it shall become invalid. No appointments shall be made from the select list after

the expiry of its validity.

(l) Contract appointments shall be for 11 (eleven) months from the date of signing the

agreement.

(m) The Appointing Authority shall evaluate the performance of a person on contract at the

end of one year of his service as prescribed under sub-section 10(2)(xi) of the Act and

based on performance, may consider his/her reappointment on fresh contract against a

vacant post under the same cadre only if it continues to be necessary in the interest of

public service.

(n) In case of re-employment on contract, the Board may fix the remuneration of the person

with an increase of 3 (three) percent over that of the previous year paid to him/her.

(o) The performance evaluation under (m) above shall be based on performance indicators

like knowledge in work, zeal, involvement in work, sincerity, management skills,

capacity to take decision, team spirit, attitude towards others and any other parameter

that the Board may like to include.

(p) No person on contract employment under any position in the Board shall continue after

attaining the age of 65 (sixty-five) years.

(4) Appointment by Absorption

(a) Subject to the approval of the Board by a Resolution and the consent of his/her parent

department or agency, a person under deputation to the Board may be absorbed into

the services of the Board.

(b) For appointment of a person by absorption by the Board, the following procedure shall

be followed:

(i) The Appointing Authority of the Board shall prepare a list, in order of the date of

joining in the Board, of persons under deputation in that cadre of post and place it

before the concerned Selection Committee together with Annual Character Reports

and other relevant documents as in case of appointed by promotion.

(ii) The Selection Committee shall, after having considered all documents and

information furnished by the Appointing Authority, complete the selection based on

merit-cum-seniority and recommend to the Appointing Authority, within 1 (one)

month of receipt of the request, a list of employees found suitable for appointment

by absorption in order of preference.

(iii) The number of candidates in the recommended list by the Selection Committee shall

be 2 (two) times the number of likely vacancies intimated to them by the

Appointing Authority.

(iv) In case the Selection Committee does not consider a person in the list received from

the Appointing Authority to be suitable for appointment by absorption, it shall

record the reasons thereof in writing and send the same along with the

recommended list to the Appointing Authority.

(v) In case the Appointing Authority disagrees in any case with the recommendations of

the Selection Committee and wants a change, he shall bring to the notice of the

Selection Committee the change proposed, which the later may review and act upon

if felt necessary.

(vi) Upon final receipt of the recommended list from the Selection Committee, the

Appointing Authority shall place the list for approval of the Board and publish the

same within 15 (fifteen) days of approval by the Board.

(c) Appointment by absorption shall be made from the approved list only in order of

preference.

(d) The recommended list furnished by the Selection Committee shall remain valid for a

period of 12 (twelve) calendar months from the date of recommendation by the

Committee, after which it shall become invalid. No appointments by absorption shall be

made from the recommended list after the expiry of its validity.

(e) The Selection Committee shall have the right to call for any record or information, as it

may feel necessary, for the purpose of selection.

(f) The mere inclusion of the name of a candidate in the recommended list of the Selection

Committee shall confer no right to the candidate for absorption unless the Appointing

Authority is satisfied after such enquiry as may be considered by him necessary that the

candidate is suitable for promotion.

(c) The inter-se seniority of the persons appointed by absorption into the services of the

Board shall be placed, en bloc and in order of preference approved by the Board, below

the existing members in the concerned cadre of services of the Board.

(5) Appointment on Compassionate Ground

(a) In the event of the death of an employee in service, where the family of the deceased

need immediate assistance, the Board by a Resolution may appoint his/her son,

unmarried daughter, wife, husband, dependent brother or a dependent unmarried sister

to a suitable post under the Groups C and D services as the person may be eligible for,

under the provisions contained in Office Memorandum No. ABP-357/80/137 dated the

9th September 1983 of the Department of Personnel of the Government of Assam and its

amendments if any or as may be decided by the Board.

(b) The scheme shall apply to the family of the deceased employee only if the employee has

completed continuous service after direct recruitment for not less than one year under

the Board.

(c) The scheme shall also apply to the family of an employee, who becomes lunatic,

physically invalid or retires on health ground.

(d) The Appointing Authority, on receipt of an application for an appointment under this

scheme against a condition as at (c) above, shall ensure before processing the

application that the employee in service, whose family needs assistance under this

scheme, is examined by the Chief Medical Officer of the district or a Medical Board

constituted by the Government or in a manner as the Board may deem fit and that

his/her condition entitles his family for such a consideration.

(e) Not more than one person from the family of the deceased shall be appointed under the

scheme.

(f) The preference for appointment shall be in order of the following of the deceased:

(i) A son

(ii) An unmarried daughter

(iii) The wife or the husband

(g) The scheme shall be applicable only to such family as may be having no other earning

member. However the facility may be extended to family with an earning member

depending on the earnings and the liabilities of the family on a case to case basis.

(h) Not more than 5 (five) percent of the vacancies in the Group D services (not above the

rank of an Assistant Grade 2) arising in a year shall be filled up under this provision.

However, this restriction shall not apply to a case, where there is only one vacancy to be

filled up under each of the two Groups of services.

(i) This scheme envisages the relaxation in the manner of recruitment only. However, no

relaxation shall be allowed in the eligibility or the suitability of the candidate for

appointment to the post.

(j) Each application for an appointment under this scheme shall be very carefully examined

by the Appointing Authority from the point of view of the actual immediate need for

assistance by the family. The Appointing Authority shall ensure that only a fully

deserving candidate gets the benefit.

(k) Any application for an appointment under this scheme after 2 (two) years of death of an

employee shall normally be discouraged, since it would appear on the face of it that the

family has managed to support itself all these years with some means of subsistence and

that an appointment under the compassionate ground at a belated stage is not ordinarily

justifiable.

(l) In case of the death of an employee during a period of extension in his service, the family

of the deceased is eligible for an appointment under this scheme.

(m) In case of the death of an employee during a period of extension in his service, the family

of the deceased is eligible for an appointment under this scheme.

(n) In case of the death of an employee during a period of reappointment in service, the

family of the deceased is not eligible for an appointment under this scheme.

(o) Once appointed, all Rules and Regulations etc. applicable to a person appointed by direct

recruitment shall apply to the person appointed under compassionate ground.

(6) Temporary Appointment

(a) In case of urgency in the interest of the Board, the Managing Director or any other

officer authorised by him or her may appoint a person, under the Groups B and below,

on contract for period of 3 (three) months only.

(b) No such appointment under (a) above shall be made unless the person is normally

qualified to hold that particular post.

(c) If owing to the emergency the appointment of a person without the required

qualification is made, such person shall be replaced by a qualified person at the earliest

opportunity.

(d) In case of necessity, the period of temporary appointment may be extended for a further

period of 3 (three) months, but in no case the total period of a temporary appointment

for person shall exceed 6 (six) months.

(e) The remuneration for the person on such temporary appointment shall be equal to that

prescribed for persons appointed on contract.

(f) All such appointments made under this Regulation shall be reported to the Board at its

next meeting.

(g) A person appointed under this Regulation shall have no right whatsoever for

reappointment to any post or for any preferential claim thereto in future.

12. Selection Committee

All appointments to the service under the Board shall be made on the basis of recommendation

made by the selection committee to be constituted by the Board as below:

13. Disqualification

(1) No person shall be eligible for appointment to the service:

(a) Unless he is a citizen of India and

(b) If he has more than one wife living or in case of a female candidate who has

married a person who has wife living.

Provided that the Board, if satisfied that there is a special ground for doing for doing

so, exempt any person from the operation of this clause.

(2) No person who attempts to enlist support for candidature directly or indirectly by any

recommendation, either written or oral or by any other means shall be appointed to the

service.

14. Reservation

(a) All appointments made for the services of the Board by direct recruitment and

promotion shall have the required reservations for the different special categories like

the Scheduled Castes and Scheduled Tribes, Women, the Physically Challenged etc. as

per prevalent Acts, Rules, Regulations, Orders, Circulars, Guidelines etc. notified by the

Government of Assam from time to time.

(b) There shall be reservation in case of candidates belonging to the Scheduled Castes and

Scheduled Tribes as per the provisions of the Assam Scheduled Caste and Scheduled

Tribes (Reservation of Vacancies in Services and Posts) Act, 1978 and the Rules etc.

framed thereunder for all appointments by direct recruitment and by promotion.

(c) There shall also be reservation for candidates belonging to Other Backward Classes as

per Government of Assam instructions contained in its Office Memorandum No. TAD/

OBC/1/2004/55 dated 31-05-2005 for all appointments by direct recruitment only.

(d) There shall be reservation in case of women candidates as per the provisions of the

Assam Women (Reservation of Vacancies in Services and Posts) Act, 2005 for all

appointments by direct recruitment only.

(e) There shall be reservation in case of physically challenged candidates as per the

provisions of the Person with Disabilities (Equal Opportunities, Protection of Right and

Full Participation) Act, 1995 for all appointments by direct recruitment only.

(f) There shall also be reservation for any other category of candidates as laid down by the

Government from time to time and in accordance with the orders of the Government in

force.

15. Joining Time

(a) A person appointed to the services of the Board shall join within 15 (fifteen) days from

the date of receipt of the order of appointment, failing which, unless the Appointing

Authority extends the period, the appointment shall be treated as cancelled.

(b) The total joining time including extension shall not exceed 3 (three) months from the

date of first receipt of the order of appointment.

16. Probation

(a) A person appointed to the services of the Board by direct recruitment, promotion or on

compassionate ground shall be placed on probation, for a period of 1 (one) year for

Group A services and 2 (two) years for other Groups of services from the date of his/her

joining against the permanent vacancy he or she has been appointed to.

(b) Any period spent by an employee on deputation or officiating in a higher post on

promotion shall be reckoned as spent on probation for purposes of (a) above.

(c) On completion of the period of probation of an employee, the Appointing Authority shall,

if in his/her opinion the work and conduct of the person on probation have been

satisfactory, declare that the person has completed his probation satisfactorily.

(d) If in the opinion of the Appointing Authority the work or conduct of a person appointed

by direct recruitment or on compassionate ground have not been satisfactory during the

period of probation, the Appointing Authority may, with the approval of the Board,

discharge the later from service.

(e) If in the opinion of the Appointing Authority the work or conduct of a person appointed

by promotion have not been satisfactory during the period of probation, the former may,

with the approval of the Board, revert the later to the previous post held by him or her.

(f) Notwithstanding anything contained under this Regulation, the Appointing Authority

may for good and sufficient reasons to be recorded in writing extend the period of

probation for a person for any period not exceeding 2 (two) years.

(g) Notwithstanding anything contained under this Regulation, the Appointing Authority

may also for good and sufficient reasons to be recorded in writing curtail or dispense

with the period of probation for any employee.

(h) An employee under probation shall be entitled to draw his/her increment(s) against the

post he or she has been appointed to, only if in the opinion of the Appointing Authority

the work and conduct of the employee have been satisfactory.

17. Training

(a) A member of the services under the Board appointed by direct recruitment, absorption,

promotion or on compassionate ground shall be required to undergo such training and

pass such departmental examinations as the Board may prescribe from time to time.

(b) This shall also apply to persons appointed on deputation or on contract if and to the

extent the Board may prescribe from time to time in its interest.

(c) Where a member of the services under the Board is deputed on training at the cost of

the Board, the period spent by the employee on deputation to training shall be treated

as on duty for all purposes.

(d) The employee so deputed for training at (c) above shall be entitled to the pay/

remuneration, which he/she would have normally drawn but for his/her deputation for

training.

(e) He/she shall also be entitled to travelling allowance as on tour for both ways

(f) Where a member of the services under the Board is deputed on training at the cost of

the Board for a period exceeding one month in India or for any period outside India, the

employee so deputed for training shall execute a bond, prior to the deputation for

training, with the Board to the effect that he or she shall serve the Board for a period not

less than 3 (three) years from the date of joining back to duties in the Board after

his/her return from the training.

(g) The bond executed by the employee shall be supported by 2 (two) sureties, who shall be

permanent employees either of the Board or of the Government of Assam having a

status equal or higher than that of the employee under deputation for training.

(h) A form for execution of the bond for the purpose of deputation to training as at (f) above

is prescribed at Schedule VII.

(i) In the event of his/her failure in not complying with the condition(s) stipulated in the

bond at (f) above or in the event of his/her failure to not passing any prescribed

examination during the training, he or she shall refund the full cost of training and

deputation.

(j) Such cost at (i) above shall include the pay and allowances, leave salary, stipend,

scholarship, travel expenses, fees, cost of books and equipment and other expenses if

any.

18. Seniority

(a) The seniority of a member, appointed by direct recruitment or promotion, in a cadre of

services under the Board shall be determined in accordance with the order of

preference in the respective list recommended by the Selection Committee with changes

if any as approved by the Board as provided under these Regulations, provided that the

he/she joins the appointment within the prescribed joining time or the extended period

intimated to him/her.

(b) In case the member fails to join the appointment within the prescribed joining time or

the extended period as might have been allowed to him/her, his/her seniority shall be

determined in accordance with the date of his/her joining the appointment, provided

that his/her joining is allowed after the prescribed or the extended period and is ratified

by the Board.

(c) If two or more members in the same cadre of posts join on the same day after the expiry

of the prescribed or extended period as at (b) above, inter-se-seniority shall be

determined on the basis of their position in the recommended list of the Selection

Committee with changes if any as approved by the Board.

(d) A member appointed by promotion in a calendar year shall be senior to a member of

that cadre of post appointed by direct recruitment in that calendar year.

(e) In case of any dispute in seniority, the Board shall refer the matter to the Selection

Committee or the Promotion Committee as the case may be and shall take a decision

taking into the consideration the recommendation of the concerned Committee.

(f) The Board’s decision in this regard shall be final and binding.

19. Gradation List

A Gradation List shall be prepared and published at the end of each calendar year containing the

names of all the members of the service cadre-wise and in order of seniority and such other

particulars as the date of birth, the date of first appointment to the services of the Board, the

date of appointment to the cadre, present posting and any other details as the Board may

consider necessary.

20. Confirmation

(a) A member of the services under the Board placed under probation under Regulation 41

under these Regulations shall be confirmed against the permanent post provided that

(i) He/she has completed the specified period of probation

(ii) He/she has successfully undergone the specified training and/or passed the

specified Departmental Examination, if any, prescribed by the Board.

(iii) He/she has completed not less than 3 (three) years of service under the Board

including the service in any higher post or on deputation to any equivalent or

higher post

(iv) His/her work and conduct, in the opinion of the Appointing Authority, are

satisfactory during and after the period of probation.

(b) Subject to fulfilling the conditions at (a) above, the confirmation of an employee under

the services of the Board shall be made on the basis of his/her seniority as per the

Gradation List.

(c) No employee of the Board shall have any right to claim confirmation, if there is no

substantive vacancy in a cadre.

21. Discharged or Reversion

A temporary or officiating member shall be liable to be discharged or reverted to the lower

cadre of service or to his original service, if

(1) He fails to make sufficient use of the opportunities given during any training as may be

prescribed by the Government from time to time, fails to render satisfactory service

during his tenure of service in the cadre and/or

(2) It is found on a subsequent verification that he was initially not qualified for the

appointment or that he had furnished any incorrect information with regard to his

appointment.

22. Mode of Employment

(1) Members of the service shall be employed in such manner as the appointing authority

may decide.

(2) A member of the service under the Board shall be liable to be posted anywhere within

the jurisdiction of Board’s activities within the state of Assam or outside Assam, or to

any other department of the Government, a body corporate, in the affairs of which Board

may be substantially interested or a autonomous district council, if so required in the

interest of public service and in such case the member shall not have any option against

such posting or transfer.

23. Pay

All appointment in the service shall be made in the time scale of pay as may be prescribed by the

Government from time to time. The scale of pay of the post in the cadres of one service on the

date of commencement of these regulations are as shown in schedule II

24. Other condition of service

(1) Except as provided in these regulations, all matters relating to pay and allowances,

leave, pension, discipline and other conditions of service shall be regulated by the

general rules or orders of the Government for the time being in force.

(2) The conditions of service of the members in respect of matters, for the time being

applicable to other office.

25. Relaxation

Where the Board is satisfied that the operation of any of these regulations, causes under

hardship in any particular case, it may , dispense with or relax the recruitment of that regulation

to such extent and subject to such conditions as it may consider necessary dealing with the case

in a just and equitable manner.

Provided that the case of any person shall not be dealt with in any manner less favourable to

him than provided in these regulations.

26. Interpretation

If any question arises relating to these regulations the decision of the Board shall be final.

27. Review of Regulations

The Board may, if found necessary on its own motion or on the recommendation of the

Government of Assam review or revise these regulations.

28. Repeal and Saving

The regulations corresponding to these regulations and in force immediately before

commencement of these regulations are hereby repealed.

Provided that all orders made or actions taken under the regulations so repealed or under any

general orders ancillary thereto shall be deemed to have been validly made or taken under the

corresponding provisions of these regulations.

Part II

1. Duties and Responsibilities of Board Employees

(a) It is clear and explicit that the services rendered by the employees of the Board are

purely and absolutely ‘public service’ in nature.

(b) It also clear and explicit that the employees of the Board are bestowed with the

important responsibility of providing the services to meet the basic needs of the

community, maintaining the health and well-being of the mankind and preserving the

wholesomeness of the environment and as such, every member under the services of the

Board shall invariably be seriously concerned about his/her duties and responsibilities

as a ‘public servant’.

(c) The Board shall, for efficient and effective management of the Board, prescribe

functions, duties and responsibilities of all its employees appointed by direct

recruitment, by promotion, on deputation, on contract or otherwise.

(d) The major duties and responsibilities or the Job Descriptions, of the employees in

various grades/cadres of services under the Board are broadly described in Schedule V.

(e) The Job Description of employees is subject to change at the discretion of the Board and

shall be notified by the Board as and when necessary.

2. Pay of Employees on Appointment by Direct Recruitment

(a) All appointments by direct recruitment in the services of the Board shall be made in the

pay structure, in conformity with the Assam Services (Revision of Pay) Rules, 2010 and

such other notifications issued by the Government of Assam from time to time or as may

be prescribed by the Board.

(b) The Pay structure shall comprise of running Pay Bands and Grade Pay as given in

Schedule II.

(c) The pay for the various categories of posts filled up direct recruitment under the

services of the Board as on the date of commencement of these Regulations shall be as

given in Schedule II.

(d) Basic Pay shall consist of pay in the Pay Band and Grade Pay.

(e) A direct recruit shall begin to draw his/her pay and allowances during his/her tenure in

the Board with effect from the date of his/her assuming duties of the post against which

he or she is appointed and shall cease to draw the pay and allowances as soon as he or

she ceases to discharge his/her duties subject to conditions as stipulated by the Board.

(f) Availing facilities like Board/departmental housing etc. shall be governed by the Grade

Pay. Seniority not fixed as per Grade Pay, it may be different as per cadre.

3. Reaching Maximum Pay Band

Upon reaching the maximum of Pay Band, an employee appointed by direct recruitment shall

have the following upgradation:

(a) The employee shall remain for two years from the date of last increment at that stage,

where he is, without further movement.

(b) At the end of two years, the employee shall be eligible to move into the next higher Pay

Band.

(c) Such an employee shall continue to draw the Grade Pay, which was drawn in the lower

Pay Band and shall not be entitled to any higher Grade Pay.

(d) Such an employee shall not also be eligible to any additional increment on being placed

in the higher Pay Band.

(e) There shall be no change in the designation or functions of such an employee by such a

change in the Pay Band.

4. Increment

(a) An employee appointed by direct recruitment or promotion under the services of the

Board shall be entitled to draw annual increments as a percentage of his/her Basic Pay,

i.e., the pay in the Pay Band and the corresponding Grade Pay.

(b) The annual increment shall be of 3 (three) percent of the Basic Pay rounded off to the

next multiple of Rs. 10.

(c) The amount of increment shall be added to the existing pay in the pay band.

(d) The date of annual increments shall be the 1st of July of each year.

(e) Employees at (a) above completing 6 (months) and above under the services of the

Board only shall be eligible for annual increment.

(f) The Board may withhold, for such period as it may consider necessary, an increment or

increments due to a member of the service failing to pass any departmental examination

prescribed for the post and/or any other assessment that the Board may notify from

time to time.

5. Dearness Allowance

All members of the services of the Board appointed by direct recruitment, promotion and

deputation shall be entitled to draw Dearness Allowance at a percentage at par with that

prescribed by the Government of India and notified by the Government of Assam for its

employees from time to time.

6. Pay of Employees on Appointment by Deputation

(a) The pay and allowances of a person appointed to the services of the Board by deputation

shall be governed by the terms and conditions of deputation stipulated by his/her

parent department/agency.

(b) He/she may also avail other benefits as may be extended by the Board to its employees

that would not violate of the terms and conditions at (a) above.

7. Remuneration of Employees Appointed on Contract

(a) The remuneration for a person appointed to the services of the Board on contract shall

be a consolidated monthly amount as may be decided by the Board.

(b) Considering that a person appointed to the services of the Board on contract shall not be

eligible for pension, provident fund, leave salary, encashment of leave and dearness

allowance etc., the monthly remunerations for persons appointed on contract for

various categories of posts are suggested at Schedule VI.

8. House Rent Allowance

(a) An employee of the Board, depending upon the place he is posted, shall be entitled to a

House Rent Allowance at the following rates:

At a rate at par with the rate admissible to employees of the Government of India or the Government of the concerned State, whichever is beneficial to the employee

(b) The House Rent Allowance shall be applicable to only that employee, who is residing in

rented houses.

(c) In order to avail of the allowance, the employee shall have to produce a certificate

identifying the mode of accommodation availed by him/her such as rented house, own

house, government quarters etc.

(d) In case both the husband and wife are serving and are posted at the same headquarters,

only one of them shall be eligible to get House Rent Allowance.

(e) If an employee is allotted with a Board’s quarters, the employee shall have a house rent

deducted from his/her salary at the rate of 10 (ten) percent of the Basic Pay or the

standard rent fixed for the type of quarters, whichever is less.

9. Daily Allowance

(a) An employee of the Board, in the event of visiting for official purposes to any other place

than his place of posting, shall be entitled to Daily Allowance (DA) at the rates as below:

(b) Normal DA (as shown in Column 3) shall be applicable for official visits to all places in

Assam except Guwahati.

(c) For a journey above 40 kilometres, half the rate of DA shall be applicable, where the

employee returns back after such travel on the same day, subject to the condition that

he/she has spent not less than 6 (six) hours on the official visit.

(d) One and half (1.5) times the rate of Normal DA (as shown in Column 4) shall be

applicable for visits to Guwahati/Dispur and other North Eastern States.

(e) Two (2) times the rate of Normal DA (as shown in Column 5) shall be applicable for

visits outside the North Eastern States.

(f) The rates at (e) above shall apply during official visits to places outside the North

Eastern Region, if an employee of the Board stays at Assam House or any

accommodation provided by the Board or the Government. But if an employee does not

get such an accommodation and stays in a hotel, reimbursement shall be made as per

actual expenditure on production of the hotel receipt subject to a maximum of the rate

as shown in Column 6.

(g) The reimbursement of the expenditure on hotel accommodation at (f) above shall be

over and above the Normal Daily Allowance.

10. Remote Area Allowance

In case any employee of the Board is posted for any purpose in the hill districts of North Cachar

Hills and Karbi Anglong or in the remote areas of Dhemaji district, Sadiya Sub-division, Majuli

Sub-division, Dhakuakhana Sub-division and South Salmara Sub-division, he/she shall be

entitled to Hill/Remote Area Allowance at the following rates:

11. Hazard Allowance

(a) The Board may, if it so decides, pay a fixed Hazard Allowance to a specific category of

employees to be listed by it at the following rates:

(b) The Board may, if it so decides, replace the Hazard Allowance at (a) above by the

Comprehensive Risk Insurance Scheme under formulation by the Personnel Department

of the Government of Assam, when the later is ready.

12. Fixed Travelling Allowance

(a) All employees of the Board, who are supposed to travel on duty within their jurisdiction

for at least 15 (fifteen) days in a month as a part of regular inspection and monitoring of

the various schemes of the Board for effective implementation and service delivery,

shall be entitled to a Fixed Travelling Allowance at the following rates:

(b) The Board shall notify the categories of posts, based on detailed justification, to be

entitled to draw such Fixed Travelling Allowance at (a) above.

(c) Fixed TA shall not be applicable to employees travelling by vehicles allotted to them or

by office vehicles.

(d) All employees, who are in receipt of Fixed TA, shall be entitled to claim normal TA for

official travels outside their jurisdictions as provided under these Regulations.

13. Journey on Tour

(a) Journey by Air:

(i) An employee in the Senior Grade or Grade 1 drawing a minimum basic pay of Rs.

24,000 per month only shall be entitled to travel on official duty by air in

economy class within or outside Assam.

(ii) No incidental expenses shall be reimbursed on journey by air apart from Daily

Allowance as admissible.

(iii) These provisions shall not be applicable for the purpose of Leave Travel

Concession (LTC), for which separate provisions have been made under these

Regulations.

(b) Journey on Tour by Train and Road:

(i) An employee of the Board shall be entitled to the following classes of train

journey for travel on official duty:

14. Kit Allowance

(a) The Board may, if it so decides, allow Kit Allowance to identified categories of its

employees discharging duties in the field for wearing specified type of uniforms while

on work.

(b) Such employees at (a) above shall also be entitled to a Kit Maintenance Allowance for

maintaining the uniforms.

(c) The Kit and Kit Maintenance Allowance at (a) and (b) above shall be as below:

15. Disability and Related Allowances

(a) Disability Allowance: A disabled employee of the Board shall be entitled to a Disability

Allowance at a rate of Rs. 500 per month.

(b) Child Care Allowance:

(i) A disabled woman employee of the Board shall be entitled to, in addition to the

Disability Allowance, a Child Care Allowance at a rate of Rs. 500 per month to

take care of her child up to attaining the age of two years.

(ii) The Child Care Allowance shall be admissible only up to two children.

(c) Constant Attendant Allowance: An employee of the Board, who retires from service due

to 100% disability attributable to the service or due to any accident in performance of

duty, shall be entitled to a Constant Attendant Allowance at rate of Rs. 1500 per month

during his/her lifetime.

(d) Interest Subsidy for Disabled Employees: A disabled employee of the Board shall be

entitled to a subsidy in the interest rate of 4 (four) per cent on bank loans for purchase

of a disabled friendly conveyance like a car or two wheeler, as such conveyances cost

more than the standard ones.

16. Leave Travel Concession

(a) An employee of the Board shall be entitled to reimburse the cost of return journey with

family from his/her place of work to his/her home town/village - as Leave Travel

Concession to home town/village - once in a block period of 2 (two) years.

(b) An employee of the Board, who has completed 10 (ten) years of service under the Board,

shall be entitled to reimburse such cost for journey to any place in India – as Leave

Travel Concession to any place in India - once during the entire period of service.

(c) The system of LTC shall be same as available to the employees of the Government of

Assam and all Rules/Regulations/Orders of the Government of Assam, as amended from

time to time, shall be applicable.

(d) Reimbursement of actual travelling expenses shall be made subject to maximum of

entitlement on journey by train irrespective of the mode of actual travel.

(e) The definition of family for the purpose of Leave Travel Concession shall include

wife/husband, son, unmarried daughter, dependent brother, dependent unmarried

sister and dependent parents.

(f) The definition of dependency shall be linked with minimum family pension, as provided

under these Regulations, for this purpose.

17. Medical Facilities and Allowance

All employees of the Board appointed by direct recruitment, deputation or promotion shall be

entitled to the following medical facilities:

(a) An employee of the Board shall be entitled to reimbursement of the cost of medicines

purchased by him/her and the members of his/her family for all chronic ailments

purchased on medical advice.

(b) The definition of family for the purpose of shall include wife/husband, son, unmarried

daughter, dependent brother, dependent unmarried sister and dependent parents.

(c) The Board shall notify a list of all chronic ailments for (a) above based on expert medical

opinion in a manner it deems fit.

(d) Normally, an employee of the Board shall seek medical assistance, including outdoor

treatment and supply of medicines, from government hospitals.

(e) In case treatment of any ailment is not feasible in government hospitals, it may be

allowed, only on medical referral the Chief District Medical Officer, for treatment in a

private hospital inside the state authorised by the Board.

(f) The Board shall notify a list of private hospitals for (e) above based on expert medical

opinion in a manner it deems fit.

(g) In case of treatment of any ailment is not feasible inside the state and is needed to be

done outside, the same may be allowed only on medical referral by the Director of

Health Services of the Government of Assam.

(h) A monthly Medical Allowance of Rs. 600 per month shall be admissible to each employee

of the Board.

(i) In case of an employee having any sudden and serious illness or meeting an accident,

which precludes him/her from going to Government Hospitals, treatment may be

allowed, on case to case basis to be allowed by the Managing Director or by an officer

authorised by the Board, at the nearest hospital without referral.

18. Group Insurance Scheme

(a) All employees of the Board appointed by direct recruitment shall be entitled to the

benefits of Group Insurance Scheme.

(b) the insurance coverage and rate of monthly subscription shall be as below:

19. Advances

(a) The Board shall issue no advance to any employee on account of any matter like house

building, purchase of vehicle, festivals etc. or otherwise.

(b) The Board may however, if it so decides, tie up an employee with a public sector bank

for a loan to him or her.

(c) A disabled employee shall be entitled to an interest subsidy on bank loans as provided

under these Regulations.

20. Advance Increment for Higher Qualification

(a) Acquisition of additional qualification, during the course of employment may be allowed

by the Board, for technical personnel wherever required, only if such additional

qualification has tangible utility in discharge of public service.

(b) Once an employee is allowed to acquire higher qualification, the Board shall place

him/her in suitable positions where the employee can make adequate use of his/her

increased expertise to achieve improved performance.

(c) After 3 years of acquiring higher qualification, subject to an evaluation of the employee

indicating better performance due to additional qualification, the employee may be

given advance increment at the rate of 1 (one) percent in the following manner:

(i) One advance increment for any qualification which requires one year of study.

(ii) Two advance increments for any qualification which requires two years of study.

(iii) Four advance increments for any qualification which requires minimum three

years of study.

(d) The qualification must be obtained from or approved by a statutory body or a nationally

recognised institute.

(e) Benefit of Advance Increment shall not be given to employees who have acquired the

higher qualification with financial assistance from the Government.

21. Revision of Pay and Allowances

The Board shall have the right to revise the pay, allowances or any perquisites of its employees

as and when it feels necessary or as and when there is a revision made towards this by the

Government of Assam for its employees.

22. Leave

(a) All employees under the services of the Board shall be entitled to the following

categories of leave:

(i) Casual Leave

(ii) Earned Leave

(iii) Half-pay Leave

(iv) Commuted Leave

(v) Extraordinary Leave

(vi) Special Disability Leave

(vii) Maternity Leave

(viii) Study Leave

(b) Leave cannot be claimed as of right and when the exigencies of public service so

demand, leave of any description may be refused or revoked by the Board.

(c) Casual Leave: The number of Casual Leave admissible to an employee shall be 12 days in

a calendar year.

(d) Earned Leave:

(i) An employee shall be entitled to Earned Leave for 30 days in a calendar year.

(ii) The maximum accumulation of Earned Leave shall be allowed up to 300 days.

(iii) Earned Leave shall be credited to leave account of the employee in two

instalments of 15 days each on 1st January and 1sy July every year.

(e) Half-pay Leave: An employee shall be entitled to Half=pay Leave 20 days for every

completed year of service.

(f) Commuted Leave: Commuted leave shall be granted to an employee only on medical

grounds not exceeding half the amount of Half-pay Leave to the credit of an employee on

the following conditions:

(i) He/she has to complete one year of service at the time of proceeding on leave.

(ii) When Commuted Leave is availed of, twice the amount of such leave shall be

debited against the Half-pay Leave due.

(g) Extraordinary Leave:

(i) Extraordinary Leave may be granted to an officer without allowances in the

following circumstances:

(a) In cases where no other leave is admissible.

(b) Even if any other leave is admissible, the official concerned applies for

Extraordinary Leave.

(ii) Except in the case of permanent employment, the duration of Extraordinary

Leave on any one occasion shall not exceed the following limit:

(a) Three months.

(b) Six months in cases where an employee has completed 3 (three) years

of continuous service on expiry of leave of any kind due and has

requested for such leave supported by a medical certificate.

(c) Eighteen months Special Leave for undergoing treatment for (a)

Pulmonary Tuberculosis (b) Leprosy and (c) Cancer.

(h) Special Disability Leave: Special Disability Leave of 120 days shall be admissible to an

employee of the Board, who is disabled by injury caused during his/her duty or in

consequence of his official position.

(i) Maternity Leave:

(i) A female employee of the Board with less than two serving children may avail

Maternity Leave for a period not exceeding 135 days.

(ii) Maternity Leave shall not be debited to the leave account.

(iii) Maternity Leave may be combined with leave of any other kind as due up to 45

days in addition to 135 days at (i) above.

(j) Study Leave: Twenty four months study leave with leave salary shall be admissible to an

employee of the Board where

(i) The leave is duly certified by the Board to be in the interest of public service

(ii) The employee has completed 5 (five) years’ of service.

(k) Leave Encashment Benefits: Cash payment of unutilized Earned Leave shall be

admissible for 300 days at the time of retirement for the employee of the Board.

23. Office Timing

The office timings of the Board shall be 9 AM to 5 PM from 1st March to 31st October and 9:30

AM to 4:30 PM from 1st November to 28th February.

24. Holidays

(a) There shall be 17 (seventeen) holidays, to be notified by the Board, in a calendar year

for the employees including 3 national holidays.

(b) An employee shall in addition be entitled to 4 (four) days of restricted holidays, to be

notified by the Board, in a calendar year.

25. Records of Service

(a) The Board shall maintain the following Records of Service, electronically or in hard

copies or both as the Board may decide, against each employee appointed in any manner

to the services of the Board:

(i) A personal file

(ii) A Service Book

(iii) Annual Confidential Reports

(b) The form for the Service Book, prescribed in Schedule VII, shall record each step in the

official life of the employee with each entry attested by the officer drawing the salary of

the employee or by an officer as may be decided by the Appointing Authority.

(c) All entries recorded in the Service Book of an employee shall be verified once in a year

in the month of April with reference to all relevant records and a certificate shall be

issued to the effect that the services of the employee have been verified up to the end of

the month of March of the preceding financial year.

(d) A Confidential Report assigning the performance, character, conduct, and qualities of

each employee shall be written, countersigned and accepted by the Reporting,

Countersigning and Accepting Officer respectively and shall be kept under the personal

custody of the Secretary of the Board.

(e) The ‘Assam Services (Confidential Rolls) Rules, 1990’ as amended from time to time

with modifications or substitutions notified thereof by the Board or any other guideline

as may be notified by the Board shall be followed for maintaining the Annual

Confidential Reports.

26. Conduct, Discipline and Appeal

Except otherwise provided under these Regulations or any guidelines notified by the Board, the

provisions contained in the ‘Assam Civil Services (Conduct) Rules, 1965’ and the ‘Assam

Services (Discipline and Appeal) Rules, 1964’ as amended from time to time with modifications

or substitutions notified thereof by the Board or any other guideline as may be notified by the

Board shall apply to employees of the Board.

27. Superannuation

(a) The age of superannuation of an employee, appointed by direct recruitment or

promotion, from services of the Board shall be the same as applicable to the employees

of the Government of Assam or as may be decided by the Board with approval of the

Government.

(b) The age of superannuation, as on the date of commencement of these Regulations, in any

grade shall be 60 years.

(c) Notwithstanding anything contained at (a) above, the Appointing Authority may, with

previous approval of the Board and under special circumstances to be recorded in

writing, re-employ an employee after the age of superannuation by appointment on

contract for a period not exceeding 1 (one) year.

(d) Such re-employment at (c) above shall not be continued beyond one year and the Board

shall fill up the post through appointment by direct recruitment or promotion or on

contract as the case may be within the shortest possible time as provided under these

Regulations.

(e) No person appointed on contract in the Board shall continue after attaining the age of 65

years of age.

28. Pension

(a) An employee of the Board, who is on deputation to the Board from the Central or State

Government or from an organisation or undertaking of these Governments, shall be

entitled to the pension and other retirement benefits as per the provisions of the Central

Civil Services (Pension) Rules of 1972, CCS (Commutation of Pension) Rules of 1981,

and CCS (Extraordinary Pension) Rules and the General Provident Fund (Central

Services) Rules of 1960 for the Central Government employee and the Assam Services

(Pension) Rules, 1969, Assam Services (Extraordinary) Pension Rules, 1963, Assam

Services (Commutation of Pension) Rules, 1965, Assam Payment of Arrears of Pension

Rules, 1963 for the State Government employees as amended from time to time or any

other Rules as provided by his/her parent department in the terms and conditions of

his/her deputation to the Board.

(b) An employee of the Board, who is recruited directly by the Board shall be entitled to the

retirement benefits of the ‘New Defined Contribution Pension Scheme, 2009’ of the

Government of Assam as summarized below:

(1) It is mandatory for all employees recruited by the Board directly into its

services to become members of the ‘New Defined Contribution Pension Scheme,

2009’.

(2) The New Pension Scheme (NPS) works on defined contribution basis and will

have two tiers, viz, Tier I and Tier II.

(3) Contribution to Tier-I is mandatory, whereas that to Tier-II is optional and is at

the discretion of the Board’s employee.

(4) The contribution towards the New Pension Scheme shall be recovered from the

salary of the employees through pay bills.

(5) In Tier-I, an employee has to make a contribution of 10 percent of his/her basic

pay plus dearness pay if any and dearness allowances, which will be deducted

from his/her salary bill every month by the Drawing and Disbursing Officer

(DDO) concerned.

(6) While calculating the 10 percent amount, a fraction of a rupee to an extent of Re.

0.50 paise and above shall be rounded off to the next nearest Rupee, while a

fraction below Re. 0.50 paise shall be ignored.

(7) The Board in turn will make an equal matching contribution to Tier I after issue

of necessary sanction.

(8) In case of employees, who are under suspension and are drawing subsistence

allowance, the contribution shall be recovered from the subsistence allowance.

(9) In case of employees, who avail extraordinary leave without pay, there shall be

no contribution from the employees or from the Board for the period of

extraordinary leave.

(10) In case of employees, who avail half-pay leave, the employees and the

matching Board contribution shall be on the basis of leave salary.

(11) In case of Board’s employees on deputation to foreign services, the

contribution of employees so deputed shall be recovered from the salaries of

the employees by the borrower and the equal matching contribution shall be

made by the borrower. The amount so recovered from the employees and the

equal matching contribution by the borrower shall be paid to the Board by the

10th of the following month to be credited to its accounts through the Bank

account.

(12) Immediately after joining in service under the Board, each employee shall be

required to furnish his/her personal details along with the details of his/her

nominees as prescribed in Table 1 under Schedule ix to the DDO. The DDO

shall ensure and be responsible to obtain such information from all

employees.

(13) The DDO shall forward all such information in a compiled form in Table 2 of

Schedule ix along with a copy of information furnished by each employee in

Table 1 of Schedule ix to the Chief Accounts Officer of the Board for allotment

of Pension Payment Account Numbers.

(14) The Chief Accounts Officer of the Board shall be the Nodal Officer for the New

Pension Scheme and shall maintain the accounts of the Scheme. Alternatively,

the Head of the Administration Department/Wing of the Board may be the

Nodal Officer for the NPS of the Board.

(15) On receipt of the Table 2 with Table 1 of Schedule ix, the Nodal Officer of the

Board shall allot Permanent Pension Account Numbers (PPANs) to the

employees, under intimation to the Head of the Administration Department,

for attaching the same to the service records of the employees concerned.

(16) A separate Ledger Account for each member of the NPS shall be maintained in

Table 4 of Schedule IX. Besides, a Consolidated Ledger of all Permanent

Pension Account Numbers shall be maintained by the Nodal Officer in Table 3

of Schedule IX.

(17) The Nodal Officer shall forward 2 copies of the PPANs, allotted to individual

employees, to the DDO in Table 4 of Schedule IX, who in turn shall hand over

one copy to the individual employee concerned and retain the other with

himself.

(18) The PPAN shall be noted, by the DDO under his seal and signature, on the 1st

page of Service Book of each employee allotted with such a number.

(19) The recovery towards Tier I contribution from the salary shall start from the

month following the month in which the employee has joined the service

under the Board.

(20) In case there is no recovery of the contribution from any employee for any

month towards NPS, the reason for non-recovery for the month shall be

furnished invariably by the DDO in the Remarks column of the Recovery

Schedule.

(21) After ascertaining the recovered amount of the employees’ contribution, the

Nodal Officer shall, after issue of sanction as may be necessary, credit an equal

amount to the NPS account from sources under appropriate head of account

of the Board earmarked for the purpose.

(22) On attaining the age of superannuation, an employee can exit from the Tier I

of the Scheme. At exit, it will be mandatory for him/her to invest 40 (forty)

percent of the pension wealth to purchase an annuity from an IRDA regulated

Life Insurance Company, which will provide pension for lifetime of the

employee and his/her dependent parents/spouse.

(23) In case of employees, who leave the Scheme before attaining the age of

superannuation, the mandatory annuation will be 80 (eighty) percent of the

pension wealth.

(24) The employee shall receive a lump-sum of the remaining 60 or 20 percent

pension wealth, as the case may be, which he would be free to utilize in any

manner.

(25) In case of withdrawal of terminal payment in the event of untimely death of

an employee or in the event of his/her leaving the Board’s service, the Board

shall follow the guidelines of the Government in similar cases under the NPS.

(26) Nomination for the NPS shall be filed by the employee at the time of

admission to the Scheme, upon marriage/remarriage, and thereafter every

five years. Necessary entries to that effect shall be made in the relevant

records/documents.

(27) Arrear contribution towards the Scheme on arrear pays, incremental benefit

and arrear DA shall be permissible.

(28) Tier I contributions with investment returns shall be kept in a non-

withdrawable Pension Tier I Account.

(29) Tier II contributions will be kept in a separate account that will be

withdrawable at the option of the Government servant. The Board shall not

make any contribution to Tier-II account.

(30) The Government of Assam shall have the right to appoint the Director of

Accounts and Treasuries, Assam as the Nodal Officer of NPS for the Board and

in such a situation, the Guidelines for the Implementation of the New Defined

Contribution Pension Scheme, 2009 as notified by the Government of Assam,

Finance (Budget) Department Office Memorandum No. BW-7/2008/Pt./40

dated the 6th October 2009 shall be followed with all its amendments from

time to time.

29. Provident Fund

(a) An employee of the Board, who is on deputation to the Board from the Central or State

Government or from an organisation or undertaking of these Governments, shall be

entitled to the Provident Fund benefits as per the provisions of the All India Services

(Provident Fund) Rules, 1955 for the Central Government employee and the General

Provident Fund (Assam Services) Rules, 1937 for the State Government employees as

amended from time to time or any other Rules as provided by his/her parent

department in the terms and conditions of his/her deputation to the Board.

(b) For employees of the Board, who are recruited directly by the Board, there shall be no

separate provision for any Provident Fund as this aspect has already been taken care of

by the ‘New Defined Contribution Pension Scheme, 2009’ of the Government of Assam.

(c) For employees on contract, the local laws will be applicable.

30. Resignation

(a) An employee of the Board may quit the service of the Board by giving to the Appointing

Authority 3 (three) months’ notice or by depositing an amount equal to 3 (three)

months of last pay and allowances drawn or admissible to him/her in lieu of such a

notice.

(b) The Board may, at its discretion, relax or waive the condition of resignation regarding

the period of notice or payment of the amount in lieu of the notice.

31. Premature Retirement

(a) The Board shall review the performance, in a manner as may be decided by the Board, of

each employee after he/she attains the age of 55 (fifty-five) years of age or completes 20

(twenty) years of service under the Board, whichever is earlier.

(b) If in the opinion of the Appointing Authority, the performance of an employee is not

satisfactory, he/she may retire the employee by giving him/her a notice of not less than

3 (three) months in writing or by paying an amount equal to 3 (three) months of last pay

and allowances drawn or admissible to him/her in lieu of such a notice.

32. Voluntary Retirement

(a) An employee of the Board may, by giving a notice of not less than 3 (three) months in

writing to the Appointing Authority, retire from service at any time after he/she has

attained the age of 50 (fifty) years or he/she has completed 20 (twenty) years of service

under the Board, whichever is earlier.

(b) In this regard, the directives and guidelines provided in Notification No. PE(D)-

69/92/PT-II/115 dated 6th September 2003 of the Department of Public Enterprises of

the Government of Assam with changes if any by the Board may be followed.

(c) An employee, against whom a departmental proceeding has been drawn and is pending

or a departmental proceeding is contemplated to be drawn, shall not be allowed to

retire voluntarily as at (a) except with specific approval of the Board.

33. Termination of Service

Except as otherwise specified in the appointment letter and the provisions under these

Regulations, the service of an employee under the Board may be terminated by the Appointing

authority in the following cases:

(a) In case of a probationer, during the period of probation or on its expiry

(b) If an agreement made between an employee and the Board specifies the period of

service or a date for such termination

(c) In case of a temporary employee, who has not completed one year of service after the

initial period of probation and gives a notice of one month to leave the service or

deposits an amount equal to one month’s pay and allowances last drawn in lieu of the

notice

(d) In case of a temporary employee, who has completed one year of service after the initial

period of probation and gives a notice of three months to leave the service or deposits

an amount equal to three months’ pay and allowances last drawn in lieu of the notice

(e) In case of a permanent employee, who gives a notice of three months to leave the service

or deposits an amount equal to three months’ pay and allowances last drawn in lieu of

the notice

(f) If an employee is found to be guilty as a result of disciplinary action.

34. Dismissal and Removal

(a) No employee of the Board, unless it is on the ground of conduct, which has led to his

conviction by a court on a criminal charge, shall be dismissed or removed from the

services of the Board unless he has been informed in writing of the grounds on which it

is proposed to take action and has been afforded an adequate opportunity of defending

himself.

(b) The pay and allowances of an employee who is dismissed or removed from service shall

cease from the date of such dismissal or removal.

35. Suspension

(a) The Appointing Authority, or any authority above his/her rank, may place an employee

of the Board under suspension, if in his/her opinion

(i) The employee has grossly violated the office discipline and decorum

(ii) The employee is found to be prima facie involved in any act of

misappropriation or theft of the Board’s funds, store or any other property

(iii) The employee is found to be prima facie involved in any act of unlawful

removal, concealing, destruction of any official records or wilful

misrepresentation of any case before his superiors

(iv) The employee has behaved in a manner, which is an act of insubordination

(v) The employee is found not acting in a manner as expected of him under the

Assam Civil Services (Conduct) Rules, 1965 or any other Rules or Regulations

adopted by the Board

(vi) Suspension of the employee is necessary for smooth running of the day-to-day

administration of the Board.

(b) In case of an employee, against whom disciplinary proceedings are contemplated

pending departmental enquiry into alleged misconduct, the Appointing Authority may

place him/her under suspension, where the charges are of serious nature and the

continuation of the employee in service pending enquiry is likely to lead to

disappearance of material evidence against him/her or cause further loss to the Board.

(c) In case of an employee, against whom a criminal charge or a proceeding for arrest for

debt is reported to be pending, the Appointing Authority shall place the employee under

suspension with immediate effect if such charge or proceeding made against the

employee is of such nature that it is likely to embarrass him/her in the discharge of

his/her official duties or involves a moral turpitude.

(d) In case of an employee, who is detained in police or jail custody under any law providing

for preventive detention or as a result of proceedings either on a criminal charge or for

his/her arrest for debt, shall be deemed to be under suspension from the date of

detention until further orders, if the period of detention exceeds 48 (forty-eight) hours

and unless he/she is already under suspension.

(e) The case of an employee, who is undergoing a sentence of imprisonment, shall be dealt

with in the same manner as at (d) above, pending decision on the disciplinary action to

be taken against him/her.

(f) It shall be the duty of the employee, who may have been arrested for any reason, to

intimate, either himself/herself or through any member of his/her family on his/her

behalf, promptly the fact of his/her arrest and the circumstances for such arrest to

his/her superior officer even though he/she might have subsequently been released on

bail.

(g) Failure of intimation by the employee as required at (f) above shall be regarded as

suppression of material information, thereby rendering him/her liable for disciplinary

action on this ground alone in addition to the action that may be called for on the

outcome of the police case against him/her.

(h) Suspension is an administrative measure to run the administration and is not a

punishment.

(i) No leave shall be sanctioned to an employee, who is placed under suspension.

(j) An employee under suspension shall not leave his/her headquarters fixed by the

Appointing Authority without the written permission of the Appointing Authority.

(k) In an employee is convicted by the court, on termination of the first trial in the lower

court, he/she shall be dismissed from service.

(l) Dismissal of an employee from service shall not be with retrospective effect.

36. Payments during Suspension

(a) An employee under suspension shall be entitled to the following payments:

(i) Subsistence allowance of an amount equal to the leave salary, which the employee

would have drawn if he would have been on leave on half pay

(ii) Dearness allowance and other allowances as admissible based on the subsistence

allowance.

(b) Where the period of suspension of an employee exceeds 3 (three) months for reasons, to

recorded in writing by the authority which made the suspension, not attributable to the

employee, the amount of subsistence allowance may be increased by a suitable amount

not exceeding 50 (fifty) percent of the subsistence allowance admissible during the first

three months.

(c) Where the period of suspension of an employee exceeds 3 (three) months for reasons, to

be recorded in writing by the authority which made the suspension, attributable to the

employee, the amount of subsistence allowance may be reduced by a suitable amount

not exceeding 50 (fifty) percent of the subsistence allowance admissible during the first

three months.

(d) No employee under suspension shall be entitled to any compensatory allowance unless

the authority which made the suspension is satisfied that the employee continues to

meet the expenditure for which they are granted.

(e) No payment shall be made to an employee under suspension unless the employee

furnishes a certificate that he/she is not engaged in any other employment, business,

profession or vocation.

37. Period of Suspension

(a) When an employee under suspension is reinstated or would have been reinstated but

for his/her superannuation while under suspension, the authority competent to order

reinstatement shall make a specific order indicating

(i) The pay and allowances to be paid to the employee for the period of suspension

ending with the date of reinstatement or the date of superannuation as the case

may be

(ii) Whether or not the period of suspension shall be treated as a period spent on

duty.

(b) Notwithstanding anything provided under these Regulations, where an employee under

suspension dies before the disciplinary proceedings or court proceedings instituted

against him are concluded, the period between the date of suspension and date of death

shall be treated as spent on duty for all purposes and his family or legal heir shall be

paid full pay and allowances for that period to which he would have been entitled had he

not been suspended subject to adjustment in respect of subsistence allowance already

paid.

(c) In a case where in the opinion, to be recorded in writing, of the authority competent to

order reinstatement, the suspension was wholly unjustified, the employee shall be paid

full pay and allowances to which he would have been entitled had he not been

suspended, subject to all other conditions, under which such allowances are admissible,

are fulfilled.

(d) In a case as at (c) above, the period of suspension of the employee shall be treated as a

period spent on duty.

(e) In a case, other than those at (b) and (c) above, an employee under suspension after

having been reinstated shall be paid such proportion of pay and allowances, to which he

would have been entitled had he not been suspended, as the competent authority may

decide, subject to all other conditions, under which such allowances are admissible, are

fulfilled.

(f) The proportion of pay and allowances as at (e) above shall not be less than the

subsistence allowance and other allowances admissible to the employee as provided

under these Regulations.

(g) In a case where suspension is revoked pending finalization of disciplinary proceedings

or court proceedings, any order passed under (a) above before conclusion of the

proceedings against the employee shall be re-viewed on his/her own motion after

conclusion of the proceedings and the competent authority shall make an order

according to the provision of (c) or (e) above as the case may be.

(h) In a case as at (e) above, the period of suspension shall not be treated as a period spent

on duty. However in such a case, if the employee so desires, the competent authority

may order the period of suspension to be converted to any kind of leave that is due and

admissible to the employee.

38. Absence of Regulations

Any matter relating to the service conditions of an employee of the Board, for which no

provision has been made under these Regulations, shall be regulated, with the approval of the

Board, by the corresponding rules and orders of the Government relating to that matter for the

time being in force with changes if any and to the employees of the corresponding status and

having similar functions.

39. Delegation of Power

The Board may, by a general or special order, direct any power exercisable by it under these

Regulations except that under Regulation 61to be exercisable by the Chairman, Managing

Director or any such officer and subject to any such condition as may be specified in that order.

40. Power to Remove Difficulties

If any difficulty arises in giving effect to any of the provisions of these Regulations, the matter

shall be referred to the Board and the Board, after consulting with the affected parties, may pass

any general or special order, not inconsistent with the provisions of the Act or any other

enactment for the time being in force, which appears necessary or expedient for the purpose of

removing the difficulty.

41. Interpretation

(a) These Regulations shall be read and construed as being subject to the provisions of the

Act, as may be amended from time to time and the other Rules made thereunder.

(b) In case of any dispute in the interpretation of the meaning or scope of these Regulations,

the interpretation given by the Board shall be final and binding on all concerned.

Schedule XI - Agreement Form for Appointments by Contract

[Regulation 11(3b)]

CONTRACT OF EMPLOYMENT

This AGREEMENT is made on this _____________ day of __________________ 201__, at Guwahati

BETWEEN

Mr/Ms________________________________ (write full name), ______________________________, Assam (write full postal address) (hereinafter

referred to as the Appointee) of the one part

AND

The Guwahati Metropolitan Water Supply and Sewerage Board (hereinafter referred to as the Guwahati Jal Board and the

Employer) represented by its Managing Director, of the other part.

WHEREAS the Guwahati Jal Board has engaged the Appointee with effect from the ________ day of _____________, 201__ to serve in

the Guwahati Jal Board in the capacity of _______________________ at the pay and upon the terms and conditions hereinafter

appearing:

NOW THIS AGREEMENT WITNESSES and the parties hereto hereby agree:

1. That the engagement of the Appointee shall be for a period of one year from the _________ day of _____________ 201__ and shall

stand terminated at the end of the period of one year.

2. That the appointee shall be paid a consolidated remuneration at the rate of Rs. _________ (Rupees

_________________________________) only per month.

3. That the Appointee shall be entitled to a leave on a pro rata basis of 1.25 days per month during the period of contract.

Prior permission for availing the leave shall have to be taken from the Managing Director or the officer authorized in this

regard.

4. That the Appointee shall in case of illness, immediately inform his immediate Controlling Authority of the same. In case of

absence for more than 3 days on the ground of illness, the Appointee shall submit a medical certificate from a competent

medical practitioner as prescribed by the Board. The Appointee shall be entitled to avail sick leave for 7 days during a

calendar year and thereafter the additional days of sick leave shall be adjusted with the annual leave to his credit and if

there is no annual leave to his credit , his absence shall be treated as leave without pay from the first day of his absence.

5. That the Appointee shall be entitled to all travelling expenses and other expenses connected with his travel and stay if any,

at actuals, on production of the vouchers and bills, for any travel outside the headquarters in connection with his official

duty undertaken under the instructions of the Managing Director or any officer authorized to issue such instructions. The

costs incurred in this connection shall not exceed the quantum of T.A. and other expenses prescribed by the Guwahati Jal

Board for the position.

6. That deduction of Tax at source as per the Income Tax Act, wherever applicable, shall be made at the time of payment of

the monthly remuneration to the Appointee.

7. That the Appointee shall be entitled to all public holidays as approved by the Guwahati Jal Board.

8. That the Appointee shall submit himself to the orders of the Managing Director and the officers and authorities under

whom he may, from time to time, be placed by the Managing Director and will at all times obey the orders and directions

issued to the Appointee.

9. That the Appointee shall perform his duties, assigned to him by the Board represented by the Managing Director,

efficiently and diligently and shall devote the working hours to the duties entrusted to him and will not engage directly or

indirectly in any trade, business or occupation on his own account and will not, except in case of accident or sickness

certified by the competent medical officer, absent himself from his duties without having first obtained the permission of

the Managing Director or the officer authorized in this regard.

10. That in the event of any misconduct, insubordination, intemperance or breach of the terms and conditions of this

agreement, the Managing Director may after due enquiry dispense with the services of the appointee. The enquiry shall be

conducted in adherence to the principles of natural justice.

11. That the Appointee shall not have the right to claim regularization in service and any other benefits other than what are

provided for under this Agreement.

12. That either party to the agreement shall have the right to terminate this Agreement without assigning any reasons;

provided that a prior written notice of one month is given to the other party or a sum equivalent to one month’s

remuneration in lieu of such notice is paid to the other party.

In witness hereof, both the parties have put their respective signatures in this agreement in token of having accepted the terms

and conditions set forth above in this agreement, on this day as hereinabove mentioned, in presence of the following witnesses.
