PREAMBLE

In the exercise of the powers conferred on it by Sections 31(2)(j) and 50 of the Constitution of the Peoples Democratic Party and all other powers enabling it in that behalf, the NATIONAL EXECUTIVE COMMITTEE OF THE PEOPLES DEMOCRATIC PARTY hereby issues the following Guidelines for the conduct of primaries for the election of Party candidates for the offices of the President of the Federal Republic of Nigeria, Governor of a State, member of the National Assembly and member of the House of Assembly of a State. The guidelines are prepared to reflect the structural and fundamental changes in the nation’s electoral law, especially those regulating the conduct of Federal and State elections as articulated in the Electoral Act, 2010 (as Amended). Another essential aspect of the law deals with the composition of congresses and conventions for nominating candidates for elections. Section 87(8) provides that “a political appointee at any level shall not be a voting delegate at the convention or congress of any political party for the purpose of nomination of candidates for any election except where such political appointee is also an officer of a political party”. Members are also to note that under the Amended Electoral Act, 2010:

i. Candidates of political parties will only emerge through primary elections duly conducted and monitored by INEC (Section 87(1) (a).

ii. Political parties are no longer allowed to change or substitute candidates whose names have been submitted to INEC, except in the case of death or withdrawal by the candidate (Section 33).

Finally, attention of members seeking nomination on the platform of our Party is drawn to Section 87(10) which prohibits courts from stropping the holding of primaries pending the determination of any suit.

The Electoral Guidelines for Primary Elections, 2014 of the Peoples Democratic Party are, therefore, drawn up to conform strictly with the provisions of the Party’s Constitution (2012 as amended), the Electoral Act, 2010 (as Amended) and the Constitution of the Federal Republic of Nigeria 1999 (as Amended).

PART I – ELECTION OF AD-HOC DELEGATES 1. National Delegate

i. For the purpose of nominating the Party’s Presidential candidate, each of

the 774 Local Government Party Chapters shall produce one National

Delegate to the Special Conventions through a Special Local Government Congress.

ii. The Party’s Executive Officers at the Ward, Local Government, State,

Zonal and National levels shall, by virtue of their respective offices in the Party, be automatic delegates to the Local Government Special Congress.

Other automatic delegates include: The LG Council Chairman, Deputy Chairman and Councillors, members of National and State Assemblies, members of the Board of Trustees, President/Vice President of the Federal Republic, State Governor and Deputy Governor who are members of the Party from the LGA.

2. Three (3) Ad-Hoc Delegates

i. For the purpose of nominating the Party’s candidates for the offices of

Governor of a State, member of the National Assembly (Senate and House of Representatives), member of the State House of Assembly and election of National Delegate, each Ward Chapter of the Party shall elect

three (3) Ward Ad-Hoc Delegates at a Special Ward Congress, at least one of whom shall be a woman. The same delegates shall participate in the Special Congresses for the nomination of the candidates mentioned in this paragraph.

ii. On the last date for the delivery of nomination papers, the Ward

Secretary shall authenticate the ward registers and close them to further registration of new members by signing and dating the last page with the words “register closed”.

iii. The ward register shall be used to accredit all registered members of the

Party at the ward between the hours of 8.00am and 12 noon and voting shall commence thereafter.

iv. The ward election of delegates’ results shall be collated by the Ward Monitoring Officer at the Local Government Party office for onward transmission to the State Party office.

v. The State Monitoring Committee shall collate the results of all the Ad-Hoc delegates elections – three (3) Ward Ad-Hoc Delegates and 1 National Delegate from the Local Government Area Congress.

3. Mode of Election of Ad-Hoc Delegates

National Delegate, delegates to the Special Local Government Congress shall queue up behind aspirants of their choice, while the three (3) Ad-Hoc delegates shall be elected by all registered and card-carrying members in the Ward. The three (3) aspirants with the highest votes shall be returned elected. Provided that where no woman is among the three (3) aspirants with the highest votes, the female aspirant that scored the highest votes among female aspirants shall be declared the third delegate.

4. Time Table for Election of Delegates and Conduct of Primaries

The National Working Committee (NWC) of the Party shall recommend a timetable for the conduct of Delegates elections and Special Congresses for the nomination of the Party’s candidates for the approval of the National Executive Committee (NEC).

PART II

DELEGATES TO SPECIAL NATIONAL CONVENTION AND SPECIAL CONGRESSES

A. Procedure for Presidential Nomination

i. For the purpose of nominating the Presidential Candidate, the Party

shall hold a Special National Convention in the Federal Capital Territory or any other place within the Federation that is agreed by the National Executive Committee of the Party where delegates shall vote for each of the aspirants at the designated centre on a date approved by the National Executive Committee (NEC).

ii. The aspirant with the highest number of votes at the end of voting

shall be declared the winner of the Presidential primaries and the aspirant’s name shall be forwarded to the Independent National Electoral Commission as the candidate of the Party.

B. Delegates to Special National Convention

The following shall be delegates to the Special National Convention: i. the National Chairman of the Party and other members of the National

Executive Committee; ii. the President and Vice-President of the Federal Republic of Nigeria,

who are members of the Party;

iii. all members of the National Assembly, who are members of the Party;

iv. all State Governors and Deputy Governors, who are members of the Party;

v. all gubernatorial candidates of the Party shall be automatic delegates

to the convention;

vi. all members of the State Houses of Assembly, who are members of the Party;

vii. members of the Board of Trustees;

viii. all members of the Zonal Working Committee and State Party

Chairmen and Secretaries including those of the Federal Capital Territory, Abuja;

ix. all State Women and Youth Leaders, including those of the Federal

Capital Territory, Abuja;

x. all Party Chairmen of the Local Government Areas;

xi. one national delegate elected from each local government area congress;

xii. all elected Local Government Council Chairmen, who are members of

the Party;

xiii. former members of the National Working Committee who are still members of the Party;

xiv. former Deputy Presidents of the Senate and Deputy Speakers of the

House of Representatives, who are still members of the Party.

A. Procedure for Nominating Gubernatorial Candidate

i. For the purpose of nominating a Gubernatorial candidate, the Party shall hold a Special Congress in the State Capital with delegates voting

for each of the aspirants at the congress to be held on a specified date appointed by the National Executive Committee (NEC) of the Party.

ii. The aspirant with the highest number of votes at the end of the voting

shall be declared the winner of the primaries of the Party and the aspirant’s name shall be forwarded to the Independent National Electoral Commission as the candidate of the Party, for the particular state.

B. Delegates to Special State Congresses

The following shall be delegates to the Special State Congress:

i. the State Chairman; ii. the President and Vice President of the Federal Republic of Nigeria,

who are members of the Party from the State;

iii. the Governor and Deputy Governor of the State, if members of the Party;

iv. the Gubernatorial candidate of the Party;

v. the members of the Board of Trustees from the State;

vi. the members of the State Executive Committee;

vii. all members of the National and Zonal Executive Committees from the State;

viii. the members of the National Assembly from the State and the members of the State House of Assembly, who are members of the Party;

ix. all elected Local Government Council Chairmen and Vice Chairmen

who are members of the Party;

x. all Local Government Party Secretaries and Treasurers;

xi. all Local Government Women and Youth Leaders;

xii. three delegates per Ward elected at Ward Congresses, at least one of

whom shall be a woman, all of whom shall cease to function at the conclusion of the Congresses for which they were elected;

xiii. former members of the State Working Committee who are still

members of the Party;

xiv. former Governors and Deputy Governors produced by the Party who are still members of the Party, and

xv. former Speakers and Deputy Speakers of the State House of Assembly

A. Procedure for Nominating a Senatorial Candidate

i. For the purpose of nominating a Senatorial Candidate, the Party shall hold a Special Congress at a designated centre in the Senatorial District on a date approved by National Executive Committee (NEC).

ii. The aspirant with the highest number of votes at the end of voting,

shall emerge as the Party’s candidate.

B. Delegates to Senatorial Special Congress

The delegates to the Senatorial Special Congress shall be all delegates to the State Congress from the Senatorial District in question.

A. Procedure for Nominating Member of House of Representatives

i. For the purpose of nominating a House of Representatives Candidate, the Party shall hold a Special Congress at a designated centre in the Federal Constituency on a date approved by the National Executive Committee (NEC).

ii. The aspirant with the highest number of votes at the end of voting,

shall emerge as the Party’s candidate.

B. Delegates to House of Representatives Special Congress

The delegates to the Special House of Representatives Congress shall be all delegates to the State Congress from the Federal Constituency in question.

A. Procedure for State Assembly Nomination

a. For the purpose of nominating a State Assembly Candidate, the Party shall hold a Special Congress at a designated centre in the State Assembly Constituency on a date approved by the National Executive Committee (NEC).

b. The aspirant with the highest number of votes at the end of voting, shall emerge as the Party’s candidate.

B. Delegates to State Assembly Special Congress

The delegates to the State Assembly Congress shall be:

i. All delegates to the State Congress from the State Assembly

Constituency; and ii. Other members of the Local Government Executive Committee from

the State Assembly Constituency who are not delegates to the State Congress.

PART III

PRESIDENTIAL PRIMARY ELECTION 1. Any aspirant to the office of the President of the Federal Republic of Nigeria on

the platform of the Peoples Democratic Party (in these Guidelines referred to as “the Party”) shall:

a. be a citizen of Nigeria by birth, not below the age of 40 years;

b. fulfill all the conditions set out in the Constitution of the Federal Republic of Nigeria 1999, the Constitution of the Party 2012 (as Amended), the provisions of any other relevant law and these Guidelines;

c. be a registered voter and attach a copy of his/her voter’s

registration card to the duly completed Nomination Form Code PD003/P;

d. complete and submit the Expression of Interest Form Code

PDP002/P;

e. be a duly registered financial member of the Party;

f. resign/retire from office if a political appointee, civil servant, public servant or party official not later than 7 (seven) days before the date

of the collection of forms for the Ward Congresses;

g. possess educational qualification not below the level of Senior Secondary Certificate or its equivalent;

2. Subject to the provisions of the Constitution of the Federal Republic of Nigeria

1999 (as Amended) and any other applicable law, an aspirant to the office of the President of the Federal Republic of Nigeria shall not be eligible to be nominated or to contest the primary election, if he/she:

a. fails to produce his personal income tax certificate, or any evidence

that he/she has paid his/her income tax for the last preceding three years or evidence of exemption from payment of personal income tax; or

b. presents a false birth certificate or declaration of age for the purpose of the primary election or for any other purpose whatsoever; or

c. has been indicted for any misconduct set out in Section 58(1) of the Constitution of the Party and has been punished in accordance with Section 59(1);

d. has been dismissed from the public service of the Federation or of a

State or Local Government Area Council or from any other employment in

the public or private sector, or

e. is a member of a Secret Society; or

f. has been adjudged guilty of treason or treasonable felony by any court in Nigeria; or

g. has been convicted by a court of competent jurisdiction of any criminal

offence involving homicide, fraud or dishonesty or the sale or use of narcotic drugs or any other psychotropic substances by any court of competent jurisdiction in Nigeria or within the Commonwealth or elsewhere; or

h. under the law in any part of Nigeria, he is adjudged to be a lunatic or

otherwise declared to be of unsound mind; or

i. is an undischarged bankrupt, having been adjudged or otherwise declared bankrupt under any law in force in Nigeria or any other country;

or

j. has not been a member of the Peoples Democratic Party (PDP) for at least 2 (two) years preceding the primary election, except if waived by the appropriate Executive Committee of the Party;

k. has been convicted for embezzlement or fraud by a court of competent

jurisdiction; 3. (1) The nomination procedure for an aspirant to the office of President of the

Federal Republic of Nigeria in the primary election of the Party shall be as follows:

(a) an aspirant shall obtain the Expression of Interest Form Code PD002/P upon payment of the prescribed non-refundable fee of Two Million Naira (N2,000,000.00) from the National Secretariat of the Party or such other place as may be designated by the National Executive Committee of the Party, and, on completion, return same to the National Secretariat;

(b) an aspirant shall obtain the Nomination Form – Code PD003/P

from the National Secretariat of the Party or such other place designated by the National Working Committee of the Party and evidenced upon payment of the prescribed non-refundable fee of Twenty Million Naira (N20,000,000); save that female aspirants shall be exempt from the payment of the prescribed nomination fee;

(c) be nominated by not less than 60 persons from at least two-

thirds of all the States of the Federation, who shall be registered voters in their respective Local Government Areas and also registered members of the Party;

(d) a copy of the Voter’s Registration Card of the aspirant shall be

attached to the duly completed Nomination Form – Code PDP003/P;

(e) a copy of the Party Membership Card of the aspirant shall be

attached to the duly completed Nomination Form-Code PDP003/P;

(f) duly completed nomination forms shall be accompanied by a

sworn declaration made before a Commissioner of Oaths or Notary Public undertaking to abide by the guidelines, all laws and any rules or regulations made by the Party relating to the conduct of primary elections;

(2) An aspirant shall ensure that all the information supplied by him in the

relevant nomination form are true and correct. Any aspirant who gives false information or makes false declaration in the nomination form shall be disqualified.

(3) The decision of the National Executive Committee of the Party

on all primary election matters shall be final and binding.

(4) a. There shall be a Presidential Screening Committee appointed

by the National Executive Committee on the recommendation of the National Working Committee of the Party, whose sole responsibility shall be to screen presidential aspirants.

b. The Presidential Screening Committee shall consist of a Chairman, a Secretary and 8 members. One shall be appointed from each of the six geo-political zones and two women; one from the

North and one from the South.

c. The result of the screening shall be announced and a copy shall be prominently displayed at the National Secretariat of the Party.

d. Any aspirant aggrieved by the decision of the Presidential

Screening Committee may appeal in writing to the Presidential Screening Appeal Panel within 24 hours or soon thereafter from the time of the announcement of the result of the screening and the Presidential Screening Appeal Panel shall pronounce its decision on the appeal within 48 hours or soon thereafter of the receipt of the petition.

e. Only aspirants cleared by the Presidential Screening Committee or

whose appeal the Presidential Screening Appeal Panel has upheld shall be qualified to participate in the primary elections.

(5) The Presidential Screening Appeal Panel shall consist of the 12 members of the National Working Committee, plus six members of the Board of Trustees, one from each zone and with the National Chairman chairing.

(6) The Presidential primary election shall be by Special Convention using

the modified open secret ballot system and delegates shall emerge as provided for in the Constitution of the Party or the Election Guidelines of the Party.

(7) a. A Special National Convention shall be convened, in

accordance with the Constitution of the Party, on a date and at a venue to be decided by the National Executive Committee of the

Party for the purpose of electing the presidential candidate of the Party.

b. The designated date, time and venue for the Special National

Convention shall be published and made known to members of the Party at least 7 days before the date for the presidential primary election.

c. Accreditation which shall be the first item on the agenda, shall be

the responsibility of the Presidential Election Panel.

d. Voting at the presidential primary election shall be by the modified open ballot system otherwise known as open secret ballot.

e. A delegate, on the receipt of a ballot paper, shall mark it in the

manner prescribed by the Presidential Election Panel in secret and deposit it in the ballot box in the open view of all present at the Special National Convention.

f. No delegate shall vote for more than one aspirant and, where

the votes cast exceed the number of accredited delegates to such an extent as to materially affect the results of the election, the election shall be declared void by the Presidential Electoral Panel and another vote shall be conducted by the Presidential Electoral Panel.

(8) a. The Chief Returning Officer shall, after the counting of the votes, announce the result of the election to the hearing of all present and immediately enter the votes polled by each candidate on Form Code PD004/P.

b. After the votes polled by each candidate have been entered, Form-

Code PD004/P shall be signed and stamped by the Chief Returning Officer. The aspirants or their agents shall also sign, but failure or refusal to sign Form-Code PD004/P by an aspirant or his/her agents shall not invalidate the result contained therein.

c. The Chief Returning Officer shall give to each aspirant or his

agent a copy of the Completed Result Sheet Form-Code

PD004/P after it has been duly signed as provided for in these Guidelines but failure or refusal to collect the result shall not invalidate the result contained therein.

d. Results recorded on ordinary paper or photocopies shall not be

accepted.

e. In a presidential primary election at the Special Convention, the

result shall be ascertained by counting the votes cast for each aspirant and no aspirant shall be declared nominated or elected as the flag bearer of the Party unless he has polled the highest number of the votes cast.

(9) Where, at the end of the first ballot, no winner emerges, by reason of a

tie there shall be a run-off election between aspirants whose votes tie and the aspirant with a simple majority of the votes cast during the run-off shall be returned elected.

(10) a. No result shall be upheld as valid in the presidential primary

election unless the same has been entered on the Result Sheet Form-Code PD004/P and duly signed by the Chief Returning Officer.

b. The Chief Returning Officer shall ensure that copies of completed

result sheets are given to aspirants or their agents, but failure or refusal to collect the result sheets shall not invalidate the result

contained therein.

c. The Result Sheet Form-Code PD004/P shall be signed by the Chief Returning Officer, failing which it shall be deemed invalid unless otherwise approved by the Presidential Electoral Panel.

(11) The National Convention Planning Committee (NCPC) shall be

constituted by the National Executive Committee on the recommendation of the National Working Committee of the Party for the planning and execution of the Special National Convention.

(12) Where, after the successful election of a presidential candidate at the

Special National Convention, the candidate so nominated dies or withdraws, or is otherwise incapacitated, the National Executive

Committee of the Party shall, immediately upon becoming aware of the death, withdrawal or incapacitation summon an Emergency Special National Convention for the purpose of electing or nominating another candidate.

PART IV GUBERNATORIAL PRIMARY ELECTION

(13) An aspirant for the Gubernatorial primary election shall:

a. be a citizen of Nigeria by birth and a registered member of the Party;

b. fulfill all the conditions set out in the Constitution of the Federal

Republic of Nigeria 1999 (as Amended), the Constitution of the Party 2012 (as Amended), the provisions of any other relevant law and these Guidelines;

c. be a registered voter and attach a copy of the voter’s

registration card to the duly completed Nomination Form Code PD003/G;

d. complete and submit the Expression of Interest Form Code

PD002/G; e. resign/retire from office if a political appointee, civil servant,

public servant or party official not later than 7 (seven) days before the date of the collection of forms for the Ward Congresses;

f. possess educational qualification not below the level of Senior

Secondary Certificate or its equivalent; g. have attained the age of thirty five(35) years or above;

(14) An aspirant to the gubernatorial primary election shall not be qualified to

be nominated or to contest the primary election, if he/she:

a. fails to produce his personal income tax certificate, or any evidence that he has paid his income tax for the last preceding years or evidence of exemption from payment of personal income tax; or

b. presents a false birth certificate or declaration of age for the

purpose of the primary elections or for any other purpose; or

c. has been indicted for any misconduct set out in Section 58(1) of the Constitution of the Party and has been punished in accordance with Section 59(1)

d. has been dismissed from the public service of the Federation or

of a State or Local Government or Area Council or from any other employment in the public or private sector; or

e. is a member of a Secret Society; or

f. has been convicted by a court of competent jurisdiction in Nigeria

or within the Commonwealth or elsewhere for any offence involving homicide, fraud or dishonesty or the sale or use of narcotic drugs or any other psychotropic substances; or

g. has been adjudged guilty of treason or treasonable felony by any

court in Nigeria; or

h. under the law in any part of Nigeria, he is adjudged to be lunatic or otherwise declared to be of unsound mind; or

i. is an undischarged bankrupt having been adjudged or otherwise

declared bankrupt under any law in force in Nigeria or elsewhere; or

j. is not a member of the PDP for at least 2(two) years preceding the

election except if waived by the appropriate Executive of the Party.

(15) 1. The nomination procedure for an aspirant to the office of Governor

of a State in the primary election of the Party shall be as follows:

a. an aspirant shall obtain the Expression of Interest Form – Code PD002/G upon payment of the prescribed non-refundable fee of One million Naira (N1,000,000) from the National Secretariat of the Party or such other place as may be designated by the National Working Committee of the Party.

b. an aspirant shall obtain the Nomination Form – Code PD003/G from the National Secretariat of the Party or such other place designated by the National Working Committee of the Party upon payment of the prescribed non-refundable fee of Ten Million Naira (N10,000,000); save that female aspirants shall be exempt from the payment of the prescribed nomination fee;

c. be nominated by not less than 45 persons from at least

two-thirds of the Local Government Areas within the State, who shall be registered voters in their respective Local Government Areas and registered members of the Party.

d. a duplicate copy of both party membership and voter’s

cards of the aspirant shall be attached to the duly completed Nomination Form – Code PD003/G;

e. the duly completed nomination forms shall be accompanied

by a sworn declaration made before a Commissioner of Oaths, or Notary Public undertaking to abide by the guidelines, all laws and any rules or regulations made by the Party relating to the conduct of primary elections.

2. An aspirant shall ensure that all the information supplied by him

in the relevant nomination form are true and correct to the best of his knowledge and belief. Any aspirant who gives false information or makes false declaration in the nomination form shall be disqualified.

3. The decision of the National Executive Committee of the

Party on all primary election matters shall be final and binding.

(16) a. There shall be a Gubernatorial Screening Committee to be appointed by the National Executive Committee of the Party on the recommendation of the National Working Committee of the Party for each of the six geo-political zones whose sole responsibility shall be to screen the gubernatorial aspirants.

b. The Gubernatorial Screening Committee shall consist of a

Chairman and 4 (four) members, at least one of whom shall be a woman. The Zonal Secretary shall serve as the Secretary of the Committee;

c. The result of the Screening shall be announced and a copy

prominently displayed at the State Secretariat of the Party. d. Any aspirant aggrieved by the decision of the Gubernatorial

Screening Committee may appeal in writing to the Gubernatorial Screening Appeal Panel within 24 hours or soon thereafter from the time of the announcement of the result of the screening and the Gubernatorial Screening Appeal Panel shall pronounce its decision on the appeal within 48 hours or soon thereafter of the receipt of the petition.

e. The Gubernatorial Screening Appeal Panel shall consist of a

Chairman and 12 (twelve) other members, two from each of the six geo-political zones, one of whom shall be the National Vice Chairman who shall be appointed by the National Executive Committee on the recommendation of the National Working Committee of the Party.

f. Only aspirants cleared by the Gubernatorial Screening

Committee or whose appeal the Gubernatorial Screening Appeal Panel has upheld shall be qualified to participate in the primary election.

(17) The gubernatorial primary elections of the Party shall be held on a

date approved by the National Executive Committee on the recommendation of the National Working Committee of the Party.

(18) 1. There shall be a State Electoral Panel for each State of the

Federation, which shall consist of five persons appointed by the National Executive Committee on the recommendation of the National Working Committee of the Party as follows:

i. a Chairman

ii. a legal practitioner

iii. a least one woman and

iv. 2 (two) others, one of whom shall be the State Party

Chairman

2. The Chairman of the State Electoral Panel shall be the Chief

Returning Officer for the Gubernatorial Primary Election.

(19) a. The designated venue, date and time for the gubernatorial primary election shall be published and made known to members and aspirants at least 7 (seven) days before the date of the election.

b. The State Electoral Panel shall, for the purpose of the gubernatorial

primary election, appoint such officers as may be required to carry out such duties as may be deemed necessary subject to the approval of the National Working Committee.

c. Accreditation, which shall be the first item on the agenda, shall

be the responsibility of the State Electoral Panel. d. Accreditation shall be between 8.00am and 12 noon and voting

shall commence thereafter or on completion of accreditation. Any delegate or aspirant or aspirant’s agent who arrives after the commencement of voting shall not be accredited or allowed to vote.

e. The number of delegates accredited shall be announced loudly

and clearly before the commencement of the poll.

f. Each accredited delegate shall be assigned an accreditation number/tag by the Electoral Officer at the venue of the Special State Congress.

g. The names of aspirants shall be announced to the hearing of

all present at the Special State Congress. h. Aspirants or their agents shall be present and may bring their

posters to the venue of the Special State Congress to assist the delegates in identifying them. Each aspirant shall be entitled to only one agent.

i. The Chairman of the State Electoral Panel shall be the State

Returning Officer for the purpose of directing and supervising the gubernatorial primary election under these Guidelines.

j. The Returning Officer for the Special State Congress, at the

commencement of the poll, shall cause each ballot box to be opened and shown to the aspirants or their duly accredited agents and to such other persons as may lawfully be present at the Special State Congress venue and shall thereafter seal the ballot box in such a manner as to prevent it from being opened by unauthorized persons and the ballot box shall then be placed in the full view of all present and shall be so maintained until the close of polls.

k. Voting at the gubernatorial primary election shall be modified

open ballot system, otherwise known as the open secret ballot. l. A delegate, an receipt of a ballot paper, shall mark it in secret in

the manner prescribed by the State Election Panel and deposit it in the ballot box in the full view of all present at the Special State Congress.

m. No delegate shall vote for more than one aspirant and where the

votes cast exceed the number of accredited delegates to such extent as to materially affect the result of the election, the election shall be declared void by the State Electoral Panel and another vote shall be conducted by the State Electoral Panel.

n. The result of the gubernatorial primary election, shall be

ascertained by counting the votes cast for each aspirant and no aspirant shall be declared nominated or elected as the flag bearer of the Party in the State, unless he has polled the highest votes cast. The winner shall be declared by the Returning Officer immediately after the election.

(20) a. In accordance with paragraph 19(m) of these Guidelines, where, at the end of the first ballot, no winner emerges, by reason of a tie, there shall be a run-off election between aspirants whose votes tie and the aspirant with a simple majority of the votes cast during the run-off shall be returned elected.

b. After counting the votes, the results shall be publicly announced, and properly entered on the official result sheet Form Code PD004/G and a copy of the result sheet shall be given to each aspirant or his agent.

c. Results recorded on ordinary paper or photocopies shall not be

accepted. d. No result shall be upheld as valid until the same has been

entered on Result Sheet Form – Code PD004/G. e. The Returning Officer shall ensure that copies of completed

result sheets are given to aspirants or their agents but failure or

refusal to collect the result sheets shall not invalidate the result contained therein.

f. The result sheet Form – Code PD004/G shall be signed by the

Returning Officer failing which it shall be deemed invalid unless otherwise approved by the State Electoral Panel.

g. There shall be a Gubernatorial Electoral Appeal Panel

appointed by the National Executive Committee and which shall comprise all members of the National Working Committee.

h. Any aggrieved aspirant shall have the right of appeal in writing to

the Gubernatorial Electoral Appeal Panel within 24 hours from the time of the receipt of the decision appealed against.

i. The Gubernatorial Electoral Appeal Panel shall pronounce its

decision on the appeal within 48 hours of the hearing of the appeal or soon thereafter.

(21) Where, after the successful nomination of a gubernatorial candidate at

the Special State Congress, the candidate so nominated dies, or withdraws or is otherwise incapacitated, the State Executive

Committee of the Party shall, immediately upon become aware of the death, withdrawal or incapacitation, summon an emergency Special State Congress for the purpose of electing or nominating another candidate.

PART V

NATIONAL ASSEMBLY PRIMARY ELECTION

(22) Any aspirant for the primary election to the National Assembly shall:

c. be a citizen of Nigeria; d. fulfill all the conditions set out in the Constitution of the Federal

Republic of Nigeria 1999 (as amended), the Constitution of the Party 2012 (as amended), the provisions of any other relevant law and these Guidelines;

e. be a registered voter and attach a copy of his/her voter’s

registration card to the duly completed Nomination Form Code PD002/NA;

f. complete and submit the Expression of Interest Form – Code

PD002/NA; g. resign/retire from office if a political appointee, civil servant,

public servant or party official not later than 7 (seven) days before the date of the collection of forms for the Ward Congresses;

h. possess educational qualification not below the level of Senior

Secondary Certificate or its equivalent;

i. have attained the age of 35 (thirty five) years in the case of Senate and 30 (thirty) years in the case of House of Representatives;

j. be a duly registered financial member of the Party whose

name is contained in the membership register of the Party; k. in the case of an aspirant for the membership of the Senate, be

nominated by 30 (thirty) persons from at least two-thirds of all the Local Government Areas within the Senatorial District, who shall be registered voters in their respective Local Government Areas within the Constituency, who shall be registered voters in the constituency and also registered members of the Party;

(23) An aspirant shall not be qualified to contest the primary election to

the National Assembly, if he:

(a) fails to produce his personal income tax certificate, or any evidence that he/she has paid his/her income tax for the last preceding three years or evidence of exemption from payment of personal income tax; or;

(b) present a false birth certificate or declaration of age; or (c) has been indicted for any misconduct set out in Section 58(1)

Constitution of the Party and has been punished in accordance

with Section 59(1) (d) has been dismissed from the public service of the Federation or

of a State or Local Government or Area Council or from any other employment in the public or

(e) is a member of a Secret Society; or (f) has been convicted by a court of competent jurisdiction of any

criminal offence involving homicide, fraud or dishonesty or the sale or use of narcotic drugs or any other psychotropic substances by any court of competent jurisdiction in Nigeria or within the Commonwealth or elsewhere; or

(g) has been adjudged guilty of treason or treasonable felony by any court in Nigeria; or

(h) under the law in any part of Nigeria, he is adjudged to be a

lunatic or otherwise declared to be of unsound mind; or (i) is an undischarged bankrupt, have been adjudged or otherwise

declared bankrupt under any law in force in Nigeria or any

other country; or (j) has not attained 2 (two) years as a registered member of the

Party unless there is a waiver by the appropriate Executive Committee of the Party;

(k) has been convicted for embezzlement or fraud by a court of

competent jurisdiction; (24) (1) The procedure for the nomination of an aspirant for the Party’s

primary election into the National Assembly shall be as follows:

a. a copy of the membership card of the aspirant shall be attached to the duly completed Nomination Form – Code PD 003/NA;

b. an aspirant shall obtain the Expression of Interest Form

Code PD002/NA upon payment of the prescribed non-

refundable fee of Five Hundred Thousand Naira (N500,000.00) from the National Secretariat of the Party or such other place as may be designated by the National Executive Committee on the recommendation of the National Working Committee of the Party and upon completion and return of same to the National Secretariat;

c. the nomination forms for the primary election to the National

Assembly shall be obtained from the National Secretariat of the Party upon payment of a non-refundable fee of:

i. Four million naira (N4,000,000.00) for a Senatorial

aspirant; and

ii. Two million naira (N2,000,000.00) for a House of Representatives aspirant;

d. female aspirants are, however, exempt from the

payment of the prescribed nomination fees; e. the duly completed nomination form shall be accompanied

by a sworn declaration by the aspirant made before a

Commissioner of Oaths, or Notary Public undertaking to abide by the guidelines and any rules or regulations made by the Party relating to the conduct of primary elections and Code of Conduct on behavior and directives of the Party for its members in the Senate and/or in the House of Representatives.

(2) All aspirants shall ensure that all the information supplied by them in the relevant nomination forms are true and correct to the best of their knowledge and belief. Any aspirant who gives false information or makes false declaration in the nomination forms shall be disqualified from the primary elections.

(3) The decision of the National Executive Committee of the

Party on all primary election matters shall be final, subject only to the right appeal by any aggrieved aspirant.

(25) i. There shall be for each State of the Federation and the Federal Capital Territory, a Screening Committee of five members (one Chairman and four others) and (at least one of whom shall be a woman) appointed by the National Executive Committee on the recommendation of the National Working Committee of the Party to screen the National Assembly aspirants.

ii. There shall be for each State and the Federal Capital Territory, a

Screening Appeal Panel, which shall comprise of three persons appointed by the National Executive Committee on the recommendation of the National Working Committee of the Party;

iii. Any aggrieved aspirant shall have the right to appeal in writing to the State or FCT Screening Appeal Committee within 24 hours from the time of receipt of the result of the screening;

iv. The State or FCT Screening Appeal Committee shall pronounce

its decision on an appeal within 48 hours or soon thereafter; v. only aspirants cleared by the State or FCT Screening Committee

or whose appeal is upheld by the Appeal Committee shall be allowed to participate in the primary elections.

vi. There shall be for each State of the federation and FCT, a

National Assembly Electoral Panel of five members (one Chairman and four others), appointed by the National Executive Committee on the recommendation of the National Working Committee of the Party.

vii. The Chairman of the National Assembly Electoral Panel shall be

the Returning Officer of the National Assembly Primary Election for that State and FCT;

viii. The National Assembly Electoral Panel shall appoint Returning

Officer for each House of Representatives and Senatorial Constituency and the Returning Officers shall be deployed to constituencies other than those of their origin. The State Executive Committee shall, for this purpose, forward two (2)

names per House of representatives or Senatorial Constituency to the National Assembly Electoral Panel.

ix. There shall be for each State and FCT, a National Assembly

Electoral Appeal Panel, which shall comprise of three (3) persons appointed by the National Executive Committee on the recommendation of the National Working Committee of the Party.

x. Any aggrieved aspirant shall have the right of appeal in

writing to the National Assembly Electoral Appeal Committee within 24 hours from the time of receipt of the decision appeal against.

xi. The National Assembly Electoral Appeal Committee shall pronounce its decision on the appeal within 48 hours of the hearing of the appeal or soon thereafter.

xii. Notwithstanding the provisions of these Guidelines and

any other rules or regulations laid down by the Party, the decision of the National Working Committee acting on behalf of the National Executive Committee shall be final

and binding on all aspirants, officers and organs of the Party in respect of the primary election to the National Assembly on the platform of the Party.

(26) The primary election for the Senate and House of Representatives shall

be held in the following order:

A. (i) In the conduct of primaries for the Party’s candidates for the Senate of the Federation Republic of Nigeria, the primaries shall be held at the Senatorial District Headquarters;

(ii) All the delegates to the Special Congress shall assembly in the Constituency Headquarters.

(iii) The Constituency Headquarters shall be as prescribed

by the Independent National Electoral Commission

B (i) In the conduct of primaries for the Party’s candidates for the

House of Representatives, the primaries shall be held at the Federal Constituency Headquarters.

(ii) All the delegates to the National Assembly Special Congress

shall assemble in the Constituency Headquarters. (iii) The Constituency Headquarters shall be as prescribed

by the Independent National Electoral Commission. (27) The delegates to the Senatorial and House of Representatives Special

Congress shall be all delegates to the State Congress from the respective Senatorial Districts and Federal Constituencies.

(28) (a) Accreditation shall be done by the Returning Officer of the Party and such other persons as may be appointed by the Electoral Panel.

(b) Accreditation shall be the first item on the agenda and shall be

undertaken between 8.00am and 12 noon. Any delegate, aspirant or aspirant’s agent who arrives after the commencement of voting shall not be accredited or allowed to vote.

(c) The number of delegates accredited shall be publicly

announced and entered on the appropriate form designed for that purpose before commencement of the election.

(d) Each accredited delegate shall be assigned an accreditation

number/tag by the Electoral Officer at the venue of the Special Congress.

(e) The names of the aspirants shall be announced to the hearing

of all present. (f) Aspirants or their agents are required to be present and may

bring their posters to the venue of the Special Congress to assist the delegates in identifying them.

(29) (a) All results polled at the National Assembly primary election shall

immediately be announced publicly and thereafter recorded on

the official result sheet Form – Code PD004/NA.

b. Results recorded on ordinary paper or photocopies shall not be accepted.

c. The result sheet Form – Code PD004/NA shall be signed by the

Returning Officer and the aspirants or their accredited agents present, provided that the failure or neglect or refusal to sign the form by an aspirant or his agent shall not invalidate the results.

d. A copy of the Result Sheet Form – Code PD004/NA shall be

signed by the Returning Officer and the aspirants or their accredited agents present, provided that the failure or neglect or

refusal to sign the form by an aspirant or his agent shall not invalidate the result contained therein.

e. No aspirant for the primary election to the Senate or the House of

Representatives shall be declared nominated or elected, unless he has polled the highest votes cast and the winner shall be declared returned by the Chief Returning Officer immediately after the election.

Where at the end of the first ballot, no winner emerges, by reason of a tie, there shall be a run-off election between aspirants whose votes tie and the aspirant with a simple majority of the votes cast during the run-off election shall be returned elected.

f. The result of the accreditation and the total votes recorded shall

tally and shall not exceed the number of delegates accredited.

g. The Chairman and Secretary of the Electoral Panel shall sign and deliver by hand all the results to the respective Zonal Chairman through their various Zonal Headquarters and the Zonal Chairman shall immediately deliver the results by hand to the National Chairman of the Party.

(30) a. No result shall be upheld as valid until it has been entered into the

appropriate Form PD004 designated for it.

b. The Returning Officer shall ensure that copies of duly completed

result sheets are made available to aspirants or their agents.

c. The result sheet Form – Code PD004/NA shall be signed by the Returning Officers and if unsigned, shall be deemed invalid, unless otherwise approved for sufficient cause by the National Working Committee of the Party.

(31) Where, after the successful nomination a National Assembly candidate at

the Special National Assembly Congress, the candidate so nominated dies, or withdraws, or is otherwise incapacitated, the State Executive Committee of the Party shall, immediately upon becoming aware of the death, withdrawal or incapacitation, summon an emergency National

Assembly Special Congress for the purpose of electing or nomination another candidate.

PART VI STATE HOUSES OF ASSEMBLY PRIMARY ELECTION

(32) Any aspirant for the primary election to the State Houses of Assembly shall:

a. be a citizen of Nigeria; b. fulfill all the conditions set out in the Constitution of the Federal

Republic of Nigeria 1999, the Constitution of the Party 2012 (as amended), the provisions of any other relevant law and these Guidelines;

c. be a registered voter and attach a copy of his/her voter’s

registration card to the duly completed Nomination Form Code PD003/SA;

d. complete and submit the Expression of Interest Form – Code

PD002/SA;

e. resign/retire from office if a political appointee, civil servant,

public servant or party official not later than 7 (seven) days before the date of the collection of forms for the Ward Congresses;

f. possess educational qualification not below the level of Senior

Secondary Certificate or its equivalent;

g. have attained the age of 30(thirty) years or above;

h. be a duly registered financial member of the Party whose name is contained in the membership register of the Party;

i. In the case of an aspirant for the membership of the State House

of Assembly, be nominated by 30 (thirty) persons from at least two-thirds of all the Local Government Areas within the

State Constituency, who shall be registered voters in their respective Local Government Areas and also registered members of the Party.

(33) An aspirant shall not be qualified to contest the primary election into the

State House of Assembly, if he: a. fails to produce his personal income tax certificate, or any

evidence that he/she has paid his/her income tax for the last preceding three years or evidence of exemption from payment of personal income tax; or

b. present a false birth certificate or declaration of age; or

c. has been convicted by a court of competent jurisdiction of any

criminal offence involving homicide, fraud or dishonesty or the sale or use of narcotic drugs or any other psychotropic substances by any court of competent jurisdiction in Nigeria or within the Commonwealth or elsewhere; or

d. has been dismissed from the Public Service of the Federation or

of a State or Local Government or Area Council or from any other employment in the public or private sector; or

e. is a member of a Secret Society; or

f. has been adjudged guilty of treason or treasonable felony by

any court in Nigeria; or

g. has been convicted for embezzlement or fraud by a court of competent jurisdiction;

h. under the law in any part of Nigeria, he is adjudged to be a

lunatic or otherwise declared to be of unsound mind; or

i. is an undischarged bankrupt, having been adjudged or otherwise declared bankrupt under any law in force in Nigeria or any other country; or

j. has not attained 2(two) years as a registered member of the Party unless the appropriate Party Executive Committee rules to the contrary (waiver).

(34) 1. The procedure for the nomination of an aspirant for the Party’s

primary election into the State Assembly shall be as follows:

a. an aspirant shall obtain the Expression of Interest Form

Code PD002/SA upon payment of the prescribed non-refundable fee of Two Hundred Thousand Naira (N200,000.00) from the National Secretariat of the Party or such other place as may be designated by the National Executive Committee on the recommendation of the National Working Committee of the Party;

b. a copy of the voter’s and membership cards of the aspirant

shall be attached to the duly completed Nomination Form – Code PD003/SA;

c. the Nomination Form – Code PD003/SA shall be issued to a

male applicant on payment of a non-refundable fee of One Million naira (N1,000,000.00);

d. female aspirants are, however, exempt from the payment

of the prescribed nomination fees;

e. be nominated by twenty (20) registered voters from at

least two-thirds of all the wards within his constituency and who are registered members of the Party;

f. the duly completed Nomination Form – Code PD003/SA shall be

accompanied by a Sworn Declaration by the aspirant made before a Commissioner of Oaths, or Notary Public, undertaking to abide by the guidelines and any rules or regulations relating to conduct of primary elections issued by the Party;

2. An aspirant shall ensure that all the information supplied by him

in the relevant Nomination Form – Code PD003/SA are true and

correct to the best of his knowledge and belief. Any aspirant who gives false information or makes false declaration in the Nomination Form Code PD/003/SA shall be disqualified;

3. The decisions of the National Executive Committee of the

Party on the recommendation of the National Working Committee on all primary election matters shall be binding on all aspirants, subject only to the right of appeal by any

aggrieved aspirant.

(35) a. Primary election for the candidate of the Party into a State House of Assembly shall be held on the date appointed by the National Executive Committee of the Party.

b. The Special Congress for the election of the candidate shall be

constituted by all delegates to the State Congress from the State Assembly Constituency and other members of the Local Government Executive Committee from the State Assembly Constituency who are not delegates to the State Congress.

(36) a. There shall be, for the purposes of the primary election, a State

Screening Panel whose duty shall, among other things, include the screening of aspirants from that State.

b. The State Screening Committee shall comprise of five persons as

follows:

(i) a Chairman and two others appointed by the National

Working Committee of the Party; and (ii) two persons appointed by the State Executive

Committee who shall be posted to serve in States other than their own.

c. There shall be for each State, a State Screening Appeal Panel which

shall comprise of three persons appoint by the National Working Committee of the Party.

d. Any aggrieved aspirant shall have the right to appeal in writing to the State Screening Appeal Panel within 24 hours from the time of receipt of the result of the screening.

e. The State Screening Appeal Panel shall pronounce its decision on

an appeal within 48 hours or soon thereafter.

f. Only aspirants cleared by the State Screening Committee or whose

appeal is upheld by the Appeal Committee shall be allowed to participate in the primary elections.

(37) a. There shall be a State Electoral Panel composed of five persons

for each State as follows: i three persons appointed by the National Working Committee

one of whom shall be the Chairman, and

ii. two other persons appointed by the State Executive Committee, (one of whom shall be a legal practitioner).

b. The names of the two persons so appointed shall be submitted

to the National Working Committee for posting to constituencies other than their own.

c. The Chairman of the State Electoral Panel shall be the Returning

Officer for the State House of Assembly Primary election.

(38) The State Electoral Panel shall appoint Returning Officers for each

State House of Assembly Constituency and the Returning Officers shall be deployed to Constituencies other than their own. Each Local Government Executive Committee shall, for this purpose, forward two names to the State Electoral Panel.

(39) a. The venue for the primary election shall be the State Assembly

Constituency Headquarters as the case may be or any other suitable venue earlier approved in writing by the state electoral panel.

b. Any official change of venue shall made public by means of

written publication and announcements in the electronic media

not later than 3 (three) days to the commencement of the primary election.

c. Where a change of venue is not published to the public as stated in

these guidelines, it may be a ground to void the election conducted therein.

(40) a. Accreditation shall be done by the Returning Officer of the

Party and such other persons as may be appointed by the State Electoral Panel.

b. Accreditation shall be the first item on the agenda and shall be

undertaken between 8.00am and 12 noon or on completion of accreditation. Voting shall commence at 12.00 noon or soon thereafter. Any aspirant, aspirant’s agent of delegate who has not arrived at the election venue before the completion of accreditation shall not be admitted to take part in the election.

c. The number of delegates accredited shall be announced publicly

before commencement of the election.

d. The names of the aspirants shall be announced to the hearing of all present

e. Each accredited delegate shall be assigned an accreditation

number/tag by the Electoral Officer at the venue of the Special

Congress

f. Aspirants or their agents are required to be present and may bring their posters to the venue of the Special Congress to assist the delegates in identifying them.

(41) a. All the results of the election shall be publicly announced and

properly recorded and entered on the official result sheet Form – Code PD004/SA.

b. A copy of the result shall be given to each aspirant or his agent and a

copy sent to the State Electoral Panel but failure or refusal to collect the result shall not invalidate the result contained therein.

c. An appeal may be made by an aggrieved aspirant in writing to the State Electoral Appeal Committee against the decision of the State Electoral Panel within 24 hours of the time of the receipt of the decision appealed against.

d. There shall be for each State and FCT, a State Assembly Electoral

Appeal Panel, which shall comprise of three (3) persons appointed by the National Executive Committee on the

recommendation of the National Working Committee of the Party.

e. The State Electoral Appeal Committee shall pronounce its decision on the appeal within 48 hours of the hearing of the appeal or soon thereafter.

f. Notwithstanding the provisions of these Guidelines and any

other rules or regulations laid down by the Party, the decision of the National Executive Committee as advised by the National Working Committee shall be final and binding on the aspirants, officers and organs of the Party in respect of the primary election to a State House of Assembly on the platform of the Party.

g. Where there is only one aspirant, election shall nevertheless be

held to confirm the nomination of the aspirant and in this case, there shall be the number of “no” votes and the “yes” votes.

(42) The aspirant with the highest votes cast shall be declared winner and returned immediately after the election by the State Constituency Returning Officer. Where no winner emerges at the end of the first ballot by reason of a tie, there shall be a run-off election between aspirants whose votes tie and the aspirant with a simple majority of the votes cast during the run-off shall be returned elected.

(43) (a) No result shall be regarded as valid until the same has been entered on Form-Code PD004/SA for it.

(b) Results recorded on ordinary paper or photocopies shall not be

accepted.

(b) Returning Officer shall ensure that copies of duly completed result sheets are given to aspirants or their agents and that the aspirant or his agent signs.

(c) The Refusal, neglect or failure of an aspirant or his agent to

sign a result sheet shall not invalidate the result of the primary election.

(d) The result sheet Form Code PD004/SA shall be signed by the Returning Officer and where it is submitted unsigned, the result shall be held invalid, unless otherwise approved by the National Executive Committee on the recommendation of the National Working Committee of the Party.

(44) Where, after the successful nomination of a National Assembly candidate

at the Special National Assembly Congress, the candidate so nominated dies, or withdraws, or is otherwise incapacitated, the State Executive Committee of the Party shall immediately upon becoming aware of the death, withdrawal or incapacitation, summon an emergency National Assembly Special Congress for the purpose of electing or nominating another candidate.

PARTY VI

GENERAL PROVISIONS (45) Subject to the provisions of the Constitution of the Federal Republic of

Nigeria 1999 (as amended), any aspirant who is a political appointee, civil servant, public servant or party official shall resign from such office not later than 7 (seven) days before the date of the collection of

forms for the Ward Congresses.

(46) a. Any officer or member of the Party who fails, refuses or neglects to carry out his duties in relation to these Guidelines on the general conduct of the primary elections or who obstructs, flouts, or in any manner hinders, impedes or subverts the implementation or success of these Guidelines is guilty of gross misconduct and shall be brought before the National Disciplinary Committee of the Party for disciplinary action.

b. Under no circumstances shall an elected official of the Party, at

any level, be appointed to perform the job of a polling agent. c. It is mandatory for every Returning Officer in each of the primary

elections other than the Presidential Primary, to submit the results to NWC within 48 hours of the conclusion of voting.

(47) a. There shall be a Zonal Monitoring Team for each Zone made up

of 10-14 (ten to fourteen) persons appointed by the National Executive Committee of the Party, whose function shall be to monitor all aspects of the primary elections in all the States comprised in the Zone and the Federal Capital Territory.

b. Each monitoring team shall submit a report to the National

Secretariat of the Party through the Zonal Headquarters which shall, in turn, send the report to the National Headquarters within 48 hours of the conclusion of the polls or soon thereafter as circumstances may permit.

c. The monitoring report shall be addressed to the National Chairman.

(48) a. The National Executive Committee on the recommendation of the

National Working Committee shall appoint Screening Panels, Screening Appeal Panels, Electoral Panels and Electoral Appeal Panels to handle the affairs of the Presidential, Gubernatorial, National Assembly and State Assembly Primaries.

b. For the purpose of Gubernatorial primaries as they relate to the conduct of primary elections, the National Working Committee, Six National Vice Chairmen, plus six members of the Board of Trustees, one per zone shall constitute the Appeal Panel to hear and determine cases/petitions arising from the exercises.

c. The National Working Committee plus six members of the Board

of Trustees, one per zone shall constitute itself into the Appeal Panel to hear and determine cases cum petitions arising from the Presidential Screening Exercise.

d. Any complaints, disputes or petitions arising from the screening or

elections or their conduct shall be submitted to the Electoral Appeal Panels at the appropriate levels in writing within 24 hours of

completion of the primary elections.

e. Before deciding on any matter, the Electoral Appeal Panels shall give an opportunity to the parties concerned to present their respective cases and shall communicate their decisions to the aspirants in writing within 48 hours of the determination of the disputes or soon thereafter as circumstances may permit.

f. Notwithstanding the provisions of the Guidelines and any

other rules or regulations laid down by the Party, the decision of the National Executive Committee as recommended by the National Working Committee shall be final and binding on all aspirants, officials and organs of

the Party with respect to the eligibility or otherwise of an aspirant.

(49) The National Chairman and the National Secretary of the Party

shall convey all the final result of the primary elections as approved by the National Executive Committee of the Party containing a detailed list of Party candidates for various elective public offices to the Independent National Electoral Commission

(INEC). (50) The National Executive Committee on the recommendation of

the National Working Committee may substitute the name of a candidate earlier submitted to the Independent National Electoral Commission (INEC) if the nominated candidate dies or withdraws.

(51) Any reference to Senatorial District, Federal Constituency or Wards and

Local Government Area in these Guidelines shall apply to the Senatorial District, Federal Constituency, Wards and Area Council in the Federal Capital Territory, Abuja.

(52) Nomination Fee: 15% of the nomination fee shall be remitted to the

State Chapters of the Party and 5% to the Zone.
