Dear Fellow Conservative,
The American Conservative Union Foundation is proud to present our ratings of the 2017 meeting of the New Hampshire State Legislature. Like our Congressional Ratings, which date back 46 years, these ratings are meant to reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property).
Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. The ACU Foundation is the only organization to score over 8,000 elected officials each year, including lawmakers from all 50 states and Congress.
The 2016 election dramatically impacted the political landscape of not only Washington but state legislative chambers all across the country. Republicans now have control of both legislative chambers in 32 states, more than double the number they controlled in 2010. With these victories comes an ability to implement policies that restore individual liberty and return us to a limited form of government run by and for “We the People.”
It is our hope that these ratings will serve as a guide showing who can be relied on to fight for conservative principles and restore the role of government to what our nation’s founding fathers envisioned.

SELECTING THE VOTES
ACU researched and selected a range of bills before the New Hampshire State Legislature that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of New Hampshire’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. SB 11 Establishing Right to Work. This bill prohibits requiring employee to join a labor union or pay dues to a labor organization as a condition of employment. Families and the economy do better when people are employed, benefiting from the dignity of work, as illustrated by the ACU Foundation's Family Prosperity Index. ACU supports the “right to work” and supported this bill. The Senate passed the bill on January 19, 2017 by a vote of 12-11.
2. SB 12 Expanding Concealed Carry. This bill allows individuals that lawfully own a gun to conceal carry without a permit. ACU supports the founders’ belief in the Second Amendment and supported this bill. The Senate passed the bill on January 19, 2017 by a vote of 13-10.
3. SB 10 Bailing Out Dairy Farmers. This bill provides $2 million to New Hampshire dairy farmers for losses they incurred during a drought in 2016. ACU opposes taxpayer-funded bailouts without corresponding budget cuts, especially for an industry that already receives numerous federal subsidies and opposed this bill. The Senate passed the bill on February 9, 2017 by a vote of 19-3.
4. SB 44 Banning Common Core. This bill prohibits federal Common Core educational standards from being implemented in the state. Educational attainment provides substantial economic returns for families and for states, which is illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports state and local control of education and supported this bill. The Senate voted to pass the bill on February 23, 2017 by a vote of 14-9.
5. SB 100 Subsidizing Light Rail Transit. This bill provides $4 million for the project development of a commuter rail line that studies have found to be economically unfeasible. ACU opposes placing taxpayers on the hook for a project that is estimated to only self-generate half of its operating costs and opposed this bill. The Senate voted to kill the bill on February 23, 2017 by a vote of 12-11 (a “Yes” vote supported the ACU position).
6. SB 97 Subsidizing Land Conservation. This bill is intended to “conserve” land by providing farmers with $3 million in subsidies so that they will not use their land for anything but farming. ACU opposes this anti-development gimmick which wastes taxpayer funds and opposed this bill. The Senate voted to kill the bill on February 23, 2017 by a vote of 13-10 (a “Yes” vote supported the ACU position).
7. SB 41 Funding for Student Loan Relief. This bill provides up to $2,500 in student loan relief to workers in the technology sector who remain employed in the state for at least three years. ACU opposes providing taxpayer-funded loan forgiveness to government-favored industries and opposed this bill. The Senate passed the bill on March 9, 2017 by a vote of 17-7.
8. SB 94 Funding for Additional Affordable Housing. This bill creates additional “free” and low-cost housing by appropriating $5 million to the state’s affordable housing fund. The bill also authorizes the issuance of revenue bonds in order to pay for the new funding. An overreliance on welfare diminishes recipients’ employment prospects, keeping families out of the workforce and unable to prosper, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes taxpayer-funded redistribution programs which lead to intergenerational poverty and opposed this bill. The Senate passed the bill on March 9, 2017 by a vote of 19-5.
9. SB 22 Providing Immunity for Employment Information Disclosure. This bill provides legal immunity to employers who truthfully disclose the work history or competency of their employees. ACU supports efforts that protect free speech and limit litigation and supported this bill. The Senate voted to kill the bill on March 9, 2017 by a vote of 20-4 (a “No” vote supported the ACU position).
10. SB 193 Expanding School Choice. This bill allows all parents in the state to send their children to the school of their choice through the creation of education savings accounts. ACU supports school choice and supported this bill. The Senate passed the bill on March 16, 2017 by a vote of 14-9.
11. SB 227 Increasing Employer Payroll Taxes. This bill increases employer payroll taxes in order to fund workforce development and training programs. Under the bill, the new funding could be used for a variety of extraneous purposes including child care and transportation assistance, and for program outreach and marketing initiatives. Higher tax burdens suppress economic growth, which reduces family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes employer tax hikes which lead to reduced hiring and opposed this bill. The Senate passed the bill on March 16, 2017 by a vote of 19-4.
12. SB 149 Legalizing the Sale of Health Insurance Across State Lines. This bill allows individuals to purchase healthcare plans from out-of-state insurance companies. ACU supports a free market in healthcare and supported this bill. The Senate passed the bill on March 16, 2017 by a vote of 14-9.

13. SB 83 Hiking the Minimum Wage. This bill drastically increases the minimum wage to $12 an hour by September, 2018. ACU opposes all price controls such as the minimum wage which create high unemployment amongst low-skilled workers and opposed this bill. The Senate voted to kill the bill on March 16, 2017 by a vote of 14-9 (a “Yes” vote supported the ACU position).
14. SB 7 Increasing Oversight of Government Assistance. Sections 1, 2 and 11 of this bill ensure food stamp benefits are being properly administered. Some of the reforms under the bill include reducing income eligibility caps to federal levels, ensuring work requirements are met for certain applicants, and requiring that child support payments are made. An overreliance on welfare diminishes recipients’ employment prospects, keeping families out of the workforce and unable to prosper, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports measures to safeguard the integrity of taxpayer-funded benefit programs and supported these sections of the bill. The Senate voted to approve these sections of the bill on March 30, 2017 by a vote of 13-10.
15. HB 436 Deregulating Bitcoin. This bill allows virtual currencies, such as Bitcoin, to be freely traded within the state and exempts cryptocurrencies from state regulation. ACU supports the free competition of currencies, especially at a time when the Federal Reserve is engaging in dangerous, unprecedented monetary policy, and supported this bill. The Senate voted to pass the bill on April 20, 2017 by a vote of 13-10.
16. HB 84 Legalizing Firearms in Motorhomes. This bill expressly declares the right for an individual to possess a loaded firearm in an immobile motorhome. ACU supports the founders’ belief in the Second Amendment and supported this bill. The Senate passed the bill on April 20, 2017 by a vote of 15-8.
17. HB 194 Deregulating Employee Pay Periods. This bill allows an employer to pay their employees bi-weekly (instead of weekly) without having to obtain a special waiver from the government. ACU supports the right for workers and employees to freely negotiate their wages and benefits and supported this bill. The Senate passed the bill on April 20, 2017 by a vote 13-10.
18. HB 140 Expanding Manufacturer Wine Sales. This bill allows wine manufacturers to sell their products at retail outlets across the state. ACU supports a competitive market in the alcohol industry and supported this bill. The Senate passed the bill on April 20, 2017 by a vote of 14-9.
19. HB 164 Legalizing In-Home Poker. Sections 1 and 3 of this bill allows individuals to freely play games of poker in private residences without being subject to any government regulations. ACU supports the common sense expansion of individual liberties and supported these sections of the bill. The Senate voted to approve these sections of the bill on May 18, 2017 by a vote of 12-10.
20. HB 469 Preserving Obamacare. The Feltes Amendment (2150s) prevents the state from eliminating any consumer protections covering pre-existing conditions or essential health benefits under Obamacare. ACU supports the complete repeal of Obamacare, a devastating program that has costs millions their health insurance and choice of doctor, and opposed this amendment. The Senate failed to pass the amendment on May 31, 2017 by a vote of 9-14.

1. HB 276 Providing Exemptions from School Testing. This bill empowers parents to exclude their children from public school statewide assessment testing and prevents any school from penalizing any student for not taking a statewide assessment test. ACU supports the strengthening of parental rights over testing decisions and supported this bill. The House passed the bill on February 2, 2017 by a vote of 203-155.
2. SB 12 Expanding Concealed Carry. This bill allows individuals that lawfully own a gun to conceal carry without a permit. ACU supports the founders’ belief in the Second Amendment and supported this bill. The House passed the bill on February 9, 2017 by a vote of 200-97.
3. HB 413 Bailout of Local Government Pension Systems. This bill forces the state to pay 15 percent of the pension obligations of towns and local governments. ACU opposes this fiscally irresponsible bailout which discourages any reform to the system and forces taxpayers in one town to subsidize the high unfunded liabilities of another and opposed this bill. The House passed the bill on February 15, 2017 by a vote of 267-83.
4. HB 644 Taxing Capital Gains. This bill increases net taxes by expanding the interest and dividends tax to now include capital gains. Higher tax burdens suppress economic growth, which reduces family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes the taxation of capital gains, which will discourage investment and harm economic growth and opposed this bill. The House voted to kill the bill on February 15, 2017 by a vote of 200-137 (A “Yes” vote supported the ACU position).
5. HB 350 Prohibiting Firearms at Polling Places. This bill prevents an individual from lawfully carrying a gun while voting and makes violations a Class B felony, punishable by up to 7 years in prison. The House voted to kill the bill on February 15, 2017 by a vote of 204-144 (a “Yes” vote supported the ACU position).
6. HB 647 Expanding School Choice. This bill allows children with disabilities to attend the school of their choice through the creation of “education freedom” savings accounts. ACU supports school choice and supported this bill. The House passed the bill on February 15, 2017 by a vote of 184-166.

8. HB 372 Enhancing Voter Integrity. This bill is meant to increase voter integrity by clearly defining a “resident” of the state. ACU supports efforts that protect the electoral process by ensuring only those residing in the state can vote and supported this bill. The House passed the bill on March 8, 2017 by a vote of 188-163.
9. HB 522 Reducing Occupational Licensure. This bill establishes a committee to determine which of the state’s occupational licensing schemes should be made optional. The committee is directed to identify schemes that restrict competition as opposed to protecting consumers from actual harm. ACU supports extraordinary reforms to the state’s occupational licensing system, which is one of the most broadly and onerously licensed states, and supported this bill. The House voted to kill the bill on March 8, 2017 by a vote of 259-82 (a “No” vote supported the ACU position).
10. HB 436 Deregulating Bitcoin. This bill allows virtual currencies, such as Bitcoin, to be freely traded within the state and exempts cryptocurrencies from state regulation. ACU supports the free competition of currencies, especially at a time when the Federal Reserve is engaging in dangerous, unprecedented monetary policy, and supported this bill. The House voted to pass the bill on March 8, 2017 by a vote of 185-170.
11. HB 633 Eliminating Health Insurance Mandates. This bill allows a health insurance company to sell a policy without any state mandated coverage. ACU supports a free market in healthcare and believes individuals should be free to select the amount of coverage that best suits them and supported this bill. The House voted to kill the bill on March 8, 2017 by a vote of 240-110 (a “No” vote supported the ACU position).
12. HB 548 Reforming the State Pension System. This bill reduces taxpayer costs by raising the retirement age for future government workers. Under the bill, the state retirement age is defined as the same age as the federal Social Security Act. ACU supports this fiscally responsible reform, especially at a time when the state is facing over $5 billion in unfunded pension liabilities, and supported this bill. The House voted to kill the bill on March 8, 2017 by a vote of 204-121 (a “No” vote supported the ACU position).

13. HB 589 Eliminating Abortion Clinic “Buffer Zones”. This bill protects 1st Amendment free speech rights by allowing pro-life activists to gather lawfully around abortion clinics. The bill is in response to a 2014 law that established a "buffer zone" around abortion facilities. ACU believes abortion is a human tragedy, supports restrictions on the practice and educating patients and supported this bill. The House voted to kill the bill on March 9, 2017 by a vote of 191-165 (a "No" vote supported the ACU position).
14. HB 614 Strengthening Asset Forfeiture Protections. This bill provides additional protections to property owners by closing a loophole that allows the federal government to receive forfeited property without a criminal conviction. ACU Foundation’s Centers for Criminal Justice Reform and 21st Century Property Rights are both leading voices on this issue. ACU opposes the seizure of property without a criminal conviction and supported this bill. The House passed the bill on March 9, 2017 by a vote of 219-139.
15. HB 115 Hiking the Minimum Wage. This bill drastically increases the minimum wage to $12 an hour by September, 2018. ACU opposes all price controls, such as the minimum wage which create high unemployment amongst low-skilled workers, and opposed this bill. The House voted to kill the bill on March 9, 2017 by a vote of 193-169 (a “Yes” vote supported the ACU position).
16. SB 10 Bailing Out Dairy Farmers. This bill provides $2 million to New Hampshire dairy farmers for losses they incurred during a drought in 2016. ACU opposes taxpayer-funded bailouts without corresponding budget cuts, especially for an industry that already receives numerous federal subsidies and opposed this bill. The House passed the bill on March 23, 2017 by a vote of 257-96.
17. SB 23 Legalizing Firecrackers. This bill legalizes the sale of firecrackers in the state. ACU supports this expansion of individual liberties and supported this bill. The House voted to pass the bill on April 20, 2017 by a vote of 229-117.
18. SB 129 Expanding Renewable Energy Mandates. This bill dramatically increases electricity costs for residents and businesses by expanding the state’s mandates for “renewable energy” and providing subsidies to the bio-fuel industry. ACU supports all forms of energy, opposes the practice of government selecting one form of energy over another, and opposed this bill. The House voted to kill the bill on June 1, 2017 by a vote of 90-217 (a “Yes” vote supported the ACU position).
19. HB 86 Preventing the Development of Private Property. This bill makes it harder for individuals to develop their land by making it more difficult to receive “variances”, or special exemption, to zoning laws. The ACU Foundation’s Center for 21st Century Property Rights staunchly defends the property rights of American citizens, which are inherently protected by the U.S. Constitution. ACU opposes measures that weaken an individual’s right to develop their land and opposed this bill. The House failed to override the Governor’s veto on November 2, 2017 by a vote of 115-164.
