WhatistheCleryAct?
Signedintolawin1990,theJeanneCleryDisclosureofCampusSecurityPolicyandCampusCrime
StatisticsAct is a federal law that requires collegesanduniversities todisclose informationabout
campuscrimeactivityandsecuritypoliciesinanannualreport.Informationdisseminatedinaccord‐
ancewithCleryActguidelinesservestoinformthepersonalsafetyandcollegeselectiondecisionsof
currentandprospectivecampuscommunitymembers.Allpost‐secondarypublicandprivateinstitu‐
tionsparticipatinginfederalstudentaidprogramsmustadheretoCleryregulations.
TheCleryActwas championedbyHoward&ConnieClery after their daughter, Jeanne,wasmur‐
deredatLehighUniversityin1986.Jeanne’sparentsbelieveshewouldhavebeenmorecautiousif
shehadknownaboutotherviolentcrimesatheruniversity.

InaccordancewiththeJeanneCleryDisclosureofCampusSecurityPolicyandCampusCrimeSta‐
tisticsActof1998,FAMUDCSSmustkeepacrimelogofallreportedcrimesthatoccuronandnear
propertyownedorcontrolledbyFloridaA&MUniversity for themostrecent60‐dayperiod.The
logliststhe natureofthe crime,the date, time and generallocation, aswell as the disposition of
the complaint if known. Entries orupdatesmay bewithheld if the information isprotected by
statute,orifthere isadangertothevictimora needto keepthe investigationcon idential.Ifthere
isreasontobelievethe releaseof informationwillresultintheperpetrator leeingthearea,orthat
evidencewillbedestroyed,the informationalsomaybewithhelduntilthejeopardy nolongerex‐
ists.Additionally,theUniversitymustkeepa irelogofallreported iresthatoccurinon‐campus
studenthousingfacilitiesforthemostrecent60‐dayperiod.TheRecordsOf iceisopentothepub‐
licMondaythroughFriday,8:00a.m.to4:00PM(closedbetween12:00PMto12:30PMandholi‐
days).

Incompliancewiththe“TimelyWarning”provisionsofthefederalJeanneCleryDisclosureof
CampusSecurityPolicyandCrimeStatisticsActof1998,FloridaA&MUniversityissuestimely
warningstotheentirecampuscommunitywhenthereisinformationthataCleryCrimehasoc‐
curredonorneartheUniversitythatisconsideredbytheinstitutiontorepresentaseriousor
continuingthreattocampussafety.
TheChiefofPoliceordesignee,withconsultationwithUniversity senior leadership,makes the
decisionwhether to issuea timelywarningona case‐by‐casebasis in lightof all the facts sur‐
rounding the incident.Timelywarnings are issuedas soonaspossible after theDepartmentof
CampusSafety&Securityisnoti ied;however,thereleaseofthewarningissubjecttotheavaila‐
bilityofaccuratefactsconcerningtheincident.

nitywithmoreimmediate noti ication.Anyone withinformation warrantingatimelywarning
should report the circumstances to the Departmentof Campus Safety & Security by
phone 850‐599‐3256, or in person at campus police headquarters at 2400 Wahnish Way,

Onthemaincampus (Tallahassee), when noti ication is necessary due to an immediate and seriousthreatto public safety, the campus community will also bealerted through its Emergency Siren Sys‐tem, whichdelivers anaudibletonefollowed bya voicemessage tothe community ofthe immediatethreat.Therearetwo sirens locatedonthe Band PracticeFieldandbehindthe Dyson Pharmacy Build‐ing,wh ich are used to alert the campus community totake precaution in the event of severeweather or life safetyissues.
Emergency“BlueLights”TelephoneSystem
TheDepartmentofCampusSafety&SecuritymonitorstheUniversity’sEmergencyBlueLightSystemtofacilitate reporting of emergencies. The Blue Light System is an interactive communications system,whichwhenactivated,automaticallyrelaysthegeographicallocationofthecallertothePoliceCommu‐nicationsCenter.BlueLightsarestrategicallylocatedthroughoutthecampusandareroutinelytestedtoensurereadiness.
Closed Circuit Television (CCTV)
Thereareover100CCTVcameras,strategicallyplacedthroughouttheuniversitycampus,inoperation24‐hoursaday.

EmergencyResponseandEvacuationProcedures
TheOf iceofEmergencyManagementassistsdepartmentsandcampuseswithdeveloping,maintaining,
and implementing emergencyoperationsplans, developing and conductingexercise, hazard and risk
education,andbuildingpartnershipswithexternal responseagencies.TheOf iceofEmergencyMan‐
agementisresponsibleforassistingwithandcoordinatingtheUniversity’soverarchingmitigation,pre‐
paredness,responseandrecoveryprograms.
Florida routinely faces tornados, hurricanes, and severe
lightningstorms, alongwithever present risksof hazard‐
ous materials and civilunrest.Plansarethereforedevel‐
oped to addressthose emergencysituationsaswell. The
Department followsestablishedUniversitypolicies and
procedures in theevent of a signi icant emergency or
dangeroussituationoncampus.Upon con irmation that
an emergencysituation exists and an initial assessment ismade,police personnelwill take immedi‐
ate control ofthescene and initiateallstandardresponseprocedures.Theseprocedurescall for the
noti ication of the appropriate agencies/personnel to assist in containingthe threat or imple‐
mentingevacuationmeasuresifwarranted.
Note: At all times, community safety will dictate thecontent/method ofnoti ication.Anoti ication
willnotbeissued whenbydoingso, it compromises efforts toassist a victim, to conduct an ade‐
quate and competent criminal investigation, or to contain, respond to,orotherwisemitigatethe
emergency.
Studentsandemployeesarenoti iedoftheemergency viaBlackboardConnectEmergency
AlertNoti icationSystem,FederalWarning Siren System, UniversityE‐MailAccounts,

CRIMEEDUCATIONALPROGRAMS/PREVENTIONSERVICESThe Department of Campus Safety & Securitymaintains several programs to inform stu‐dentsandemployeesaboutcampussecurityproceduresandtoencourageresponsibilityfortheirsafetyandthatofothers.Duringorientationsandthroughout theyear,studentsandtheir parents are presented with information on police services, property safety, hazing,personal safetyandsexualassaultpreventionbymembersof theDepartment.CrimePre‐ventionProgramsandSexualAssaultPreventionProgramsareofferedonacontinualbasisduringtheyearbylawenforcementof icialsandotheron‐campusgroups,suchasResidentLife, Student Health Services and student groups. STATEOFFLORIDASTATUTES
1006.63 Hazingprohibited.—(1) Asusedinthissection,“hazing”meansanyactionorsituationthatrecklesslyorinten‐tionallyendangersthementalorphysicalhealthorsafetyofastudentforpurposesinclud‐ing,butnotlimitedto,initiationoradmissionintooraf iliationwithanyorganizationoper‐atingunderthesanctionofapostsecondaryinstitution.“Hazing”includes,butisnotlimitedto,pressuringorcoercingthestudentintoviolatingstateorfederallaw,anybrutalityofaphysicalnature,suchaswhipping,beating,branding,exposuretotheelements,forcedcon‐sumptionofanyfood,liquor,drug,orothersubstance,orotherforcedphysicalactivitythatcouldadverselyaffectthephysicalhealthorsafetyofthestudent,andalsoincludesanyac‐tivity thatwould subject the student toextrememental stress, suchas sleepdeprivation,forcedexclusionfromsocialcontact,forcedconductthatcouldresultinextremeembarrass‐ment,orotherforcedactivitythatcouldadverselyaffectthementalhealthordignityofthestudent. Hazing does not include customary athletic events or other similar contests orcompetitionsoranyactivityorconductthatfurthersalegalandlegitimateobjective.(2) Apersoncommitshazing,athirddegreefelony,punishableasprovidedins.775.082ors.775.083,whenheorsheintentionallyorrecklesslycommitsanyactofhazingasde‐inedinsubsection(1)uponanotherpersonwhoisamemberoforanapplicanttoanytypeofstudentorganizationandthehazingresultsinseriousbodilyinjuryordeathofsuchoth‐erperson.(3) A person commits hazing, a irst degreemisdemeanor, punishable as provided in s.775.082ors.775.083,whenheorsheintentionallyorrecklesslycommitsanyactofhazingasde inedinsubsection(1)uponanotherpersonwhoisamemberoforanapplicanttoanytypeofstudentorganizationandthehazingcreatesasubstantialriskofphysicalinjuryordeathtosuchotherperson.(4) Asaconditionofanysentenceimposedpursuanttosubsection(2)orsubsection(3),the court shall order the defendant to attend and complete a 4‐hour hazing educationcourseandmayalsoimposeaconditionofdrugoralcoholprobation.(5) Itisnotadefensetoachargeofhazingthat:(a) Theconsentofthevictimhadbeenobtained;(b) Theconductoractivitythatresultedinthedeathorinjuryofapersonwasnotpartofanof icialorganizationaleventorwasnototherwisesanctionedorapprovedbytheorgani‐zation;or(c) Theconductoractivitythatresultedindeathorinjuryofthepersonwasnotdoneasaconditionofmembershiptoanorganization.(6) Thissectionshallnotbeconstruedtoprecludeprosecutionforamoregeneraloffenseresultingfromthesamecriminaltransactionorepisode.(7) Public andnonpublic postsecondary educational institutionswhose students receivestate student inancialassistancemustadoptawrittenanti‐hazingpolicyandundersuchpolicymustadoptrulesprohibitingstudentsorotherpersonsassociatedwithanystudentorganizationfromengaginginhazing.

impositionof ines;thewithholdingofdiplomasortranscriptspendingcompliancewiththerules
orpendingpaymentof ines;andtheimpositionofprobation,suspension,ordismissal.
(b) InthecaseofanorganizationataFloridaCollegeSysteminstitutionorstateuniversitythat
authorizeshazinginblatantdisregardofsuchrules,penaltiesmayalsoincluderescissionofper‐
mission for thatorganization tooperateon campuspropertyor tootherwiseoperateunder the
sanctionoftheinstitution.
(c) Allpenaltiesimposedundertheauthorityofthissubsectionshallbeinadditiontoanypenalty
imposedforviolationofanyofthecriminallawsofthisstateorforviolationofanyotherruleof
theinstitutiontowhichtheviolatormaybesubject.
(9) Rulesadoptedpursuantheretoshallapplytoactsconductedonoroffcampuswheneversuch
actsaredeemedtoconstitutehazing.
(10) Uponapprovaloftheanti‐hazingpolicyofaFloridaCollegeSysteminstitutionorstateuni‐
versity and of the rules and penalties adopted pursuant thereto, the institution shall provide a
copyofsuchpolicy,rules,andpenalties toeachstudentenrolled inthat institutionandshallre‐

(1) Florida Agricultural andMechanical University (“University”) strictly prohibits any student
(s),group(s)ofstudents,orstudentorganization(s)af iliatedwiththeUniversityfromengaging
inany form(s)ofhazingactivities.Moreover, theUniversityhaszero tolerance forviolationof
anyprovisionsoftheAnti‐hazingRegulation2.028.“Zerotolerance”meansthatgiventhefactual
circumstances of the alleged violation, the charged student may be removed from University
HousingandreceiveapenaltyuptosuspensionorexpulsionfromtheUniversity.
(a)DueprocessprotectionsinaccordancewithUniversityRegulation2.013willbeappropriately
accordedthechargedstudent.
(b) “Student” isgiven thesamemeaninghereinas it isde ined in theStudentCodeofConduct,
Regulation2.012.
(c)“Engaging”isde inedhereinandprohibitedbythisRegulationasanyonewho(i)perpetrates
hazingactivitiesbyplanningand/or executing thehazingactivities; (ii) is theobjectof or con‐
sentstohazingactivities;or(iii)observesorhasknowledgeofhazingactivitiesandfailstoreport
theincidentwithintwenty‐four(24)hoursasrequired.
(d)ThisRegulationisincorporatedintoUniversityRegulation2.012.
(2)Thetermhazingshall include,butnotbe limitedto,pressuringorcoercingthestudent into
violatingstateorfederal law,anybrutalityofaphysicalnature,suchasstriking inanymanner,
whipping,beating,branding,exposuretotheelements,forcedconsumptionoffood,liquor,drugs,
orothersubstances,orotherforcedphysicalactivitiesthatwouldadverselyaffectthehealthor
safety of the student and also includes any activity thatwould subject the student to extreme
mentalstress,suchassleepdeprivation,forcedexclusionfromsocialcontacts,forcedconductthat
wouldbedemeaningorresultsinextremeembarrassmentoranyotherforcedactivitythatcould
adverselyaffect thementalhealthordignityof thestudent.Hazingdoesnot includecustomary
athleticeventsorothersimilarcontestsorcompetitionsoranyactivityorconductthatfurthersa
legalandlegitimateobjective.Forpurposesofthissection,anyactivityasdescribedabove,orany
actionorsituationthatrecklesslyorintentionallyendangersthementalorphysicalhealthorsafe‐
tyofastudentforpurposes,including,butnotlimitedto,initiationoradmissionintooraf iliation
withaUniversitysanctionedorganization,shallbepresumedtobehazinganda“forcedactivity.”

The Department of Campus Safety & Securi-ty Office of Transportation & Office of Park-ing & Transportation will launch its initiative to transition to a “Virtual" Parking Permit. Beginning fall 2015, parking permits will be associated with a vehicle’s license plate ra-ther than a traditional windshield sticker or hangtag. All faculty and staff will be re-quired to register their vehicle information (a max of two vehicles). Sophomores, juniors, seniors, and graduate students with a vehicle will be required to register their vehicle information (a max of one vehicle). Effective September 30, all cur-rent student and faculty/staff permits (ARP, ARP-HC, GAT, and EMP) will become inva-lid and the new registration system (License Plate Recognition) will take effect along with parking enforcement (Ticketing, Towing, and/or Booting) on October 5. The tentative start date for the License Plate Recognition (LPR) online system will be on or before September 25. We thank you for your patience as we transi-tion to this new and improved permit man-agement system.

Q. What is the Transportation Access Fee applied to? A. The transportation access fee of $65.00 for Fall/Spring Semester and $33.00 for Summer Semester provides parking permits, the Venom Express bus system, and parking lot and garage maintenance and upkeep. Q. Where can I park my motorcycle/scooter? A. Motorcycles and scooters are required to park in designated parking spots that are solely for two-wheeled
