CITY OF HAYS PUBLIC WORKS DEPARTMENT

SOLID WASTE DIVISION

The City of Hays, Kansas is inviting sealed bids for one (1) new Floor Mounted, Full Eject, Horizontal Closed Chamber, and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt – bid must include removal of current 2001 Ex62 Excel Baler & Conveyer and installation of new Baler and Conveyer. Sealed proposals addressed to the City of Hays, Kansas, and endorsed “BALER AND

CONVEYER” will be received at the City Clerk’s Office, City Hall, P.O. Box 490, 1507 Main Street, Hays, Kansas 67601, until 3:00 pm July 13, 2021. Faxed bids will not be accepted. Bids received later than specified hour and date shall be returned unopened. Bid prices shall be honored through October 13, 2021 and shall include the removal of

current 2001 Ex62 Excel Baler and Conveyer and installation of new Baler and Conveyer. The attached bid sheet with specifications shall be submitted to be considered a valid bid. Bids will be opened at 3:00 p.m. on July 13, 2021, in the City Commission Chambers. Bids will be reviewed, and a recommendation made to the City Commission. GROUND CONVEYER BELT - BID MUST INCLUDE REMOVAL OF CURRENT 2001

GENERAL

The specifications and dimensions that follow shall apply to the purchase of one (1) new Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt – bid must include removal of current 2001 Ex62 Excel Baler and Conveyer and installation of new Baler & Conveyer for the City of Hays, Kansas. The City reserves the right to waive minor technicalities under this specification. Federal and State laws supersede any conflicting part of this specification. The bidder agrees, if his proposal is accepted, to guarantee the design, material, and workmanship of the Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt according to the standard factory warranty, or for one year, whichever is greater. A copy of the warranty shall

accompany the bid. All service called for in the standard warranty shall apply without exception. Warranty coverage shall include costs incurred in the transportation of the Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt to and from the dealer’s shop, if required, or travel time and expenses to and from the City of Hays Solid Waste Division facilities, should warranty work be performed in the field. Complete specifications and literature on the Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt shall accompany the bid. Any exceptions to these specifications shall be indicated on the bid or on a separate attachment to the bid, labeled as such. Any “Or Approved Equal” or “equivalent” (OAE) items for brand specified components shall be listed with the bid package. Complete description and literature on the “equivalent” components shall be supplied for consideration by the City. The burden of proof regarding “equivalent” items will be upon the vendor.

DELIVERY & INSTALLATION

The Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt shall be delivered complete and fully operational. Bidder will be responsible for removal of current 2001 Ex62 Excel Baler & Conveyer and installation of new Baler & Conveyer. The new Baler & Conveyer will sit inside of the building with power unit and control box located inside the building. Delivery shall be made to the City of Hays Solid Waste Division’s Recycling Facility, 1780 W 55th St, Hays, KS. The Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt and installation must comply with all applicable Federal and State regulations. It shall be properly serviced, free of defects, and all mechanical adjustments made prior to delivery. A minimum of three (3) days’ notice shall be given prior to delivery. Delivery must be made between the hours of 8:00 a.m. and 3:00 p.m. weekdays. All cost associated with transportation will be bidder’s responsibility. Inspection of the Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt and installation will be made as soon as possible after delivery. The Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt with missing equipment or otherwise failing to meet specification shall not be accepted and shall become the vendor’s responsibility.

A dealer’s representative shall provide instructions in the proper operation and maintenance at the time of delivery. TECHNICAL SERVICE

The services of a competent technician, thoroughly knowledgeable in the use, operation and servicing of the Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt shall instruct City personnel in the proper use, safety, operation, and preventive maintenance of the Floor Mounted, Full Eject, Horizontal Closed Chamber and Automatically Cycled Baler fed by a Heavy-Duty Rubber In-Ground Conveyer Belt and test the Baler & Conveyer for satisfactory performance. This instruction shall be performed on a date to be agreed upon by the Public Works Solid Waste Division Superintendent.

TRADE – IN INFORMATION

The City of Hays will have a trade-in. Trade in is a 2001 Ex62 Excel Baler and In-Ground Rubber Belt Conveyer. Please find photos of the existing Baler and Conveyer attached. Conveyer is In-Ground. Pit size is 78.5” wide, 114.5” in length, and 47.5” in depth.

This purchase is tax exempt. Appropriate certification will be supplied to the vendor upon request.

Legal Notice

All City of Hays contracts are subject to the provisions of Section 2-576 through 2-580 of

the City of Hays, Kansas, Code of Ordinances.

All parties doing business with the City of Hays should familiarize themselves with the

provisions of the City of Hays Code of Ordinances Sections 2-576 through 2-580, prior to

proposing any contract to the City of Hays.

To the extent any contract entered into by or on behalf of the City of Hays, Kansas, omits

any of the contract provisions required by the City of Hays Code of Ordinances, the Code

will prevail, and the required contract provisions will be read into the contract. To the

extent any contract entered into by or on behalf of the City of Hays, Kansas contains any

of the contract provisions barred by the City of Hays Code of Ordinances, the Code will

prevail, and the offending provisions shall be null and void and shall be unenforceable as

to the City of Hays, Kansas.

The City of Hays expects a professional job, done commensurate with the standards and

practices of the profession/or business.

All persons awarded and/or entering into purchase orders with the City of Hays shall be

subject to and required to comply with all applicable City, State and Federal provisions.

The City of Hays has an affirmative action program. Any firm will be required to include

The Recipient, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252,

42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of

Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in

Federally-Assisted Programs of the Department of Transportation issued pursuant to such

Act, hereby notifies all bidders that it will affirmatively ensure that in any contract

entered into pursuant to this advertisement, disadvantaged business enterprises as defined

at 49 CFR Part 26 will be afforded full opportunity to submit bids in response to this

invitation and will not be discriminated against on the grounds of race, color, national

origin, or sex in consideration for an award.

The City reserves the right to complete any aspect of this project with City Personnel

preceding, during or after the project is complete. Those items would be deleted from the

Consultants scope of services. At any time, the City may elect to abandon the project. At

that time, the consultant would be compensated for all items previously completed.

Rights to intellectual property developed, utilized, or modified in the performance of

services shall remain the property of the City of Hays.
