ATHENS BANNER-HERALD

Founded in 1832, the Athens Banner-Herald's roots trace back to one of the state's oldest newspapers, the Southern Banner. It merged with the Herald in 1921 and was purchased by William S. Morris III in 1965 as it was emerging as one of the finest newspapers in the state. It excelled beyond its competition in content, technology and print methods.

The Daily News began as a converted weekly that had once been a shopper. The Athens Advertiser, as it was called before it became a daily, became an instant sensation with readers. In 1967 Morris Communications Corporation purchased the Daily News, and the morning and afternoon papers in Athens were brought together under one roof.

In May 2001, the two papers were merged into one paper - the resulting newspaper was a redesigned morning paper named the Athens Banner-Herald. Its current circulation is between 14,500 and 18,000 daily and 24,000 Sunday, and its website, OnlineAthens, averages almost 8 million page views in a given month.

ATHENSThe quintessential southern city, Athens is located in Northeast Georgia, 61 miles outside of Atlanta. While very well known as the home of the University of Georgia, Athens continues to rank as one of the Coolest Small Cities in America by GQ Magazine. Other rankings include: One of the 25 Best Places to Retire (CNN Money October 2012); one of the Top 10 College Towns (Livability.com, 2012); 1st of the Top 10 Cities with the Best Music Scenes Outside of Nashville, NYC, and LA (Livability.com, March 2012); 12th in the Top 25 Arts Destinations (AmericanStyle Magazine, 2011); and America’s #1 College Music Scene (Rolling Stone Magazine, 2003).1

OCONEEFormed in 1875, Oconee County has been fueled by a strong community, rich agricultural lands, and an educated approach to economic development. Progressive Farmer Magazine has named it “The Best Place to Live ... Raise a Family” (2006 - 2009).

Oconee County is known for its educational success in the state of Georgia, boasting the 11th best high school in Georgia, as reported by U.S. News and World Report (2012)3.

UNIVERSITY OF GEORGIAAthens was no more than a trading settlement on the banks of the Oconee River called Cedar Shoals during the late 1700s. But by 1801 the University of Georgia had been chartered as the first state-supported university in the United States and John Milledge named the land Athens, in honor of the Greek city that was the center of culture and learning during ancient times. The first class from the University of Georgia graduated on May 31, 1804.4

The University of Georgia is ranked in the 2013 edition of the Best Colleges and Universities by U.S. News and World Report as the 21st Top Public University in the country, with renowned graduate programs in its College of Veterinary Medicine (9th), College of Education (38th), and Law School (34th).5 But perhaps, the University of Georgia is best known for its outstanding athletic programs, including the 2012 SEC East Champion Georgia Bulldogs football team.

GENERAL INSTRUCTIONSThese rates apply to all Athens Banner-Herald products that accommodate inserts. Zoning* is available. Inserts are to be scheduled 14 days in advance of desired insert date. Inserts are to be delivered to the newspaper at least 10 days prior to insertion. Discounts are based on the number of insert run dates per year. Written agreements are available from your ad representative. The quantity of inserts billed to the advertisers may vary based upon the actual circulation or the number of inserts distributed within the geographic area that the advertiser has designated to receive the advertising message. The actual circulation may vary from time to time and may differ from published circulation figures. The actual number of inserts to be billed to the advertiser will be furnished by the publisher’s representative prior to publication.

POLICY – ALL CLASSIFICATIONS30-day notice given on any rate revisions. All orders and/or agreements are subject to this notice. Alcoholic beverage advertising accepted. Retail rates apply to permanent business establishments located within the Athens retail trade area. General rates apply to all non-retail advertisers, retailers with more than one signature in ad or no local address plus retailers located outside the retail trade area. All mail order advertising is also billed at the General rate. CONTRACT AND COPY REGULATIONSRoll Over Clause – This agreement will automatically be renewed for the same successive periods unless (a) the Agreement is cancelled by either party in writing at least thirty (30) days prior to any twelve month anniversary date, or (b) the Advertiser fails to meet the lineage/revenue requirement in any year, in which case the publisher may cancel the Agreement without notice, or may renew the Agreement at its discretion. If Publisher amends its Rate Card, Advertiser may, within thirty (30) days from said notice, cancel the remaining term of this Agreement by giving written notice of its decision to cancel. In the even that this contract is not fulfilled, all inches run will be re-figured at the appropriate rate on the current rate card and if there is any difference, the difference will be billed to the above account as a short rate. This agreement shall not be assigned or amended without the prior written consent of all undersigned parties. Contract rates do not apply toward employment ads.A. This contract covers all advertising space utilized in the products of Athens Newspapers, LLC, as stated in the current advertising rate book.B. All contracts must be in writing, duly signed and dated by an authorized representative of both the advertiser and publication, in order for the advertiser to receive contract rate discounts.C. This contract must be signed and returned within thirty (30) days of the effective date. Failure to do so will result in any pending re-rates being forfeited.D. A contract is not assignable by an advertiser to another person or firm. Orders for space for periods longer than a contract year are not acceptable. Open rate contracts are not acceptable.E. Two or more companies may not advertise under a single contract except in cases where one firms owns one or more subsidiary companies and the advertising contract is signed by the parent firm. Billing will be sent to one location only when a contract includes subsidiaries.F. A contract is subject to rejection at the options of the Publisher unless the insertion schedule has commenced within 30 days from the date the contract was accepted.G. This contract cannot be invalidated by wrong insertions or omission. In the event publication is interrupted for any reason, or if advertising to be published is omitted, the publisher shall not be held liable for failure to publish advertising.H. There may be a charge for advertising space reserved if the advertisement is cancelled after the advertising space reservation deadline. This applies to all Athens Newspapers Inc. publications.I. The Publisher reserves the right to edit or reject any copy, including that which, in its sole opinion, is not in the best interest of its readers or public decency. All contracts and orders are subject in all respects to the Publisher’s rules and regulations on content of advertising matter, make-up and availability of advertising space.J. The Publisher reserves the right to insert above any copy the word “advertisement” one or more times if the advertisement could be construed by the reader as news or editorial content. “Advertisement” will not be set in the typeface used in editorial columns.K. The Publisher’s liability for any error shall not exceed the cost of space occupied by the error and under no circumstances shall the Publisher be liable for any consequential damages. Credit will be allowed for the first insertion only. Claims for allowances for errors must be made within ten (10) days of insertion. Notice of typographical errors must be given in time for correction before the second insertion, otherwise no claim for the repetition of the error shall be allowed. Allowance is not made for errors that do not materially affect the value of the advertisement. In the event of a typographical error advertising goods and services at less than the proper price, the Publisher will, on request, furnish letters to be posted in the store stating the correct price. Goods may not be sold at the incorrect price printed in the advertisement with intent to charge the difference to the Publisher. The Publisher shall not be liable for errors unless a corrected proof is returned by the specified proof release deadline.L. The Publisher will not be responsible for any errors when correct proof of advertisement does not accompany insertion order or for insertion of incorrect material supplied by a third party.M. The Publisher’s schedule of copy and proof deadlines must be observed in order to assure publication. NO adjustment, refund, or reinsertion will be allowed for errors or omission as a result of corrections furnished by advertiser after specified proof release deadlines. Only one proof service is furnished.N. The Publisher will not be responsible for typographical accuracy of copy received for publication after proof/copy deadline.O. The Publisher will not be responsible for illustration material, drawings or photographs not called for within 30 days after date of insertion.P. Key numbers and/or reference lines in advertisements are accepted at advertiser’s risk.Q. Athens Newspapers, LLC reserves the right to insert an ad number for tracking purposes in the bottom left corner of all advertisements appearing in our publications.R. The Publisher assumes no responsibility for improper use or redemption of coupons forming part of an advertisement.S. The forwarding of an order will be construed as an acceptance of all rates and conditions currently in effect. Failure to make the order correspond in rate, or otherwise, with the rate schedule in force will be regarded as a clerical error, and publication will be made and charged for upon terms of the rate schedule in force without further notification. T. Orders containing a provision that advertising shall not appear in proximity to or to the exclusion of other advertising cannot be accepted. The Publisher’s advertising columns are open to competition of all legitimate advertisers. Specifications on orders restricting the kinds of news on any page are treated as requests only. U. Orders requiring specific position or authorizing insertions with proviso “or omit” cannot be accepted. Positions may be requested on any page on which advertising is acceptable and will be filled, if possible, depending upon editorial make-up and advertising space requirements. The Publisher will not honor claims for adjustment, refund or reinsertion because of the position in whish can advertisement has been published.V. Advertiser agrees to assume sole responsibility for statements contained in the copy and to protect and hold harmless the Publisher against any and all liability, loss or expenses including attorney’s fees arising out of claims for libel, unfair trade practices, unfair competition, infringement of trademarks, names of patents, copyrights and proprietary rights and all violations of the right of privacy resulting from the publication by the Publisher of the advertiser’s copy.W. Composition charges may be assessed for advertisements requiring extensive proof revisions.X. Claims for errors in invoices must be made within thirty (30) days of the date of invoice. Otherwise such claims will not be considered.Y. It is expressly understood and agreed that the Publisher reserves the right to cancel advertising at any time upon failure if the advertiser to meet any of the conditions stated in the current rate book or in this contract or upon default by the advertiser in the payment of invoices. Upon such cancellation, all advertising published there under and unpaid shall become immediately due and payable.Z. Rates on retail or classified sections are not subject to advertising agency commission.AA. Political advertising must be paid by cash in advance. Political ads must carry the name of the person responsible for the advertisement. If placed by a committee or group, then the name of the committee plus one of the officials of the group must be included. BB. Payment is due with acceptance of advertising unless credit has been established. When credit is established, payment is due on the 30th of the month following publication. CC. Advertising orders which contain “Sequential Liability” clauses will be rejected.
