ROAD TRAFFIC
The A96 Trunk Road (Inverurie Road) (40mph and 50mph
Speed Limits) Order 2016

Coming into force - - 2016
The Scottish Ministers make the following Order in exercise of the powers conferred by section
84(1)(a) of the Road Traffic Regulation Act 1984(a) and all other powers enabling them to do so.
In accordance with section 84(2)(b) of that Act, they have given public notice of their intention to
make the following Order, and have complied with Parts II and III of the Secretary of State’s
Traffic Orders (Procedure) (Scotland) Regulations 1987(c).
Citation and commencement
1. This Order may be cited as the A96 Trunk Road (Inverurie Road) (40mph and 50mph Speed
Limits Order) 2016 and comes into force on [ ] 2016.
Speed restriction
2. No person may drive any motor vehicle at a speed exceeding—
(a) 40 miles per hour on the lengths of road specified in Part 1 of the schedule of this Order;
(b) 50 miles per hour on the length of road specified in Part 2 of the schedule to this Order.
Exemption
3. No speed restriction imposed by this Order applies to—
(a) vehicles falling within regulation 3(4) of the Road Traffic Exemptions (Special Forces)
(Variation and Amendment) Regulations 2011(d) when used in accordance with
regulation 3(5) of those Regulations; or
(a) 1984 c.27; section 84(1) was substituted by the Road Traffic Act 1991 (c.40), section 45(2). The Scottish Ministers are the
traffic authority by virtue of section 121A of the Road Traffic Regulation Act 1984 (c.27) (inserted by the New Roads and Street Works Act 1991 (c.22) (“the 1991 Act”), schedule 8, paragraph 70 and amended by S.I. 2001/1400) as read with section 151(1) of the Roads (Scotland) Act 1984 (c.54) (relevantly amended by S.I. 2001/1400). The functions of the Secretary of State were transferred to the Scottish Ministers by the Scotland Act 2016 (c.11) section 40(2).

SCHEDULE Article 2
SPECIFIED LENGTHS OF ROAD
PART 1
1. That length of the A96 Aberdeen - Inverness Trunk Road from a point 348 metres or thereby
east of its junction with the C89C to a point 325 metres or thereby west of the centre of the
roundabout forming a junction with Sclattie Park and Bankhead Avenue, a distance of 2.034
kilometres or thereby.
2. That length of the A96 Aberdeen – Inverness Trunk Road off slip leading to the “A96 Park and
Choose” from the point where it diverges from the main carriageway, northwards for a distance of
70 metres or thereby.
PART 2
1. That length of the A96 Aberdeen - Inverness Trunk Road from a point 132 metres or thereby
west of its junction with the C89C to a point 348 metres or thereby east of its junction with the
C89C, a distance of 480 metres or thereby.

Order 2016
Statement of The Scottish Ministers’ reasons for proposing to make the above named Order.
Following completion of the A96 Craibstone Junction as part of the Aberdeen Western
Peripheral Route (“AWPR”) project, the Scottish Ministers propose to apply:-
a 40mph speed limit to those lengths of the A96 Trunk Road (Inverurie Road)
specified in Part 1 of the schedule of the Order and
a 50mph speed limit to the length of the A96 Trunk Road specified in Part 2 of the
schedule of the Order.
It is considered that this Order should be made in the interests of road safety, to ensure that
speed limits are appropriate and consistent to the new road layout and configurations
resulting from the construction of the new infrastructure related to the AWPR.
