I n view of the provisions of section 9, sub section 3 of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions and Fees) Act, 2015 (Mah. Act No. XXVIII of 2015) published on 1 7 ~ ~ August 2015, the Pravesh Niyantran Sarniti existing as on the date of commencement of the Act shall continue to exercise the powers of Adrnissions Regulating Authority till such Authority is duly constituted under the Act.

The Authority perused the aforesaid letters dated llth March 2016 received from Maharashtra University of Health Sciences, Nashik regarding approval of admissions done in NRI Quota for the Acadeniic Year 2012-13, 2013-14 and 2014-15 and the admissions done in lSt Year of UG and PG courses in Academic Year 2015-16. It is noticed that Maharashtra University of Health Sciences, Nashik has declared schedule as 1 4 ~ ~ March 2016 to 2lSt March 2016 for accepting exam forms of 1" Year students of Academic Year 2015-16.

On circulatory subrnission of both the letters of University for decision, i t was directed to issue letter to University to allow the students to appear for summer exam, 2016 (except students admitted through CET at Institute level). The Authority perused the letter of Office so issued, dated 31St March, 2016 to the Maharashtra University of Health Sciences, Nashik. I n the light of above and interest of the students, the Authority directs the University to accept the Examination forms of the above mentioned students Office to inform accordingly.

Item No. 4(a): Letter dated 3%'' March. 2816 received from Directorate of AYUSH, Makarashtra State, Mumbai submittinq verification and observation report of admissions done in unaided colleqes of Avurved, Unani and Homeopathv Deqree courses for Academic Year 2015-16.

The Adrr~issions Regulating Authority perused observations of Directorate of AYUSH, Mumbai having found certain discrepancies in admission process of Under Graduate Courses. The Admissions Regulating Authority, after deliberations decides to approve eligibility and selection process of Academic Year 2015-16, subject to the Directorate of AYUSH, Mumbai sorting out and disposing off with the said discrepancies after appropriate compliances from respective Institutions for Acaderr~ic Year 2015-16. The details of which is listed and marked herewith as Annexure-A.

The Authority also went through the decision taken in its meeting held on 1 8 ~ ~ March 2016 (at Item No. 3[b]).

It is noticed that Directorate of AYUSH in its verification report pointed out that following colleges used both lists of WlH-CET-2015 and Asso-CET-2015 during the admission process which was against the set procedure and it is serious in nature and the same should not happen in future, which may be noted by the colleges. I n view of the above, after deliberations, as a one time measure and in the interest of students, the Authority decides to approve above admissions for the Acaderr~ic Year 2015-16, student- The Authority further directs that the said permission is granted only for the Academic Year 2015-16 and the Colleges/Institutes should not treat it as a precedent for the years to come.

The amount of penalty shall be paid by these Institutions within a period of four weeks from the date of publication of these minutes on tlie official website of the Authority. The Authority directs the College/Institute that payment should be paid in the form of Demand Draft / Pay order in favour of "PRAVESH NIYANTRAN SAMITI, MUMBAI", payble at Mumbai. The Maharashtra University of Health Sciences, Nasl-~ik may also be requested to give eligibility and enrollment to these students for the Academic Year 2015-16, subject to fulfillment of the above conditions w.r.t. aforesaid Colleges/Institutes. Office to take necessary steps.

It is noticed that aforesaid college used both lists of IYH-CET-2015 and Asso-CET-2015 during the admission process and admitted 08 students viz. - 1) Oza Sourab Hariprasad, 2) Ansari Aliya Jalal, 3) Khillare Shital Ashok, 4) Borade Swapna Dlliprao, 5) Sakhre Vaibhav Maharud, 6) Tai Mohammaed Umer Ayub, 7) Narwade Rakshanda Vithalrao and 8) Shaikh Zainab Rafiq on the basis of merit list of MH-CET-2015 which was against the set procedure and it is serious in nature and the same should not happen in future, which may be noted by the college.

the process of conducting CET Exam for different departments/stream till last year will be continued by CET-CELL for Academic Year 2016-17. Accordingly State C B CELL took review in this regard and hereby proposed the name of above agencies for conducting CET and CAP process of various CETs.

I n respect of Higher Education Department there are four new types of CETs to be conducted which are: 1) MAH - IAW 5 years 2) MAH - IAW 3 Years 3) MAH - B.P.Ed., 4) MAH - M.P.Ed - As per information obtained from Higher Education Department, MKCL was receiving application forms from candidates and conducting admission process for M.Ed./B.Ed. courses till last year and the department has no objection to continue with MKCL for the Academic Year 2016-17 and also has no objection to conduct above mentioned CETs through IBPS. Hence it is proposed to appoint IBPS to conduct CET online and MKCL to conduct CAP process of above mentioned CETs of Higher Education.

I n view of the above, after deliberations, the Authority decides to approve the proposals submitted by the Office of the Commissioner, State CET-CELL regarding appoirltment of agency for conducting various CETs and CAP for the Academic Year 2016-17 only. After deliberations, the Authority approved the proposals submitted by the Directorate of Technical Education, Mumbai. The details of which is listed and marked herewith as Annexure-E. The Authority perused the aforesaid proposal received from the Degree College of Physical Education - Shree Hanuman Vyayam Prasarak Mandal, Amravati regarding fixation of dates and venues for online tests and field tests of B.P.Ed. and M.P.Ed. The Authority discussed the issue at length. There is a some urgency in this matter. After deliberations, the Authority decides to sought the clarification in this respect from the Government of lvlaharashtra through the Addl. Chief Secretary, Medical Education and Drugs Department and Principal Secretary, Higher and Technical Education, Mantralaya, Mumbai. After receipt, the clarification to be placed before Authority for its consideration. Office of the Commissioner, State CET-CELL to take necessary steps.

The Authority directs to the Commissioner, State CET-CELL, lvlumbai to take necessary steps in this respect and inform the Authority accordingly.

Item No. 20: To finalize the office mace for Admission Reaulatinq Authoritv and State CET CELL.

The Authority perused the details submitted by the office of the Commissioner, State CET-CELL in respect of the office space for Admissions Regulating Authority and State CET-CELL.

After deliberations, the Authority directs the Commissioner, State CET-CELL to finalize the appropriate and convenient space for the office of Admissions Regulating Authority and State CET-CELL ar~d do the needful at the earliest.

The Authority perused the proposals submitted by the Under Secretary, Admissions Regulating Authority regarding no. of vacancies to be filled in the office.

The Under Secretary invited kind attention of the Authority to the provisions of GR No. MISC-2715/C.R.100/13, dated 08/01/2016 and GR No. MISC - 2715/CR 100/13, dated 02/03/2016 of GAD and GR No. MISC-2015/C.R. 276/Techn-4, dated 04/08/2015 of Higher and Technical Education Department. He also emphasized the need of urgent staff for quick and efficient disposal of the office work.

After deliberations, the Authority directs the Commissioner, State CET-CELL to take necessary action in this respect and submit report before the Authority for its considerations.

-The Authority also perused the Hon'ble High Court Order dated 31St March 2016, in Writ Petition IVo. 1141 of 2016.

After deliberations, the Authority directs that the Addl. Chief Secretary, Medical Education and Drugs Department or its representative and the Director, Medical Education and Research, Mumbai should be present along with all necessary documents before the Authority in its next meeting. Hence aforesaid matter should be considered in the next meeting. Office to inform all concerned accordingly.

hlo responsible Officer/Trustee/Dean of the College/Institute was present for the meeting.

It is noticed that as per the Order of Hon'ble Supreme Court dated 18'~ and 25'h September 2014 in Writ Petition No. 469 of 2015 the aforesaid College/Institute needs to give admission to the students from the merit list prepared by the States and they shall be charged fees prescribed by the Government Medical Colleges of their respective States. However the aforesaid College/Institute admitted students from the merit list of Asso-CET-2014. Therefore the SamitiJAuthority in its meeting held on 12'~ December 2014 at Itern No. 8(a) to not to approve the admissions of students admitted in First Year MBBS course in Institute of Medical Sciences and Research, Satara for the Academic Year 2014-15.

I n view of the above, after deliberations, the Authority directs the DeanITrustee of the Institute of Medical Sciences and Research, Satara and representatives of the students/parents to be present before the Authority in its next meeting. The Authority further decides that if the aforesaid College/Institute if remain absent before the Authority in the next meeting, then the Authority may take ex-parte decision and the same shall be binding to the concerned. Office to inform accordingly.

Item No. 22(e): Letters dated 12'~ April 2016 received from Holv Family Institute of Nursinq Education, Kurla, Mumbai and Holy S ~ i r i t Institute of Nursinq Education, Andheri, Mumbai reqardinq admissions of Nursinq Course on the basis of Non-CET

The Authority perused the aforesaid letters received from Holy Family Institute of Nursing Education, Kurla, Mumbai and Holy Spirit Institute of Nursing Education, Andheri, Mumbai regarding admissions of Nursing Course on the basis of Non-CET.

After deliberations, the Authority directs that the provisions of Act 2015 is effective and have the approval to the admissions of Non CET students is not within the purview of this Authority. Hence rejected.
