6.3 The Legal Landscape of Same-Sex Marriage: The Impact on Life InsurersOn July 26, 2013, the Supreme Court issued its decision in U.S. v. Windsor, which declared a section of the Defense of Marriage Act (DOMA) to be unconstitutional. The result is that the Federal government must recognize valid same-sex marriages for Federal purposes. This session will describe the current rules, including guidance issued and guidance still needed from IRS, Treasury, and Department of Labor, and reactions from state insurance regulators.
