f 2014 was good for your busi-ness, we think 2015 will be even

better. It has certainly been the case for the Engineering Contractors' Association.

We have grown in terms of mem-bership with both new and returning

members. In part, this is due to the improving economy, but as we all know, there is a lot of room for more growth before we all get back to the kind of business activity we experienced nearly a decade ago.

One of the best things about the ECA's leadership structure is the two-year term for each office. This gives us time to both understand the relationship of our positions to the associa-tion…and to each other, so that the officers and board have a shared understanding of the association's goals and objectives. Like with any other job, it takes several months to come terms with the work, but with our extended terms, we have time to both make and execute strategic efforts.Our Focus Shift

About a year ago we began to shift the focus of ECA to local–local politics, local govern-ments and local funding. This refocusing our efforts on local has resulted in growth in involve-ment and influence, a key com-ponent to our membership growth.

We work with governments at all levels, from federal (to influence policy) to state (to influence funding) to city councils and public works departments, the top customers for most members. We are in city halls and county seats throughout our 12-county area.

We learned that cooperation with local agencies pays bigger dividends than confrontation and that when you bring opportu-nity to the table, working with our labor partners we can bring more projects forward to the construction phase, where the backhoe meets the asphalt.

We are also bringing expertise to these projects, things like value engineering, new technologies and the productivity benefits of a highly skilled workforce. We are also sharing those efforts with our members and hope to, this year, develop a case study series on best practices in our business as a member benefit.Our Focus Shift

This brings us back to the two-year leadership terms. A major shift in focus, like the one we have embarked on, takes years to complete, not weeks or months. I have just a year left in my term as president, but our leadership team is just as commit-

ted to this new approach as I am…we're here for the long term. D

CA is actively engaged in devel-oping work in the much needed

public infrastructure arena to benefit local communities, the industry and our members.

The key to our success comes from our highly skilled underground

contractors are adept at tackling any level of water, sewer and underground utility projects. Our members bring a lot more to the table beyond the lowest responsible bid, as out-lined below. ECA's members bring to help any agency, help like developing a comprehensive plan to fix wet and dry utili-ties, including everything from means of conveyance to treatment and processing facilities.Engineering Expertise

We bring the right assessment team to review piece by piece concerns or conduct a comprehensive review. Our con-tractors are out in the streets, re-engineering and re-building infrastructure on a daily basis. They have developed an abil-ity to bring a common sense, cost saving, value engineering approach to getting the job done.

Funding – We have a bench of funding opportunities that we bring to any project, from a deep understanding of public and bonded funding to venture capital money. This public pri-vate funding partnership is at the vanguard of funding choices that will work in today's economy and political cli-mate.

Advocacy – When it comes time for authorities to ap-prove a project at the agency level, in many instances there is a need for a clear perspective on the scope, value and ben-efits to the project. ECA has retained the Southern California Group to help in this clarification process. Teamed up with the ECA's in-house staff, and member companies, we have the ability to reach out to stakeholders and relevant interest groups to clarify the benefits of these projects.

Jobs – Simply stated, the results of this approach are jobs for men and women in the construction industry. This has the attendant benefit of providing work and spending dol-lars in the communities where this activity occurs. Every dol-lar spent on an infrastructure project has four-fold multiplier effect in increased spending that raises economic activity in that community. These projects also provide a great level of improved service to consumers as well as relief and peace of mind to the agencies that need these projects done.It's All about You

n early January, Governor Brown delivered his inaugural

address outlining the year ahead and his goals for his fourth term as Governor, providing a window into the types of opportunities and chal-lenges that lie ahead for the con-

struction industry in 2015.“We must also deal with longstanding infrastructure chal-

lenges,” Brown said, noting that with the passage of the water bonds, “we are finally grappling with the long-term sustainability of our water supply. Equally important is having roads, highways and bridges in good enough shape to get people and commerce to where they need to go.” Brown said. “It is estimated that our state has accumulated $59 billion in needed upkeep and main-tenance. Each year, we fall further and further behind and we must do something about it.”

This is good news to our industry and from a government af-fairs perspective, creates an opportunity for ECA and our mem-bers to weigh in and support potential new investment in Califor-nia infrastructure.

With this opportunity comes challenge as the Governor did not make clear how we will pay for improved infrastructure. This creates an opportunity for ECA, working with our industry part-ners and allies, to help support traditional financing tools while developing the innovative financing approaches that will be nec-essary to close this massive infrastructure funding gap.

The Governor outlined three ambitious new climate change goals, to further reduce our state's carbon emissions by 2030: !Increasing from one-third to 50 percent our electricity derived from renewable sources; !Reducing today's petroleum in cars and trucks by up to 50 per-cent and;!Doubling the efficiency of existing buildings and making heat-ing fuels cleaner.

The Governor's new climate objectives offer yet another re-minder of the numerous environmental and regulatory chal-lenges, both new and ongoing, that our industry must engage. This is where ECA's government affairs representation is vitally important for our industry.

Last year, ECA retooled its government affairs program to be focused on outcomes directly beneficial to its members to defend against new challenges and seize new opportunities. Since then, ECA has begun meeting with key public agencies and private-sector companies in order to support and promote new infrastructure projects and the jobs they will bring. Likewise, ECA has continued and increased its advocacy on key environ-mental, regulatory and other issues where our industry's voice is needed in order to assure better outcomes for members. ECA enters 2015 well-positioned to seize opportunities, con-

The Association

he Engineering Contractors’ Asso-ciation, ECA, since 1976 has served

underground and heavy construction professionals in Southern California providing leadership and education on issues important to our member’s success. Working to enhance

continued development ECA promotes a healthy construction environment through education of regulatory bodies from the contractor’s perspective and informing the industry on critical developments.

ECA’s mission champions the interest of its members acting as a collective influence in the construction industry in matters of labor relations, government relations, legislative interests and public relations. Membership in the ECA is drawn from 11 Southern California counties and is made up of contractors and affiliates with interests in sewer and water line, stormdrain, pipeline, underground utilities, trenching, excavating and grading, tunnels, street and highway construction, water and sewer treatment plants and related engineering construction.

Under the guidance of ECA’s board of directors, Executive Director is Wes May, Sheila Voss is Office manager, and ECA Magazine Editor is John Simpson.

ECA Membership Classifications

ECA Memberships are made up of two categories:

1. A Contractor is either signatory or non-signatory to one or more of the five basic crafts: Carpenters, Cement Masons, Construction Laborers, Operating Eng ineer s and Cons t ruc t ion Teamsters.

2. The Affil iate Member manufactures, supplies, services, and/or distributes materials or services used by contractors involved in the general and underground construction industries.

Legislation

As a basic element of its long-range planning efforts, ECA maintains both a Political Action Committee and a Legislative Committee. These two bodies of the association work in conjunction with each other and strive constantly to ensure that legislation which could adversely affect construction is either blocked or modified. They diligently work toward the goal of implementing favorable legislation so that contractors and affiliates may enjoy a more successful and profitable business climate.

Additionally, ECA works in conjunction with labor

unions to provide the most direct individual representa-

tion of union contractors’ labor problems available. The

ECA Labor Committee’s responsibility is to gather,

evaluate, and disseminate labor information affecting

contractor operations. The committee also negotiates

Master Labor Agreements with the five basic crafts:

Carpenters, Cement Masons, Construction Laborers,

Operating Engineers, and Construction Teamsters.

Membership Meetings & DIG Award

Monthly membership events, featuring industry

experts, are the basic meeting grounds for members. The

association also holds its annual convention in spring and

golf tournaments for the benefit and enjoyment of

members. The DIG Award, ECA’s most prestigious event,

is presented annually to individuals of Dignity, Integrity &

Generosity DIG in underground construction. This black

tie affair presents a gathering of industry greats and

recognizes recipients for their achievement.

ECA Magazine

Keeping members informed on issues both within the

association and the underground and general construc-

tion fields, ECA publishes its monthly magazine distrib-

uted industrywide to construction professionals.

Safety & Risk Management

ECA promotes job safety through a comprehensive risk

management program. ECA’s Risk Management

Committee serves as liaison with the various occupa-

tional safety agencies such as OSHA and Cal/OSHA.

APWA & Public Agencies

ECA members serve in the APWA (American Public

Works Association) committee for the membership in

improving and streamlining the Standard Specifications

for Public Works Construction (known as the Green

Book), plus all new specifications, materials, sewer and

drain design, compaction requirements, and related

regulations. It is the Association’s intention that once a

contractor receives a contract, he will be able to work

efficiently and, most important, cost effectively within

the specifications required.

The strong voice ECA has earned within the construc-

tion industry has placed the association in a respected

position. ECA provides constant input and represents

member’s most important interests before agencies,

legislative bodies and regulatory entities. Dedication and

commitment to individual member needs have been key

E CA can declare victory for its members! The California Supreme Court de-

published a case that had effectively rendered the stop payment notice ineffectual, titled Golden State Boring & Pipe Jacking, Inc. v. Eastern Municipal Water District, et al. Case No. E054618, Super Ct. No. RIC502935.

On November 7, 2014, Anthony Niccoli and Bernard Kamine on behalf of the ECA filed with the Supreme Court of California an Amicus Curiae letter seeking the de-publication of Golden State Boring in support of its membership’s stop payment notice rights. Shortly thereafter, the Supreme Court ordered:

The Reporter of Decisions is directed not to publish in the Official Appellate Reports the opinion in the above entitled appeal filed July 23, 2014, which appears at 228 Cal.App.4th 273.The Golden State Boring opinion was so

damaging to ECA members because as contrac-tors, our members rely on the stop payment notice to secure payment for the difficult and quality work that they do. In Golden State, the Appellate Court essentially held that a stop payment notice served before a notice of completion was recorded was premature.

Previously, it was commonly understood that a claimant could file a stop payment notice during construction. Indeed, the Golden State Boring ruling was contrary to the plain language of the statute governing the timeliness of stop payment notices and the custom and practice of serving stop payment notices in the construction industry.

The Appellate Court’s decision reflected a lack of understanding of the purpose of a stop payment notice – that is, to freeze or lien the construc-tion funds in the hands of an owner or lender (on a private work) up to the amount of the claim. It stands to reason that after the owner records a notice of completion, most, if not all, of the construction funds will have already been disbursed, leaving virtually nothing left to withhold.

But the Golden State Boring case, even if it veered down a frightening detour, ultimately has a happy ending, that is, under California Rules of Court, rule 8.1115(a), with some exceptions, an opinion that is not published “must not be cited or relied on by a court or a party in any other action.” In short, the Golden State Boring opinion now resides on the ash heap of history.

The New ECA Legal Committee

Members

ECA is proud to announce its new Legal Advi-sory Committee, whose primary purpose will be to protect, enhance, and serve the legal rights and interests of members. The committee will be comprised of attorneys who are also ECA mem-bers, and who therefore, have a vested interest in the success of the ECA and fighting for legislation that positively affects the organization, and en-hances work opportunities for members.

The committee will, among other things, protect its member’s legal interests by advocating for legislation deemed beneficial to the organiza-tion; drafting Amicus Curiae (“Friends of the Court”) letters to challenge rulings adverse to the interests of ECA members (like Golden State Boring dis-cussed) or to support rulings beneficial to ECA; act as a referral source for legal services where needed; provide relevant and useful legal informa-tion through seminars, updates, and presenta-tions; and respond and adapt to the ever-changing needs of ECA members. We welcome feedback, questions, and input from members on needs it would like the Legal Advisory Committee to meet.
